MINUTES REGULAR MEETING BOARD OF MAYOR AND BURGESSES OCTOBER 7, 2014 1. Mayor Robert A. Mezzo called the regular meeting to order at 6:00 p.m. with the following in attendance: BURGESSES: PRESS: T. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the minutes of the regular meeting of September 2, 2014 and the special meetings of September 2, 2014 and September 22, 2014. Each member received copies for review. 4. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the monthly reports of September. Each member received copies for review. 5. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully to recess to Executive Session at 6:02 p.m. for discussion on the following: Collective Bargaining (UPSEU Clerical) and Real Estate Negotiations (Parcels A, B and C, Jesse Camille’s Restaurant, 1 South Main Street, Prospect Street School, Naugatuck Train Station) inviting in Attorney E. Fitzpatrick, Naugatuck Economic Development Corporation CEO R. Pugliese and Attorney N. W. Hess, III. Mayor Mezzo reconvened the meeting at 7:26 p.m. 6. The following motions emanated from Executive Session. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns to authorize Mayor Mezzo to enter into a settlement  -2- Minutes – Board of Mayor and Burgesses Regular Meeting – October 7, 2014 agreement between the Borough of Naugatuck and One South Main Street, LLC. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth to authorize Mayor Mezzo to enter into an agreement of lease by and between the Borough of Naugatuck and J.C. Restaurant Group, Inc. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth to approve the Preliminary Agreement Granting Exclusive Rights with Option to Purchase and authorize Mayor Mezzo to execute all contracts and related documents subject to borough attorney approval. This is a six month option agreement on Parcel A with ART 6, LLC. Motion by Deputy Mayor Rossi and seconded by Burgess Scully to enter into a general release and settlement agreement by and between UPSEU Local 424, Unit 15 James Michalek and the Borough of Naugatuck, and to also enter into a memorandum of agreement between the Borough of Naugatuck UPSEU Local 424, Unit 15 and Mr. James Michalek. Burgess Neth opposed. 7. Public Comment There is concern regarding the traffic control for public safety during referendum voting. A Finance Board member urged the board to vote against the Electric Vehicle Charging Station Grant since it will cost the borough money for the electricity. Twenty thousand dollars is being spent to tear down her house. A resident finds it unacceptable that the Fire Department radios do not work in his part of town. 8. Burgess Comments – Open Topic Burgess Vitale questioned whether we received an answer if the borough board meetings could be webcast. He reported the Fire Marshal’s Office cannot keep up with the amount of inspections and it concerns him. The filth in the Industrial Park is getting worse and he has not seen anything being done about it. Burgess Jackson said the Oktoberfest Fundraiser at the Howard Whittemore Library had a wonderful turnout. The Senior Center Fair was well attended also. Burgess Scully urged everyone to vote in the referendum next Tuesday. Deputy Mayor Rossi recognized the Alumni Association Honorees – Carlos Batista, Francis Branco, Cindy Herb, James Goggin, Wayne McAllister, Ray Lennon, Jr. and Mary Lou Burmeister. Second Assistant Fire Chief Paul Russell has been named the Firefighter of the Year. The Deputy Mayor commends Lieutenant Cammarata from the Police Department for reaching out to the community through Facebook. She received two phone calls regarding the new middle school we are building. For the record:  -3- Minutes – Board of Mayor and Burgesses – Regular Meeting – October 7, 2014 “There was a presentation made by the school space needs committee and there was discussion of a new middle school but I want to stress that there was just discussion. Strategies talked about and populations and that sort of thing but nothing whatsoever has come before this board or the Finance Board to make any types of decisions on that. I think that there’s been some misunderstanding on behalf of the public that we’re not even finished with this big undertaking of the high school and we are already leaping into the middle school. I think there’s just been some miscommunication and maybe some misunderstanding.” Burgess Neth said the NHS Renovation Committee asked the school superintendent to revise the current grant application to incorporate the homes in front of the high school giving the committee the ability to purchase the homes in the future and receive seventy- five percent reimbursement. Locust Street was only paved on one side of the road after the utility work was done. He thinks we should look at road work being done by utility companies and find the funds to pave the other half of the road so it is done right. Burgess Ernsky received phone calls regarding health inspectors giving low ratings on establishments for nonsensical issues. Burgess Olbrys feels the Fire Department radio situation needs to be addressed but doesn’t know where the money will come from. He is concerned for residents living in Oak Terrace. There isn’t a requirement to have more fire hydrants than are currently there but he would like to see two additional. 9. Mayor Mezzo appointed Captain Steven Hunt, 211 Spring Street, Naugatuck, CT 06770 as a member of the Northwest Connecticut Public Safety Communication Center, Inc., filling the vacancy of T. Brouillette, term to expire April 1, 2016. 10. Mayor Mezzo appointed Elizabeth Wierzbicki, 50 Rockwell Avenue, Naugatuck, CT 06770 as a regular member of the Arts Commission, filling the unexpired term of M. Vagnini Dadamo, term to expire April 1, 2016. 11. Mayor Mezzo reappointed Arlene Schwartz Regan (D), 114 Evelyn Drive, Naugatuck, CT 06770 as a regular member of the Zoning Board of Appeals, term to expire September 1, 2019. 12. Mayor Mezzo reappointed Robert E. Lauer (D), 51 Tanglewood Lane, Naugatuck, CT 06770 as a regular member of the Code of Ethics Commission, term to expire October 1, 2016. 13. Mayor Mezzo reappointed Joan B. Taf, 219 Margaret Circle, Naugatuck, CT 06770 as a member of the Housing Authority, term to expire October 1, 2019. 14. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the appointment of Jeremy Lennon, 84 Birch Lane, Naugatuck, CT 06770 as the Local 1303-12 Representative of the Board of Education and AFSCME Pension Board, filling the vacancy of J. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the appointment of John Clark, 58 Nettleton Avenue, Naugatuck, CT 06770 as an elector of the Board of Education and AFSCME Pension Board, filling the vacancy of A. Malone, indefinite term. 16. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the appointment of John Clark, 58 Nettleton Avenue, Naugatuck, CT 06770 as an elector of the Non Union Pension Board, filling the vacancy of M. DiPerna, indefinite term. 17. Motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the appointment of Seth Bronko, 34 Fairfield Court, Naugatuck, CT 06770 as a member of the Naugatuck Valley Health District, filling the unexpired term of B. Chawla, term to expire October 1, 2015. Burgess Bronko abstained. Mayor Mezzo swore S. Bronko into office as a member of the Naugatuck Valley Health District. Mayor Mezzo swore S. Bronko in as a bailiff. 18. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the reappointment of Lieutenant Brian Newman, 211 Spring Street, Naugatuck, CT 06770 as a regular member of the Human Resource Development Board, term to expire October 1, 2017. 19. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the reappointment of Mary Ann Reilly, 170 Meadow Street, Naugatuck, CT 06770 as a regular member of the Human Resource Development Board, term to expire October 1, 2017. 20. Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Robert A. Mezzo to accept and approve the accounting for the Everett Rogers Trust, waive further accountings and accept an initial distribution from the trust in the amount of $47,243, it being understood that a reserve in the amount of $6,000 is being held to pay for any further trust expenses; and to authorize the mayor to sign any documents that may recently be required. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and authorize Mayor Mezzo to execute all contracts and related documents for the proposed Temporary Access and Drainage Easement for Drainage Repair to 73-75 Goodyear Avenue and 113-115 Trowbridge Place based on a favorable report from the Planning Commission pursuant to Section 8-24 of the General Statutes in a form approved by borough counsel as recommended by Borough Engineer Wayne Zirolli. Burgess Ersnky left 8:20 p.m. 22. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and authorize Mayor Mezzo to execute all contracts and related documents for the proposed Transfer of a Portion of Borough Property to the Owner of 132 School Street Extension to Rectify the Existing Septic System Encroachment on Borough Property based on a favorable report from the Planning Commission pursuant to Section 8-24 of the General Statutes in a form approved by borough counsel as recommended by Borough Engineer Wayne Zirolli. Burgess Ernsky was not present for the vote. 23. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents to approve the road acceptance of D’Archangelo Drive and the remaining portion of Adriatic Lane as recommended by Borough Engineer Wayne Zirolli and the Planning Commission, subject to borough attorney approval. Burgess Ernsky was not present for the vote. Burgess Ersnky returned 8:29 p.m. 24. Motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Mezzo to enter into Connecticut Department of Energy and Environmental Protection (DEEP) Electric Vehicle Charging Station Grant and all accompanying documents that may come with that upon approval by borough attorney. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Mezzo to sign a “Request for the Installation of Street Lighting for Melissa Court, SNET Pole #6008” with CL&P as recommended by Burgess Robert Burns. 26. Motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses adopt the following resolution: RESOLVED: That Robert A. Mezzo, Mayor of the Borough of Naugatuck, is empowered to execute and deliver in the name and on behalf of this municipality a contract with the Connecticut State Library for a Historic Documents Preservation Grant. The board discussed the proposed Public Works Commission Ordinance. The members of the current public works commissions would be filtered into the new consolidated Public Works Commission. It was questioned why the commission was being changed to an advisory only commission instead of giving the commissioners the ability to vote. The Mayor said we have department heads now. In the past commissions did the work and made the decisions. Burgess Bronko left 8:53 p.m. 28. Public Comment – None Burgess Bronko returned 8:56 p.m. 30. Burgess Comments/Sub-Committee Reports Burgess Olbrys asked if anything has been done about lines being painted on Candee Road. He spoke at the Police Commission along with Burgess Jackson and Burgess Vitale regarding the necessity to have the lines painted. Burgess Ernsky asked if it was a valid idea to use CodeRed to remind residents to vote in the referendum. Mayor Mezzo said he thinks it is extremely inappropriate to use the CodeRed system for voting. Burgess Neth would like a letter sent to new School Superintendent Sharon Locke asking her to be on the Naugatuck High School Building Committee.  -9- Minutes – Board of Mayor and Burgesses Regular Meeting – October 7, 2014 Deputy Mayor Rossi reported the Fire Department responded to 94 incidents in September. The IT Commission saved the borough $60,000 by doing a full audit and inventory. The Carriage House Board of Directors’ decision making process has been revamped so meetings do not have to be held in order to purchase items. Burgess Burns thanked the board for approving the street light on Melissa Court. Burgess Jackson congratulated her brother-in-law Paul Russell on being named the Firefighter of the Year. Burgess Vitale congratulated Fire Marshal Bob Weaver on finishing his recertification. 31.
