Lutheran Social Services Rental Fee 12 - 18 Motion by_____Second by_____ to recommend increasing Lutheran Social Services Community Center kitchen and cafetorium rental fee on January 1, 2025 to $_____ per day. Recommend increasing Lutheran Social Services Community Center kitchen and cafetorium rental fee on January 1, 2025 to $54.11 per day. 1. Lutheran Social Service (LSS) has been renting the Community Center’s kitchen and cafetorium for many years; to prepare, serve on site, and deliver off site, meals to seniors in New Ulm and surrounding communities in Brown County. 2. The City of New Ulm values LSS performing this function for senior residents of the City of New Ulm. 3. The City’s fee guidelines include: A. Analyze and consider adjustments, at least annually. B. Adjust to account for inflation. C. Recoup City costs and expenses. D. Charge non-residents more than residents, due to residents paying City property taxes. 4. Approximately 45% to 51% of meals prepared in the Community Center, go to residents of other cities. 5. In the past, the City has asked LSS to seek funding from other cities with residents receiving City of New Ulm subsidized meals. 6. The City provides and pays for: Kitchen appliances; furnishings; fixtures; custodial supplies; water softener salt; labor in the building, grounds and parking lots; utilities, refuse and recycling, and LSS office space. Budgetary/Fiscal Issues 1. City expenses are approximately $100.00 per day. 2. 2009 rent - $74.89 3. 2010, 2011, 2012, 2013 - $81.55 4. 2014 - $86.50 5. 2015 and 2016 - $50.00 6. 2017, 2018, 2019, 2021, 2022 - $51.00 7. 2023, 2024 - $52.53 2025 LSS Lease Draft 6.3. Statewide Health Improvement Partnership (SHIP) Grant Application Page 2 of 22 Motion by __________ and seconded by _________ to recommend the City Council approve SHIP grant application for Smoke Free signage in parks and recreational facilities. 1. Park and Recreation Commission recommended approving an updated Smoke-Free Policy to include Tobacco and Cannabis at the September 11, 2023 meeting. 2. City Council approved the updated Smoke-Free Policy at their September 19, 2023 to take effect January 1, 2024. 3. Staff has been in contact with the Association of Non-Smokers MN, who provided free signage for the Tobacco-Free Policy in 2021, however funding will not be available at this time. 4. This SHIP grant if successful, would cover the full cost of $3,000.00 for signage. 5. Park and Recreation maintenance staff would install replacement signage. 6.4. Realtor Association of Southern Minnesota Grant Acceptance Motion by __________ and seconded by _________ to recommend the City Council offer a resolution and waive the reading to accept the following donation offered to the City of New Ulm through the Park and Recreation Department for a new shade structure at the Dog Park, located at 527 South German St. 1. The Realtor Association of Southern Minnesota was interested in helping fund an amenity that is in a public space that can accessed by the community. 2. Staff provided a list of options that fit that criteria along with a narrative on the impacts of adding or enhancing those amenities. 3. RASM was most interested in the option to improve the shade structure at the Dog Park. 4. The current structure, pergola, is in need of replacement. 5. This funding will go towards a new steel 14' x 14' shelter. 6. Project will also include a 16' x 16' concrete structural pad, funded through Dog Park Improvement Fund. 6.5. Hermannfest 2024 Motion by __________ and seconded by _________ to recommend the City Council offer a resolution and authorize the requests by the Hermann Monument Society for Hermannfest on Saturday, September 7, 2024 in Hermann Heights and Harman Parks. 1. HMS, President Tom Furth, is again requesting to host Hermannfest, a free community celebration on the Saturday after Labor Day, September 7, 2024 in Hermann Heights and Harman Parks. 2. An approximately fifteen-minute professional fireworks discharge is planned to be conducted by the Erv Haman firm RES Specialty Pyrotechnics of Belle Plaine MN, which has conducted each of the past ten discharges over Hermann Monument in 2023, 2022, 2021, 2019, 2018, 2017, 2016, 2015, 2014, 2013 and 2009. 3. The New Ulm Battery is planning cannon fire in the parks to include Thunder in the Valley and 1812 Overture with the New Ulm Municipal Page 3 of 22 Band. 4. A fireworks permit will be applied for with the Fire Chief. 5. HMS is coordinating with the Park and Recreation Director regarding use and protection of city property and facilities in the two parks. 6. The noise variance is not required for the amplified live music between 10:00 p.m. and 12:00 a.m., the end of the celebration, because of HMS’s non-profit status. 7. All emergency services, road authorities and the airport will be contacted. 8. HMS is requesting Brown County temporarily close the Center Street hill (County Highway 13) during the fireworks discharge. 9. Certificates of liability insurance coverage will be obtained from HMS and RES Specialty Pyrotechnics. 6.6. Donations Motion by __________ and seconded by _________ to recommend the City Council offer a resolution and waive the reading to accept the following donations offered to the City of New Ulm through the Park and Recreation Department for the identified purposes. 1. APPROVAL OF MINUTES 4.1 Motion was made by Gulden and seconded by A Johnson to approve the May 13, 2024 meeting minutes. All voted in favor of the motion. Motion carried unanimously. 5. CITY COUNCIL MEETING(S) RECAP – Chair Schugel summarized the past month’s City Council Meetings and work sessions: May 21 2024 Regular – Approved staff to apply for the Allina Health Charitable Contribution Grant for Free Fitness in the Park; approved the lease to New Ulm Baseball Association for lawful gambling activity at Johnson Park during the 2024 baseball season. June 4, 2024 Regular – Approved use of Riverside Park for the American Legion Post 132 Music in the Park event on July 17 from 3-8 p.m., including a canon shoot by the New Ulm Battery. 5.1 Motion was made by Luneburg and seconded by A Johnson to receive and order filed this city council past action report. All voted in favor. Motion carried unanimously. 6. OLD BUSINESS 6.1 Comprehensive Plan Update – Director Schugel reported that • The community open house was held on Wednesday, May 15 at City Hall from 5-7 p.m. Approximately 40 people attended, along with City Staff and Plan Consultants. • Planning Commission approved the Comprehensive Plan at their May 30 meeting. The four area plans were not part of this approval. • City Council adopted the Comprehensive Plan at their June 4 regular meeting. • Area plans are planned to be presented at the June Planning Commission Meeting and City Council in July. 7. NEW BUSINESS Page 6 of 22 7.1 Director Schugel presented an updated concept after much consideration and evaluation at German Park. Loss of trees, protecting greenspace and all the various uses of the park. The new concept for the Veterans Memorial in German Park includes an addition of flagpoles (symmetrical), lighting and area for future paver stones. There was discussion on how to recognize future Veterans that will preserve greenspace and trees to expand, if needed. Members of the Veteran’s Memorial groups like the plan but would prefer to have 3 flags, rather than 2, but will work with this concept. Director Schugel stated they would work with the design of the flagpole to include 2 flags per pole, if desired. Motioned by Gulden and seconded by A Johnson to recommend the City Council approve the concept as presented. REPORTS FROM COMMISSIONER AND STAFF 8.1 Department Activity Highlights – • Seasonal facilities opened (splash pad, wading pools, Hermann Monument). • May was water safety month and highlighted in the Journal and Social Media. Motion carried unanimously. 8.2 Director Schugel highlighted additional items: • Seasonal attended safety training through MMUA, along with position specific training for their assigned duties this summer. • Summer programming kicks off for the season this week, including youth camps and athletics. Rec on the Go, Summer Concerts, and Puppet Wagon. • German Park Fountain repair is nearing completion. • Phase one of pickleball court replacement project is complete at Lincoln Park. Phase 2 to begin about 30 days after. • Air handler unit replacement project is underway at the Rec Center (done behind the scenes). 8.3 Commissioner Reports this month • Chair Buegler asked how long the Puppet Wagon has been around. It is estimated to be at least 40 years. • Commissioner Gulden commented how great the parks look this year! 9. Affordability & value based 2. Comparable to like facilities in peer market group of cities. 3. Consider fee adjustments based on the Consumer Price Index (CPI), to keep up with inflation of expenses, And recouping maintenance and operational costs where feasible 4. Consider partially subsidizing youth activities, rather than adult activities. 5. Regular small increases are favored by users, rather than occasional large increases. 6. Fees should be user-based, rather than subsidized by property taxpayers. Present Free Uses in Parks include playgrounds, wading pools, splashpad, outdoor courts, shelters and fields not reserved, dog, skate and pollinator parks, trails, ,archery range, etc. Fee Notes - most fees average between 2-4% increase 1. Some fees kept flat for a few years, then increased $1.00 or more to avoid managing coins. 2. Recommend removing annual membership to Civic Center and allow access with Recreation Center Membership. 3. Recommend increasing Recreation Center membership 3-4%, the first time in 4 years since renovation and expansion. 4. Youth (4-11) Membership stays at 50% of regular because they cannot use the fitness center or attend classes. 5. Eliminate double membership and simplified model to single + additional $100. 6. Increased gym court reservations to bring in line with peer market facilities but kept pool rental fees flat. 7. Ballfield high use discounts reduced to two, 10% and 20% and increased number of games needed for discount. User groups were usually on the cusp of 1 rate or the other, complicating billing. Page 11 of 22 LEASE AGREEMENT THIS AGREEMENT is made and entered into this _1st day of __January, 2025 (the “Effective Date”) by and between the City of New Ulm, Minnesota, (hereinafter referred to as City) and Lutheran Social Service of Minnesota. WHEREAS, the City is the owner of a building located in the City of New Ulm and referred to herein as the New Ulm Community Center located at 600 North German Street; WHEREAS, Lutheran Social Service is organized and exists for the purpose of providing meals for qualifying individuals; WHEREAS, Lutheran Social Service desires to lease and use a portion of the New Ulm Community Center for the purpose of installing equipment for the provision of meals and for the preparation and consumption of meals. NOW THEREFORE, in consideration of the mutual obligations and agreements of the parties herein, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties hereby agree as follows: 1. City hereby leases to, and Lutheran Social Service hereby accepts, space within the New Ulm Community Center, as set forth in paragraph 5 of this agreement (the “Premises”), for the following purposes: a. The location and installation of food preparation and storage equipment for preparation of food for the nutrition program. b. Serving and consumption areas for the patrons of the nutrition program. c. Preparation area to provide meals to be delivered out of New Ulm city limits, not to exceed 75% of the total number of meals prepared. 2. This lease shall run from the January 1, 2025 until December 31, 2025 unless sooner terminated in accordance with the provisions hereof. a. Either party hereto, upon sixty days written notice to the other party, may terminate the lease. In the event of such termination, Lutheran Social Service shall remove all equipment and supplies belonging to it within such sixty-day notice period and shall leave the premises in good repair and condition, reasonable wear and tear accepted. Any personal property not removed within that notice period shall become the property of the City. 1 City of New Ulm/Lutheran Social Service Lease – 07/25/24 Page 12 of 22 b. This lease shall be automatically renewed for successive one-year periods unless either party gives written notice of termination for the ensuing calendar year to the other party on or before November 1 of each year. 3. Lutheran Social Service will pay to City as and for rental for said premises for the time period from the date hereof to December 31, 2025 the sum of fifty-four dollars and eleven cents ($54.11) per day or partial day of use, which sum shall include the cost to the City for utility services (gas, water, sewer and electricity), hot water, and trash service. Said amount shall be payable monthly on or before the fifteenth day of the month following the month in which Lutheran Social Services used the Premises. The rental amount provided for by this paragraph may be adjusted upwards by the City upon sixty days notice to Lutheran Social Service; such adjustments to be based on increases in the use of utility services by Lutheran Social Service or upon increase in rates for such services. The rental amount may also be increased by the City as it deems appropriate if the percentage of meals which are prepared on site and delivered to out of city limit locations exceeds the permissible percentage set forth in paragraph 1.c of this agreement. Lutheran Social Service shall provide accurate information to City on a monthly basis of the total number of meals prepared, the number of meals delivered to locations outside the City of New Ulm, and the number of days of operation. 4. Lutheran Social Service shall be allowed the use of the kitchen located at the New Ulm Community Center Monday through Friday from the hours of 6:00 a.m. to 2:00 p.m., and shall be allowed the use of the cafetorium room in the New Ulm Community Center from the hours of 11:00 a.m. until 1:00 p.m. Any other hours of use of the New Ulm Community Center by Lutheran Social Service shall require prior approval of the City. Likewise, the City may request use of the Cafetorium during these times in order to provide space for community meetings and other gatherings. City may use or permit use by others of those areas at any other time. 5. a. Insurance: At all times throughout the term of this Lease, Lutheran Social Service shall maintain at a minimum the following insurance coverage from financially solvent insurance carriers approved by the City. i. Statutory worker’s compensation coverage; ii. Commercial General Liability Insurance - $2,000,000 combined single limit, written on an occurrence basis, insuring Licensee against claims for bodily injury, death or property damage arising out of its general business activities (including automobile or vehicle use), and including endorsements to include contractual liability; ii. Any other insurance coverages required by state or federal laws or regulations applicable to Licensee. 2 City of New Ulm/Lutheran Social Service Lease – 07/25/24 Page 13 of 22 b. Lutheran Social Service must cause certificate(s) of insurance evidencing the required coverages to be provided to the Public Works Director 30 days prior to the Commencement Date and every annual anniversary date thereof. The issuer of the certificate of insurance must provide the City ten days' written notice, by certified mail, prior to cancellation, non-renewal, or material change in the insurance policy(ies). If Lutheran Social Service fails to give such certificate of insurance to the City within ten days after execution of this Agreement, this Lease shall be null and void. If Lutheran Social Service fails to maintain a policy of insurance as required by the City for the term of this Agreement, the City may immediately revoke this Lease and require the Lutheran Social Service to restore the Premises to its preexisting condition or better. c. All insurance required by this Lease must be primary insurance and not in excess of or contributing with other insurance which Lutheran Social Service or its designee may carry. All policies, excluding worker's compensation policies, must name the City as an additional insured. The applicable insurance policies required by this Lease, must apply separately to City as if separate policies had been issued to Lutheran Social Service and the City. d. The amounts of all required insurance policies must not be deemed a limitation of Lutheran Social Service's covenant to indemnify City, and if Lutheran Social Service or City becomes liable in an amount in excess of the amount(s) of said policies, then Lutheran Social Service must indemnify City from the whole thereof, except in the event of negligent or willful misconduct on the part of City, its officers, or employees. e. With respect to Lutheran Social Service's workers compensation insurance, it is specifically understood by and between the parties that all times under this agreement and all employees, agents, and servants of Lutheran Social Service who participate in the meals program or in any other way authorized by this agreement shall be deemed to be employees of Lutheran Social Service and not of the City of New Ulm, for the purpose of determining worker's compensation liability. 6. a. Indemnification of City: Lutheran Social Service shall indemnify, protect, save, hold harmless and insure City, and its respective officers, employees and members and agents, from and against any and all claims and demands for, or litigation with respect to, all damages which may arise out of or be caused by Lutheran Social Service or its agents, employees, contractors or subcontractors with respect to Lutheran Social Service's performance of its obligations under this Agreement or its presence on or use of the Premises, or that of Lutheran Social 3 City of New Ulm/Lutheran Social Service Lease – 07/25/24 Page 14 of 22 Service's employees, members, board, officers, agents, sub-lessees, volunteers, clients and invitees. Lutheran Social Service shall defend the City against the foregoing, or litigation in connection with the foregoing, at Lutheran Social Service's expense, with counsel reasonably acceptable to City. City, at its expense, shall have the right to participate in the defense of any Claims or litigation and shall have the right to approve any settlement, which approval shall not be unreasonably withheld. The indemnification provision of this Section shall not apply to damages or other losses proximately caused by or resulting from the negligence or willful misconduct of City. All indemnification obligations shall survive termination, expiration or cancellation of this Agreement. b. Assumption of Risk: Lutheran Social Service knows, understands and acknowledges the risks and hazards associated with using the Premises for the purposes stated herein and hereby assumes any and all risks and hazards associated therewith. Lutheran Social Service, for itself and its agents and invitees, hereby irrevocably waives any and all claims against the City or any of its officials, employees or agents for any bodily injury (including death), loss or property damage incurred by Lutheran Social Service as a result of Lutheran Social Service's or its agents' or invitees' use of the Premises or presence within Community Center, and hereby irrevocably releases and discharges the City and any of its officials, employees or agents from any and all claims of liability. 7. A complete inventory of equipment provided and used by Lutheran Social at the New Ulm Community Center will be provided to the City at the beginning of the contract period, and any changes thereto will be promptly reported in writing to the City. a. Except to the extent that the City has reviewed and approved such list of equipment provided by Lutheran Service, all food service storage and preparation furniture, fixtures and equipment located at the New Ulm Community Center shall be deemed to be the sole and exclusive property of the City. 8. Lutheran Social Service shall make its equipment available to the City for use by it or such persons or organizations as it may designate upon reasonable notice and at such times and under such conditions as the parties may agree to and the circumstances may warrant. 9. Lutheran Social Service shall at all times be responsible for the maintenance and repair of equipment belonging to Lutheran Social Service, or belonging to the City and used by Lutheran Social Service, and shall keep and maintain such equipment in a safe and sanitary condition and shall be responsible for custodial activity associated with and resulting from their meals program. A memorial bench was installed at North Park by the lower playground. Teamwork makes the dream work; staff worked with Baseball Association volunteers to prepare for the two large Legion Baseball Tournaments happening the end of June and early July. Work is complete on the German Park fountain refurbish project and is expected to be filled and operating soon. Construction on the new Battery storage building located at the Trap Range started and is expected to be completed late summer. Approximately 608 youth and 1,148 adults visited Lincoln and Washington wading pools in June. Civic Center Private and Group Figure Skating lessons were offered through the New Ulm Figure Skating Club. A spring hockey league was offered by a group based out of the Twin Cities, as well as camps from various groups. Open Skate and Hockey sessions were offered to the Public. One unique event held at the Civic Center was a wedding couple who decided to forgo a traditional wedding dance and instead brought their group to our facility to skate. There are currently 9 annual memberships and 189 punch cards active. Community Center 600 N. German St. There were roughly 3,555 meals prepared at the Community Center in May. Approximately 44 percent of the meals were delivered to neighboring communities. Activities included Cheer Classes, bridal showers, graduation celebrations, a Wedding and a Community concert. The Community Concert series at German Park also started in June with the Concord Singers kicking off the line up on June 6, followed by the Ulmer Quartet, Bate Boots and Molly and Sonny Boy. Concerts are held in German Park each THURSDAY evening at 7 p.m. This is a change from the past; they were previously offered Monday evenings. The Municipal Band held concerts in German Park on Wednesday nights. Infected ash trees were removed with additional dead tress removed. Crews finished installing playground safety mulch and did routine maintenance. July was an extremely busy month for baseball; there were only 9 of 31 where there was no play on either field. There was extensive use during the three major tournaments; Upper Midwest Classic July 4-7, Division 1, Senior League Substate July 24-27 and Tomahawk East tournaments July 28. With the extensive heat and use, we expect damage to the playing surface. Approximately 1,352 visited Washington Wading Pools and 807 Lincoln in July. The programming division offered three special events at the wading pools in July. There were 4 community concerts in German Park, including a children’s concert featuring Leonardo, which was co-sponsored by the Public Library, followed by The Original German Band, Wendinger Band and Schell’s Hobo Band for New Ulm Night Out. The Puppet Wagon and Rec on the Go provided additional opportunities for families to play before the concert! New Ulm Night Out was a FREE night featuring local food trucks, music, children’s games and public safety groups that promoted fun and safety. Themed youth camps were offered weekly in the Harman Park Shelter and youth sports programs continued throughout July.
