MINUTES REGULAR MEETING BOARD OF MAYOR AND BURGESSES MAY 1, 2012 1. Mayor Robert A. VOTED: Unanimously on a motion by Second Deputy Mayor Ciacciarella and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the minutes of the regular meeting of April 3, 2012 and the special meetings of April 2, 2012, April 9, 2012 and April 23, 2012. Each member received copies for review. 4. VOTED: Unanimously on a motion by Second Deputy Mayor Ciacciarella and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the monthly reports of April. Each member received copies for review. 5. VOTED: Unanimously on a motion by Second Deputy Mayor Ciacciarella and seconded by Burgess Neth to recess to Executive Session at 6:05 p.m. for discussion on the following: Real Estate (Property Negotiations, Borough/Chemtura Discharge and Access Agreement), Personnel (Golf Course Employment Agreement) inviting in Attorney N. W. Hess, III and Public Works Director J. Stewart.  -2- Minutes – Board of Mayor and Burgesses Regular Meeting – May 1, 2012 Mayor Mezzo reconvened the meeting at 7:17 p.m. 6. The following motions emanated from Executive Session. VOTED: Unanimously on a motion by Second Deputy Mayor Ciacciarella and seconded by Deputy Mayor Rossi that the Board of Mayor and Burgesses authorize Mayor Robert Mezzo to execute the amendment and any other related documents to the Discharge and Access Agreement between the Borough of Naugatuck and Chemtura. VOTED: Unanimously on a motion by Second Deputy Mayor Ciacciarella and seconded by Deputy Mayor Rossi that the Board of Mayor and Burgesses approve the employment contract between the Borough of Naugatuck and Robert Clark as a seasonal Golf Pro at the Hop Brook Golf Course. 7. Public Comment – Open Topic Favorable comments were made regarding the Community Dialogue sponsored by the Naugatuck Cultural Council. 8. Burgess Comments – Open Topic Burgess Bronko thanked Senior Center Director Harvey Frydman for putting on a great Senior Day Fair. Deputy Mayor Rossi said she and the Mayor will be participating in the River Race. There will be a block party May 19th on the green to promote awareness for the Legion Field Playground without boundaries. The Deputy Mayor thanked Harvey Frydman for doing such a great job with the Senior Center Fair. Mayor Mezzo asked the board to consider if there are additional issues in the Charter that need to be addressed. Burgess Scully thanked Ron San Angelo, Mike Bronko and Robert Burns for getting everything in order to revise Ordinance 83. Burgess Jackson congratulated Mr. Burns for being honored for his years of service at Peter J. Foley League. 9. Mayor Mezzo reappointed Timothy Ryan (R), 64 City Brook Road, Naugatuck, CT 06770 as a regular member of the Fire Commission, term to expire May 1, 2017. 10. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the appointment of Sharon Hebb, 136 Conrad Street, Naugatuck, CT 06770 as a member of the Visiting Nurses Association Professional Advisory Committee, filling the term of M. Good, term to expire May 1, 2015. 12. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the appointment of William Stopper (D), 117 Stonefence Road, Naugatuck, CT 06770 as an alternate member of the Zoning Commission, filling the unexpired term of M. Sheehy, term to expire May 2, 2013. 13. A discussion regarding the Open Space and Watershed Land Acquisition Grant Program took place with Attorney E. Fitzpatrick. The board discussed the land off of Andrew Mountain Road and the grant money regarding it. The board’s intention to purchase the land was to designate portions of the land for recreation and sports fields as well as leaving the remainder as passive open space which will accommodate all interests. 14. Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Mezzo to sign the application, secure appraisals, evaluations and other related documents as may be required in connection with the Open Space and Watershed Land Acquisition Grant Program consisting of the possible DEEP Open Space Grant border which is rendered in yellow in maps that have been provided to the borough board. P. Scully opposed.  -4- Minutes – Board of Mayor and Burgesses Regular Meeting – May 1, 2012 15. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Mezzo to enter into and execute all contracts and related documents with GeoDesign, Inc., 984 Southford Road, Middlebury, CT 06762 in the amount of $3,400.00 regarding the Phase I Environmental Site Assessment for the 146 acres off of Andrew Mountain Road. 16. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses add to the agenda the attached addendum that’s been provided. 17. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents for the proposed purchase by the Borough of approximately 146 acres off of Andrew Mountain Road based on a favorable report from the Planning Commission pursuant to Section 8-24 of the General Statutes in a form approved by the Borough Attorney. 18. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the bid and authorize Mayor Mezzo to execute all contracts and related documents for the “Sale of a 1987 Mack Fire Vehicle” to Walter P. Seaman, 360 Preston Road, Terryville, CT 06786 in the amount of $1,750.00 as recommended by Fire Chief Kenneth Hanks. 19. VOTED: Unanimously on a motion by Burgess Burns and seconded by Burgess Scully that the Board of Mayor and Burgesses approve each one of the proposed Charter Revision Changes will be listed individually as opposed to collectively on the ballot. 20. Board of Education IT Director Alan Merly and Naugatuck Police Lieutenant Robert Harrison made a presentation regarding the iWatch Application. It is an application that would allow people to report crime activity anonymously to law enforcement officials without fear of retaliation. The application would be available to Naugatuck High School and City Hill Middle School students as well as the community. The app can be used regardless of how someone communicates electronically. Tips can be transmitted in the form of an image, text, video, or call. All forms of communication go through a call center which then transmits it to law enforcement officials anonymously. Tips can come in various languages and be translated through the application. Funds for the first year will come from the current Police Department 2011-2012 fiscal budget.  -5- Minutes – Board of Mayor and Burgesses – Regular Meeting – May 1, 2012 Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Mezzo to enter into any agreements and related documents in connection with entering into a one year agreement for utilization and implementation of the iWatch Application as presented this evening. San Angelo: “My vote “no” will not be a reflection of supporting or not supporting the program but in that we really, I think we should go down a course of looking at this a little bit more deeply before we spend taxpayers’ money.” 21. Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Robert Mezzo to enter into the Naugatuck Borough and Board of Education cooperative agreement for Human Resources Director John D. Lawlor as provided to the burgesses this evening. M. Ciacciarella abstained. For the record: M. Ciacciarella: “For clarification, this is actually an agreement between the borough, the Board of Education and Mr. Lawlor. That’s different from what it states on the agenda. I just want to state that for the record.” For the record: M. Ciacciarella: “I’m gonna abstain from voting on this because I know Mr. Lawlor from my previous, I worked with him at my previous employer.” 22. Motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the bid and authorize Mayor Mezzo to execute all contracts and related documents for “State Project #87-143 Naugatuck Pedestrian Greenway Phase I” to Guerrera Construction, 154 Christian Street, Oxford, CT 06478 in the amount of $1,609,640.00 as recommended by Public Works Director James Stewart. Motion withdrawn. 23. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses adopt the LOCIP (Local Capital Improvement Program) for the five year fiscal period 2012-2013 through 2016-2017 as recommended by Public Works Director James Stewart.  -6- Minutes – Board of Mayor and Burgesses Regular Meeting – May 1, 2012 24. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the bid and authorize Mayor Mezzo to execute all contracts and related documents for “State Project #87-143 Naugatuck Pedestrian Greenway Phase I” to Guerrera Construction, 154 Christian Street, Oxford, CT 06478 in the amount of $1,609,640.00 as recommended by Public Works Director James Stewart. 25. Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the following resolution: RESOLVED: That Mayor Robert A. Mezzo is empowered to enter into or amend contractual instruments in the name and on behalf of the Borough of Naugatuck with the State of Connecticut Department of Education for a Child Day Care program if such an agreement is offered, and to have the corporate seal affixed to all documents required as a part of any offered agreement. Discussion took place regarding the Proposed Revision to Ordinance 83 (Ordinance Creating Alternative Pension Plan and a Supplement Pension Plan for certain Non-Union Employees) and the proposed Ordinance XXX (Regarding Elected Employees) the later of which was tabled until next month. VOTED: Unanimously on a motion by Burgess Scully and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the ordinance stated as the Ordinance Creating Alternative Pension Plan and a Supplement Pension Plan for certain Non-Union Employees. Mayor Mezzo was not present for the discussion and vote. 27. Public Comment – None 29. Burgess Comments/Sub-Committee Reports Burgess Jackson said Naugatuck Housing Authority will be voting in a new Executive Director tomorrow. Testing will take place next month for the Police Department captain position. Burgess Jackson congratulated Bob Clark. Burgess Ciacciarella said he was glad to see the Zoning Commission alternate appointment. He congratulated Bob Clark on being the new golf pro. Burgess Burns congratulated Bob Clark on his new position. Mayor Mezzo congratulated Bob Clark on his new position and looks forward to working with him. Deputy Mayor Rossi congratulated Bob Clark. She attended the Emblem Club installation and recognized the club for all the good work they do. The Deputy Mayor thanked Mr. Burns for his service and congratulated him for being honored at Peter J. Foley League. FOR THE RECORD: “Thank you for your service not only to our country but abundantly prolific service to our community. We’re richer for it.” Burgess Neth congratulated Bob Clark. He was very impressed with Mr. Merly and his presentation. He said he is a tremendous asset to the Board of Education. The Naugatuck High School Building Committee is meeting to get preliminary numbers. A fire pump may not need to be installed at the high school. The committee is looking into options to go forward in a different direction. Burgess Bronko referenced an anonymous letter sent to board members and said he will not entertain letters sent to the board that are not signed. Burgess Ernsky congratulated Bob Clark on his new position. Burgess San Angelo congratulated Bob Clark. He recently gave a tour of downtown. Naugatuck is something we should all be proud of. The Industrial Park is nicely kept. The visitors had a nice perspective of our town. 30.
