MINUTES REGULAR MEETING BOARD OF MAYOR AND BURGESSES MARCH 3, 2020 1. Mayor “Pete” Hess called the regular meeting to order at 6:02 p.m. with the following in attendance: BURGESSES: PRESS: L. Each member received copies for review. 4. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the monthly reports of February. Each member received copies for review. 5. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Bronko to recess to Executive Session at 6:04 p.m. for discussion on the following: Contract Negotiations (Street Department Union, Chapter 90 CSEA/SEIU Union, BOE Administrators’ Union) and Pending Litigation inviting in Human Resources Director J. Lawlor. Mayor Hess reconvened the meeting at 7:08 p.m. 6. The following motion emanated from Executive Session. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses reject the contract settlement between the Naugatuck Administrators’ Negotiation Association and the Naugatuck Board of Education for period July 1, 2020 to June 30, 2023.  -2- Minutes – Board of Mayor and Burgesses – Regular Meeting – March 3, 2020 7. Public Comment – None 8. Presentation by Human Resources Director John Lawlor regarding the Fully Insured Healthcare Proposal. Mr. Lawlor said claims are high and the trend will continue going forward this fiscal year. Connecticare, our current health care provider, is projecting a 15.53% increase in premiums. Brown & Brown Insurance Brokers negotiated with Connecticare on behalf of the borough and the lowest rate they could get was 14.21%. Brown & Brown created a purchasing group of eight municipalities and Board of Educations. Towns participating are Darian, Weston, Region 7, Stratford, Thomaston, Winchester, Old Saybrook and Naugatuck. Brown & Brown went to Anthem and asked what rate they would give the group. Anthem said 8.5% the first year and the second year will not exceed 7.9%. The borough will save approximately a million dollars by accepting the Anthem offer. Mr. Lawlor suggests the borough join the purchasing group to get the best rate. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the Fully Insured Healthcare Proposal and authorize Human Resource Director John Lawlor to execute all contracts and related documents for Medical and Dental Provider Services through Anthem Blue Cross Blue Shield for plan years 2020-2021 and 2021-2022 as recommended by Director of Human Resources John Lawlor and Brown & Brown Insurance Brokers. 9. Mayor Hess approved the appointment of Sharon Heady-Labansky, 63 Hackett Street, Naugatuck, CT 06770 to the Naugatuck Day Care Board of Directors, filling the unexpired term of C. Ramos, term to expire April 1, 2020. 10. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Bronko that the Board of Mayor and approve the appointment of Diane M. Carangelo (D), 30 Cadbury Place, Naugatuck, CT 06770 as a member of the Parks Commission, filling the unexpired term of E. Forlenzo, term to expire October 1, 2023. 11. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the appointment of Adam M. Bronko (R), 34 Fairfield Court, Naugatuck, CT 06770 as an alternate member of the Board of Assessment Appeals, filling the expired term of S. Desai, term to expire June 1, 2022. Mayor Hess swore in Adam Bronko as an alternate member of the Board of Assessment Appeals. 12. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the bid for a “2020 Ford F-550 Regular Cab 4X4” to Shaker’s Family Ford Lincoln, 831 Straits Turnpike, Watertown, CT 06795 in the amount of $119,062.00 as recommended by Assistant to the Public Works Director Sandra Lucas- Ribeiro. 15. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the bid for “Two (2) 12,000 lb. GVWR Deck Over Trailers” to Elm City Trailer, 240 Amity Road, Woodbridge, CT 06525 in the amount of $14,798.00 as recommended by Assistant to the Public Works Director Sandra Lucas- Ribeiro. 16. Motion by Burgess Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses award the bid for “Field Irrigation – Kevin M. DelGobbo Field Project” to National Lawn Sprinklers, 645 North Broadway, White Plains, NY 10603 in the amount of $124,500.00 and authorize Mayor Hess to execute all contracts and related documents as recommended by Assistant to the Public Works Director Sandra Lucas Ribeiro. Motion withdrawn and tabled. 17. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses award the bid for “Field Rock Blasting – Kevin M. DelGobbo Field Project” to D’Ambrosio Construction, 60 Quaker Farms Road, Oxford, CT 06478 in the amount of $15,040.00 plus $75.00 per cubic yard for any additional blasting and authorize Mayor Hess to execute all contracts and related documents as recommended by Assistant to the Public Works Director Sandra Lucas Ribeiro. 18. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the bid and authorize Mayor Hess to execute all contracts and related documents for the “Fireworks Display” to Central Maine Pyrotechnics, 165 Maple Street, Farmingdale, ME 04344 in the amount of $15,000 and an additional event scheduled anytime from September to December 2020 in the amount of $5,000 as recommended by the Assistant to the Public Works Director Sandra Lucas Ribeiro.  -4- Minutes – Board of Mayor and Burgesses Regular Meeting – March 3, 2020 19. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses authorize Mayor Hess to execute all contracts and related documents for the “CampDoc Software – Park Department” to DocNetwork, 4750 Venture Drive, Ann Arbor, Michigan 48108 in the amount of $1,250 as recommended by Park Department Director Kim Eyre. 21. Motion by Burgess Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses adopt the following resolution, as if read: WHEREAS, Federal monies are available under the Connecticut Small Cities Community Development Block Grant Program, administered by the State of Connecticut, Department of Housing pursuant to Public Law 93 – 3 83, as amended; and, WHEREAS, pursuant to Chapter 127c, and Part VI of Chapter 130 of the Connecticut General Statutes, the Commissioner of Housing is authorized to disburse such Federal monies to local municipalities; and, WHEREAS, it is desirable and in the public interest that the Borough of Naugatuck make application to the State for $1,000,000 in order to undertake a Small Cities Community Development Program and to execute an Assistance Agreement therefore, should one be offered. NOW, THEREFORE, BE IT RESOLVED BY THE Board of Mayor and Burgesses: 1. That it is cognizant of the conditions and prerequisites for State Assistance imposed by Part VI of Chapter 130 of The Connecticut General Statutes; and, 2. That the filing of an application by the Borough of Naugatuck in an amount not to exceed $1,000,000 is hereby approved, and that the Mayor is hereby authorized and directed to file such Application with the Commissioner of the Department of Housing, to provide such additional information, to execute such other documents as may be required by the Commissioner, to execute an Assistance Agreement with the State of Connecticut for State financial assistance if such an Agreement is offered, to execute any amendments, rescissions, and revisions thereto and to act as the authorized representative of the Borough of Naugatuck. Motion by Burgess Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses adopt the following Fair Housing Resolution, as if read: WHEREAS, all persons are afforded a right to full and equal housing opportunities in the neighborhood of their choice; and WHEREAS, federal fair housing laws require that all individuals, regardless of race, color, religion, sex, handicap, familial status or national origin, be given equal access to all housing-related opportunities, including rental and homeownership opportunities, and be allowed to make free choices regarding housing location; and WHEREAS, Connecticut fair housing laws require that all individuals, regardless of race, creed, color, national origin, ancestry, sex, marital status, age, lawful source of income, familial status, learning disability, physical or mental disability, sexual orientation, or gender identity or expression be given equal access to all housing-related opportunities, including rental and home ownership opportunities, and be allowed to make free choices regarding housing location; and WHEREAS, the Borough of Naugatuck is committed to upholding these laws, and realizes that these laws must be supplemented by an Affirmative Statement publicly endorsing the right of all people to full and equal housing opportunities in the neighborhood of their choice; and NOW THEREFORE, BE IT RESOLVED, that the Borough of Naugatuck hereby endorses a Fair Housing Policy to ensure equal opportunity for all persons to rent, purchase, obtain financing and enjoy all other housing-related services of their choice on a non-discriminatory basis as provided by state and federal law; and BE IT FURTHER RESOLVED, that the chief executive officer of the Borough of Naugatuck or his designated representative is responsible for responding to and assisting any person who alleges to be the victim of an illegal discriminatory housing practice in the Borough of Naugatuck and for advising such person of the right to file a complaint with the State of Connecticut Commission on Human Rights and Opportunities (CHRO) or the U.S. Department of Housing and Urban Development (HUD) or to seek assistance from the CT Fair Housing Center, legal services, or other fair housing organizations to protect his or her right to equal housing opportunities. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses authorize Mayor Hess to enter into a proposed lease with Con-Tec, Inc. for 41 Raytkwich Road effective February 1, 2020 and terminating on February 1, 2023. 24. Mayor Hess discussed the possibility of a Community Garden on Springdale Avenue. The borough owns the property. It is approximately nine acres of rough topography with a steep hill. A house could possibility be built on the parcel but it doesn’t have road frontage. We had a potential buyer, Simon Theron, who offered to do site work on the land free of charge if the borough decided to make the property a community garden. The mayor asked the burgesses to look at the property and give feedback on their thoughts for the use of the property. Whether we should sell the land or use it for some other purpose. No decision was made on the property. 25. The mayor discussed the possibility of an Indoor Sports Complex. The site the committee is looking at has topography and rock challenges. Mayor Hess said he is in discussions with a man who needs the rock and would be willing to purchase it from the borough. If the cost could be quantified, this location would be the best site for a complex. 26. The Bulk Trash Subcommittee gave an update on the proposals they are leaning toward. Two proposals are to have the transfer station open an extra day a week during the season and extend the hours into the evening. Assistant to the Public Works Director Sandra Lucas Ribeiro said the extra day would be Tuesday, which would give her time to have the dumpsters emptied. The hours would be extended on Thursdays. Another proposal is to open the transfer station two Saturdays during the months of January, February, and March to give residents the opportunity to bring things during the winter months. Another proposal is a town wide system. The borough would need to use an outside vendor. Residents would call and schedule a pickup and pay the vendor directly. Ten pickups would be scheduled in a day. Residents would need to be educated which items can be left for pickup. The town would charge the resident for any ineligible items left curbside. 27. He is working with Boys Scout Troop Leaders to see if there is a possibility a new roof could be built on the old gazebo. Many boys are looking to do their Eagle Scout projects. There might be a possibility for picnic tables and benches as another project. New bluebird houses along with bat houses are at the dog park. Burgess Marenghi said the Arts Commission’s Summer Concert Series would begin on June 13th. They are investigating if the Gem Room at the Event Center could be used as a possible rain date location since it is downtown. Many times cancellations happen last minute. The Gem Room would make it easier for people since it is already downtown. The commission has to pay to use the high school for a rain date. Opening day for Union City Little League is April 18th at 10 a.m. Burgess DeOliveira said the census forms will be going out this month. Residents need to fill out the forms. It is necessary to receive funding for Naugatuck. He asked where we are in the process of updating our website. Burgess Mizeski read at Maple Hill Elementary School for Read Across America. He said he had a nice time. The Greater Waterbury Transit District will be meeting next week. Burgess Dambowsky said Zoning Enforcement Officer Ed Carter reported the land use commissions approved the special permit for the temporary recycling center. The Inland Wetlands Commission said a mulch berm is needed to protect the wetlands. There will be a public information meeting on the Coronavirus (COVID-19) this Thursday at 9 a.m. at town hall. Dr. Peter Jacoby from St. Mary’s Hospital and Jessica Stelmaszek from Naugatuck Valley Health District will discuss the planning and preparation for a possible outbreak in the area. Burgess Neth said the Non Union Salary Review Board met to make a recommendation to the Joint Boards for the budget. He said Go Naugy! Big game tomorrow night. 30.
