Each member received copies for review. 4. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the monthly reports of October. Each member received copies for review. 5. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses add to the agenda for executive session, Pending Litigation. 6. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully to recess to Executive Session at 6:02 p.m. for discussion on the following: Collective Bargaining (UPSEU), Contract Negotiations (EMS) and Real Estate Negotiations (Parcels A, B and C, Naugatuck Train Station, Naugatuck Youth Services, Inc. Mayor Mezzo reconvened the meeting at 7:00 p.m.  -2- Minutes – Board of Mayor and Burgesses Regular Meeting – November 5, 2014 7. The following motions emanated from Executive Session. Motion by Deputy Mayor Rossi and seconded by Burgess Scully to authorize Mayor Robert Mezzo to enter into a collective bargaining agreement between the Borough of Naugatuck and the United Public Service Employees Union Local 424, Unit 15 White Collar dated July 1, 2014 through June 30, 2015. Burgess Ernsky, Burgess Jackson and Burgess Olbrys abstained. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully to authorize Mayor Robert Mezzo to enter into a commercial lease between the Borough of Naugatuck and Naugatuck Youth Services, Inc. for property located at 13 Scott Street, Naugatuck, CT. 8. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses recess to the Firemen’s Pension Plan “C” Board at 7:02 p.m. Mayor Mezzo reconvened the meeting at 7:05 p.m. 9. Public Comment – None 10. Burgess Comments – Open Topic Burgess Ernsky congratulated Deputy Mayor Rossi for representing Naugatuck in the New York City Marathon. Deputy Mayor Rossi congratulated the Naugatuck Hall of Fame inductees. She thanked Hop Brook Intermediate School for donating $200 toward her run in the New York City Marathon which will benefit the Naugatuck Education Foundation. She also thanked everyone who supported her financially and otherwise on her marathon. Burgess Scully urged everyone to attend the Veterans Day wreath ceremony and parade. Burgess Jackson congratulated Deputy Mayor Rossi. She said the Senior Center Bazaar was well attended. Burgess Vitale said it’s interesting and sad to see Building 25 come down. He is excited to see what will come in its place. 11. Mayor Mezzo reappointed Vincent Cascella, 84 Gail Drive, Naugatuck, CT 06770 as a member of the Building Code Board of Appeals., term to expire September 1, 2019. 12. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses adopt the State of Connecticut Department of Economic and Community Development Certified Resolution and authorizes Mayor Robert A. Mezzo to execute and file all agreements & related documents in connection with a reallocation of $940,000.00 in grant funds from the State of Connecticut DECD to the Borough of Naugatuck regarding the demolition of 58 Maple Street (Goodyear Building) and the renovation of the Bronson B. Tuttle House at 380 Church Street. 18. Motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses adopt the following Environmental Stewardship Pledge Resolution, as if read: WHEREAS, the Borough of Naugatuck recognizes that a healthy natural environment is critical to the well-being of our community; WHEREAS, the Borough of Naugatuck aims to provide long term environmental health for its residents through the efficient and smart use of natural resources, protection of the quality and diversity of the local environment upon which the community and residents depend; WHEREAS, the Borough of Naugatuck will continually improve the efficient use of all natural resources in order to ensure a future with secure, clean and sustainable environmental benefits to all of its residents; WHEREAS, the Borough of Naugatuck will encourage environmental stewardship and protection of our natural environment through sharing of information and collaboration with the community, community groups as well as local, state and federal agencies; WHEREAS, the Borough of Naugatuck will strive to incorporate environmental considerations as an integral part of assessing economic development and growth management options, land use plans, transportation strategies and development proposals for an overall sustainable and healthy community design;  -5- Minutes – Board of Mayor and Burgesses Regular Meeting – November 5, 2014 WHEREAS, the Borough of Naugatuck will continue to review, investigate and encourage best practices that have the potential of substantially improving the environment, NOW THEREFORE, be it resolved by the Borough of Naugatuck as follows: WE SHALL PRESERVE AND ENHANCE THE ECOLOGICAL SYSTEMS AND DIVERSITY OF THE LOCAL ENVIRONMENT BY; Objective 1: Developing general municipal policies that encourage conservation and proactively address environmental issues and improve and protect air, water and natural resource standards above the current levels. Objective 2: Enhance our sewage treatment facility so that best practices, and effective and modern measures assure environmental compliance and the preservation of valued and protected natural resource of our waters. Objective 3: Discourage, object and actively resist efforts by development, industry, utility, governmental or other body to cause pollutants to be expelled into our air or into our water resources that may be deemed harmful to our environment and the general health and quality of life of our residents. Objective 4: Reject as inconsistent any development, industry, utility, governmental or other body which jeopardizes our air and water resources against the long term collective best interest of our community. Objective 5: Encourage, inspire and support efforts by development, industry, utility, governmental or other body to pursue modern business practices with conservation techniques in a fashion that respects, enhances and celebrates our natural resources and environment and protects the general health and quality of life of our residents. Objective 6: Encourage sustainable economic development and smart growth emphasizing health, safety and quality of life for all of our residents. Objective 7: Support local organizations that educate the public, schools, business and industry about environmental stewardship. Objective 8: Ensure that this environmental stewardship pledge keeps pace with technology, nation-wide trends and the community collective best interest at center. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Public Works Director James Stewart to accept payment in the amount of $70,005.60 from the Connecticut Water Company as a payment in lieu of final road trench paving for the work on Bear Paw Road and Tawny Thrush Road. 20. Motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses hereby adopt Ordinance #128 Public Works Commission of the Code of Ordinances of the Borough of Naugatuck, Connecticut. The Public Works Commission shall replace the following existing commissions of the Borough of Naugatuck: Streets Commission (Chapter 16, Article II., Sec. 16-31 through 16-42; Ord. No. 71 § 1, 9-19-85), Park Commission (Chapter 14, Sec. 14-1, Code 1973 § 17-1) and Municipal Golf Course Commission (Chapter 2, Article II., Division 6, Sec. 2-101 through 2-104. It reads as follows, as if read: Ordinance #128 Public Works Commission CREATION. The Borough of Naugatuck hereby establishes the Public Works Commission in accordance with Section 7-148(c)(6)(C) of the Connecticut General Statutes and the Charter and Code of Ordinances of the Borough of Naugatuck. The Public Works Commission shall replace the following existing boards or commissions of the borough: Streets Commission (Chapter 16, Article II., Sec. 16-31 through 16-42; Ord. No. 71 § 1, 9-19-85), Park Commission (Chapter 14, Sec. 14-1, Code 1973 § 17-1) and Municipal Golf Course Commission (Chapter 2, Article II., Division 6, Sec. 2-101 through 2-104). PURPOSE. The purpose of the Public Works Commission is to combine the Streets Commission, Park Commission, and Municipal Golf Course Commission into one commission that will streamline the administration, maintenance and control of the borough’s streets, sidewalks and curbs, drainage facilities, borough vehicles, parks, playgrounds and other recreational facilities, including the Hop Brook Golf Course, and lands within the borough.  -7- Minutes – Board of Mayor and Burgesses Regular Meeting – November 5, 2014 POWERS AND DUTIES. The powers and duties of the Public Works Commission shall be exercised and performed as herein provided in accordance with all borough ordinances and applicable laws. The Public Works Commission shall be responsible to provide advice and consultation to the Department of Public Works pertaining to the administration of public works and other enterprises related to the infrastructure of the borough, including: A. All streets, avenues, highways, alleys and bridges, and the opening, grading, improving, repairing and cleaning of the same; B. The construction, protection, repair, furnishing, cleaning, heating, lighting and general care of all public streets and appurtenances; C. The construction, repair, cleaning and general care of all drains, culverts, sluiceways and catch basins; D. The administration, maintenance and control of borough properties, parks and recreational lands and facilities; E. The preservation, care and removal of trees within highways or public places; F. The administration, maintenance and control of the Hop Brook Golf Course. In addition to the above, the commission shall: A. Continually review the borough’s needs with respect to public works and make such recommendations to the Board of Mayor and Burgesses. B. Advise and recommend procedures and guidelines designed to improve the operation of the Department of Public Works. C. Advise and recommend procedures and guidelines designed to improve the maintenance and care of school buildings and grounds as may be requested by the Board of Education. D. Request assistance from any other department of the borough in the performance of the commission’s duties and cooperate with any other department of the borough in projects of mutual interest and in the interests of the borough. E. Submit to the borough, at a time determined by the Board of Mayor and Burgesses, an annual report for presentation and/or publication relative to the work of the commission. The commission shall submit such other reports as are requested by the Board of Mayor and Burgesses. COMPOSITION; TERMS OF MEMBERS; VACANCIES. A. The Public Works Commission shall consist of nine (9) members, who are domiciled in the borough and are electors therein, and shall be appointed by the Board of Mayor and Burgesses. Commission members shall serve without compensation. No more than five (5) such appointive commissioners shall at any time be from the same political party. B. The commission shall annually elect from its voting membership a chairman and such other officers as it shall from time to time determine may be necessary. C. All members shall be appointed for _____ year terms. The terms shall commence on ________, 2014. In the event of a vacancy in the commission’s membership, a  -8- Minutes – Board of Mayor and Burgesses Regular Meeting – November 5, 2014 successor shall be appointed by the Board of Mayor and Burgesses, to serve the unexpired term of the vacating member from the same political party as the vacating member. Any member may be removed by the mayor for just cause, which shall include failure to attend three meetings of the commission without reasonable cause within a calendar year. D. The mayor and the Director of Public Works shall serve as members ex officio of the commission without voting rights and their attendance will not be a factor in determining a quorum. E. The commission may also consist of two (2) alternate members and shall be appointed by the Board of Mayor and Burgesses. The members shall meet all the requirements of the regular members. They shall fill temporary vacancies on the commission, and when so doing, shall have all the powers of regular members. F. A majority of all voting members of the commission shall constitute a quorum for conducting the commission’s business. LIMITATIONS. A. Nothing in this subchapter shall be construed as conferring upon the commission any administrative authority over the staff or the operation of the Department of Public Works. B. The commission’s authority is limited to providing advice and recommendations to the Department of Public Works and the Board of Mayor and Burgesses. C. The commission shall have no authority to incur any expenses without the prior approval of the Board of Mayor and Burgesses. The commission shall have no fiscal authority. *Formatting can change to conform to other sections of the Code. Motion withdrawn. 21. Burgess Comments/Sub-Committee Reports Deputy Mayor Rossi attended the annual NEDC meeting. The Fire Department responded to 91 incidents in October. Three Fire Department retirements are expected next summer. Engine 5 is due back at the end of the month and then Engine 2 will be sold. She hopes to see many people in attendance at the Veterans Day events. Happy Thanksgiving. Burgess Neth reported the Naugatuck High School Building Committee discussed additional items to be considered should there be money remaining after the project is  -13- Minutes – Board of Mayor and Burgesses Regular Meeting – November 5, 2014 completed. Items on the list are bleachers, air conditioning in the cafeteria, cafeteria tables, a storage building for sports groups, netting for the tennis court and softball field, the purchase of homes on Rubber Avenue and site work. An amendment to the current grant has been done to receive 75% reimbursement from the state if the homes in front of the school on Rubber Avenue were to be purchased. The committee asked for an equipment list from the Board of Education Maintenance Department to assist them in maintaining the facility better. 30.
