MINUTES REGULAR MEETING BOARD OF MAYOR AND BURGESSES SEPTEMBER 3, 2013 1. Mayor Robert A. Mezzo called the regular meeting to order at 6:00 p.m. with the following in attendance: BURGESSES: PRESS: T. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the minutes of the regular meeting of August 6, 2013. Each member received copies for review. 4. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Jackson that the Board of Mayor and Burgesses approve the monthly reports of August. Each member received copies for review. 5. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully to recess to Executive Session at 6:04 p.m. for discussion on the following: Personnel (Borough Engineer), Pending Litigation (Veolia, Janice Buck et al), Real Estate (GDC Property, Prospect Street School) and Contract Negotiations (Naugatuck Ambulance Incorporated) inviting in Attorney Edward Fitzpatrick and Human Resources Director John Lawlor. Mayor Mezzo reconvened the meeting at 7:00 p.m.  -2- Minutes – Board of Mayor and Burgesses Regular Meeting – September 3, 2013 6. The following motions emanated from Executive Session. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Mezzo to enter into an employment agreement between the Borough of Naugatuck and Wayne Zirolli. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Mezzo to sign a settlement agreement in respect of a settlement for Mrs. Janice Buck, Mr. William Waddicor and Mr. William Waddicor II in the amount of $633.73 in return for a release of all claims. 7. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Jackson that the Board of Mayor and Burgesses recess to the Firemen’s Pension Plan “C” Board at 7:03 p.m. Mayor Mezzo reconvened the meeting at 7:07 p.m. 8. Public Comment Mayor Mezzo introduced Ronald Pugliese as the new President and CEO of the Naugatuck Economic Development Corporation. Mr. Pugliese told the board he was excited to be here and together good things are going to be done in the borough. Two residents gave their opinion on the replacement of Burgess San Angelo. A resident asked if the bright lights installed at the golf course could be hooded to prevent them from shining into her home. 9. Burgess Comments – Open Topic Burgess Ernsky said she had a great time at the Sao Paio Festival. She congratulated the Mayor for the Day. Burgess Bronko said he was disappointed to see Matt Katra was not on the agenda to be reappointed to the Finance Board. He said it is disconcerting to him. While he appreciates Kim Kiernan, she already has a spot on the board as an alternate. Deputy Mayor Rossi thanked the Portuguese Club for keeping alive the tradition. She congratulated Mr. Rodrigues as the Mayor for the Day. The Deputy Mayor said our community suffered a tremendous loss. Edward Mariano was a fine example for so many and contributed significantly to our community. Mayor Mezzo said everyone involved did a tremendous job getting Naugatuck High School ready for the new school year. The project is proceeding on schedule. It will take an extra two weeks to finish the track. Burgess Scully said the Sao Paio Festival was wonderful and a credit to all the organizers involved. Ed Mariano was a great man, educator and coach.  -3- Minutes – Board of Mayor and Burgesses Regular Meeting – September 3, 2013 Burgess Ciacciarella was caught by surprise to see Matt Katra was not on the agenda for reappointment to the Finance Board. He has never received a more impressive letter than the one Matt Katra sent to the board asking to be considered for reappointment. Burgess Ciacciarella asked why not leave Kim Kiernan as an alternate and reappoint Matt Katra. Burgess Jackson gave her condolences to the Mariano family. She congratulated the Pour House on the grand opening of their new business in the borough. She asked if it was possible to do a split car tax next year. 10. Attorney Edward Fitzpatrick spoke to the board regarding the replacement of Burgess San Angelo. He said the charter states that the burgess replacement must be from the same political party and the same ward, appointed at a special meeting of the Board of Mayor and Burgesses within ninety days of the vacancy. He said the charter is a living breathing document. The chairpersons of both political parties told him ward politics no longer apply. Attorney Fitzpatrick’s legal opinion is that the replacement should be from the same political party and at a special meeting of the Board of Mayor and Burgesses within ninety days of the vacancy. He does not feel it is in violation of the charter if the replacement is not from the same ward. No action was taken by the board. 11. Mayor Mezzo shall appoint Marie G. Maroney, 53 Conrad Street 7C, Naugatuck, CT 06770 as the tenant commissioner on the Naugatuck Housing Authority, filling the unexpired term of B. Wood, term to expire October 1, 2015. Motion tabled. 12. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the appointment of Janice Dambowsky, 35 Moonlight Circle, Naugatuck, CT 06770 as an elector of the Non Union Pension Board, filling the vacancy of L. Russell, indefinite term. 13. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the appointment of Janice Dambowsky, 35 Moonlight Circle, Naugatuck, CT 06770 as an elector of the Board of Education and AFSCME Pension Board, filling the vacancy of L. Russell, indefinite term. 14. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the appointment of Janice Dambowsky, 35 Moonlight Circle, Naugatuck, CT 06770 as an elector of the UPSEU and Chapter 90 Pension Board, filling the vacancy of L. Russell, indefinite term.  -4- Minutes – Board of Mayor and Burgesses Regular Meeting – September 3, 2013 15. Motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the appointment of Kimberly Kiernan (R), 33 Marbern Lane, Naugatuck, CT 06770 as a regular member of the Board of Finance, filling the vacancy of M. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the reappointment of Andrew Bottinick (R), 64 Inwood Drive, Naugatuck, CT 06770 as a regular member of the Board of Finance, term to expire June 1, 2016. 17. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the reappointment of Aldo Pistarelli (R), 41 Pleasant Avenue, Naugatuck, CT 06770 as a regular member of the Board of Finance, term to expire June 1, 2016. 18. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses join the Leukemia & Lymphoma Society in designating the month of September 2013 as Leukemia, Lymphoma & Myeloma Awareness Month in the Borough of Naugatuck. 19. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses proclaim September 17 - 23, 2013 as Constitution Week in the Borough of Naugatuck. 20. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses adopt the following resolution: WHEREAS, texting has become the way many people communicate today, which means some people are doing it at the worst possible time - while driving, and  -5- Minutes – Board of Mayor and Burgesses Regular Meeting – September 3, 2013 WHEREAS, texting while driving is involved in over 100,000 motor vehicle crashes each year, often causing injuries and deaths, and WHEREAS, those who text while driving are 23 times more likely to be involved in some type of safety critical event as compared to those drivers who don't text while they drive, and WHEREAS, in 2009 AT&T launched the public awareness campaign “It Can Wait” to educate the public about the dangers of texting while driving by encouraging consumers to take the personal pledge not to text while driving, and NOW, THEREFORE, BE IT PROCLAIMED, that the Board of Mayor and Burgesses designate September 19, 2013 as “No Texting While Driving Day” to focus attention on the dangers of texting while driving, and BE IT FURTHER PROCLAIMED, that the members of the Board of Mayor and Burgesses have taken the personal pledge to not text and drive, support efforts to raise public awareness about the dangers of texting while driving and encourage others to take the pledge not to text and drive. 21. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents between the Naugatuck Visiting Nurses Association and IVAN/ABILITY as recommended by Naugatuck Visiting Nurses Association Director Theresa Stieber. 22. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the bid and authorize Mayor Mezzo to execute all contracts and documents for the “Police Department Drug and Alcohol Testing Program” to Connecticut Conference of Municipalities (CCM), 900 Chapel Street 9th Floor, New Haven, CT 06510 in the amount of $80 per individual subject to random testing as recommended by Human Resources Director John Lawlor. 23. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Mezzo to sign all documents regarding the annual Equitable Sharing Agreement and Certification as recommended by Police Chief Christopher Edson.  -6- Minutes – Board of Mayor and Burgesses – Regular Meeting – September 3, 2013 24. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the bid for the “Police Department Maintenance Garage Alarm Devices” to Dyna Electric Company, Inc., P.O. Box 1687, Manchester, CT 06040 in the amount of $4,740.00 as recommended by Lieutenant Gregory Dean. The following motions (25-29) were tabled. 25. Motion by Burgess that the Board of Mayor and Burgesses approve the bid for the “Sale of a 1995 Ford Aerostar Van” to Carlos Santos, 165 Falcon Crest Road, Middlebury, CT 06762 in the amount of $400.00 as recommended by Lieutenant Gregory Dean. 26. Motion by Burgess that the Board of Mayor and Burgesses approve the bid for the “Sale of a 1999 Ford Crown Vic Sedan (86,431 miles)” to Harry Perock, 88 Perock Lane, Naugatuck, CT 06770 in the amount of $700.00 as recommended by Lieutenant Gregory Dean. 27. Motion by Burgess that the Board of Mayor and Burgesses approve the bid for the “Sale of a 1999 Ford Crown Vic Sedan (104,143 miles)” to Harry Perock, 88 Perock Lane, Naugatuck, CT 06770 in the amount of $400.00 as recommended by Lieutenant Gregory Dean. 28. Motion by Burgess that the Board of Mayor and Burgesses approve the bid for the “Sale of a 2003 Ford Expedition” to Carla Longino, 297 White Avenue, Middlebury, CT 06762 in the amount of $500.00 as recommended by Lieutenant Gregory Dean. 29. Motion by Burgess that the Board of Mayor and Burgesses approve the bid for the “Sale of a 2004 Suzuki Dirt Bike” to Carla Longino, 297 White Avenue, Middlebury, CT 06762 in the amount of $150.00 as recommended by Lieutenant Gregory Dean. 30. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the bid and authorize Mayor Mezzo to execute all contracts and related documents for a “Thermal Imaging Camera” to Brigham Industries, 10 Brigham Road, Paxton, MA 01612 in the amount of $7,965 as recommended by Fire Chief Kenneth Hanks. 31. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the purchase of a “2014 International 7500 Plow Truck” and authorize  -7- Minutes – Board of Mayor and Burgesses – Regular Meeting – September 3, 2013 Mayor Mezzo to execute all contracts and documents with Nutmeg International Trucks, Inc., 31 Leonardo Drive, North Haven, CT 06473 under GSA contract #12PSX0024 in the amount of $164,165 as recommended by Public Works Director James Stewart and subject to borough attorney approval. 32. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents regarding the Conservation Easement for Fawn Meadow depicted on record map 41- 95 and 96, sheets 1 and 2 as recommended by Borough Engineer Wayne Zirolli. 33. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents regarding the Drainage Easement for Lot 96R at Longwood Drive, Fawn Meadow as recommended by Borough Engineer Wayne Zirolli. 34. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents regarding the Drainage Easement Containing Detention Basin within Lot 96R, Fawn Meadow as recommended by Borough Engineer Wayne Zirolli. 35. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents regarding the Drainage Easement for Lots 88 and 98, Fawn Meadow as recommended by Borough Engineer Wayne Zirolli. 36. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents to approve the road acceptance of Pear Tree Lane (Fawn Meadow Subdivision) as described in the Warranty Deed as recommended by Borough Engineer Wayne Zirolli and the Planning Commission, subject to borough attorney approval. 37. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents with BETA Group, Inc., 6 Blackstone Valley Place, Suite 101, Lincoln, RI 02865 in the  -8- Minutes – Board of Mayor and Burgesses – Regular Meeting – September 3, 2013 amount of $39,200 for the development of a Pavement Management Program with sidewalk and handicapped ramps inventory and assessment as recommended by Public Works Director James Stewart and subject to borough attorney approval. 38. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Public Works Director James Stewart to accept payment in the amount of $48,763.22 from Yankee Gas as a payment in lieu of final asphalt road trench paving related to the Yankee Gas Main Replacement on Millville Avenue from Terrace Ave to Clear View Circle. 39. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the Revised (LOCIP) Local Capital Improvement Program for fiscal year period 2013-2014 through 2017-2018 as recommended by Public Works Director James Stewart. 40. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Mezzo to sign the agreement entitled “Project Authorization Letter” which restates the Original Agreement Dated July 18, 2011 and as supplemented by the First Supplemental Construction Agreement Dated June 15, 2012 between the State of Connecticut and the Borough of Naugatuck for the Construction, Inspection and Maintenance of the Naugatuck Pedestrian Greenway Utilizing Federal Funds Under the Enhancement Component of the Surface Transportation Program as recommended by Public Works Director James Stewart. 41. Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses adopt the following resolution: RESOLVED: That Robert A. Mezzo, Mayor of the Borough of Naugatuck, is empowered to execute and deliver in the name and on behalf of this municipality a contract with the Connecticut State Library for a Historic Documents Preservation Grant. Motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses adopt the following resolution: RESOLVED, any financial institution designated by the Borough of Naugatuck, depository for this municipality, be and it is hereby requested, authorized and directed said depository honor checks, drafts or other orders for the payment of money drawn in this municipality name, including those payable to the individual order of any two persons whose names appear there on as signers thereof, when bearing or purporting to bear the facsimile signatures (s) of any two of the following: Mayor Robert A. Mezzo, Treasurer Judith E. Anderson, and Controller Robert W. Public Comment Matt Katra appreciated comments from some of the burgesses regarding his seat on the Finance Board. Burgess Comments/Sub-Committee Reports Burgess Jackson wished Matt Katra good luck and hopes he will serve on another board. She reported Naugatuck Housing Authority has new handicapped units and the Police Department is getting a new officer. Burgess Scully wished good luck to the students on the new school year. Deputy Mayor Rossi wished the students and Matt Katra good luck. The TRIAD will be at the Senior Fair. Burgess Bronko heard from a few residents regarding the pubic not being allowed to comment on the Blum Shapiro report at meetings. Burgess Ernsky thanked everyone for their support of the Arts Festival. She congratulated Lisa D’Andrea and the Arts Commission. There was a decent turn out. 49.
