MINUTES - FINAL OF THE NEW BRAUNFELS CITY COUNCIL - SPECIAL REGULAR MEETING OF MONDAY, NOVEMBER 14, 2022 AGENDA CALL TO ORDER Mayor Brockman called the meeting to order at 3:34 p.m. CALL OF ROLL: CITY SECRETARY Councilmember Blackey arrived at 3:35 p.m. after roll call Councilmember Campos arrived at 3:36 p.m. after roll call Present 7 - Mayor Rusty Brockman, Councilmember Andres Campos, Councilmember Christopher Willis, Mayor Pro Tem Harry Bowers, Councilmember Lawrence Spradley, Councilmember Jason Hurta, and Councilmember James Blakey 1. CONSENT A) Approval of the appointment of April Rodgers to the Building Standards Commission for a term ending November 30, 2024. B) Approval of appointments to the Landa Park Golf Advisory Board for James Clay Carter for term ending November 30, 2025, Michael Graves and Terry Moorhead for two unexpired terms ending November 30, 2023. C) Approval of five Mayoral appointments to Partnership Committee - Andrew Korpi, Bret Bradberry, Fernando Yarrito, Hans-Bernhard Moeller, and Kelly Jackson for the term ending November 30, 2025. D) Approval of the appointment of David Davenport to the River Advisory Board for a term ending November 30, 2025 Approval of the Consent Agenda Mayor Brockman read Consent Items A-E. Councilmember Campos asked to abstain from Consent Item E. Mayor Pro Tem Bowers moved to approve Consent Items A-D. Councilmember Hurta seconded to motion, which passed 6-0 with Councilmember Campos abstained. E) Approval of the appointments to The Workforce Housing Advisory Monday, November 14, 2022 New Braunfels City Council - Special Regular Meeting  Board for Alice Jewell, Johnnie Rosenauer, Jonathan Packer, Kristin Reynolds, and Sarah Dixon for the terms ending November 30, 2025, and Randall Allsup for an unexpired term ending November 30, 2024. Motion for A-D Campos abstained from Item E Approval of the Consent Agenda Councilmember Hurta moved to approve Consent Item E. Councilmember Willis seconded to motion, which passed 6-0 with Councilmember Campos abstained. Abstain: Campos 2. WORKSHOP Mayor Brockman asked Gayle Wilkinson to review the new process in place for appointing members to the boards and commissions. A) Discuss and appoint two (2) individuals to the Animal Service Advisory Board for a term ending November 30, 2025. Mayor Brockman read the aforementioned item. Gayle Wilkinson presented this item. Councilmember Spradley moved to appoint Eric Trager as the Animal Facility Owner/Operator to the Animal Services Advisory Board, for a term ending November 30, 2025. Mayor Pro Tem Bowers seconded the motion, which passed unanimously. Mayor Pro Tem Bowers moved to appoint Robert Blythin as the City/ETJ Resident to the Animal Services Advisory Board for a term ending November 30, 2025. Councilmember Willis seconded the motion, which passed unanimously. C) Discuss and appoint three (3) individuals for terms ending November 30, 2025, one (1) individual for an unexpired term ending November 30, 2024 and one (1) individual for an unexpired term ending November 30, 2023, for Community Development Advisory Committee. Councilmember Hurta seconded the motion, which passed unanimously. Mayor Pro Tem Bowers moved to appoint Lianna McNeil to Community Development Advisory Committee, for a term ending November 30, 2024 and Jude Aririesike to Community Development Advisory Committee for a term ending November 30, 2023. Councilmember Spradley seconded the motion, which passed unanimously. B) Discuss and appoint two (2) individuals to the Building Standards Commission for terms ending November 30, 2024. Councilmember Spradley moved to appoint Bethany Bryan and Tommy Carden to the Building Standards Commission, for terms ending November 30, 2024. Councilmember Campos seconded the motion, which passed unanimously. D) Discuss and appoint one (1) individual to the Landa Park Golf Course Advisory Board for a term ending November 30, 2025. Councilmember Spradley moved to appoint Kailee Fulton to the Landa Park Golf Course Advisory Board, for a term ending November 30, 2025. Councilmember Campos seconded the motion, which passed unanimously. E) Discuss and appoint two (2) individuals to the Library Advisory Board for a term ending November 30, 2025. Councilmember Spradley moved to appoint Carol Bissett and Connie Board to the Library Advisory Board, for terms ending November 30, 2025. Councilmember Hurta seconded the motion, which passed unanimously. Mayor Pro Tem Bowers moved to appoint Kristen Carden and Thomas Blagg to the Parks and Recreation Advisory Board, for terms ending November 30, 2025. Councilmember Hurta seconded the motion, which passed unanimously. G) Discuss and appoint one (1) individual to the River Advisory Board for a term ending November 30, 2025. Councilmember Hurta seconded the motion, which passed unanimously. H) Interview applicants and appoint three (3) individuals to the New Braunfels Economic Development Corporation. Mayor Brockman read the aforementioned item. Gayle Wilkinson called Brian Cox forward to be interviewed. Brian Cox was interviewed by Council beginning by giving a brief statement about himself and his desire to serve on the New Braunfels Economic Development Corporation Board. Mayor Brockman called Kristen Carden forward to be interviewed. Mayor Pro Tem Bowers moved to appoint Kristen Carden, Larry Hammond, and Shane Hines to the New Braunfels Economic Developement Corporation for terms ending November 30, 2024. Councilmember Hurta seconded the motion, which passed unanimously. 3. EXECUTIVE SESSION In accordance with the Open Meetings Act, Texas Government Code, Ch. 551, the City Council may convene in a closed session to discuss any of the items on this agenda or listed below. Any final action or vote on any executive session item will be taken in open session. A) Deliberate pending/contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code, specifically: · Chapter 242 of the Texas Local Government Code and proposed replacement of the current Interlocal Agreement with Guadalupe County on subdivision development regulations. · Stryker Sales Corp. Agreement for emergency equipment. B) Deliberate the purchase, exchange, lease or value of real estate in accordance with Section 551.072 of the Texas Government Code, specifically · Former Fire Station 2 - 4120 Loop 337 C) Deliberate the appointment, evaluation, duties, discipline, or removal of the City Attorney in accordance with Section 551.074 of the Texas Monday, November 14, 2022 New Braunfels City Council - Special Regular Meeting  Government Code. Mayor Brockman read the aforementioned Executive Session Items. Mayor Brockman recessed into Executive Session at 4:38 p.m. 4. RECONVENE INTO OPEN SESSION AND TAKE ANY NECESSARY ACTION RELATING TO THE EXECUTIVE SESSION AS DESCRIBED ABOVE. Mayor Brockman reconvened into Open Session at 5:47 p.m. No action taken. 5.
