MINUTES REGULAR MEETING BOARD OF MAYOR AND BURGESSES JULY 2, 2013 1. Mayor Robert A. Mezzo called the regular meeting to order at 6:05 p.m. with the following in attendance: BURGESSES: PRESS: T. K. Mayor Mezzo led in the Pledge of Allegiance to the flag. 3. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the minutes of the regular meetings of May 7, 2013 and June 4, 2013 and the minutes of the special meeting of June 12, 2013. Each member received copies for review. 4. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the monthly reports of June. Each member received copies for review. 5. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully to recess to Executive Session at 6:06 p.m. for discussion on the following: Real Estate (GDC Property, Prospect Street School), Contract Negotiations (Naugatuck Ambulance Incorporated), Collective Bargaining (Chapter 90), Personnel (Controller/School Business Manager) and Pending Litigation (Lot 3 Industrial Park) inviting in J. Lawlor, HR Director. Mayor Mezzo reconvened the meeting at 6:36 p.m. 6. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Bronko that the Board of Mayor and Burgesses add to the agenda a motion to invite Attorney Stephen Savarese into executive session. -2- Minutes – Board of Mayor and Burgesses – Regular Meeting – July 2, 2013 7. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Bronko to recess to Executive Session at 6:37 p.m. for Pending Litigation (Lot 3 Industrial Park) inviting in Attorney Stephen Savarese. Mayor Mezzo reconvened the meeting at 7:01 p.m. 8. The following motions emanated from Executive Session. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Robert Mezzo to sign a quit claim deed and any related documents per recommendation of Attorney Savarese to correct an existing title issue from the Borough of Naugatuck to Tamra French and it will be signed upon final review by Attorney Savarese. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Robert Mezzo to enter into an employment agreement by and between the Borough of Naugatuck and Robert W. Butler, Jr. for the position of controller. 9. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Bronko that the Board of Mayor and Burgesses recess to the Retirement Board at 7:03 p.m. Mayor Mezzo reconvened the meeting at 7:07 p.m. 10. Public Comment – None 11. Burgess Comments – Open Topic Burgess Bronko said it’s been great working with Burgess San Angelo. He thanked him for his service to the borough and the state. Deputy Mayor Rossi wished Burgess San Angelo well. She wished Wayne McAllister well also. She attended the high school graduation at the Palace Theatre and career day at Hillside Intermediate School. The Deputy Mayor thanked the veterans for conducting the MIA/POW ceremony. Mayor Mezzo gave everyone an update on upcoming budget meetings that will be contingent on the outcome of the referendum. Burgess Scully congratulated Burgess San Angelo and wished him good luck in his new position in Massachusetts. He thanked everyone who supported the MIA/POW ceremony. Burgess Ciacciarella wished Burgess San Angelo good luck and said he will be missed on the board. Burgess Jackson wished Burgess San Angelo good luck. She congratulated the Class of 2013. -3- Minutes – Board of Mayor and Burgesses Regular Meeting – July 2, 2013 12. Mayor Mezzo reappointed Joseph Richard (R), 25 Counselor Drive, Naugatuck, CT 06770 as a regular member of the Code of Ethics Commission, term to expire July 1, 2015. 13. Mayor Mezzo reappointed Linda Ramos, 17 Carriage Drive, Naugatuck, CT 06770 as a member of the Blight Citation Hearing Board, term to expire July 1, 2016. 14. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the appointment of Reverend Liz Leggett, 207 Millville Avenue, Naugatuck, CT 06770 as a member of the Visiting Nurses Association Advisory Committee, filling the unexpired term of J. Clisham, term to expire July 1, 2015. 15. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the appointment of Wayne McAllister (U), 35 Park Avenue, Naugatuck, CT 06770 as an alternate member of the Board of Finance, filling the expired term of A. Campbell, term to expire June 1, 2016. 16. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the reappointment of Mark E. Ruccio (D), 70 Fairview Avenue, Naugatuck, CT 06770 as a member of the Street Commission, term to expire July 1, 2018. 17. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the reappointment of Judith Rossi Scatena (U), 174 Beacon Manor Road, Naugatuck, CT 06770 as a member of the Street Commission, term to expire July 1, 2018. The following motions (18-22) were tabled: 18. Motion by Burgess that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents regarding the Conservation Easement for Fawn Meadow depicted on record map 41-95 and 96, sheets 1 and 2 as recommended by Borough Engineer Wayne Zirolli. 19. Motion by Burgess that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents regarding the Drainage Easement for Lot 96R at Longwood Drive, Fawn Meadow as recommended by Borough Engineer Wayne Zirolli. -4- Minutes – Board of Mayor and Burgesses Regular Meeting – July 2, 2013 20. Motion by Burgess that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents regarding the Drainage Easement Containing Detention Basin within Lot 96R, Fawn Meadow as recommended by Borough Engineer Wayne Zirolli. 21. Motion by Burgess that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents regarding the Drainage Easement for Lots 88 and 98, Fawn Meadow as recommended by Borough Engineer Wayne Zirolli. 22. Motion by Burgess that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents to approve the road acceptance of Pear Tree Lane (Fawn Meadow Subdivision) as described in the Warranty Deed as recommended by Borough Engineer Wayne Zirolli and the Planning Commission, subject to borough attorney approval. 23. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents regarding the updated HIPAA/HITECH Business Associate Agreement as recommended by Visiting Nurses Association Director Theresa Stieber. 24. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Robert Mezzo to sign a Renewal of the Lease Agreement with the State of Connecticut, Department of Transportation, State Route 8, File No. 87-67-64A, Agreement No. 8.05-02(03) and the Borough of Naugatuck. 25. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Robert Mezzo to sign the agreement entitled “First Supplemental Agreement” between the Borough of Naugatuck and Clough, Harbour and Associates for Construction Inspection Services of the Rubber Avenue Bridge No. 3713 over Long Meadow Pond Brook as recommended by Public Works Director James Stewart. 26. Motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses adopt the following resolution for the Reconstruction of Cross Street from Interchange 25 on Route 8 to its approach to Route 63, approximately 4,150 feet as recommended by Public Works Director James Stewart, as if read: WHEREAS, the Borough of Naugatuck has published a legal notice display ad, mailed a news release to a number of officials and agencies, and mailed a preliminary notification -5- Minutes – Board of Mayor and Burgesses Regular Meeting – July 2, 2013 letter to abutting property and business owners, announcing a public informational meeting on the proposed transportation project known as Major Reconstruction of Cross Street, Naugatuck, Connecticut; and WHEREAS, a public informational meeting was held on Thursday May 30, 2013 At 7:00 p.m. at which meeting residents and interested parties had the opportunity to voice their concerns; and WHEREAS, the Central Naugatuck Valley Council of Governments has selected this project as a regional priority and to utilize federal funds for design, right-of-way and construction activities; and WHEREAS, the project is located on a municipally owned road, all phases (preliminary engineering, right-of-way and construction) will be performed by the Borough of Naugatuck or its consultant utilizing 80% federal funds, 10% state funds and 10% Borough of Naugatuck funds for all phases; and WHEREAS, the Board of Mayor and Burgesses has considered the concerns of the residents from the public information meeting and finds that the proposed Major Reconstruction of Cross Street is in the best interest of the Borough of Naugatuck, and will promote the health, safety and general welfare of its residents and provide for convenience and safety of the motoring public. NOW, THEREFORE, BE IT RESOLVED that the Borough of Naugatuck based on the above information, and by virtue of this resolution, hereby fully support the proposed Major Reconstruction of Cross Street project. Burgess San Angelo will be leaving the board to take an administrative position in Massachusetts. The Mayor said it’s been a pleasure to serve with him over the years. He wished him the greatest success, happiness and health. Burgess San Angelo thanked the Mayor for his support. He thanked the people of Naugatuck for giving him the honor of serving the community as a state representative, burgess and their mayor. He told the burgesses they were a talented group of people whose hearts are always with Naugatuck. Burgess Jackson wished Burgess San Angelo the best of luck. Burgess Ciacciarella congratulated Burgess San Angelo and wished him good luck. Burgess Scully congratulated Burgess San Angelo and wished him good luck. He congratulated Robert Butler on his new position as controller. Burgess Burns wished Burgess San Angelo the best of luck. Deputy Mayor Rossi wished Burgess San Angelo good luck. She thanked him for his service to the community. The Fire Department responded to 99 incidents in the month of June. The Deputy Mayor said we lost a great firefighter and member of the community, William Passeck. She is looking forward to the Blum Shapiro report. Burgess Bronko thanked Burgess San Angelo for his kind words to the board. Naugatuck Day Care is accepting applications for the upcoming year. He thinks there will be a waiting list again this year. Burgess Bronko asked when the Blum Shapiro report will be available. Burgess Ernsky wished Burgess San Angelo good luck. She reminded everyone of the concerts on the green throughout the summer sponsored by the Arts Commission. There will be an Arts Festival in August. 42. Motion by Burgess that the Board of Mayor and Burgesses adopt the following resolution for the Reconstruction of Cross Street from Interchange 25 on Route 8 to its approach to Route 63, approximately 4,150 as recommended by Public Works Director James Stewart, as if read: WHEREAS, the Borough of Naugatuck has published a legal notice display ad, mailed a news release to a number of officials and agencies, and mailed a preliminary notification letter to abutting property and business owners, announcing a public informational meeting on the proposed transportation project known as Major Reconstruction of Cross Street, Naugatuck, Connecticut; and WHEREAS, a public informational meeting was held on Thursday May 30, 2013 At 7:00 p.m. at which meeting residents and interested parties had the opportunity to voice their concerns; and WHEREAS, the Central Naugatuck Valley Council of Governments has selected this project as a regional priority and to utilize federal funds for design, right-of-way and construction activities; and WHEREAS, the project is located on a municipally owned road, all phases (preliminary engineering, right-of-way and construction) will be performed by the Borough of Naugatuck or its consultant utilizing 80% federal funds, 10% state funds and 10% Borough of Naugatuck funds for all phases; and WHEREAS, the Board of Mayor and Burgesses has considered the concerns of the residents from the public information meeting and finds that the proposed Major Reconstruction of Cross Street is in the best interest of the Borough of Naugatuck, and will promote the health, safety and general welfare of its residents and provide for convenience and safety of the motoring public. -4- Agenda – Board of Mayor and Burgesses Regular Meeting – July 2, 2013 NOW, THEREFORE, BE IT RESOLVED that the Borough of Naugatuck based on the above information, and by virtue of this resolution, hereby fully support the proposed Major Reconstruction of Cross Street project.
