MINUTES - FINAL OF THE NEW BRAUNFELS CITY COUNCIL REGULAR MEETING OF MONDAY, APRIL 11, 2022 AGENDA CALL TO ORDER Mayor Brockman called the meeting to order at 6:01 p.m. CALL OF ROLL: CITY SECRETARY Present: 7 - Mayor Rusty Brockman, Councilmember Shane Hines, Mayor Pro Tem Justin Meadows, Councilmember Harry Bowers, Councilmember Lawrence Spradley, Councilmember Jason Hurta, and Councilmember James E. Blakey REQUEST ALL PHONES AND OTHER DEVICES BE TURNED OFF, EXCEPT EMERGENCY ON-CALL PERSONNEL. INVOCATION: MAYOR RUSTY BROCKMAN Mayor Brockman provided the Invocation. PLEDGE OF ALLEGIANCE & SALUTE TO THE TEXAS FLAG Mayor Brockman led the Pledge of Allegiance and the Salute to the Texas Flag. Mayor Brockman read the proclamation. CITIZENS' COMMUNICATIONS This time is for citizens to address the City Council on issues and items of concerns not on this agenda. There will be no City Council action at this time. MINUTES A) Approval of the minutes for Special Council Meeting March 23, 2022, Executive Session March 28, 2022, and Regular Session March 28, 2022 Mayor Brockman read the aforementioned item. Councilmember Bowers moved to approve this item. Councilmember Hurta seconded the motion which passed unanimously. 2. CONSENT AGENDA All items listed below are considered to be routine and non-controversial by the City Council and will be approved by one motion. There will be no separate discussion of these items unless a Councilmember or citizen so requests, in which case the item will be removed from the consent agenda and considered as part of the normal order of business. Citizens must be present to pull an item. Resolutions & Action Items A) Approval of professional services contracts with Atlas Technical Consultants, LLC., Raba Kistner, Inc, and Terracon Consultants, Inc. for on-call materials testing and inspection support services, on an as-needed basis. B) Approval for the City Manager to execute a Joint Use Agreement between the City of New Braunfels Utilities and the Headwaters at the Comal. C) Approval of the purchase of a replacement fire engine through Siddons-Martin Emergency Group, LLC built by Pierce Manufacturing to New Braunfels Fire Department specifications. D) Approval of annual routine recurring expenditures for FY 2022 in accordance with City Charter Section 9.17. E) Approval to declare two Chevy Tahoe’s, three Humvees, and one Blue Bird All American Bus from the Police Department fleet as surplus. F) Approval of the second and final reading of an ordinance to amend Section 126-346 to establish a no parking zone on Altgelt Lane between SL 337 and city limits. Approval of the Consent Agenda Mayor Brockman read the aforementioned Consent Agenda A-F. Councilmember Bowers moved to approve Consent Agenda A-F. Councilmember Hines seconded the motion which passed unanimously. 3. INDIVIDUAL ITEMS FOR CONSIDERATION A) Discuss and consider the first reading of an ordinance amending Chapter 86, Section 86-94 Landa Park Swimming Pool Fees, to adjust seasonal pass rates. B) Public hearing and the first reading of an ordinance regarding Youth Program Standards of Care for the Parks and Recreation Department. Mayor Brockman read the aforementioned item. Geronimo Aguirre presented this item. Councilmember Hurta moved to approve this item. Councilmember Bowers seconded the motion which passed unanimously. C) Discuss and consider a request for the City to consent to the addition of 140.552 acres into the existing Lone Oak Farm Municipal Utility District (MUD) within the City’s ETJ in Guadalupe County, located on the north side of FM 758, approximately 500 feet west of the intersection of State Highway 123. D) Discuss and consider the first reading of an ordinance granting rehabilitation tax relief for a five-year period to the property currently addressed as 1072 Church Hill Drive, an individual landmark known as the Eickenroht House. Mayor Brockman read the aforementioned item. Katie Totman presented this item. The following individual spoke at this time: Timothy Davis Councilmember Spradley moved to approve this item. Councilmember Blakey seconded the motion which passed unanimously. E) Discuss and consider approval of a resolution of the City Council of the City of New Braunfels, approving a recommendation of the New Braunfels Economic Development Corporation for an expenditure of up to $2,184,315.50 for engineering, design and related professional service and acquisition costs of approximately 3.62 acres of Union Pacific property in downtown New Braunfels. Councilmember Hines moved to approve this item. Councilmember Hurta seconded the motion which passed unanimously. Mayor Brockman took a break at 8:17 p.m. Monday, April 11, 2022 New Braunfels City Council Regular Meeting  Mayor Brockman reconvened at 7:21 p.m. F) Discuss and consider approval of a resolution of the City Council of the City of New Braunfels, approving a recommendation of the New Braunfels Economic Development Corporation for a grant of up to $1,200,000 to the Headwaters at the Comal for a capital project to construct a facility to house meeting and conference spaces and educational exhibits and improve site visibility and access. Mayor Brockman read the aforementioned item. Jeff Jewell presented this item. Councilmember Bowers moved to approve this item. Councilmember Spradley seconded the motion which passed unanimously. 4. EXECUTIVE SESSIONS In accordance with Texas Government Code, Subchapter D, the City Council may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public. A) Deliberate pending/contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code, specifically: · Cause No. 2022-0386D, City of New Braunfels, Texas vs. IN REM 420 BUS 35 N, New Braunfels, Texas 78130; and JIMON INC. D/B/A River Ranch RV Park Resort · Municipal Utility Districts; Texas statutes and municipal subdivision development ordinances B) Deliberate the appointment, evaluation, duties, discipline, or removal of the City Manager in accordance with Section 551.074 of the Texas Government Code. RECONVENE INTO OPEN SESSION AND TAKE ANY NECESSARY ACTION RELATING TO THE EXECUTIVE SESSION AS DESCRIBED ABOVE.
