COMMISSION ON PUBLIC WORKS/UTILITIES COUNCIL ROOM OCTOBER 22, 2019 6:45 P.M. The Commission on Public Works/Utilities met in regular session, Chair Quicker presiding. On roll call: all members present. The minutes of the previous meeting were declared approved. Director of Public Works Flynn reported on four burials at the Cemetery, equipment maintenance, mulching leaves and weed trimming at the Cemetery and Parks, trenching for the wiring for the Schuster Park pathway lights, setting the light poles and tying in the wiring to the poles, trimming and pruning trees, maintaining street lighting, filling potholes, hauling compost and brush, cleaning up the compost site, burned the brush pile, street sweeping, ATV trail sign maintenance-removed all trail arrows and speed limit signs, mowed the landfill, Industrial Park and road shoulders, worked on leaf picker box and installed the box on a truck (please do not place branches, sticks or yard waste in with the leaves as they plug up the machine), the Sewer Department installed the third pump at the old sewer plant, prepared for sludge hauling and lift station maintenance, he is working with the City Attorney on updating the snow removal ordinance, there were traffic concerns during the Autumn Harvest Fest and he suggests that the event be moved off Hewett Street to the West Street area. The Pledge of Allegiance was recited. The minutes of the previous meeting were declared approved. Council Member Counsell reported on the October 9, 2019 meeting of the Historic Preservation Commission regarding: 1) discussion on and approval of a $2,000 grant request from Jeff Kluckhohn for a total reconstruction of 518 Hewett Street and 2) discussion on a demolition request from Lisenby Properties, LLC, Mark Lisenby, for 551/549 Hewett Street-Chair Counsell will draft a letter asking for more information-no action taken. Council Member Weiers reported on the October 21, 2019 meeting of the Beautification Committee regarding: 1) discussion on the Prock Park sign, suggests revisions-no action taken and 2) discussion on and approval of the downtown planters tree decorating contest criteria-a Chamber of Commerce Gift Certificate will be awarded to the winner at the December 6, 2019 tree lighting. Council Member Quicker reported on the October 22, 2019 meeting of the Commission on Public Works/Utilities regarding: 1) current activities and 2) payment of bills. Mayor Glassbrenner declared all reports filed as presented with the City Clerk. City Attorney Wachsmuth read the following ordinance which adds “nicotine products” to the ordinance including “vapors”. ORDINANCE NO. 1058 AN ORDINANCE AMENDING §9-2-15 PURCHASE OR POSSESSION OF TOBACCO PRODUCTS, The Common Council of the City of Neillsville does hereby ordain as follows: Section 9-2-15 is hereby amended to read as follows: (a) DEFINITION OF TOBACCO PRODUCTS. For this section, “tobacco products” means any substance containing tobacco leaf, including, but not limited to, cigarettes, cigars, pipe tobacco, snuff, chewing tobacco or dipping tobacco. “Nicotine products” means any product that contains nicotine and is not any of the following: 1) a tobacco product; 2) a cigarette; 3) a product that has been approved by the U.S. food and drug administration for sale as a smoking cessation product or for another medical purpose and is being marketed and sold solely for such an approved purpose. (b) PURCHASE BY MINORS PROHIBITED. It shall be unlawful for any person under the age of eighteen (18) years to possess tobacco or nicotine products, or to misrepresent their identity or age, or to use any false or altered identification for the purpose of purchasing tobacco or nicotine products. (c) POSSESSION BY MINORS PROHIBITED. It shall be unlawful for any person under the age of eighteen (18) years to possess any tobacco or nicotine products; provided that the possession by a person under the age of eighteen under the direct supervision of the parent or legal guardian of such person in the privacy of the parent’s or guardian’s home shall not be prohibited. __________________________ Charles W Glassbrenner, Mayor ___________________________________ Rex R. Mayor Glassbrenner presented a request from the Neillsville Area Chamber of Commerce for use of the CC Sniteman Town Square Park and Gazebo for the “Official Tree Lighting/Santa’s Coming to Town” event on Friday, December 6, 2019. Mayor Glassbrenner presented a request from the CART Center to hang a banner on the Gazebo for the “Ugly Sweater Fun Walk” on Saturday, December 7, 2019. Motion Weiers, second Clough, to grant the CART Center request to hang a banner on the Gazebo for the “Ugly Sweater Fun Walk” event on Saturday, December 7, 2019. City Attorney Wachsmuth reported that the Sewer Connection Agreement with Memorial Hospital, Inc. d/b/a Marshfield Medical Center-Neillsville has been signed and they are working on a tri-party agreement with MMC, the Town of Pine Valley and City of Neillsville regarding easements, etc. City Attorney Wachsmuth stated that Scott Davis has been served a Raze Order on the property at 305 E. Fifth Street, Parcel No. 261.0604.000 and we are now in the 30 day response period.
