MINUTES REGULAR MEETING BOARD OF MAYOR AND BURGESSES MARCH 5, 2019 1. Mayor “Pete” Hess called the regular meeting to order at 6:18 p.m. with the following in attendance: BURGESSES: PRESS: L. Mezzo, City Hill Middle School Principal 2. Burgess Wisniewski led in the Pledge of Allegiance to the flag. 3. Motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the revised minutes of the regular meeting of February 5, 2019 and the special meeting of February 28, 2019. Each member received copies for review. Burgess D. Hoff abstained. 4. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the monthly reports of February. Each member received copies for review. 5. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth to recess to Executive Session at 6:20 p.m. for discussion on the following: Real Estate (0 Andrew Avenue, Recycling Center, Park Department Building-Rubber Avenue) and Pending Litigation (Sunrun, Inc., Borough/Matty’s Paving). No one was invited into executive session. Mayor Hess reconvened the meeting at 7:07 p.m. 6. There were no motions emanating from Executive Session. Students from City Hill Middle School were invited to attend the meeting tonight to share their proposed legislative bill restricting children under the age of sixteen from consuming energy drinks. The class studied energy drinks and its effect on the brain and body. The top students went to Hartford and shared their proposed bill with the legislature. In the near future, they will produce a Public Service Announcement (PSA) pamphlet for distribution.  -2- Minutes – Board of Mayor and Burgesses Regular Meeting – March 5, 2019 7. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses recess to the Retirement Board at 7:16 p.m. Mayor Hess reconvened the meeting at 7:19 p.m. 8. Public Comment A resident is upset additional taxes are being taken out of his pension check. He does not approve of the new police chief. He thinks the deputy chief should have received the promotion. 9. Mayor Hess approved the appointment of Valerie Dunn, 268 Hunters Mountain Road, Naugatuck, CT 06770 to the Naugatuck Day Care Board of Directors, filling the expired term of C. Munro, term to expire April 1, 2019. 10. Mayor Hess appointed Paul E. Singley (U), 34 Woodside Drive, Naugatuck, CT 06770 as an alternate member of the Police Commission, filling the expired term of R. Blanchard, term to expire October 1, 2020. 11. Motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the bid and authorize Mayor Hess to execute all contracts and related documents for “GEM Room Chairs – Event Center” to Classroom Essentials, 186 Hickory Springs Industrial Drive, Canton, GA 30115 in the amount of $8,273.12 (includes shipping) as recommended by Purchasing/Financial Analyst Robert W. Butler, Jr. Burgess D. Hoff opposed. 12. Motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses adopt the following resolution, as if read: WHEREAS, Federal monies are available under the Connecticut Small Cities Community Development Block Grant Program, administered by the State of Connecticut, Department of Housing pursuant to Public Law 93 – 3 83, as amended; and, WHEREAS, pursuant to Chapter 127c, and Part VI of Chapter 130 of the Connecticut General Statutes, the Commissioner of Housing is authorized to disburse such Federal monies to local municipalities; and, WHEREAS, it is desirable and in the public interest that the Borough of Naugatuck make application to the State for $400,000 in order to undertake a Small Cities Community Development Program and to execute an Assistance Agreement therefore, should one be offered. NOW, THEREFORE, BE IT RESOLVED BY THE Board of Mayor and Burgesses;  -3- Minutes – Board of Mayor and Burgesses – Regular Meeting – March 5, 2019 1. That it is cognizant of the conditions and prerequisites for State Assistance imposed by Part VI of Chapter 130 of The Connecticut General Statutes; and, 2. That the filing of an application by the Borough of Naugatuck in an amount not to exceed $400,000 is hereby approved, and that the Mayor is hereby authorized and directed to file such Application with the Commissioner of the Department of Housing, to provide such additional information, to execute such other documents as may be required by the Commissioner, to execute an Assistance Agreement with the State of Connecticut for State financial assistance if such an Agreement is offered, to execute any amendments, rescissions, and revisions thereto, to carry out approved activities and to act as the authorized representative of the Borough of Naugatuck. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses amend the action of the board made on February 5, 2019, item #18, to approve a three (3) year extension to the original contract with USA Recycling for “Dumpsters at Town Buildings” and authorize Mayor Hess to execute all contracts and related documents as recommended by the Assistant to the Public Works Director Sandra Ribeiro. 14. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Hess to execute all contracts and related documents for a “GPS Fleet Management Contract” with Verizon Connect, 100 Southgate Parkway, Morristown, NJ 07960 in the amount of $795.90 a month as recommended by Public Works Director James Stewart. 15. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the 5 Year LOCIP Paving Program as set forth on the paving schedule for Fiscal Year 2019-2023 as recommended by Public Works Director James Stewart. 16. Discussion took place regarding the limitation on time limits for Redemption on Tax Auctions. Pursuant to CGS 12-157, the time limit a municipality can wait to turn over auctioned property is between sixty and one hundred eighty days. The borough has been giving the property owner one hundred eighty days after the tax auction to redeem the  -4- Minutes – Board of Mayor and Burgesses – Regular Meeting – March 5, 2019 property. The tax collector suggests the borough reduce the amount of time. Discussion took place whether to reduce the amount of time from one hundred eighty days to sixty days or ninety days. Motion by Burgess Bronko and seconded by Deputy Mayor Taf Jackson that the Board of Mayor and Burgesses reduce the redemption period from one hundred eighty (180) to sixty (60) days for all tax auctions pursuant to section 12-157 CGS. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Hess to execute all contracts and related documents with Skyview Ventures LLC, 114 Pearl Street, Suite 2c, Port Chester, New York 10573 for the installation of a Solar Energy Project at Maple Hill Elementary School subject to legal review. 18. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Hess to sign appropriate papers to sell real estate known as Lot #17 Auburn Street for the purchase price of $6,000. 19. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Hess to sign appropriate papers to sell real estate known as 0 Auburn Street for the purchase price of $2,000. 20. Public Comment A young man attended the meeting to earn a Boys Scout merit badge. He wanted to know the term limits of the burgesses, if burgesses did anything outside of attending meetings and when did the high school solar roof project begin. A resident asked what the town plans to do with land purchased at the end of Country Hollow Road. She thanked the town for cleaning up the area which became a dumping ground. Sidewalks in the area are raising up. Bring back the spring/fall clean-up where the town would pick up bulk trash at residents’ homes. 23. Mayor and Burgess Comments Burgess Herb said there are issues between the Park Commission and the Conservation Commission regarding Gunntown Passive Park. Burgess Burns is recuperating in Glendale Center. This Saturday will be the Easter Seals Chocolate Expo at the Naugatuck Event Center. Burgess Neth said the Capital Committee will be meeting Thursday, March 5th to discuss the high school solar roof situation and the HVAC system at the police station. Former Finance Board Chairman Jack Tedesco passed away. Deputy Mayor Taf Jackson hopes the Park Commission and Conservation Commission work out their issues. The Housing Authority has a new maintenance director. She wished the new police chief good luck. She looks forward to the swearing in ceremony. Burgess Vitale reported people are not being compliant with alternate street parking during snow storms. Burgess DeOliveira said there is a No Tolls Resolution going around. He wanted the board to vote against the State of Connecticut installing tolls on our highways. Mayor Hess said he will not allow a motion to be added to the agenda on the issue of tolls. He said the matter is not a town issue. The mayor said that he is not for tolls. He is for transportation funding to support the Port of Naugatuck and our downtown T.O.D. project. The state needs to find a way to fund the state transportation fund. They should cut spending but also find a revenue source to support transportation. The mayor also is against injecting partisan issues into our monthly town meetings. During his entire tenure,  -11- Minutes – Board of Mayor and Burgesses Regular Meeting – March 5, 2019 we never had a partisan vote on any issue. Partisanship is governing at its worst. We will continue to run the town like a business and continue to be the opposite of governing in Hartford. Burgess DeOliveira For the record: “I do support transportation funding but I am opposed to tolls and I believe that as local burgesses we should be aware of our residents, how much they’re actually going to pay from these tolls that will be directly on . . . The roadway traffic that we’re going to have when people that then divert off of Route 8 to go around these tolls to hop on . . . It’s not a tolls debate. It’s not something for here, I agree with you. I was just bringing up that we should look into a resolution that we are all against something that can be detrimental to our residents. I see you don’t look at it that way so I will just save the discussion for another time.” Burgess Bronko said residents questioned the activity behind Maple Hill School. He wanted confirmation that is was the construction of the cell tower. Mayor Hess said the solar roof at the high school is a big problem. If the project is not eligible for state reimbursement, then it’s a bigger problem. We’ve already taken precautions to prevent electrical issues in the school. Firefighters have been supplied with special boots should they need to go on the roof. 24.
