MINUTES REGULAR MEETING BOARD OF MAYOR AND BURGESSES OCTOBER 1, 2013 1. Mayor Robert A. Mezzo called the regular meeting to order at 6:00 p.m. with the following in attendance: BURGESSES: PRESS: T. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the minutes of the regular meeting of September 3, 2013 and the special meeting of September 10, 2013. Each member received copies for review. 4. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the monthly reports of September. Each member received copies for review. 5. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns to recess to Executive Session at 6:02 p.m. for discussion on the following: Pending Litigation (Heart and Hypertension Claim), Contract Negotiations (EMS, Confidentiality Agreements) and Real Estate Negotiations (Downtown Properties) inviting in Attorney Edward Fitzpatrick, Controller R. Butler, Jr. and CEO of Naugatuck Economic Development Corporation R. Pugliese. Mayor Mezzo reconvened the meeting at 7:11 p.m.  -2- Minutes – Board of Mayor and Burgesses – Regular Meeting – October 1, 2013 6. The following motion emanated from Executive Session. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Naugatuck Economic Development Corporation to market the Naugatuck Train Station at 195 Water Street for private development. 7. Public Comment The fountain on the green should be fixed. Why was the train station the only polling place for the referendum? What was the cost for the high school graduation? 8. Burgess Comments – Open Topic Burgess Fennell thanked the board for unanimously approving his appointment as a burgess. He and his wife are celebrating their 25th anniversary today. Burgess Bronko was sad to hear Diana Raczkowski resigned from her position as chairwoman on the Zoning Commission. Burgess Neth has been receiving calls daily from residents wondering when Millville Avenue, Scott Street and Cedar Street are going to be paved. He would like to know why the cutting crew doesn’t take the extra steps to finish the job after mowing. He feels they should pick up papers before mowing and use the trimmer afterward. Deputy Mayor Rossi attended a computerized customer service center meeting and found it to be very interesting. She commended Senior Center Director Harvey Frydman for the wonderful job he did organizing Senior Day. The Deputy Mayor said its unfortunate there’s an influx of cases for the Juvenile Review Board but she’s glad for the students to have this opportunity. Burgess Scully complimented Jim Stewart and the River Walk Committee. He was upset the new bridge has already been spray painted. He played golf over the weekend and thought it was ridiculous how long he had to wait for a golf cart. Burgess Scully asked the Mayor to form a committee before budget time to investigate the need for additional golf carts. Burgess Ciacciarella thinks the crew is doing an excellent job on the ramp. He asked if the rust could be removed from the railing. Burgess Jackson wished Burgess Ciacciarella the best of luck. She told him she hopes he returns back to the board in the future. 9. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses add to the agenda a motion to enter into a four (4) year lease with Pitney Bowes. 10. Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents for a four (4) year lease with Pitney Bowes to replace the existing equipment with new and to reduce the current monthly lease rate from $1,757 per month to $1,453.46 per month as recommended by Controller Robert Butler, Jr. and IT Director James Kallipolites. Motion withdrawn.  -3- Minutes – Board of Mayor and Burgesses Regular Meeting – October 1, 2013 VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses waive the bids and authorize Mayor Mezzo to execute all contracts and related documents for a four (4) year lease with Pitney Bowes to replace the existing equipment with new and to reduce the current monthly lease rate from $1,757 per month to $1,453.46 per month as recommended by Controller Robert Butler, Jr. and IT Director James Kallipolites. For the record: Mayor Mezzo “Quotes were obtained by the Finance Department for additional vendors.” 11. Mayor Mezzo appointed Ronald Pugliese, 452 Heritage Road Unit 301, Southbury, CT 06488 as a member of the Building 25/Tuttle Building Transition Committee, filling the term of David Prendergast. 12. Mayor Mezzo reappointed Stephanie Gunnoud Savoy (R), 1081 New Haven Road 2-A, Naugatuck, CT 06770 as an alternate member of the Police Commission, term to expire October 1, 2018. 13. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the reappointment of Jay Kuczenski (D), 107 Dunn Avenue, Naugatuck, CT 06770 as a member of the Park Commission, term to expire October 1, 2018. Mayor Mezzo swore in Jay Kuczenski as a commissioner on the Park Commission. 14. Motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute any and all documents for the settlement of a Heart and Hypertension Claim for Thomas and Maureen Kaminski in the sum of $90,000 payable in two installments of 45,000 each; the first installment due November 30, 2013 and the second installment due July 31, 2014 in a form approved by borough counsel. R. Neth opposed. 15. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute any and all documents to take title to the Warren Avenue Dam Property. As conditions of acceptance of the warranty deed, the seller, Cel-Mor Investments, Inc., shall pay the taxes through 2014 and the performance bond shall remain in effect through the period set forth in the agreement. The warranty deed shall be subject to approval by borough counsel.  -4- Minutes – Board of Mayor and Burgesses – Regular Meeting – October 1, 2013 16. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents for the proposed Conservation Easement to the State of Connecticut for the West Mountain Road property based on a favorable report from the Planning Commission pursuant to Section 8-24 of the General Statutes in a form approved by borough counsel. 17. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents for the proposed Sale of Prospect Street School based on a favorable report from the Planning Commission pursuant to Section 8-24 of the General Statutes in a form approved by borough counsel. 18. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses declare the month of November as “Pancreatic Cancer Awareness Month” in the Borough of Naugatuck and to adopt the following resolution, as if read: WHEREAS in 2013, an estimated 45,220 people will be diagnosed with pancreatic cancer in the United States and 38,460 will die from the disease; WHEREAS pancreatic cancer is one of the deadliest cancers, is the fourth leading cause of cancer death in the United States, and is the only major cancer with a five-year relative survival rate in the single digits at just six percent; WHEREAS when symptoms of pancreatic cancer present themselves, it is late stage, and 73 percent of pancreatic cancer patients die within the first year of their diagnosis while 94 percent of pancreatic cancer patients die within the first five years; WHEREAS approximately 530 deaths will occur in Connecticut in 2013; WHEREAS the incidence and death rate for pancreatic cancer are increasing and pancreatic cancer is anticipated to move from the fourth to the second leading cause of cancer death in the U.S. by 2020; WHEREAS the U.S. Congress passed the Recalcitrant Cancer Research Act last year, which calls on the National Cancer Institute to develop a scientific frameworks, or strategic plans, for pancreatic cancer and other deadly cancers, which will help provide the strategic direction and guidance needed to make true progress against these diseases; and WHEREAS the Pancreatic Cancer Action Network is the national organization serving the pancreatic cancer community in the town of Naugatuck and nationwide through a  -5- Minutes – Board of Mayor and Burgesses – Regular Meeting – October 1, 2013 comprehensive approach that includes public policy, research funding, patient services, and public awareness and education related to developing effective treatments and a cure for pancreatic cancer; WHEREAS the Pancreatic Cancer Action Network and its affiliates in the town of Naugatuck support those patients currently battling pancreatic cancer, as well as to those who have lost their lives to the disease, and are committed to nothing less than a cure; WHEREAS the good health and well-being of the residents of the town of Naugatuck are enhanced as a direct result of increased awareness about pancreatic cancer and research into early detection, causes, and effective treatments; therefore be it RESOLVED that the Board of Mayor and Burgesses designate the month of November 2013 as “Pancreatic Cancer Awareness Month” in the town of Naugatuck. 19. Motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents for the extension of the “Single Stream Recycling Disposal Services” contract through June 30, 2014 to Winters Brothers Waste Systems of CT, 307 White Street, Danbury, CT 06810 as per bid as recommended by the Naugatuck Street Commission and Sheila Baummer, Recycling and Solid Waste Coordinator. Motion withdrawn. Public Comment A resident agreed with Burgess Neth that the job needs to be finished after mowing. The board needs to come up with a plan to finance the golf carts without going to taxpayers to fund the purchase.  -11- Minutes – Board of Mayor and Burgesses Regular Meeting – October 1, 2013 31. Burgess Comments/Sub-Committee Reports Mayor Mezzo ceremoniously turned the gavel over to Burgess Michael Ciacciarella for the rest of the meeting. Burgess Ciacciarella will not be seeking reelection as a burgess in the upcoming election. The Mayor said it was an honor to serve with Burgess Ciacciarella and thanked him for his time and service. He wished everyone running for office good luck and good health to their families in the upcoming election. Burgess Jackson wished Burgess Ciacciarella the best of luck. Burgess Scully said Burgess Ciacciarella dedicated many years to the town. He thanked him for his time and energy. Burgess Burns told Burgess Ciacciarella it has been wonderful working with him. He wished him good luck. Burgess Ciacciarella wished everyone running for office good luck. He said this has been a great board to serve on. He started serving the community as a member of the Zoning Commission and as the Chairman he learned it’s not just about serving the town but listening to people and educating them how the town government operates. Deputy Mayor Rossi reported the Fire Department responded to 80 incidents in August and 87 incidents in September. The department received the Life Safety Achievement Award for their fire prevention efforts in 2012. The IT Committee has two new members. The retirement party for Dave Prendergast, CEO of the Naugatuck Economic Development Corporation, will be October 23rd. The annual NEDC meeting will be held November 20th. The Deputy Mayor wished everyone the best of luck in the upcoming election. She said it’s been a wonderful opportunity to serve with Burgess Ciacciarella on this board. Burgess Bronko said they did a beautiful job on the field at the high school. He said we are opening ourselves up to state events with a larger field. Burgess Bronko wished everyone well in the election. Burgess Fennell took a walk through Gunntown Passive Park before the meeting and told Jim Stewart it looked very well maintained. 32.
