JOINT MEETING OF THE COMMON COUNCIL AND PLANNING COMMISSION COUNCIL ROOM, CITY HALL AUGUST 19, 2021 6:05 P.M. Common Council-The Common Council was called to order by Mayor Murphy. On roll call: Mayor Diane Murphy, Council Members John Perrine, Daniel Clough, David Harnisch and Jose Neville present. Council Member Julie Counsell absent Planning Commission-The Planning Commission was called to order by Mayor Murphy. On roll call: Mayor Diane Murphy, Council Member John Perrine, Natalie Erpenbach and Amber Vine present. Council Member Julie Counsell, Allan Hoesly and Greg Glisczinski absent. Also present: Chris Straight, West Central Wisconsin Regional Planning Commission, (WCWRPC) Senior Planner, Luke Friemoth Director of Public Works, Mark Lisenby, Donna Pavlac, Jerilyn St. Amand and Chris Wachtendonk. 6:05 P.M.-Mayor Murphy declared the joint session Public Hearing on the City of Neillsville Comprehensive Plan 2021-2041 now open. Mayor Murphy called for appearances. Donna Pavlac, 615 W. Seventh Street, she is considering purchasing the Boon properties (#261.1418.000 – 4.38 acres and #261.0130.132 - .048 acres) with closing within the next month. Her plans are to open a retail nursery to grow plants, trees and shrubs. The preferred future land use Map 17 on Page 162 shows its residential which doesn’t support her business plans. Erpenbach asked if a change to commercial or mixed use would apply. Perrine asked if she was going to have sales there or just grow the plants to be sold elsewhere. Pavlac stated she would be selling from there, originally it was thought that a driveway could be off W. Tenth Street, but the City has an easement to the Sewer Plant, it is not a roadway. Access would be from the intersection of Ayers Street and W. Seventh Street, because a driveway has to be set back from an intersection, she will have to come to the City to allow a driveway off of the intersection over the road rightaway. Roehl stated that this change would be for future land use map purpose only, Pavlac would still have to go through the zoning process. Roehl stated that the Public Hearing was published in The Clark County Press, July 14, 2021 edition, the draft comprehensive plan was on the City’s website, two printed copies were picked up, the only written comment received was from Donna Pavlac which she presented tonight. Mayor Murphy called three times for any further appearances, there being none. 6:11 P.M.-Mayor Murphy declared the Public Hearing closed. Straight explained the Pavlac proposed change stating that City Zoning should be consistent with the City’s Comprehensive Plan or there could be a conflict. The change could be accepted as either commercial or mixed use. Should the nursery not happen or only needs a portion of the properties, there could still be some residential. Changes would be made to the Map on Page 162 and Table on Page 160. Discussion continued. Planning Commission-Motion Vine, second Erpenbach, to incorporate the mixed use classification for Parcels #261.1418.000 and #261.0130.132 in the Comprehensive Plan making changes where needed. All Aye. Erpenbach read Resolution No. 612. RESOLUTION NO. 612 RESOLUTION RECOMMENDING COMMON COUNCIL ADOPTION OF THE CITY OF NEILLSVILLE COMPREHENSIVE PLAN 2021-2041 WHEREAS, the City of Neillsville has determined the need for an updated comprehensive plan with the general purpose of guiding, directing, and accomplishing a coordinated, adjusted, and harmonius development of the City, which will, in accordance with existing and future needs, best promote public health, safety, order, convenience, prosperity, and the general welfare, as well as, efficiency and economy in the process of development; and WHEREAS, the City of Neillsville Plan Commission, in concert with the City Economic Development Commission, have prepared the City of Neillsville Comprehensive Plan 2021-2041 pursuant to §66.1001 and §62.23, Wisconsin Statutes, which contains plan documents, maps and other materials in the comprehensive plan elements required by §66.1001(2) of the Wisconsin Statutes; and WHEREAS, the City of Neillsville Plan Commission, pursuant to § 66.1001(4)(b) of the Wisconsin Statutes, may recommend to the Common Council the adoption of the updated comprehensive plan by adoption of a resolution to that effect by a majority of the entire Plan Commission. WHEREAS, a properly noticed public joint hearing has been conducted by the Plan Commission and City Council on the proposed approval and adoption of the updated comprehensive plan, pursuant to §66.1001(4)(d) of the Wisconsin Statutes NOW THEREFORE BE IT RESOLVED, the City of Neillsville Plan Commission officially recommends adoption of the City of Neillsville Comprehensive Plan 2021-2041, as drafted in the Public Hearing Draft as modified by previous motion of the Plan Commission based on public comments received during the public hearing, by the City of Neillsville Common Council. ____________________________________________ Diane L. Common Council-The Common Council having received written comment from Donna Pavlac on the Comprehensive Plan and the Planning Commission has taken action on the written comment received. Mayor Murphy read Ordinance No. 1066. ORDINANCE NO. 1066 AN ORDINANCE TO ADOPT THE CITY OF NEILLSVILLE COMPREHENSIVE PLAN 2021-2041 The Common Council of the City of Neillsville, Wisconsin, do ordain as follows: SECTION 1. Pursuant to Sections 62.23(2) and 62.23(3) of the Wisconsin Statutes, the City of Neillsville is authorized to prepare, adopt, and amend a comprehensive plan as defined in Sections 66.1001(1)(a) and 66.1001(2) of the Wisconsin Statutes. SECTION 2. Pursuant to Section 66.1001(2)(i) of the Wisconsin Statutes, a comprehensive plan shall be updated no less than once every 10 years. SECTION 3. The Common Council of the City of Neillsville, Wisconsin, has adopted and implemented written procedures designed to foster public participation in every state of the preparation of a comprehensive plan as required by Section 66.1001(4)(a) of the Wisconsin Statutes, which included a public hearing as required by Section 66.1001(4)(d) of the Wisconsin Statutes. SECTION 4. On August 19, 2021, the Common Council and City Plan Commission conducted a properly noticed joint public hearing on the draft comprehensive plan update. SECTION 5. The Plan Commission of the City of Neillsville, by a majority vote of the entire Plan Commission recorded in its official minutes, has adopted a resolution recommending to the Common Council the adoption of an updated comprehensive plan entitled “RESOLUTION RECOMMENDING COMMON COUNCIL ADOPTION OF THE CITY OF NEILLSVILLE COMPREHESNIVE PLAN 2021-2041”. SECTION 6. The Common Council has considered and responded to written comments received on the draft plan. SECTION 7. The Common Council of the City of Neillsville, Wisconsin, does, by the enactment of this ordinance, formally adopt the “CITY OF NEILLSVILLE COMPREHENSIVE PLAN 2021-2041” pursuant to Section 66.1001(4)(c) of the Wisconsin Statutes.
