MINUTES SPECIAL MEETING BOARD OF MAYOR AND BURGESSES MARCH 30, 2015 1. Mayor Robert A. Mezzo called the special meeting to order at 6:00 p.m. with the following in attendance: BURGESSES: RESIDENTS: T. K. Rossi R. Neth Seventy-five + M. Bronko A. Olbrys R. Burns P. Scully, Sr. PRESS: C. Ernsky, absent R. Vitale L. Marshall L. Jackson, arrived 6:02 p.m. P. Singley DEPARTMENT HEADS: OTHERS: K. Hanks, Fire Chief E. Fitzpatrick, Attorney B. Kelly, CPV Towantic 2. Mayor Mezzo led in the Pledge of Allegiance to the flag. 3. Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses adopt the following resolution, as if read: WHEREAS, Federal monies are available under the Connecticut Small Cities Community Development Block Grant Program, administered by the State of Connecticut, Department of Housing pursuant to Public Law 93 – 3 83, as amended; and, WHEREAS, pursuant to Chapter 127c, and Part VI of Chapter 130 of the Connecticut General Statutes, the Commissioner of Housing is authorized to disburse such Federal monies to local municipalities; and, WHEREAS, it is desirable and in the public interest that the Borough of Naugatuck make application to the State for $500,000 in order to undertake a Small Cities Community Development Program and to execute an Assistance Agreement therefore, should one be offered. NOW, THEREFORE, BE IT RESOLVED BY the Board of Mayor and Burgesses; 1. That it is cognizant of the conditions and prerequisites for State Assistance imposed by Part VI of Chapter 130 of The Connecticut General Statutes; and, 2. That the filing of an application by the Borough of Naugatuck in an amount not to exceed $500,000 is hereby approved, and that the Mayor is hereby authorized and directed to file such Application with the Commissioner of the Department of Housing, to provide such additional information, to execute such other documents as may be required by the Commissioner, to execute an Assistance Agreement with the State of Connecticut for State financial assistance if such an Agreement  -2- Minutes – Board of Mayor and Burgesses Special Meeting – March 30, 2015 is offered, to execute any amendments, rescissions, and revisions thereto, to carry out approved activities and to act as the authorized representative of the Borough of Naugatuck. ROLL CALL VOTE: FOR OPPOSE ABSTAIN Mayor Mezzo R. Neth None None T. K. Rossi A. Olbrys M. Bronko P. Scully R. Burns R. Vitale Motion carried 8-0-0 Burgess Jackson was not present for the vote. 4. Attorney Edward Fitzpatrick gave the board an update on the Proposed Oxford Power Plant. The Borough of Naugatuck applied for intervener status. CPV Towantic needs to purchase credits to improve the overall ozone. A permit is not available until the credits are purchased. Credits will not diminish emissions. CPV contends the plume ends at the fence line. That claim is disputed by the interveners. The borough intends on submitting briefs. The CPV Towantic Engineer met with the Borough Engineer and was asked to submit a wastewater plan by the April WPCA meeting to request the use of the treatment plant. There is no claim of processing water, only wastewater from sinks, toilets, showers and floor drains. The borough has asked that no storm water come to the borough, prefer the storm water stay on their site. Unanswered questions have to do with storm water and the contents of the floor drains. CPV Towantic Senior Vice President Braith Kelly said for every pound of submission, 1.2 pounds of credit must be purchased. Credits cannot be bought to go over the limit. He asked that the board allow them the opportunity to answer questions before a vote is taken. Burgess Vitale is not comfortable with the purchase of credits by CPV. Mayor Mezzo does not support opposition to the plant. Deputy Mayor Rossi can’t support a motion that doesn’t make a clear statement. She has trust and faith in our legal and intervening team. Burgess Neth said the credit issue bothers him. Our legal team is continuing to work on the issue. Motion by Burgess Olbrys and seconded by Burgess Vitale that the Borough of Naugatuck finds the CPV Towantic Power Plant to be contradictory to the Environmental Pledge passed by this board.  -3- Minutes – Board of Mayor and Burgesses Special Meeting – March 30, 2015 ROLL CALL VOTE: FOR OPPOSE ABSTAIN A.
