In the matter of the Charges filed against Firefighter Robin Haffner by City Administrator Noah Wiedenfeld Please take notice the Police and Fire Commission will convene in closed session for the purpose of deliberating and consulting with legal counsel with regard to the above matter. The Police and Fire Commission will be in Closed Session for the entirety of the meeting, with the exception of roll call and adoption of the agenda. The Police and Fire Commission’s legal counsel and a majority of the Police and Fire Commission may participate virtually/remotely. This deliberation is continued from 27 Nov 2023 and 29 Nov 2023. 8. ADJOURNMENT Police and Fire Commission Meeting Minutes Wednesday, November 29, 2023 at 5:30 PM Council Chambers The Police and Fire Commission of the City of New Richmond was called to order on Wednesday, November 29, 2023, at 5:30 PM, in the Council Chambers, with the following members present: PRESENT: Kirk Lindell, Jon Hailey, Andrea Guinn ABSENT: Michael Hedges OTHERS James Kalny, the Police and Fire Commission’s legal counsel (virtual), Michelle PRESENT: Scanlan (Open Session only) CALL TO ORDER ROLL CALL ADOPTION OF AGENDA Andrea Guinn made a motion to adopt the Agenda. Jon Hailey seconded the motion. Carried unanimously. APPROVAL OF MINUTES Andrea Guinn made a motion to approve the Minutes from 27 Nov 2023. Kirk Lindell seconded the motion. Carried unanimously. Andrea Guinn made a motion to enter into Closed Session. Kirk Lindell seconded the motion. Carried unanimously. CLOSED SESSION PER STATE STATUTE 19.85 (1)(A) AND (G) DELIBERATION IN THE MATTER OF THE CHARGES FILED AGAINST FIREFIGHTER ROBIN HAFFNER BY CITY ADMINISTRATOR NOAH WIEDENFELD Andrea Guinn made a motion at 7:24pm to suspend deliberation until 5:30pm on Thursday, November 30 and to enter back into Open Session. Police and Fire Commission Meeting November 29, 2023 Police and Fire Commission Meeting Minutes Wednesday, August 16, 2023 at 10:00 AM Council Chambers The Police and Fire Commission of the City of New Richmond was called to order on Wednesday, August 16, 2023, at 9:59 AM, in the Council Chambers, with the following members present: PRESENT: Kirk Lindell, Jon Hailey, Andrea Kier, Michael Hedges ABSENT: Jorden Aufderhar OTHERS Attorney Kalny, Attorney Sandstrom, Attorney Weld, Noah Wiedenfeld, Marcus PRESENT: Chute, Robin Haffner CALL TO ORDER ROLL CALL President Hailey called the meeting to order at 9:59 AM. ADOPTION OF AGENDA Andrea Kier made a motion to adopt the agenda. Michael Hedges seconded the motion. Carried unanimously. APPROVAL OF MINUTES MINUTES FROM: Kirk Lindell made a motion to approve the minutes from July 12, 2023 and July 25, 2023. Michael Hedges seconded the motion. Carried unanimously. HEARING _____________________________________________________________________ In the matter of the Charges Filed Against Firefighter Robin Haffner Charged Party By City of New Richmond City Administrator Noah Weidenfield Charging Party ______________________________________________________________________ Police and Fire Commission Meeting August 16, 2023 Mr. Hailey called the evidentiary portion of the hearing to order at 9:59 a.m.1. The parties made their appearances, Robin Haffner appearing by his Attorney Steve Weld and in person; Mr. Wiedenfeld appearing in person and by City Attorney Kevin Sandstrom. Mr. Hailey asked Mr. Kalny to address the record of the matter. 5.1 Mr. Kalny reviewed of the Record of this matter to date 5.2 Mr Kalny reviewed the of Decisions of President on evidentiary matters 5.3 There were no dipositive motions that were left to address 5.4 Mr. Kalny reviewed the process for the evidentiary hearing as provided by the Commission rules. Mr. Weld raised 3 concerns regarding evidentiary matters that were addressed by the commission 5.5 Counsel for each party presented Opening Argument 5.6 Presentation of Charging Party’s case- Mr. Wiedenfeld testified, Marcus Chute testified. 5.7 Presentation of Charged Party’s defense- was not reached 5.8 Rebuttal was not reached 5.9 Closing Arguments were not reached 5.10 Deliberations were not reached ADJOURNMENT After the testimony, at 4:30 p.m., the Commission determined to reconvene on August 17, 2023 at 9:00 a.m. 1 The proceedings were both recorded and transcribed. Police and Fire Commission Meeting August 16, 2023 Police and Fire Commission Meeting Minutes Wednesday, August 16, 2023 at 9:00 AM Council Chambers The Police and Fire Commission of the City of New Richmond was called to order on Wednesday, August 16, 2023, at 8:59 AM, in the Council Chambers, with the following members present: PRESENT: Kirk Lindell, Jon Hailey, Andrea Kier, Michael Hedges ABSENT: Jorden Aufderhar OTHERS PRESENT: CALL TO ORDER President Hailey called the meeting to order at 8:59 a.m. ROLL CALL ADOPTION OF AGENDA Andrea Kier made a motion to adopt the Agenda. Micheal Hedges seconded the motion. Carried Unanimously. CLOSED SESSION PER STATE STATUTE 19.85 (1)(C) 4.1 The commission may convene into Close under Wis. Stat. Section 19.85(1 (g), to confer with legal counsel regarding litigation it is involved in. Procedural or Substantive questions regarding the Decision and Order in the case of Jonathan Haffner, St Croix County Case No. 22-cv-257 confer with legal counsel regarding litigation it is involved in. OPEN SESSION - ACTION ON CLOSED SESSION AGENDA Police and Fire Commission Meeting August 16, 2023 Kirk Lindell made a motion to come out of Closed Session. Andrea Kier seconded the motion. Carried unanimously. CONSIDERATION OF DECISION AND ORDER IN THE CASE OF JONATHAN HAFFNER, ST CROIX COUNTY CASE NO. 22-CV-257 The Circuit Court Judge ordered the dismissal of the Complaint by Acting Chief Bell against Firefighter Jonathan Haffner. Kirk Lindell made a motion to dismiss the complaint of Acting Chief Bell against Firefighter Jonathan Haffner in accordance to the Circuit Court Findings. Andrea Kier seconded the motion. Roll Call Vote carried unanimous PFC POSITION OPENING Jorden Aufderhar has resigned from the PFC. Anyone interested in becoming a member, please contact City Clerk Michelle Scanlan.
