1. Mayor “Pete” Hess called the regular meeting to order at 6:02 p.m. with the following in

3. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses approve the monthly reports
of November. Each member received copies for review.
4. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully to recess to Executive Session at 6:05 p.m. for discussion on the
following: Collective Bargaining (Naugatuck Administrative Negotiating
Association Agreement), Real Estate Negotiations (Woodcrest Drive,
Rubber Avenue, Clark Road/New Haven Road, T-Mobile Cell Tower,
Parcel C) and Pending Litigation inviting in Naugatuck Economic
Development Corporation CEO R. Pugliese, Tax Collector J. Goggin,
Assistant Superintendent of Schools C. Montini and Human Resources
Director J. Lawlor.
Mayor Hess reconvened the meeting at 7:18 p.m.
5. Public Comment
A resident gave an overview of events happening at Gunntown Passive Park and Nature
Preserve.

6. Mayor Hess reappointed Edward Rachuba (U), 636 Andrew Mountain Road, Naugatuck,
CT 06770 as a regular member of the Zoning Board of Appeals, term to expire
December 1, 2021.
7. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses approve the reappointment
of Brian Vaugh, 24 Rayron Circle, Naugatuck, CT 06770 as a regular
member of the Conservation Commission, term to expire November 1,
2019.
8. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses approve the reappointment
of Mary Lou Sharon, 228 Lewis Street, Naugatuck, CT 06770 as a regular
member of the Conservation Commission, term to expire November 1,
2019.
9. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses accept a factory credit offer
in the amount of $15,000 for decommissioned Engine 2 from Gowans-
Knight, 49 Knight Street, Watertown, CT 06795 for repairs, parts or
equipment as recommended by Fire Chief Ellen Murray.
10. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses authorize Mayor “Pete”
Hess to execute an agreement with Nobis Engineering, Inc., 122 Church
Street, Naugatuck, CT 06770 for the BRRP (Brownfield Remediation
and Rehabilitation Program) Application and Phase 1 ESA for Parcel
C South as recommended by Public Works Director James Stewart and as
approved by borough counsel.
11. Motion by Deputy Mayor Neth and seconded by Burgess Jackson that the Board of Mayor
and Burgesses adopt the following resolution for the appropriation and authorization of a
lease purchase agreement for the purchase of energy efficiency equipment, as if read:
WHEREAS, the Board of Mayor and Burgesses of the Borough of Naugatuck (the
“Board”) has determined that a true and very real need exists for the Purchase of Energy
Efficiency Equipment (the “Equipment”) for use within the Borough of Naugatuck; and
WHEREAS, the Borough of Naugatuck (the “Lessee”), has or will take the necessary
steps, including those relating to any applicable legal bidding requirements, to arrange for
the acquisition of the Equipment; and
WHEREAS, the Board proposes to finance the acquisition of the Equipment with a lease
which shall be subject to annual appropriations (the “Lease”); and

WHEREAS, all Lease payments which may be due from the Lessee pursuant to the Lease
for fiscal year ending June 30, 2017, if any, are within an available, unexhausted and
unencumbered appropriation.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF MAYOR AND
BURGESSES OF THE BOROUGH OF NAUGATUCK AS FOLLOWS:
Section 1. It is hereby recommended to the Board of Finance and Board of Mayor and
Burgesses and the Board of Finance sitting jointly that the sum of $1,200,000 be
appropriated for the cost of the purchase and installation of certain equipment to achieve
savings in energy costs for the Lessee, including, but not limited to, new high efficiency
LED Street Lighting and poles, and all alterations, repairs and improvements in
connection therewith, as well as engineering, architectural and temporary and permanent
financing costs (the “Project”), said appropriation being inclusive of any and all grants
which may be received for the Project.
Section 2. Provided that the appropriation for the Equipment is approved by the Board of
Mayor and Burgesses and the Board of Finance sitting jointly to finance the purchase of
the Equipment, the Mayor of the Lessee is authorized to purchase the Equipment and to
execute and deliver the Lease with TCF Equipment Finance or other appropriate entity
(the “Lessor”) which offers the proposal which is in the best interests of the Borough, in
the sole discretion of the Mayor, and to execute and deliver any acceptance certificates,
schedules of payments, escrow agreements and related documents in connection with the
leasing of the Equipment as may be approved by the Mayor, such approvals to be
conclusively evidenced by the execution and delivery of such agreements, certificates and
documents.
Section 3. The Mayor and the Controller of Lessee be, and each of them hereby is,
authorized and directed to execute and deliver such other papers, instruments, opinions,
certificates, affidavits and other documents and to do or cause to be done any and all other
acts and things necessary or proper for carrying out this resolution and the terms and
obligations of the Lease in connection with the purchase and lease of the Equipment.
Section 4. The Lessee hereby designates the Lease as a “qualified tax-exempt obligation”
within the meaning of Section 265(b)(3) of the Internal Revenue Code.
Section 5. The Lessee reasonable expects to incur expenditures (the “Expenditures”) in
connection with the capital project for which a general functional description is provided
above. The Lessee reasonably expects to reimburse itself for the cost of such Expenditures
with the proceeds of the obligation described above. The maximum principal amount of
such obligation is not expected to exceed $1,200,000. This declaration of official intent is
a declaration of official intent made pursuant to Treasury Regulation Section 1.150l.

12. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses authorize Mayor “Pete”
Hess to execute the street light conversion contract and maintenance
agreement with ESCO/PowerSecure, Inc. as recommended by Public
Works Director James Stewart.
13. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses authorize Public Works
Director James Stewart to accept a fee in lieu of final paving from
Eversource in the amount of $87,158.50 for the final trench paving on
Calvin Street, Curtis Street, Curtis Court, Linden Street, Orchard
Street and Orchard Terrace related to a gas main installation.
14. Naugatuck Housing Authority Executive Director Christine Warren and Project
Manager Steve Ball are requesting permit fees to be waived for the Conrad Street
improvements. The Housing Authority was approved for a grant in the amount of 3.7
million dollars to renovate bathrooms, sidewalks and abate asbestos at Oak Terrace. The
project went out to bid and came in at 4.6 million dollars. Permit fees were not charged to
the Housing Authority in the past. They only paid educational fees up until a year ago.
The building permit fees being charged for this project total $77,000. There is a short fall
now of $126,000. They do not want to reduce anything in the project. They want to be
able to renovate all of the units as originally bid. Mayor Hess wants to hear from Building
Inspector Bill Herzman who was unable to attend tonight’s meeting. In the meantime, he
told Mrs. Warren and Mr. Ball to get a breakdown of their budget figures to the
subcommittee. He appointed a subcommittee consisting of Burgess Scully, Burgess
Donovan and Deputy Mayor Neth to assist them with their budget on the project.
15. A discussion took place regarding Pictometry International Corporation and other
similar programs. Mayor Hess said new technology would be a benefit to the Assessor‘s
Office to help her identify additional property to add to the grand list. There are other
similar technologies that could possibly be cheaper than Pictometry International
Corporation but we need to make sure it satisfies the assessor’s requirements. Assessor
Carol Ann Tyler is familiar with Pictometry International Corporation. Pictometry will do
a flyover in town which will give a picture of all sides of a property. The data could show
if a porch was put on a house or if a double garage was added. If there was a question

about the square footage of a property, Pictometry can provide the accurate square footage
based on their data. Borough Engineer Wayne Zirolli questioned whether Pictometry was
the best company to go with or if another company could provide the services needed at a
lower cost. Mayor Hess will meet with the assessor and borough engineer to compare the
services each company provides and the costs associated with those services.

Scully that the Board of Mayor and Burgesses refer to the Joint Boards of
Mayor and Burgesses and Board of Finance a transfer request of
$35,000.00 from Contingency to the Public Works Department – Motor
Vehicle Repairs Account as recommended by Public Works Director
James Stewart.
17. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses refer to the Joint Boards of
Mayor and Burgesses and Board of Finance a transfer request of
$70,000.00 from Contingency to the Public Works Department – New
F550 Truck, Plow and Sander Account as recommended by Public
Works Director James Stewart.

19. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses accept conveyance of real
property from Donald F. Woodfield in lieu of back taxes for real
property off Rubber Avenue Extension on a pass way account # 007-
8801.
20. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses accept conveyance of real
property on New Haven Road near Trout Brook Drive/Clark Road, an
irregularly shaped parcel from the owner Arend Holz identified as R-
16E47 which is an unbuildable lot in lieu of back taxes.
21. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses accept conveyance of real
property from Raymond Smith and/or the owner of real property on

23. Burgess Comments/Sub-Committee Reports
Burgess Vitale reported the Parks Commission tabled the establishment of fees for field
use. They need to raise $10,000 for the skate park; $7,185 has been raised so far. The fire
inspectors are behind on inspections. Timothy Ryan resigned after sixteen years on the
Fire Commission.
For the record:
Mayor Hess: “We are, I believe, we are responding to that problem.” Mayor Hess said in
response to the fire inspector statement in Burgess Vitale’s comments.
Burgess Jackson thanked Mayor Hess and Shelby Lineweber for a wonderful Fall
Festival. Assistant Fire Chief Paul Russell’s dad passed away. Youth Services is holding a
pancake breakfast with Santa Claus.
Burgess Scully said the PSAP Committee is working on a new tower in the Industrial
Park. Burgess Burns will be inducted into the Connecticut Hall of Fame tomorrow at 5
p.m. at the State Armory.
Burgess Herb reported the Conservation Commission is concerned about the pipeline
expansion. He said it was a very good Christmas Festival. Merry Christmas! God bless,
it’s Christ’s birthday.
Burgess Donovan reported A Better Way Wholesale is requesting a special permit. She
had an enjoyable time at the Christmas Festival.
Burgess Hoff said the festival was the best event in a long time. There were so many
people in attendance. She thanked the mayor and Shelby Lineweber for a great job. Merry
Christmas and Happy Holidays!
Burgess Neth said it was a great event. There will be more to come. Merry Christmas!

accept a factory credit offer in the amount of $15,000 for decommissioned Engine 2

11. Motion by Burgess that the Board of Mayor and Burgesses
authorize Mayor “Pete” Hess to execute an agreement with Nobis Engineering, Inc., 122
Church Street, Naugatuck, CT 06770 for the BRRP (Brownfield Remediation and
Rehabilitation Program) Application and Phase 1 ESA for Parcel C South as
recommended by Public Works Director James Stewart and as approved by borough
counsel.

12. Motion by Burgess that the Board of Mayor and Burgesses
adopt the following resolution for the appropriation and authorization of a lease purchase
agreement for the purchase of energy efficiency equipment:
WHEREAS, the Board of Mayor and Burgesses of the Borough of Naugatuck (the
“Board”) has determined that a true and very real need exists for the Purchase of Energy
Efficiency Equipment (the “Equipment”) for use within the Borough of Naugatuck; and
WHEREAS, the Borough of Naugatuck (the “Lessee”), has or will take the necessary
steps, including those relating to any applicable legal bidding requirements, to arrange for
the acquisition of the Equipment; and
WHEREAS, the Board proposes to finance the acquisition of the Equipment with a lease
which shall be subject to annual appropriations (the “Lease”); and
WHEREAS, all Lease payments which may be due from the Lessee pursuant to the
Lease for fiscal year ending June 30, 2017, if any, are within an available, unexhausted
and unencumbered appropriation.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF MAYOR AND
BURGESSES OF THE BOROUGH OF NAUGATUCK AS FOLLOWS:
Section 1. It is hereby recommended to the Board of Finance and Board of Mayor and
Burgesses and the Board of Finance sitting jointly that the sum of $1,200,000 be
appropriated for the cost of the purchase and installation of certain equipment to achieve
savings in energy costs for the Lessee, including, but not limited to, new high efficiency
LED Street Lighting and poles, and all alterations, repairs and improvements in
connection therewith, as well as engineering, architectural and temporary and permanent
financing costs (the “Project”), said appropriation being inclusive of any and all grants
which may be received for the Project.
Section 2. Provided that the appropriation for the Equipment is approved by the Board of
Mayor and Burgesses and the Board of Finance sitting jointly to finance the purchase of
the Equipment, the Mayor of the Lessee is authorized to purchase the Equipment and to
execute and deliver the Lease with TCF Equipment Finance or other appropriate entity
(the “Lessor”) which offers the proposal which is in the best interests of the Borough, in
the sole discretion of the Mayor, and to execute and deliver any acceptance certificates,
schedules of payments, escrow agreements and related documents in connection with the
leasing of the Equipment as may be approved by the Mayor, such approvals to be
conclusively evidenced by the execution and delivery of such agreements, certificates and
documents.
Section 3. The Mayor and the Controller of Lessee be, and each of them hereby is,
authorized and directed to execute and deliver such other papers, instruments, opinions,
certificates, affidavits and other documents and to do or cause to be done any and all

other acts and things necessary or proper for carrying out this resolution and the terms
and obligations of the Lease in connection with the purchase and lease of the Equipment.
Section 4. The Lessee hereby designates the Lease as a “qualified tax-exempt obligation”
within the meaning of Section 265(b)(3) of the Internal Revenue Code.
Section 5. The Lessee reasonable expects to incur expenditures (the “Expenditures”) in
connection with the capital project for which a general functional description is provided
above. The Lessee reasonably expects to reimburse itself for the cost of such
Expenditures with the proceeds of the obligation described above. The maximum
principal amount of such obligation is not expected to exceed $1,200,000. This
declaration of official intent is a declaration of official intent made pursuant to Treasury
Regulation Section 1.150l.

authorize Mayor “Pete” Hess to execute the street light conversion contract and
maintenance agreement with ESCO/PowerSecure, Inc. as recommended by Public
Works Director James Stewart.
14. Motion by Burgess that the Board of Mayor and Burgesses
authorize Public Works Director James Stewart to accept a fee in lieu of final paving
from Eversource in the amount of $87,158.50 for the final trench paving on Calvin
Street, Curtis Street, Curtis Court, Linden Street, Orchard Street and Orchard
Terrace related to a gas main installation.
15. Discussion/possible action regarding waiving the permit fee for Conrad Street
improvements through the Naugatuck Housing Authority.
16. Discussion/possible action regarding Pictometry International Corporation or other
similar programs.
17. Motion by Burgess that the Board of Mayor and Burgesses
refer to the Joint Boards of Mayor and Burgesses and Board of Finance a transfer request
of $35,000.00 from Contingency to the Public Works Department – Motor Vehicle
Repairs Account as recommended by Public Works Director James Stewart.
18. Motion by Burgess that the Board of Mayor and Burgesses
refer to the Joint Boards of Mayor and Burgesses and Board of Finance a transfer request
of $70,000.00 from Contingency to the Public Works Department – New F550 Truck,
