BOARD OF MAYOR AND BURGESSES
MAY 2, 2017
1. Mayor “Pete” Hess called the regular meeting to order at 6:03 p.m. with the following in
attendance:

2. Burgess Scully led in the Pledge of Allegiance to the flag.
3. Motion by Deputy Mayor Neth and seconded by Burgess Scully that the Board of Mayor
and Burgesses approve the minutes of the regular meeting of April 4, 2017and the special
meetings of March 22, 2017 and April 11, 2017. Each member received copies for
review.
L. Jackson abstained.
4. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses approve the monthly reports
of April. Each member received copies for review.
5. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully to recess to Executive Session at 6:05 p.m. for discussion on the
following: Real Estate Negotiations (Chemtura), Collective Bargaining
(Chapter 90 Contract), Personnel (HR Shared Services with BOE,
Purchasing Agent/Financial Analyst) and Pending Litigation (Sewer
Backup Claims) inviting in Human Resources Director J. Lawlor and
Controller R. Butler, Jr.
Mayor Hess reconvened the meeting at 7:28 p.m.
6. The following motions emanated from Executive Session.
VOTED: Unanimously on a motion by Burgess Jackson and seconded by Burgess
Burns that the Board of Mayor and Burgesses authorize Mayor Hess to sign

a collective bargaining agreement with the Borough of Naugatuck
Supervisors, Chapter 90, C.S.E.A. Inc./ SEIU, Local 2001 and the
Borough of Naugatuck for the period of July 1, 2016 through June 30,
2019.
VOTED: Unanimously on a motion by Burgess Donovan and seconded by Burgess
Burns that the Board of Mayor and Burgesses authorize Mayor Hess to
enter into an employment agreement with Robert W. Butler, Jr. for a
three year period in the position of Purchasing Agent/Financial Analyst.
VOTED: Unanimously on a motion by Burgess Vitale and seconded by Burgess
Scully that the Board of Mayor and Burgesses enter into a sewer back-up
settlement agreement with Anthony Madden, 27 Morning Dove Road in
the amount of $4,084.23.
7. Public Comment
Two residents spoke in favor of transferring the oversight of passive land to the
Conservation Commission from the Parks Commission. Earth Day on the green is June
4th, the same day as Duck Day. Executive Director Kristin Mabrouk applied for a drug free
community grant.
8. Motion by Deputy Mayor Neth and seconded by Burgess Scully that the Board of Mayor
and Burgesses adopt the following Farm Viability Grant Award resolution, as if read:
BE IT RESOLVED that it is in the best interest of the Borough of Naugatuck to enter
into contracts with the State of Connecticut Department of Agriculture.
IN FURTHERANCE OF THIS RESOLUTION, the Honorable N. Warren “Pete” Hess,
Mayor, is duly authorized to enter into and sign said contracts dated May 3, 2017 on
behalf of the Borough of Naugatuck. The Honorable N. Warren “Pete” Hess, Mayor, is
further authorized to provide such additional information and execute such other
documents as may be required by the State of Connecticut in connection with said
contracts and to execute any amendments, rescissions, and revisions thereto.
THE BOROUGH CLERK IS AUTHORIZED to impress the seal of the Borough of
Naugatuck on any such document, amendment, rescission, and revision.

9. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses authorize Mayor Hess to
execute all contracts and related documents with MIRA for the Tier I
Municipal Solid Waste (MSW) for a term of ten years without services
for recyclables.
10. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses authorize Mayor N. Warren
“Pete” Hess to execute all contracts and related documents for a Summer
Employment Grant through the Northwest Regional Workforce
Investment Board in the amount of $21,125.77 managed by Naugatuck
Youth Services as recommended by Naugatuck Youth Services Director
Kristin Mabrouk.
11. Mayor Hess spoke about the surplus funds in the Town Clerk’s Local Capital
Improvement Fund. He wants to purchase a stage and tent for the upcoming Spring
Festival. DPW Assistant Sandra Ribeiro spoke about the cost difference between a new
stage and a used stage. She found a slightly used stage which is larger than a new stage
similarly priced. The owner of the used stage, Unlimited Party and Rental, said he was
giving all new hardware to assemble the stage. The company will come and assemble the
new stage for the festival so our employees will now how to in the future.
VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses authorize the purchase of a
stage and tent from Unlimited Party and Rental in the amount of $22,401.
12. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses amend the motion on the
Borough Reserve Fund Policy.
VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses approve the following
amendment to the Borough Reserve Fund Policy:
As has been consistent with past budgetary practices, the 2017/2018 proposed budget
anticipates funding up to 1.6 million dollars of capital purchases funded by the use of the
fund balance.
The use of the fund balance for this purpose could potentially reduce the borough’s fund
balance below the minimum of 8% unassigned fund balance level that was set as a goal in
a borough policy as approved on June 12, 2013.
In accordance with paragraph four of the adopted policy, “the borough reserves the right
to appropriate funds for the assigned fund balance for emergencies or other requirements
the borough believes to be in the best interest of the borough”.

Due to concerns regarding the amount of state funding that will be received by the
borough for Fiscal Year 2017/2018 as well as the impact on the borough taxpayer and the
importance of maintaining and replacing capital items, the borough believes that it is in
the best interest of the borough to approve the use of the fund balance that could
potentially cause the unassigned fund balance to go below the 8% goal established by the
fund balance policy.
The borough hereby amends its policy to allow for the balance to go below 8% but not
lower than 7%, provided that the fund balance will be replenished with the results of
operations and incremental budget increases to the contingency line to return the
unassigned fund balance to the minimum of 8% within two years/end of Fiscal Year
2019/2020. The borough will also use its best efforts to continue to increase the fund
balance to 12% within five years.
13. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses ratify the execution of the
Fourth Amendment to the Incineration Facilities Lease Agreement
with Naugatuck Environmental Technologies LLC dated April 26,
2017.
14. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses approve the bid and
authorize Mayor Hess to execute all contracts and related documents for
the “Purchase of Golf Carts” to New England Golf Cars, 62 Industrial
Way, Seekonk, MA 02771 as per bid as recommended by DPW Director
James Stewart.
15. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess
Scully that the Board of Mayor and Burgesses refer to the Joint Boards of
Mayor and Burgesses and Board of Finance a transfer request of
$171,528.73 from Account #6005-0862 North Main Street Siphon to the
General Fund as recommended by Controller Robert W. Butler, Jr.
16. Motion by Deputy Mayor Neth and seconded by Burgess Scully that the Board of Mayor
and Burgesses authorize Controller Robert W. Butler, Jr. to refund the following tax

18. Burgess Comments/Sub-Committee Reports
Burgess Herb reported the Planning Commission made a favorable decision on the
proposed development at Salem Square.
Burgess Donovan said an additional porta potty is needed at the other end of Linden Park.
Little ones under five years old have a hard time making it in time to the other end of the
park.
Burgess Hoff said there will be a pasta dinner fundraiser for Bob Veillette at St. Francis
Church Hall on May 10th.
Burgess Burns told the mayor to keep up the good work.
Mayor Hess said the Memorial Day Parade will be bigger and better this year. The last
surviving member of Doolittle’s Raiders will be in attendance; Richard Cole will be 102
years old. B25 planes will do a fly over.
Burgess Jackson said everyone did a great job at GDC. Next Tuesday is the Foley Award
Dinner, next Wednesday is the Cross Street School Talent Show and next Thursday is the
Grand Opening of a new nail salon on New Haven Road.
Burgess Vitale reported the Dog Park Grand Opening has been rescheduled to May 13th,
11 to 3 p.m. due to the weather forecast. The sponsor board has been installed. There will
be dog demonstrations from the state police, local police and the Orange Police.
Deputy Mayor Neth said George Hadoulis, owner of Atlantis Diner, passed away last
week due to pancreatic cancer. Burgess Neth said he lost a friend. He went in the diner
every day for seventeen years. Mr. Hadoulis’s wife said she is not planning on reopening
the diner. Burgess Neth said the ladder truck from Florida was brought to the Fire
Department. It did not meet the needs of the borough. Burgess Neth thinks Pierce trucks
are overpriced.

Jackson to adjourn the meeting at 8:55 p.m.
