BOARD OF MAYOR AND BURGESSES
APRIL 4, 2017
1. Mayor “Pete” Hess called the regular meeting to order at 6:45 p.m. with the following in
attendance:

2. Burgess Scully led in the Pledge of Allegiance to the flag.
3. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses approve the minutes of the
regular meeting of March 7, 2017. Each member received a copy for
review.
4. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses approve the monthly reports
of March. Each member received copies for review.
5. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully to recess to Executive Session at 6:45 p.m. for discussion on the
following: Real Estate Negotiations (GDC Building, Armory, Chemtura),
Personnel (Golf Course/Pro Shop Manager) and Pending Litigation (Tax
Appeals, Sewer Backup Claims). No one was invited into executive
session.
Mayor Hess reconvened the meeting at 7:21 p.m.
6. There were no motions emanating from Executive Session.
7. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses create the position of
purchasing agent/financial analyst. The position shall be non-union and
be contractual with a salary and benefits to be negotiated. The purchasing
agent shall be responsible to oversee all borough purchasing and

construction projects and shall report directly to the mayor. All other
aspects of the position shall be set forth in the job description to be
finalized by the mayor and the personnel director.
VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses offer the position of
purchasing agent/financial analyst to Robert Butler subject to
finalization of the job description and a mutually agreeable contract on the
terms noted above.
8. Mayor Hess said the General Data Comm building has been renamed the Naugatuck
Event Center. The Don Clady Car Show was a huge success. Since the car show, many
organizations have reached out to the mayor wanting to use the facility. He discussed the
possibility of purchasing air conditioning for the first floor of the event center. It
could cost between $50,000 and $60,000 installed. He said the building has realized
$59,831 net revenue from sponsorships, ticket sales, rental payments and profits from the
concession stand. The mayor said he will continue to get quotes and bring it back to the
board for approval.
9. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses recess to the Firemen’s
Pension Plan “C” Board at 7:30 p.m.
Mayor Hess will reconvene the meeting at 7:32 p.m.
10. Public Comment – None
11. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses approve the bid and
authorize Mayor Hess to execute all contracts and related documents for
the “Roof Replacement at East Side Fire Department” to DiGiorgi
Roofing and Siding, Inc., P.O. Box 126, 33 Lancaster Drive, Beacon Falls,
CT 06403 in the amount of $48,568.00 as recommended by Controller
Robert W. Butler, Jr. and the Five Year Capital Committee.
12. Motion by Burgess that the Board of Mayor and Burgesses refer to the
Joint Boards of Mayor and Burgesses and Board of Finance a transfer request not to
exceed $100,000.00 from Contingency to the Police Department Maintenance
Computer Account for the purchase of body cameras – 100% reimbursable by grant
as recommended by Deputy Police Chief Joshua Bernegger.
Motion withdrawn.
13. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses designate April 2017 as
National Autism Awareness Month in the Borough of Naugatuck.

14. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses designate April 2017 as
Child Abuse Prevention Awareness Month in the Borough of
Naugatuck.
15. Motion by Burgess Deputy Mayor Neth and seconded by Burgess Scully that the Board of
Mayor and Burgesses adopt the following resolution:
RESOLVED: That the Mayor, N. Warren “Pete” Hess, is empowered to execute and
deliver in the name and on behalf of the Borough of Naugatuck a certain contract with
the Department of Energy and Environmental Protection of the State of Connecticut for
the fulfillment of the America-the-Beautiful grant, and is authorized to affix the
Corporate Seal.

16. Motion by Burgess Deputy Mayor Neth and seconded by Burgess Scully that the Board of
Mayor and Burgesses adopt the following resolution, as if read:
WHEREAS, the Borough of Naugatuck has conducted a public information meeting
regarding the proposed project for the “Rubber Avenue at Hoadley Street and
Melbourne Street Traffic Signal improvements” (State Project NO. 87-146); and
WHEREAS, the Borough of Naugatuck, CT has published a legal notice display ad,
mailed a news release to multiple officials and agencies, and mailed a formal letter to
abutting property owners, announcing the public informational meeting on the proposed
project; and
WHEREAS, the Borough of Naugatuck Department of Public Works held a public
informational meeting on Thursday, March 2, 2017 at 6:00 pm in the Town Hall, at which
residents and elected officials had the opportunity to voice their concerns; and
WHEREAS, the Naugatuck Valley Council of Governments has endorsed this project;
and
WHEREAS, the Borough of Naugatuck Board of Mayor and Burgesses has considered
the concerns of residents from the pubic informational meeting and finds that the proposed
project, “Rubber Avenue at Hoadley Street and Melbourne Street Traffic Signal
improvements” (State Project NO. 87-146) is in the best interest of the Borough of
Naugatuck, CT and will promote the health, safety and general welfare of its residents and

provide for the convenience and safety of the motoring public and pedestrian traffic. The
borough will continue to address the concerns of residents and other interested parties as
design development of the project proceeds.
NOW THEREFORE, the Borough of Naugatuck, CT based on the above information,
and by virtue of this resolution, hereby fully supports the proposed project.

17. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses authorize Mayor “Pete”
Hess to execute all contracts and related documents in support of the
LOTCIP (Local Capital Improvement Program) application for The
Naugatuck River Greenway Phase II from the Whittemore Bridge
southerly to the Rotary (Breen’s) Recreational Fields as recommended by
Borough Engineer Wayne Zirolli.
18. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses approve a Heart and
Hypertension Settlement of $67,500 as full and final settlement of
Robert Harrison’s Heart and Hypertension Claim and authorize Mayor
Hess to execute any and all documents subject to approval by borough
counsel.
19. Mayor Hess stated there is a surplus of $125,000 in the Town Clerk’s Local Capital
Improvement Fund. The excess can only be used for capital purchases by law. The board
discussed at a previous meeting purchasing some of the following items. The mayor
quoted $10,000 for a portable stage, $15,000 for a sound system, $5,000 for a sound
system tent, $17,000 for an aerator at Baummers Pond, $10,000 for a “Zamboni” type
floor cleaning machine to be used at the event center, $5,000 for a generator and an
amount to be determined for an irrigation system for the green. Another idea was a
projector with a smart board for presentations during commission/board meetings in the
Hall of Burgesses. The mayor said all options will be considered and brought back to the
board for a vote.
20. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses authorize Mayor Hess to
execute all contracts and related documents for a lease tower agreement
with Eco-Site, Inc., 240 Leigh Farm Road, Suite 415, Durham, NC 27707
subject to approval by borough counsel.

23. Burgess Comments/Sub-Committee Reports
Burgess Wisniewski said the event center is a great idea. It will bring more people into
town and generate revenue for businesses.
Deputy Mayor Neth said the car show was absolutely fantastic. The Department of
Public Works did a fantastic job preparing for it. It generated so much buzz. He took his
granddaughters to the petting zoo. Events like these are positive for the Borough of
Naugatuck. It’s been a long time since we’ve had a mayor that has taken the initiative to
bring some life into this town. The mayor is doing a fantastic job for the future of
Naugatuck.
Mayor Hess praised the DPW for their outstanding job getting the GDC Building ready.
He said an incredible amount of work has been done. He is very proud of the entire team.
He commends Bob Butler who was instrumental in putting everything together. He said
Don Clady is a ball of fire and incredibly enthusiastic. Mike Massicotte and John Roden
worked tirelessly on the project. The golf course opens tomorrow and the mayor is hitting
the first ball. He said they plan on having a profitable year. Less people are working there
and more work is getting done.
Burgess Burns congratulated Mayor Hess, the Fire Department, the Police Department
and the Public Works Department for the fine job on the GDC Building.
Burgess Scully congratulated everyone for doing a fine job. He said we have the most
enthusiastic mayor in years. Keep up the good work. Thank you.
Burgess Vitale reported the girl scouts will be at Gunntown Passive Park and Nature
Preserve hosting an interactive walk. Naugatuck Glass donated the glass for the posts. The

Conservation Commission and the Park Commission have an issue over which
commission has what power. Burgess Vitale said benches will be made for the dog park as
part of an Eagle Scout Project and another kiosk will be built by high school students.
Burgess Herb reported a proposed project for Salem Square went before the Planning
Commission.
24. VOTED: Unanimously on a motion by Burgess Scully and seconded by Burgess
Vitale to adjourn the meeting at 8:43 p.m.

grant as recommended by Deputy Police Chief Joshua Bernegger.
13. Motion by Burgess that the Board of Mayor and Burgesses designate
April 2017 as National Autism Awareness Month in the Borough of Naugatuck.
14. Motion by Burgess that the Board of Mayor and Burgesses designate
April 2017 as Child Abuse Prevention Awareness Month in the Borough of
Naugatuck.
15. Motion by Burgess that the Board of Mayor and Burgesses adopt the
following resolution, as if read:
RESOLVED: That the Mayor, N. Warren “Pete” Hess, is empowered to execute and
deliver in the name and on behalf of the Borough of Naugatuck a certain contract with
the Department of Energy and Environmental Protection of the State of Connecticut for
the fulfillment of the America-the-Beautiful grant, and is authorized to affix the
Corporate Seal.
ROLL CALL VOTE:
16. Motion by Burgess that the Board of Mayor and Burgesses adopt the
following resolution, as if read:
WHEREAS, the Borough of Naugatuck has conducted a public information meeting
regarding the proposed project for the “Rubber Avenue at Hoadley Street and
Melbourne Street Traffic Signal improvements” (State Project NO. 87-146); and
WHEREAS, the Borough of Naugatuck, CT has published a legal notice display ad,
mailed a news release to multiple officials and agencies, and mailed a formal letter to
abutting property owners, announcing the public informational meeting on the proposed
project; and
WHEREAS, the Borough of Naugatuck Department of Public Works held a public
informational meeting on Thursday, March 2, 2017 at 6:00 pm in the Town Hall, at
which residents and elected officials had the opportunity to voice their concerns; and
WHEREAS, the Naugatuck Valley Council of Governments has endorsed this project;
and
WHEREAS, the Borough of Naugatuck Board of Mayor and Burgesses has considered
the concerns of residents from the pubic informational meeting and finds that the
proposed project, “Rubber Avenue at Hoadley Street and Melbourne Street Traffic Signal
improvements” (State Project NO. 87-146) is in the best interest of the Borough of
Naugatuck, CT and will promote the health, safety and general welfare of its residents

and provide for the convenience and safety of the motoring public and pedestrian traffic.
The borough will continue to address the concerns of residents and other interested
parties as design development of the project proceeds.
NOW THEREFORE, the Borough of Naugatuck, CT based on the above information,
and by virtue of this resolution, hereby fully supports the proposed project.
ROLL CALL VOTE:
17. Motion by Burgess that the Board of Mayor and Burgesses authorize
Mayor “Pete” Hess to execute all contracts and related documents in support of the
LOTCIP (Local Capital Improvement Program) application for The Naugatuck
River Greenway Phase II from the Whittemore Bridge southerly to the Rotary (Breen’s)
Recreational Fields as recommended by Borough Engineer Wayne Zirolli.
18. Motion by Burgess that the Board of Mayor and Burgesses approve a
Heart and Hypertension Settlement of $67,500 as full and final settlement of Robert
Harrison’s Heart and Hypertension Claim and authorize Mayor Hess to execute any
and all documents subject to approval by borough counsel.
19. Discussion/possible action purchase of Capital Items from Town Clerk Recording Fee
Account.
20. Motion by Burgess that the Board of Mayor and Burgesses authorize
Mayor Hess to execute all contracts and related documents for a lease tower agreement
with Eco-Site, Inc., 240 Leigh Farm Road, Suite 415, Durham, NC 27707 as approved
by borough counsel.
21. Motion by Burgess that the Board of Mayor and Burgesses authorize
Controller Robert W. Butler, Jr. to refund the following tax refunds approved by Tax
Collector James Goggin; as if read:
