MINUTES REGULAR MEETING BOARD OF MAYOR AND BURGESSES DECEMBER 3, 2013 1. Mayor Robert A. Mezzo called the regular meeting to order at 6:00 p.m. with the following in attendance: BURGESSES: PRESS: T. Sheridan, Finance Board Attorney E. Fitzpatrick R. Krzykowski, Planning Commission E. Jamieson, Smartlink Attorney L. Chiocchio 2. Mayor Mezzo led in the Pledge of Allegiance to the flag. 3. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the minutes of the regular meeting of November 6, 2013. Each member received a copy for review. 4. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the monthly reports of November. Each member received copies for review. 5. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully to recess to Executive Session at 6:01 p.m. for discussion on the following: Personnel (Golf Pro/Pro Shop Manager and Public Works Superintendent), Contract Negotiations (EMS) and Pending Litigation inviting in Attorney Edward Fitzpatrick, Human Resources Director John Lawlor and Public Works Director James Stewart. Mayor Mezzo reconvened the meeting at 7:00 p.m. 6. The following motion emanated from Executive Session. -2- Minutes – Board of Mayor and Burgesses Regular Meeting – December 3, 2013 Motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize the Mayor to enter into an employment agreement by and between the Borough of Naugatuck and Robert Clark and to sign all related documents. Deputy Mayor Rossi abstained. 7. Public Comment Thanked the Public Works Department for the new signage at Gunntown Passive Park. 8. Burgess Comments – Open Topic Burgess Vitale praised the JR ROTC for the excellent job cleaning Linden Park. Burgess Jackson attended the DARE Graduation at Cross Street School before the meeting this evening and said they did an awesome job. She congratulated the students at Hillside School who will have their DARE Graduation tomorrow. Burgess Scully welcomed Alex Olbrys as a member on the board. Burgess Burns welcomed Alex Olbrys. He asked the Mayor to look into DARE Graduation Ceremonies being held on the same nights as the monthly borough board meetings. Burgesses are unable to attend the ceremony when the conflict happens. Mayor Mezzo welcomed Alex Olbrys. Deputy Mayor Rossi congratulated the following people on receiving awards: Jim Desmaris for the Franklin Johnson Citizenship Award, Joseph Healy, Manuel Matos, Robert Stauffer and John McSherry for the Robert Genovese Patriotism Award and Larry Erickson for the Paul Harris Fellow Award. She thanked Beacon Brook for inviting her to their open house. She congratulated the students of City Hill Middle School for their artwork and performance at the Mayor’s Inauguration. She wished Coliseum Pawn well on the opening of their business. Naugatuck Fire and Police Departments will be holding toy drives this weekend. She congratulated the Fire Police for a successful food drive. The Deputy Mayor said a lengthy discussion took place at the last Fire Commission meeting regarding the poor radio service the Fire Department has been dealing with for quite some time. The issue is that firefighters on scene are able to communicate with each other but communication with dispatch can and has been lost. Burgess Neth remembers the Capital Committee having discussions six or seven years ago regarding a town wide communication system going from the old band to the digital band. He said the high school project is going extremely smooth. Burgess Bronko said the Day Care is doing well. They received their recertification. He said they have a full load of children and will not loose funding. Burgess Olbrys said he was honored to be at the meeting. He thanked everyone for their kind words. He attended the 100th anniversary celebration of Troop 102. 9. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the appointment of Tracy L. DeBarber (R), 815 Maple Hill Road, Naugatuck, CT 06770 as a regular member of the Inland Wetlands Commission, filling the unexpired term of Alexander Olbrys, term to expire January 1, 2015. -3- Minutes – Board of Mayor and Burgesses Regular Meeting – December 3, 2013 10. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the appointment of Frank DiPerna (R), 25 Walnut Street, Naugatuck, CT 06770 as an alternate member of the Finance Board, filling the expired term of Kimberly Kiernan, term to expire June 1, 2016. Mayor Mezzo swore in Frank DiPerna as a member of the Finance Board. 11. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses confirm the appointments of the following Assistant Registrars of Vital Statistics, terms to run from January 6, 2014 to January 4, 2016: Leslie K. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute a Subordination Agreement in connection with a sewer lien in a form approved by borough counsel. 17. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses waive the bid and approve a one year extension for the RICOH Copier Contract with a 15% discount and authorize Controller Robert W. Butler, Jr. to execute all contracts and related documents. 18. Discussion will continue at a later date regarding setting the Rate for Bailiffs. No action was taken. 19. Discussion/possible action regarding the Acceptance of the Unaccepted Roads. Tabled. 20. Motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents for the AT&T Cell Tower at the Heights Property – Spring Street as recommended by Borough Engineer Wayne Zirolli and the Planning Commission. Motion withdrawn. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that pursuant to Section 8-24 of the General Statutes the Board of Mayor and Burgesses may approve the lease of borough property know as the Heights Property located at 211 Spring Street for a cell tower to be constructed by New Cingular Wireless PCS, LLC AT&T as approved by the Planning Commission and the Borough Attorney. -5- Minutes – Board of Mayor and Burgesses Regular Meeting – December 3, 2013 21. Motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses authorize Mayor Mezzo to preserve the Naugatuck to Shelton corridor in the Regional Planning Agency Consolidation regardless of the city designated to be with Naugatuck. Burgess Burns expressed sincere appreciation for the proclamation from the Mayor honoring him with the Robert Genovese Award. Burgess Scully wished everyone a Merry Christmas and Happy New Year. Burgess Jackson congratulated Alex Olbrys. Happy Holidays! Burgess Vitale congratulated the Mayor on receiving the Dibble Award. He wished everyone a Merry Christmas. 27.
