MINUTES REGULAR MEETING BOARD OF MAYOR AND BURGESSES NOVEMBER 1, 2022 Due to the COVID-19 Pandemic, the Borough of Naugatuck held the Board of Mayor and Burgesses meeting on a hybrid basis. Everyone was welcomed to attend in person, by Zoom Webinar or by phone. 1. Mayor “Pete” Hess called the regular meeting to order at 7:04 p.m. with the following in attendance: BURGESSES: PRESS: R. Jim Kallipolites led in the Pledge of Allegiance to the flag. 3. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the minutes of the regular meeting of October 6, 2022. Each member received a copy for review. 4. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the monthly reports of October. Each member received copies for review. 5. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses recess to the Retirement Board at 7:05 p.m. Mayor Hess will reconvene the meeting at 7:07 p.m. 6. Mayor’s Opening Comments Mayor Hess swore in two sergeants that were promoted to lieutenants this evening, Lieutenant Castro-McMasters and Lieutenant Baskins. He said this is a good police department with an excellent command staff. Chief McAllister is doing a great job leading the team. Chief Kyle Kelley gave the monthly update on the Naugatuck Ambulance Corps (NAC). NAC responded to four hundred fifty calls in October. They are no longer providing a dedicated car to Trinity EMS Service for the City of Waterbury. They will still give mutual aid to Waterbury when needed. The new ambulance was showcased at the EMS PRO Expo at Foxwoods Casino. He thanked the mayor, burgesses, and community for their support to bring NAC to where they are today. 9. Mayor Hess said Sunset Farm owners Kaitlyn Kimball and Lawrence Passeck approached him regarding the property the borough owns close to their property. The mayor said the borough has no current plans for the property. Sunset Farm grows on one and a half acres. They said they have maxed out their land and would like to expand. They are an organic farm and plant directly into the soil without the use of pesticides or fertilizer. Mayor Hess said they would lease the property to Sunset Farm on a year-to-year basis. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses authorize Mayor Hess to enter into a lease with Sunset Farm for approximately three and one half acres of land on Andrew Mountain Road, at the former Four Winds Development property that the borough acquired by foreclosure, for a reasonable rental rate to be negotiated by Assessor Shelby Jackson and Sunset Farm. 10. Mayor Hess established a group to look into Town Wide Sidewalk Improvements. Deputy Mayor Neth, Burgess Bronko, Burgess Marenghi, DPW Director Stewart and DPW Foreman Lennon will sit on the committee. Burgess Vitale would like to see a Board of Education member sit on the committee also. He said sidewalks might eliminate the need for a school bus. Mayor Hess would like the committee to inventory sidewalks over the winter. He said the key is establishing priorities for fixing or replacing sidewalks. They will discuss the results before the next budget season as to whether there are grants or if they need to add to the budget. 11. Mayor Hess said the Zoning Commission has not voted on or made a decision in regards to cannabis. He said we need a Cannabis Ordinance. There will be a legal and land use team to develop a strict regulation. Burgess Neth-Kunin, Burgess Mizeski and Burgess Dambowsky will also sit on the team. 12. Public Works Director James Stewart said the state will cover curbing, trees and/or lighting if we have a town wide Standards for Streetscape Design and Sidewalk Amenities Policy in place. He wants to obtain funding for amenities and set standards that developers will have to follow as well. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses adopt the Standards for Streetscape Design and Sidewalk Amenities on Church Street, Maple  -3- Minutes – Board of Mayor and Burgesses Regular Meeting – November 1, 2022 Street, Old Firehouse Road and Rubber Avenue from Water Street to Hoadley Street, plus additional streets recommended by the DPW Director and set forth on his proposed Standards for Streetscape Design and Sidewalk Amenities. 13. Mayor Hess reappointed Jan J. Mizeski, 106 Woodbine Street, Naugatuck, CT 06770, as a member of the Greater Waterbury Transit District, term to expire November 1, 2026. 14. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the appointment of Lee Wehry, 24 Auburn Street, Naugatuck, CT 06770 as a nonunion employee member of the Non Union Pension Board, filling the vacancy of R. Butler, Jr., indefinite term. 15. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the bids for contract FY23-B033 for Request for Qualifications for “Winter Snow Plowing, Sanding & Snow Removal” to the following vendors as per bid as recommended by Public Works Director James Stewart, as if read: Big K’s Landscaping LLC S&S Asphalt Paving, Inc. P.O. Box 756 P.O. Box 429 Naugatuck, CT 06770 Southbury, CT 06488 Contracts shall commence upon vendor completing all borough requirements and the purchase order is received by vendor. 16. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve Skyeye Technologies as an approved vendor to provide goods and/or services for “Camera and Security Related Issues”. 17. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses award the bid for the “Excavation & Disposal of Controlled Materials on Parcel B – Area 5” to Red Technologies, Inc., 173 Pickering Street, Portland, CT 06480 in the amount of $213,825.00 as recommended by Down to Earth Consulting, DPW Director James Stewart and the CT DECD and authorize Mayor Hess to sign all contracts and related documents. 18. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses authorize Mayor Hess to sign a renegotiated five year contract with Axon Enterprise, Inc., 180 East Sky Harbor Circle, Phoenix, AZ 85034 for “Tasers, Digital Storage for Body Worn Cameras and Additional Body Worn Cameras” as recommended by Police Chief C. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses authorize Public Works Director James Stewart to accept a fee in lieu of final paving from Connecticut Water Company in the amount of $86,000.00 for work completed on Millville Avenue as recommended by Public Works Director James Stewart. 20. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses authorize Public Works Director James Stewart to accept a fee in lieu of final paving from Connecticut Water Company in the amount of $323,500.00 for work completed on Chestnut Street, Fern Street, North Hoadley Street and Quinn Street as recommended by Public Works Director James Stewart. 21. Public Comment – Agenda Items – None 23. Mayor and Burgess Comments/Sub-Committee Reports Burgess Smith was thankful to see the Whittemore Bridge lit in blue lights in memory of the two Bristol police officers that were tragically murdered last month. Burgess Vitale congratulated the two sergeants that were promoted to lieutenant. On November 10th. .at 8 a.m., Ralph Roper will be honored with the Franklin Johnson Award. The Veterans Day Parade will be held on November 11th. NAC will receive money if people sign up on Amazon Smile when they shop and designate NAC as the Amazon Smile recipient. Mayor Hess said the probate court has moved out of town hall into a new location on Meadow Street. Burgess Mizeski is glad he is going to sit on the Cannabis Ordinance Committee. Burgess Marenghi congratulated the high school marching band on winning the state championships. He wished them luck at the regional championships. Burgess Dambowsky said the founding member of the emergency response team passed away. He has a newfound respect for DPW Director Jim Stewart and his staff since he has been working at a desk in their office. Deputy Mayor Neth said a new sign is needed at the left turn on Oak Street after crossing over the Whittemore Bridge. Oncoming traffic is blocking the intersection. 24. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko to recess to Executive Session at 8:20 p.m. for discussion on the following: Real Estate (LANXESS Property, Parcels A, B, Y & Z, Bank of America, Acquisition of Land for Downtown Parking, Tax Incremental Financing District, Sale of Former Recycling Center – Rubber Avenue, Church Street, Maple Street, VNA Building), Personnel (Public Works Director, Assistant Building Inspector, ADA Coordinator), Collective Bargaining (Police Union, Fire Union) and Pending Litigation. The following motion emanated from Executive Session. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses authorize Mayor Hess to enter into a Memorandum of Understanding with Pennrose and the Cloud Company to sell Phase 1 of Parcel B which is approximately one third of Parcel B as discussed in executive session with the condition that the issue of tax incentives be negotiated. 26.
