COMMISSION ON PUBLIC WORKS/UTILITIES COUNCIL ROOM MAY 25, 2021 6:45 P.M. The Commission on Public Works/Utilities met in regular session, Chair Clough presiding. On roll call: Council Members Counsell absent; all other members present. The minutes of the previous meeting were declared approved. Director of Public Works Friemoth reported on three burials at the Cemetery, lawn mowing and weed trimming, park shelter rentals and landscaping at Prock Park, street light maintenance, road repair, hauling brush, burned the brush pile, storm sewer maintenance, street sweeping, Water Department-well maintenance, daily testing and maintenance, leak checking system, exercising water main valves, hydrant maintenance, lift station maintenance, hydrant maintenance. Sewer Department–I & I testing, daily testing and lab work, plant maintenance, lift station maintenance and the City has received our 2021 WIS DNR recycling grant award. City Attorney Wachsmuth stated that in trying to put something together for the Fence Ordinance, she really is unsure what the Committee Members wanted, so she marked the various conflicting and confusing sections for the Commission’s review. Discussions followed on the height differences, various setbacks, maintenance requirements, etc. A fence is technically a structure. City Attorney Wachsmuth asked the Commission Members to make notations, suggestions and proposed changes for the next meeting, so she has more guidance in drafting an ordinance. 6:55 P.M. – Council Member Counsell now present. Director of Public Works, Friemoth opened and read the American Asphalt of Wisconsin, Mosinee, asphalt bid: $81.90 per ton for full width road paving $132.80 per ton for patch paving Director of Public Works, Friemoth stated that the bid is based on an estimated use of 1,000 tons for the City’s use only. The asphalt plant will be in the Neillsville area July through October. Motion Neville, second Murphy, to recommend to the Common Council the acceptance of the American Asphalt of Wisconsin, Mosinee asphalt bid in the amount of $81.90 per ton for full width road paving and $132.80 per ton for patch paving. Director of Public Works Friemoth presented the unleaded motor vehicle fuel proposals: Drescher Oil Company 8 cents per gallon discount Kwik Trip 8 cents per gallon discount Hansen’s IGA 8 cents per gallon discount Director of Public Works Friemoth stated that Hansen’s has the current contract, prior to that Kwik Trip had it, it has been awhile since Drescher’s BP has had it. Motion Counsell, second Neville, to recommend to the Common Council to accept the Drescher Oil Company proposal for 8 cents per gallon discount off the pump price for unleaded motor vehicle fuel. All Aye. Director of Public Works Friemoth reviewed the Sewer Department’s 2020 Compliance Maintenance Annual Report (CMAR) and Resolution. There were no major changes. Our overall grade point average is 3.91 which put us in the voluntary range. Our rate structure and replacement fund were reviewed in 2020. Future projects are rehab sewer mains, rehab clarifier and rehab E. 2nd lift station panel. It remains a concern. City Attorney Wachsmuth read Resolution No. 611. Motion Perrine, second Counsell, to accept the Compliance Maintenance Annual Report and recommend to the Common Council that Resolution No. 611 be adopted. Motion Neville, second Counsell, that Water Bills Nos. 104 to 129 in the amount of $42,434.58 and Sewer Bills Nos. 86 to 99 in the amount of $19,405.16 be paid. All Aye. The Pledge of Allegiance was recited. The minutes of the previous meetings were declared approved. Council Member Harnisch presented the May 13, 2021 meeting of the Beautification Committee regarding: 1) discussion on Prock Park rocks, 2) discussion on and approval of ordering Prock Family plaques, 3) discussion on the flowers/shrubs/brick flower beds, 4) discussion on planting, weeding and dead heading, 5) discussion on and approval of reimbursement to Over The Garden Gate for 2021 flowers for the Library flower bed ($128.23) and up to $150.00 in future years. Council Member Neville reported on the May 13 and 20, 2021 meetings of the Heritage Days Committee regarding: 1) discussion on movie night, 2) discussion and approval of a beer vendor and beverages, 3) discussion on tent setups in Schuster Park and the City parking lot on West Street, 4) discussion on games, Fun Time Funktions, food trucks and food vendors, 5) update on Miss Neillsville, 6) update on the parade, 7) discussion on poster, security, t-shirts, pub crawl, pottery and golf outing, 8) approved a movie night for Thursday evening at the Library parking lot; 9) discussion on golf sponsors, 10) discussion on tent setups in Schuster Park and the City parking lot on West Street, 11) discussion on and hiring of Steve a/k/a Mr. Fun – Funtime Funktions for Sunday and 12) reviewed the poster. Mayor Murphy reported on the May 18, 2021 joint meeting of the Planning Commission and Economic Development Commission regarding: 1) discussion on and recommendation to donate $250 to the Neillsville Trout Pond Members for stocking the Neillsville Trout Pond in Listeman Park and that the Parks and Recreation Board budget for it in the future, 2) discussion on a City Banner for Farm Technology Days-Daniel Clough and Natalie Erpenbach will work with Clark County Economic Development Corporation on this, 3) presentation by Chris Straight, West Central Wisconsin Regional Planning Commission (WCWRPC) Senior Planner, of draft “City of Neillsville Year 2033 Comprehensive Plan” elements for discussion and review-City of Neillsville 2041 Vision Statement, Transportation element, Utilities and Community Facilities element, Agricultural and Natural Resources element, Historical and Cultural Resources element, Implementation element and land use maps and 4) discussion on needed repairs at the Clark County Jail Museum. Council Member Harnisch reported on the May 19, 2021 meeting of the Historic Preservation Commission regarding: 1) discussion on the preliminary nomination of the “Merchants Hotel” property, 105 W. Seventh Street, to the Local Historic Register, 2) discussion on the 2021 Action Plan, 3) reviewed the City Comprehensive Plan-Historic Preservation updates draft version, 4) discussion on funds and 5) discussion on needed repairs at the Clark County Jail Museum and an upcoming June meeting with the Clark County Property Committee to discuss options. City Attorney Wachsmuth present the May 20, 2021 meeting of the Property Committee - City Hall and Police Department regarding: 1) a presentation by and discussion with Spectrum/Charter on telephone systems, broadcasting, streaming, alarms, YouTube, etc., 2) discussion on signage-City Hall, directional, Police Department, etc., 3) discussion on insulation quotes and hiring Quality Foam to do the insulation work, 4) discussion on HVAC quotes and hiring RC Heating to do the HVAC work, 5) discussion on plumbing fixes quote and hiring Ewing Plumbing to do the plumbing fixes, 6) discussion on electrical fixes quotes and hiring Next Generation Electrical to do the electrical fixes, 7) discussion on reworking the teller station area, 8) discussion on carpet, carpet tile and porcelain tile, 9) discussion on interior fixes (carpenters), 10) discussion on safety deposit boxes-removal and possible sale, 11) discussion on IT equipment and 12) discussion on the part-time janitorial position. Council Member Counsell reported on the May 20, 2021 meeting of the Library Board regarding: 1) Librarians’ reports, 2) 1st and 2nd graders visiting the Library, 3) summer programs and story hours, 4) discussion on and approval of steps to Re-opening to normal operations, 5) discussion on and approval of accepting hygiene kits for the public from the Cummins Women Employees Resource Group and 6) discussion on Board Members and open records law compliance. City Clerk Roehl reported on the May 25, 2021 meeting of the Personnel Committee regarding: 1) discussion on and recommendation to allow the Police and Fire Commission to hire a Full-time Police Officer and 2) discussion on and recommendation to approve hiring an Other Part-time Custodian and advertising the position. City Clerk Roehl reported on the May 25, 2021 meeting of the Board of Review regarding: 1) calling the Board of Review to order to meet the statutory requirements and 2) adjourning the Board of Review until such date as the Assessment Roll is completed. Council Member Clough reported on the May 25, 2021 meeting of Commission on Public Works/Utilities regarding: 1) current activities, 2) discussion on fences, 3) opening, discussion and recommendation to accept the American Asphalt of Wisconsin, Mosinee, asphalt bid in the amount of $81.90 per ton for full width road paving and $132.80 per ton for patch paving, 4) the recommendation to accept the Drescher Oil Company proposal for 8 cents per gallon discount off the pump price for unleaded motor vehicle fuel, 5) the recommendation to accept the Drescher Oil Company proposal for 8 cents per gallon off the pump price for off-road diesel motor vehicle fuel and the Hansen’s IGA proposal for 8 cents per gallon discount off the pump price for on-road diesel motor vehicle fuel, 6) reviewed and accepted the Sewer Department’s Compliance Maintenance Annual Report and recommendation that Resolution No. 611 be adopted and 7) payment of bills. Mayor Murphy declared all reports filed as presented with the City Clerk. Jerilyn St. Amand stated that she walked in on Personnel Committee and Board of Review meetings tonight, she did not receive a phone notification of these meetings and they are not on the website, she asked why TDS was not asked what they could do at the new City Hall since Spectrum/Charter gave a presentation and she had asked before if consideration was given to broadcasting the Council meetings on TDS, people don’t know what is being spent on the new building and they are concerned. Mayor Murphy stated that they have been working with TDS and the Finance Committee has approved a $210,000 budget for the project. Mayor Murphy asked if there were any questions on the joint Planning Commission and Economic Development Commission item (1). Motion Counsell, second Clough, to accept the recommendation to donate $250 to the Neillsville Trout Pond Members for stocking the Neillsville Trout Pond in Listeman Park and that the Parks and Recreation Board budget for it in the future. Motion Clough, second Neville, to accept the recommendations to allow the Police and Fire Commission to hire a Full-time Police Officer. All Aye. All Aye. RESOLUTION NO. 611 COMPLIANCE MAINTENANCE RESOLUTION RESOLVED that the City of Neillsville informs the Wisconsin Department of Natural Resources that the following actions were taken by the Common Council: 1. Reviewed the Compliance Maintenance Annual Report, which is attached to this resolution. ___________________________ Diane L. Murphy, Mayor ___________________________ Rex R. Roehl, Clerk Motion Perrine, second Clough, to accept the recommendation that Resolution No. 611 be adopted. All Aye. City Clerk Roehl reported on receiving a $3,500 donation from the Listeman/Naedler Foundation for the 4th of July Fireworks. Motion Counsell, second Clough, to accept and appropriate $3,500 to Account No. 55340 Celebrations, and to thank the Listeman/Naedler Foundation for the donations. All Aye. City Clerk Roehl presented the 2021 Recycling Grant Funds received from the State of Wisconsin Department of Natural Resources in the amount of $9,977.16 (2020 - $9942.70). Motion Neville, second Counsell, that City Bills Nos. 463 to 500 in the amount of $97,986.21 be paid. All Aye. Mayor Murphy announced a closed session per Section 19.85(1)(g) of Wis. Stats. allows a governmental body to confer with its legal counsel and closed session for the purpose of obtaining oral or written advise concerning strategy to be adopted by the body with respect to present and prospective litigation directly involving the governmental body regarding reimbursement claim from James Mankowski and may reconvene in open session. Motion Clough, second Neville, to invite Chief of Police Mankowski, City Attorney Wachsmuth and City Clerk-Treasurer Roehl to remain for the closed session All Aye. Motion Neville, second Counsell, to go into closed session per Section 19.85(1)(g) of Wis. Stats. allows a governmental body to confer with its legal counsel and closed session for the purpose of obtaining oral or written advise concerning strategy to be adopted by the body with respect to present and prospective litigation directly involving the governmental body regarding reimbursement claim from James Mankowski and may reconvene in open session. On roll call: All Aye. CLOSED SESSION Motion Neville, second Counsell, to reconvene into open session. All Aye. Motion Counsell, second Clough, to reimburse Chief of Police James Mankowski, $20,000.00 for legal fees, out of the Police Department Administration – Supplies and Expenses budget line, acknowledging that the Police Department will be over budget by $20,000.00 in 2021, doing this as a one-time instance, in showing support of the Chief of Police working through unusual circumstances in his first year, in this case the City will reimburse him.
