MINUTES REGULAR MEETING BOARD OF MAYOR AND BURGESSES APRIL 1, 2014 1. Mayor Robert A. Mezzo called the regular meeting to order at 6:00 p.m. with the following in attendance: BURGESSES: PRESS: T. K. Mayor Mezzo led in the Pledge of Allegiance to the flag. 3. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the minutes of the regular meeting of March 4, 2014 and the special meetings of March 10, 2014 and March 24, 2014. Each member received copies for review. 4. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Jackson that the Board of Mayor and Burgesses approve the monthly reports of March. Each member received copies for review. 5. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns to recess to Executive Session at 6:02 p.m. for discussion on the following: Contract Negotiations (EMS) and Real Estate Negotiations (Risdon Property, Downtown) inviting in Naugatuck Economic Development Corporation CEO R. Pugliese. Mayor Mezzo reconvened the meeting at 7:00 p.m. Mayor Mezzo asked everyone to observe a moment of silence in memory of our Building Custodian John Kochis who passed unexpectedly yesterday afternoon.. The Mayor said John was a good man, loved his family, and was very much a community servant in Naugatuck and to this building specifically. 6. The following motion emanated from Executive Session.  -2- Minutes – Board of Mayor and Burgesses Regular Meeting – April 1, 2014 VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Robert A. Mezzo to execute any and all agreements and/or documents with First Hartford Capital Corporation, its successors and/or assigns, current record owner of the former Risdon property, formerly known as 1 Risdon Drive, Naugatuck, CT 06770, to accept the amount of THREE HUNDRED THOUSAND and 00/100THS ($300,000) DOLLARS as payment full of all outstanding, real estate tax obligations against all parcels associated with said property through June 30, 2014; in exchange for the following: (i) transfer of title of the parcel currently used as a parking lot by the Peter J. Foley Little League located along Andrew Avenue to the Borough of Naugatuck; (ii) a deed restriction to the Borough of Naugatuck duly recorded against all parcels of the former Risdon property prohibiting any residential uses on such properties in perpetuity, and (iii) a commitment by First Hartford Capital Corporation to pay all future tax obligations from July 1, 2014, forward and redevelop the property in a reasonable amount of time in cooperation with the Borough of Naugatuck and the Naugatuck Economic Development Corporation. 7. Public Comment Why subsidize the golf course when it’s not making any money? Get rid of the golf course. When will there be a public comment on the Blum Shapiro Report? The public has been taken out of the equation. There is a need for more input by residents on the Blum Shapiro Report, less than 300 residents gave input. The borough should look at other studies instead of through a company out of London. Privatizing trash is a step in the wrong direction. Check into other communities who privatized and then reversed it. Department heads attend borough meetings; will the private trash haulers attend meetings? Why can’t the Visiting Nurses Association take patients from surrounding communities? Referrals from doctors have dropped because most doctors think the VNA is closed. Let the employees know the closing date so patients can have continuity of care and employees can find new jobs. The borough should use Naugatuck Youth Services as our service provider. Flashing signs not allowed according to Zoning Regulations and yet there are several flashing signs still in the borough. There is a multiple commissions issue according to the Code of Ordinances Section 2- 117. There are problems with both Veolia and the Naugatuck Ambulance which are private; the borough should take them back. Blum Shapiro’s viewpoint is to run the town to make a profit. Don’t run it to make a profit. Run it efficiently. Is there a rule for the Public Works Department employees as to when and where they can smoke on the job? Burgess Comments – Open Topic Burgess Olbrys thanked the following organizations for their contribution toward the success of the St. Patrick’s Day Road Race – Ion Bank, The Poor House, Cook’s Café, Naugatuck Valley Savings and Loan and the Police and Fire Departments. There will be a Kayak/Canoe River Race on May 3rd at 11 a.m. Burgess Ernsky said there was an excellent turn out for the road race. She thanked Ion Bank for their sponsorship. Burgess Ernsky thanked Deputy Mayor Rossi for her dedication spearheading the EMS Committee and the IT Committee. Burgess Bronko said Naugatuck Day Care has a full roster and a waiting list. He tried to encourage the Day Care to become autonomous but they decided they would still like to stay connected to the borough. Burgess Neth stated the Blum Shapiro report is not set in stone. Naugatuck Youth Services came back to the borough with a plan. The Board of Mayor and Burgesses is not involved with negotiations; the Mayor and his team are involved. He has seen a decline in the Visiting Nurses Association over the years. Burgess Neth said he is skeptical on the five year plan for privatization of the trash. He would like to see a ten year plan instead. Deputy Mayor Rossi said there was an incredible amount of supporters for the road race. She thanked the Police and Fire Departments as well as the Safety Patrol. She congratulated Deputy Police Chief Josh Bernegger who is at the FBI Academy for training. She said the Blum Shapiro Report was a recommendation document. There is a need for public comment on the report but when a plan can be brought forward for intelligent conversation. The Deputy Mayor said the IT Commission is an advisory commission only. There is no voting at the meetings. Burgess Burns thought very good points were brought up this evening. There has not been enough information to vote on the Visiting Nurses Association at the present time. Burgess Scully thanked Jim Goggin and everyone who worked hard at the St. Patrick’s Day celebration. He said the golf course is loosing $65,000 but brought in over $500,000. The parks do not bring in revenue but cost the borough over 2 million dollars. Burgess Jackson thanked Naugatuck Education Foundation for distributing $18,000 in grants to six schools. She also thanked Senior Center Director Harvey Frydman for the St. Patrick’s Day luncheon. Burgess Vitale said the Fire Department Recognition Ceremony was a wonderful recognition of our firefighters and others people that assist our Fire Department. He is a member of the Early Childhood Council. There is a need for preschool education and the funds that are available can’t service all the kids in need. They brought in a $20,000 grant for a breakfast club program at five elementary schools and a $10,000 literacy grant. The week of the child will be celebrated April 26th on the green. The Masons are building a handicapped playground at Legion Field. 9. Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses remove the last sentence in Subsection (c) in Section 2-17 – Police Commission; alternates of Division I – Generally of Article II – Boards, Commission  -5- Minutes – Board of Mayor and Burgesses – Regular Meeting – April 1, 2014 and Committees in Chapter 2 – Administration of the Code of Ordinances of the Borough of Naugatuck which sentence in the subsection reads as follows: Any such vacancy shall be filled from the same political party from which the former alternate was appointed. Mayor Mezzo appointed Joseph Corona (U), 73 Hilltop Road, Naugatuck, CT 06770 as a regular member of the Fire Commission, filling the unexpired term of Susan Ruggeri- Thornton, term to expire May 1, 2014. Mayor Mezzo swore in Joseph Corona as a commissioner on the Fire Commission. 19. Mayor Mezzo appointed John Ford (U), 22 Nichols Road, Naugatuck, CT 06770 as an alternate member of the Fire Commission, filling the unexpired term of Matthew Brunyansky, term to expire December 1, 2015.  -6- Minutes – Board of Mayor and Burgesses Regular Meeting – April 1, 2014 20. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses add to the agenda two motions approving the appointment of members to the Board of Finance. 21. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the appointment of Samantha Stirk (R), 71 Longwood Drive, Naugatuck, CT 06770 as a regular member of the Board of Finance, filling the unexpired term of Jennifer Merrill, term to expire June 1, 2015. 22. Motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the appointment of Joseph Savarese (D), 145 Union City Road, Naugatuck, CT 06770 as an alternate member of the Board of Finance, filling the unexpired term of Samantha Stirk, term to expire June 1, 2015. C. Ernsky opposed. 23. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the bid and authorize Mayor Mezzo to execute all contracts and documents for the “Public Works Department Non DOT Drug and Alcohol Testing Program” to Connecticut Conference of Municipalities (CCM), 900 Chapel Street 9th Floor, New Haven, CT 06510 in the amount of $80 per individual subject to random testing as recommended by Human Resources Director John Lawlor. 24. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the bid for the “Refurbishment of the 1996 Pierce Fire Rescue Pumper” to Bulldog Fire Apparatus Inc., 17 Winter Street, Hopkinton, MA 01784 in the amount of $111,965.24 as recommended by Fire Chief Kenneth Hanks. 25. Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses adopt the following Fair Housing Resolution, as if read: WHEREAS, all persons are afforded a right to full and equal housing opportunities in the neighborhood of their choice; and WHEREAS, federal fair housing laws require that all individuals, regardless of race, color, religion, sex, handicap, familial status or national origin, be given equal access to all housing-related opportunities, including rental and homeownership opportunities, and be allowed to make free choices regarding housing location; and  -7- Minutes – Board of Mayor and Burgesses Regular Meeting – April 1, 2014 WHEREAS, Connecticut fair housing laws require that all individuals, regardless of race, creed, color, national origin, ancestry, sex, marital status, age, lawful source of income, familial status, learning disability, physical or mental disability, sexual orientation, or gender identity or expression be given equal access to all housing-related opportunities, including rental and home ownership opportunities, and be allowed to make free choices regarding housing location; and WHEREAS, the Borough of Naugatuck is committed to upholding these laws, and realizes that these laws must be supplemented by an Affirmative Statement publicly endorsing the right of all people to full and equal housing opportunities in the neighborhood of their choice; and NOW THEREFORE, BE IT RESOLVED, that the Borough of Naugatuck hereby endorses a Fair Housing Policy to ensure equal opportunity for all persons to rent, purchase, obtain financing and enjoy all other housing-related services of their choice on a non-discriminatory basis as provided by state and federal law; and BE IT FURTHER RESOLVED, that the chief executive officer of the Borough of Naugatuck or his designated representative is responsible for responding to and assisting any person who alleges to be the victim of an illegal discriminatory housing practice in the Borough of Naugatuck and for advising such person of the right to file a complaint with the State of Connecticut Commission on Human Rights and Opportunities (CHRO) or the U.S. Department of Housing and Urban Development (HUD) or to seek assistance from the CT Fair Housing Center, legal services, or other fair housing organizations to protect his or her right to equal housing opportunities. Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses adopt the following resolution: RESOLVED, that the Naugatuck Board of Mayor and Burgesses may enter into with and deliver to the State of Connecticut Department of Emergency Services and Public Protection (formerly the Department of Emergency Management and Homeland Security) any and all documents which it deems to be necessary or appropriate; and FURTHER RESOLVED, that Robert A. Burgess Olbrys said there will be an Easter Egg Hunt on April 19th at City Hill Middle School from 12-2 p.m. The VNA Advisory Board is running a blood clinic. Burgess Vitale said three parks in the borough will be dedicated in the month of May. 31.
