MINUTES - FINAL OF THE NEW BRAUNFELS CITY COUNCIL REGULAR MEETING OF MONDAY, MARCH 28, 2022 AGENDA CALL TO ORDER Mayor Brockman called the meeting to order at 6:01 p.m. CALL OF ROLL: CITY SECRETARY Present: 6 - Mayor Rusty Brockman, Mayor Pro Tem Justin Meadows, Councilmember Harry Bowers, Councilmember Lawrence Spradley, Councilmember Jason Hurta, and Councilmember James E. Blakey Absent: 1 - Councilmember Shane Hines REQUEST ALL PHONES AND OTHER DEVICES BE TURNED OFF, EXCEPT EMERGENCY ON-CALL PERSONNEL. INVOCATION: COUNCILMEMBER JASON HURTA Councillmember Hurta provided the Invocation. PLEDGE OF ALLEGIANCE & SALUTE TO THE TEXAS FLAG Mayor Brockman led the Pledge of Allegiance and the Salute to the Texas Flag. PROCLAMATIONS: A) Autism Awareness Month Mayor Brockman read the proclamation. CITIZENS' COMMUNICATIONS This time is for citizens to address the City Council on issues and items of concerns not on this agenda. There will be no City Council action at this time. The following individuals spoke at this time: David Wermke, Easton Smith, Pam Kraft, Jim Holster Monday, March 28, 2022 New Braunfels City Council Regular Meeting 1. MINUTES A) Approval of the minutes for executive session March 14, 2022, and the regular session March 14, 2022. Mayor Brockman read the aforementioned item. Councilmember Hurta moved to approve this item. Councilmember Bowers seconded the motion which passed unanimously. Absent: Councilmember Hines 2. PRESENTATIONS: Mayor Brockman moved Presentation Item B to be presented first. A) Update and possible direction to City staff on Urban Wildlife Management Efforts. Mayor Brockman read the aforementioned item. Greg Malatek presented this item. Jessica Alderson from Texas Parks and WIldlife answered questions from Council and offered suggestions for the CIty. B) Presentation by Dr. Marbut on community responses to homelessness. Mayor Brockman read the aforementioned Item. Alice Jewell introduced the speaker for Presentation Item B. Dr. Marbut presented this item. The following individuals spoke at this time: Amanda Haegy, Roman Leal, James Cox, Anakin Cox, Brian Emerson, Carrie Evans, Jefferson Whitehead, Peggy Welch, Pam Sandberg, Carla Knepp, David Wermke, Jim Holster, Mary Whitehead, Bruce Nyman, Chris Smith, Susie Lynn. Mayor Brockman took a break at 8:16 p.m. Mayor Brockman reconvened at 8:31 p.m. Monday, March 28, 2022 New Braunfels City Council Regular Meeting 3. CONSENT AGENDA All items listed below are considered to be routine and non-controversial by the City Council and will be approved by one motion. There will be no separate discussion of these items unless a Councilmember or citizen so requests, in which case the item will be removed from the consent agenda and considered as part of the normal order of business. Citizens must be present to pull an item. Resolutions & Action Items A) Approval for the City Manager to execute a Memorandum of Authorization between the City of New Braunfels and the City of Pflugerville for sharing data between Law Enforcement agencies. B) Approval of the City of New Braunfels FY 2022 First Quarter Investment Report. C) Approval of a contract with Chain Electric Company for installation of single mode fiber optic network cabling to complete a redundant fiber ring between City Hall and the Library and completes a fiber segment for Fire Station 4; including authorization for the City Manager to execute any change orders up to the contingency amount. D) Approval of a contract with FleetCor Technologies Inc. for the provision of Citywide fleet fuel card services. E) Approval of annual routine recurring expenditures for FY 2022 in accordance with City Charter Section 9.17. F) Approval of a budget amendment within the FY 2021 General Fund for the Fire Department to support a year end accrual entry. Ordinances (In accordance with Section 3.10 of the City Charter, a descriptive caption of each ordinance shall be read on two separate days.) G) Approval of the second and final reading of an ordinance amending Section 126-346(f)(54) of the City of New Braunfels Code of Ordinances to extend the existing no parking zone on Walnut Avenue. H) Approval of the second and final reading of an ordinance amending Section 126-346 (e) of the City of New Braunfels Code of Ordinances to restrict parking on Willowbrook Avenue at the intersection with FM 1101. Monday, March 28, 2022 New Braunfels City Council Regular Meeting I) Approval of the first reading of an ordinance to amend Section 126-346 to establish a no parking zone on Altgelt Lane between SL 337 and city limits. Approval of the Consent Agenda Mayor Brockman read the aforementioned Consent Agenda items A-I. Councilmember Bowers moved to approve Consent Agenda items A-I. Councilmember Hurta seconded the motion which passed unanimously. Absent: Councilmember Hines 4. INDIVIDUAL ITEMS FOR CONSIDERATION A) Approval of the acceptance of the FY 2021 Audit and Annual Financial Report performed by Belt Harris Pechacek, LLLP. Mayor Brockman read the aforementioned item. Angie Harris made preliminary remarks and introduced the speaker Robert Belt with Belt Harris Pechacek who presented this item. Mayor Pro-Tem Meadows moved to approve this item. Councilmember Bowers seconded the motion which passed unanimously. Absent: Councilmember Hines B) Approval of the second and final reading of an ordinance amending Section 126-354 of the City of New Braunfels Code of Ordinances to add a new parking by permit area, Area P, on the 100 block of Hampe Street. Mayor Brockman read the aforementioned item. Garry Ford presented this item. The following individuals spoke to this item: Pam Kraft, David Wermke, Mayor Pro-Tem Meadows moved to approved this item with staff recommendations. Councilmember Hurta seconded the motion which passed unanimously. Monday, March 28, 2022 New Braunfels City Council Regular Meeting Absent: Councilmember Hines C) Public hearing and first reading regarding the proposed rezoning of approximately 10.57 acres out of the A.M. Esnaurizar League Grant from “R-2” Single-Family and Two-Family District to “C-1B” General Business District located at the northeast corner of the intersection of the future extension of Alves Lane at Barbarosa Road. Mayor Brockman read the aforementioned item. Chris Looney presented this item. Applicants representative, Chris Crin, amended the applicants request to C-1A at the podium and presented this item. The following individuals spoke at this time: Jill Kimball, Walter Sparkman, Michael Way, Timothy Davis, Michael Kivlin. Mayor Pro-Tem Meadows moved to postpone this item to the April 25, 2022 Council Meeting. Councilmember Bowers seconded the motion which passed unanimously. Absent: Councilmember Hines D) Public hearing regarding the proposed Mayfair Sector Plan 1, within the Comal County Water Improvement District #3, encompassing approximately 387 acres out of the A M Esnaurizar Survey 1, Abstract 1, including property east of IH 35 N, north of Kohlenberg Rd and south of Watson Lane E within the Mayfair Project. Mayor Brockman read the aforementioned item. Jean Drew presented this item. Councilmember Hurta moved to approve this item. Councilmember Bowers seconded the motion which passed unanimously. Absent: Councilmember Hines E) Public hearing regarding the proposed Veramendi Sector Plan 5, within the Comal County Water Improvement District #1, encompassing approximately 194 acres out of the JM Veramendi Monday, March 28, 2022 New Braunfels City Council Regular Meeting Survey 2 Abstract 3, including property east of the intersection of Hueco Springs Loop Road and River Road within the Veramendi Project. Mayor Brockman read the aforementioned item. Jean Drew presented this item. Councilmember Bowers moved to approve this item. Mayor Pro-Tem Meadows seconded the motion which passed unanimously. Absent: Councilmember Hines F) Public hearing and consideration of the proposed Veramendi Sector Plan 4, within the Comal County Water Improvement District #1, encompassing approximately 222 acres out of the Juan Martin de Veramendi Survey No. 2, Abstract 3, including property northeast of the intersection of Oak Run Parkway and Borchers Boulevard. Mayor Brockman read the aforementioned item. Chris Looney presented this item. Councilmember Bower moved to approve this item with staff recommendations. Councilmember Spradley seconded the motion which passed unanimously. Absent: Councilmember Hines 5. EXECUTIVE SESSIONS In accordance with Texas Government Code, Subchapter D, the City Council may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public. A) Deliberate pending/contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code, specifically: · Cause No. 2022-0386D, City of New Braunfels, Texas vs. IN REM 420 BUS 35 N, New Braunfels, Texas 78130; and JIMON INC.
