MINUTES REGULAR MEETING BOARD OF MAYOR AND BURGESSES AUGUST 1, 2017 1. Mayor “Pete” Hess called the regular meeting to order at 6:30 p.m. with the following in attendance: BURGESSES: PRESS: R. Neth, absent L. Jackson L. Marshall R. Burns P. Scully, Sr. K. Donovan R. Vitale RESIDENTS: C. Herb D. Wisniewski Three D. Hoff DEPARTMENT HEADS: J. Lawlor, Human Resources Director R. Butler, Jr., Controller J. Stewart, Public Works Director W. Zirolli, Borough Engineer OTHERS: D. Sheridan, Jr., Board of Finance S. Ribeiro, DPW Assistant M. Leonard, Conservation Commission Chairwoman 2. Burgess Burns led in the Pledge of Allegiance to the flag. 3. VOTED: Unanimously on a motion by Burgess Jackson and seconded by Burgess Hoff that the Board of Mayor and Burgesses approve the minutes of the regular meeting of July 5, 2017 and the special meeting of July 18, 2017. Each member received copies for review. 4. VOTED: Unanimously on a motion by Burgess Jackson and seconded by Burgess Hoff that the Board of Mayor and Burgesses approve the monthly reports of July. Each member received copies for review. 5. VOTED: Unanimously on a motion by Burgess Jackson and seconded by Burgess Scully to recess to Executive Session at 6:32 p.m. for discussion on the following: Real Estate Negotiations (Chemtura), Personnel (Comptroller) and Pending Litigation inviting in Human Resources Director John Lawlor. Mayor Hess reconvened the meeting at 7:13 p.m. 6. The following motions emanated from Executive Session. VOTED: Unanimously on a motion by Burgess Jackson and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Hess to enter into a four year employment contract with Allyson Bruce for the position of controller as set forth in a proposed contract presented to the Board of Mayor and Burgesses by Human Resources Director John Lawlor.  -2- Minutes – Board of Mayor and Burgesses – Regular Meeting – August 1, 2017 VOTED: Unanimously on a motion by Burgess Jackson and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Hess to enter into a settlement agreement with Ronald and Jackie Nitowski to resolve all issues relating to a tax appeal at 357 Scott Street, Naugatuck. 7. VOTED: Unanimously on a motion by Burgess Jackson and seconded by Burgess Scully that the Board of Mayor and Burgesses recess to the Retirement Board at 7:17 p.m. Mayor Hess reconvened the meeting at 7:20 p.m. 8. Public Comment Conservation Commission Chairwoman Melissa Leonard gave the annual report for the commission to the board. She said they hosted a biofuel presentation, a light bulb swap at the festival, informed people of home energy audits and visited numerous open spaces. Burgess Scully asked if the commission compiled a list of private and public open spaces as per the code of ordinances, he was told they have not. 9. VOTED: Unanimously on a motion by Burgess Jackson and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the appointment of Linda Anderson (R), 147 City Hill Street, Apt. 2, Naugatuck, CT 06770 as an alternate member of the Zoning Commission, filling the unexpired term of M. DeBarber, term to expire July 1, 2018. 10. Motion by Burgess Jackson and seconded by Burgess Scully that the Board of Mayor and Burgesses accept conveyance of a parcel of real property consisting of 3.72 acres located at Mulberry Street from Valley Associates, Inc. to the Borough of Naugatuck in lieu of back taxes as recommended by Borough Engineer Wayne Zirolli Mayor Hess abstained. 11. Motion by Burgess that the Board of Mayor and Burgesses authorize Mayor Hess to execute all contracts and related documents to approve the road acceptance of the entire length (or a portion thereof) of the following unaccepted roads as described in the legal descriptions as recommended by Borough Engineer Wayne Zirolli and the Planning Commission, subject to borough attorney approval, as if read: 1. Nicole Drive 2. Karen Drive 3. Melbourne Court 4. Melissa Court 5. Parkman Place 6. Rayron Circle 7. Tracyann Court 8. Victoria Lane The above motion was amended to read as follows:  -3- Minutes – Board of Mayor and Burgesses – Regular Meeting – August 1, 2017 VOTED: Unanimously on a motion by Burgess Jackson and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Hess to execute all contracts and related documents to approve the road acceptance of the entire length (or a portion thereof) of the following unaccepted roads as described in the legal descriptions except for Melbourne Court as recommended by Borough Engineer Wayne Zirolli and the Planning Commission; as if read: 1. Motion by Burgess Jackson and seconded by Burgess Scully that the Board of Mayor and Burgesses accept conveyance of a parcel of real property, Account # 033-0301, recorded in the Town Clerk’s records in Volume 295, page 75, consisting of 0.11 acres located at 0 Grandview Street from William M. Karnofsky to the Borough of Naugatuck in lieu of back taxes as recommended by Borough Engineer Wayne Zirolli. Burgess Scully abstained. 13. VOTED: Unanimously on a motion by Burgess Jackson and seconded by Burgess Scully that the Board of Mayor and Burgesses accept and discontinue the proposed roadway known as Sylvia Street, as depicted on an un-recorded map entitled: Map Showing Layout of Lots for Lavergne G. Clark, Adella Street, Naugatuck, CT, September 26, 1941. Scale 1”-40 feet by Charles D. Curtis, Engineer and Surveyor, 76 North Hoadley Street, Naugatuck, CT as recommended by Borough Engineer Wayne Zirolli. 14. VOTED: Unanimously on a motion by Burgess Jackson and seconded by Burgess Scully that the Board of Mayor and Burgesses add to the agenda a motion regarding the Street Light Maintenance Contract. 15. VOTED: Unanimously on a motion by Burgess Jackson and seconded by Burgess Scully that the Board of Mayor and Burgesses waive the bid and award the “Street Light Maintenance Contract” to Turri Masterson, 766 Riverside Avenue, Torrington, CT 06790 and authorize Mayor Hess to execute all contracts and related documents as recommended by Public Works Director James Stewart. 16. VOTED: Unanimously on a motion by Burgess Jackson and seconded by Burgess Scully that the Board of Mayor and Burgesses add to the agenda a motion regarding the “Findings of Violation and the Order for Compliance on Consent”.  -4- Minutes – Board of Mayor and Burgesses – Regular Meeting – August 1, 2017 17. Motion by Burgess Jackson and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Hess to execute all contracts and related documents regarding the “Findings of Violation and the Order for Compliance on Consent” as recommended by Public Works Director James Stewart. Motion withdrawn. 18. VOTED: Unanimously on a motion by Burgess Jackson and seconded by Burgess Scully that the Board of Mayor and Burgesses add to the agenda a motion regarding the Town Clerk’s Local Capital Improvement Fund. 19. Motion by Burgess Jackson and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the purchase of the following items from the Town Clerk’s Local Capital Improvement Fund; two pond aerators for Baummer’s Pond in the amount of $16,014, an endzone football camera from Sport Scope Inc. in the amount of $4,499 and a field groomer for the Sand Pro Machine in the amount of $2,899.35. C. Herb and D. Wisniewski opposed. 20. VOTED: Unanimously on a motion by Burgess Jackson and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize the Tax Department to reprocess and record credit card payments from Public Comment – None 24. Burgess Comments/Sub-Committee Reports Burgess Herb said Touro University started clearing the land for their project. Forty-five to sixty children are swimming at the high school pool from 1 to 5 p.m. every day. Burgess Donovan reported the site plan modification for Parcel C was approved. Burgess Hoff said the Greater Waterbury Transit District will be having a special meeting at the NVCOG offices. The Arts Commission’s concerts on the green are going well. Elderly Commission member Officer Aaron Borys is extremely helpful to the Senior Center. Mayor Hess said we were awarded the grant for a new senior bus. Elert and Associates is interviewing all department heads to do their analysis and to submit a report by the end of August. They recommended filling the vacant IT position right away. Burgess Jackson said Senior Center Director Harvey Frydman commended the mayor for arranging excess produce from the community garden be brought to the senior center. The Parks Commission discussed hosting beehive classes for free. Burgess Burns thanked Jim Stewart and the mayor for the fine job on paving the roads. Burgess Scully was on vacation in Ireland and was very sad to hear about the passing of Kevin DelGobbo. He was a good friend. Burgess Vitale reported the Parks Commission is showing the movie Sing at movie night on Friday. He said The Club in the old Prospect Street School is doing a great business. Their grand opening will be Saturday at 1 p.m. Dmitriy Fogie made four benches and two picnic tables for the dog park as his Eagle Scout Project. Burgess Vitale stopped by the armory and said it looks wonderful and very busy. Mayor Hess said the town will be adopting a fee schedule for usage of the court and room at the armory. It is a revenue generator. 25.
