MINUTES REGULAR MEETING BOARD OF MAYOR AND BURGESSES APRIL 7, 2015 1. Mayor Robert A. Mezzo called the regular meeting to order at 6:15 p.m. with the following in attendance: BURGESSES: PRESS: T. K. Carter, Mayoral Aide 2. Mayor Mezzo led in the Pledge of Allegiance to the flag. 3. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the monthly reports of March. Each member received copies for review. 4. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Scully to recess to Executive Session at 6:17 p.m. for discussion on the following: Real Estate Negotiations (General DataComm, Parcels A, B and C, Naugatuck Train Station, Prospect Street School, Property bordering Water Street and Cedar Street, Chemtura property) and Pending Litigation inviting in Attorney E. Fitzpatrick and Naugatuck Economic Development Corporation CEO R. Pugliese. Mayor Mezzo reconvened the meeting at 7:03 p.m. 5. The following motions emanated from Executive Session. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Scully to authorize Mayor Mezzo to execute a preliminary agreement and any and all related documents on behalf of the Borough of Naugatuck with Sustainable Development Corporation for the possible development of a portion of the former Uniroyal Parcel B as unanimously recommended by the Naugatuck Economic Development Corporation subject to final review and approval by the borough attorney.  -2- Minutes – Board of Mayor and Burgesses – Regular Meeting – April 7, 2015 VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Scully to authorize Mayor Mezzo to sign a confidentiality agreement and any and all related documents on behalf of the Borough of Naugatuck with Chemtura regarding the former Uniroyal Chemical property, subject to review and approval by borough counsel. 6. Public Comment Residents had the following comments: Thanked Burgess Olbrys and Burgess Vitale for standing up for the Environmental Pledge the board previously took. The borough needs to move toward renewable energy. Disappointed the board did not vote for the health of residents. Do not need the power plant. Any apartments built on Parcel B should be age restrictive. Do not want the wastewater from the power plant coming to our treatment plant. Upset no one from the borough approached her about selling her home/salon in front of the high school. 7. Burgess Comments – Open Topic – None 8. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses recess to the Retirement Board at 7:27 p.m. Mayor Mezzo reconvened the meeting at 7:29 p.m. 9. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses add to the agenda three motions authorizing Mayor Mezzo to execute all contracts and related documents for the proposed sale of three properties based on favorable reports from the Planning Commission. 10. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents for the proposed sale of the property bordering Water Street and Cedar Street, known as Cedar Park, based on a favorable report from the Planning Commission pursuant to Section 8-24 of the General Statutes in a form approved by borough counsel as recommended by Naugatuck Economic Development Corporation. 11. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents for the proposed sale of the Naugatuck Train Station, based on a favorable report from the Planning Commission pursuant to Section 8-24 of the General Statutes in a form approved by borough counsel as recommended by Naugatuck Economic Development Corporation.  -3- Minutes – Board of Mayor and Burgesses Regular Meeting – April 7, 2015 For the record: Mayor Mezzo: “Note for the record and make it a part thereof the Planning Commission’s memo to the Board of Mayor and Burgesses that reference their comments. So their comments should be attached as part of the approvals for these motions if they’re so granted.” The Planning Commission’s memo to the Board of Mayor and Burgesses that reference their comments is below, as if read: Please be advised that at the regular meeting of the Planning Commission held on Monday, April 6, 2015, the following was decided: 1. SEND a POSITIVE referral to the Board of Mayor and Burgesses in accordance with Section 8-24 of the Connecticut General Statutes regarding the proposed sale of the property bordering Water Street and Cedar Street, known as Cedar Park together with a request that Attorney Fitzpatrick inquire as to the potential rights of the YMCA to use the property. 2. SEND a POSITIVE referral to the Board of Mayor and Burgesses in accordance with Section 8-24 of the Connecticut General Statutes regarding the proposed sale of Prospect Street School together with the commission’s concerns over the amount of off-street parking as well as the impact to traffic on Prospect Street. 3. SEND a POSITIVE referral to the Board of Mayor and Burgesses in accordance with Section 8-24 of the Connecticut General Statutes regarding the proposed sale of the Naugatuck Train Station together with the comments that the architectural integrity outside remain intact and the inside remain intact as much as possible. Also, the commission requests that the appropriate amount of parking be reserved by the Borough for train riders. 12. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents for the proposed sale of Prospect Street School, based on a favorable report from the Planning Commission pursuant to Section 8-24 of the General Statutes in a form approved by borough counsel as recommended by Naugatuck Economic Development Corporation. 13. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses add to the agenda a motion regarding the purchase of houses on Rubber Avenue.  -4- Minutes – Board of Mayor and Burgesses – Regular Meeting – April 7, 2015 14. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize the borough attorney to start negotiations with property owners on Rubber Avenue regarding the purchase of houses as recommended by the Naugatuck High School Renovation Committee. 15. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses add to the agenda a motion to appoint members to the Renewable Energy Committee. 16. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses appoint Ronald Pugliese, Melissa Leonard and James Stewart, ex-officio as members of the Renewable Energy Committee. 17. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses add a resolution endorsing the Regional Performance Incentive Program. 18. Motion by Burgess Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses adopt a resolution endorsing the Regional Performance Incentive Program proposals listed below, referenced in Connecticut General Statutes Section 4-124s, (2014 Supplement), as if read: 1. NVCOG Regional GIS Data Development and GIS Website Enhancement 2. Regional Animal Control Facility Management and Operations Plan and Final Design 3. Senior Citizen Property Tax Loan Program Feasibility Study 4. State-wide orthophotography and LIDAR data (Proposal to be submitted by CRCOG) and authorize Robert A. Mezzo, Mayor to act on this endorsement by signing all necessary agreements and take all necessary actions related to this proposal to enter into a binding agreement with the Office of Policy and Management according to terms of the RPI grant program. Mayor Mezzo approved the reappointment of Lisa Dias, 55 Golden Hill Street, Naugatuck, CT 06770 as a member of the Day Care Board of Directors, term to expire April 1, 2017. 20. Mayor Mezzo approved the reappointment of Erica Osborne, 45 Morris Road, Prospect, CT 06712 as a member of the Day Care Board of Directors, term to expire April 1, 2017. 21. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses waive the bid process and authorize Mayor Mezzo to execute all contracts and related documents for the “Music Lab Equipment – Naugatuck High School” to Sweetwater, 5501 US Highway 30W, Fort Wayne, IN 46818 in the amount of $8,528 as recommended by Business Manager Robert W. Butler, Jr. and Board of Education IT Director Alan Merly. 22. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses approve financial support to repair Hillside Intermediate School roof so that an application can be made to the state for grant funds as recommended by the Five Year Capital Committee. For the record: Mayor Mezzo: “Let the record note that near the gymnasium is striked.” 23. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses approve financial support to replace the roof on Western Elementary School so that an application can be made to the state for grant funds as recommended by the Five Year Capital Committee. Deputy Mayor Rossi arrived 7:50 p.m. 24. Motion by Burgess Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses refer to the Joint Boards of Mayor and Burgesses and Board of Finance a transfer request of $6,800.00 from Contingency to the Police Department – “Snow Removal on the Roof” as recommended by Controller Robert W. Butler, Jr. Deputy Mayor Rossi abstained. 25. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize the potential usage of a purchasing consortium with NJPA (National Joint Powers Alliance) as recommended by Controller Robert W. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses enter into an agreement with Artspace Projects, Inc. for a field visit and market assessment in the amount of $15,000 to be billed in two installments and authorize Mayor Mezzo to execute all contracts and related documents. 27. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the Revised (LOCIP) Local Capital Improvement Program/Pavement Management Program dated April 7, 2015 for fiscal year period 2015- 2016 through 2019-2020 as recommended by Public Works Director James Stewart. 28. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses designate April 2015 as Child Abuse Prevention Awareness Month in the Borough of Naugatuck. 29. Public Comment A resident said she owns and lives in one of the houses in front of the high school on Rubber Avenue. She is quite upset that no one from the borough has approached her about selling her house. She has only read about it in the newspaper. The two homeowners who want to sell their houses rent them and do not live there.  -9- Minutes – Board of Mayor and Burgesses Regular Meeting – April 7, 2015 31. Burgess Comments/Sub-Committee Reports Burgess Vitale congratulated the Parks and Recreation Department for a fabulous Easter Egg Hunt. Over five hundred children attended. Burgess Jackson made hats for the Easter Egg Hunt. She thanked the Public Works Department employees for doing a great job. Deputy Mayor Rossi reported the Fire Department responded to 78 incidents in March. The Annual Recognition Ceremony will be held tomorrow at 6:30 p.m. in the St. Francis Church Hall. New portable radios are at the shop and should be in use soon. Various options are being looked at for the firefighter replacement list. For the record: “If there is anyone out there in the public, for the press’s benefit, that is looking to be able to be a firefighter, they have to understand once that list is created that is the list that remains in place for quite a while.” Burgess Neth said the Police Department met with the High School Renovation Committee and discussed the light at the entryway of the high school. It will cost twenty- five thousand dollars to fix what is currently there. Bids are being obtained. 32.
