APPROVAL OF AGENDA 3.1 Motion was made by Gulden and seconded by K Johnson to approve the August 12, 2024 agenda. All voted in favor of the motion. Motion carried unanimously. 4. APPROVAL OF MINUTES 4.1 Motion was made by Gulden and seconded by Luneburg to approve the June 10, 2024 meeting minutes. All voted in favor of the motion. Motion carried unanimously. 5. CITY COUNCIL MEETING(S) RECAP – Director Schugel summarized the past month’s City Council Meetings and work sessions: August 6 2024 Regular – Approved use of Park and Recreation Fund Balance to replace Recreation Center Indoor Pool Recirculation Pump during the annual pool shut down. July 2, 2024 Regular – Approved the Veterans Memorial Concept at German Park. June 18, 2024 Regular – Accepted Park and Recreation related donations. 5.1 Motion was made by Jensen and seconded by Christian to receive and order filed this city council past action report. All voted in favor. Motion carried unanimously. 6. NEW BUSINESS 6.1 2025 Park and Recreation Fee Schedule Director Schugel presented the 2025 Park and Recreation Department proposed fees, explanation and list of free uses. He reminded Commissioners of the work session and items discussed merging the Rec and Civic Center memberships, condensing/simplifying the fees and fee increase for the first time in three years for Rec Center membership. After receiving, considering and commenting on the fees, a motion was made by Gulden and seconded by Luneburg to recommend the City Council adopted the 2025 Park and Recreation Department proposed fees. Motion carried unanimously. 6.2 Director Schugel presented a plan to the Commission recommending an increased daily fee for Lutheran Social Services rental of the Community Center kitchen and cafetorium rental fee to $54.11 per day, effective January 1, 2025. The group has been renting the kitchen and cafetorium for years to Page 5 of 19 prepare, serve on site and deliver off site meals to seniors in New Ulm and surrounding communities in Brown County. Staff recognizes this valuable service for seniors. Approximately 45 to 51 percent of meals prepared in the Community Center go to residents of other cities. Kristy Altman, Area Director. They are receiving a 5 percent cut for older adult services, which will affect their services. They are looking at those most in need. Commissioners asked several questions concerning funding from other communities, cost/fee per person, donations, proposed fee. LSS is requesting no fee increase for 2025. They also asked if LSS requests funding from Brown County or any neighboring communities. She said they get some funding on individual need, but not from the county or other cities. In the past, City Council members have asked LSS to seek funding from other cities with residents receiving subsidized meals in order to assist LSS with the daily fee. The City of New Ulm provides and pays for kitchen appliances, furnishings, fixtures, custodial supplies and services in the building, grounds and parking lots, softener salt, utilities, refuse and recycling and LSS office space at a cost of approximately $100 per day. Motion was made by Gulden and seconded by Jensen to recommend increasing LSS rental fee to $54.11 per day, effective January 1, 2025. Motion carried unanimously. 6.3 Statewide Health Improvement Partnership (SHIP) Grant Application The approval for a $3,000.00 SHIP grant application to fund Smoke Free signage in parks and recreational facilities is requested. The city implemented a Smoke-Free (including tobacco and cannabis) policy effective January 1, 2024. The grant, if successful would cover the full cost for the signage that would be installed by PR maintenance staff. Motion was made by K Johnson and seconded by Gulden to recommend the City Council approve the SHIP grant application. Motion carried unanimously. 6.4 New Shade Structure – Dog Park The Realtor Association of Southern Minnesota was interested in helping fund an amenity that is in a public space accessible by the community. A new shelter at the Dog Park rose to the top of the list supplied by the Park and Recreation Department. The current structure, a pergola , is in need of replacement. The funding will go toward a new steel 14’ x 14’ shelter and concrete structure pad, funded through the Dog Park Improvement Fund. A motion was made by K Johnson and seconded by Christian to recommend the City Council offer a resolution and waive the reading to accept the donation for a new shade structure at the Dog Park, 527 S. German St. Motion carried unanimously. 6.5 Hermannfest 2024 – annual request for Community Celebration Motion was made by Jensen and seconded by Gulden to recommend the City Council offer a resolution and authorize the requests made by the Hermann Monument Society for Hermannfest Saturday, September 7, 2024 in Hermann Heights and Harman Parks. Motion carried unanimously. 6.6 Donations - A motion was made by K Johnson and seconded by Gulden to recommend the City Council offer a resolution and waive the reading to accept the following donations offered to the City of New Ulm’s Park and Recreation Department for the identified purposes: Page 6 of 19  1. REPORTS FROM COMMISSIONER AND STAFF 7.1 Department Activity Report • Heavy on youth programming, wading pools • National Recreation and Parks Association month; highlights what we do • New Ulm night out • Department is providing intern position for the Hans Joohs candidate Christian made a motion to receive and order filed the June and July activity reports. Luneburg seconded. The motion passed unanimously. 7.2 Director Schugel highlighted additional items: • NU-CAT produces a Park and Rec. show highlighting the department. The first show was produced in July. It is a simple staff conversation highlighting department and is a good way for the public to meet staff, receive updates on projects and what is happening. • City Strategic plan is progressing with assistance from Bolton and Menk. Board/Commission Recommendation: Overview: 1. The City of New Ulm Park and Recreation Department receives inquiries from private businesses, individuals and corporations interested in sponsorship of programs, facilities and other aspects of parks and recreation business. 2. Currently there is not a policy that sets guidelines for sponsorship agreements involving the City. 3. This policy would provide staff direction when when sponsorships opportunities become available. 4. Sponsorship opportunities can be another form of revenue generation for Park and Recreation. 5. Park and Recreation Commission and City Council will have final approval of sponsorship proposals. Primary Issues/Alternatives to Consider: Draft policy has been reviewed by City Attorney. Budgetary/Fiscal Issues: N/A Attachments: Naming Rights Policy NU Park and Recreation (Proposed Draft) Page 10 of 19 City of New Ulm Parks, Trails and Recreation Facilities/Program Sponsorship Policy Section 1: Introduction 1.1 New Ulm Park and Recreation receives inquiries from private businesses, individuals and corporations interested in sponsorship of programs, facilities and other aspects of parks and recreation business. The City welcomes partnership opportunities that enhance our ability to deliver parks and recreation services as long as the services and products of those businesses, if applicable, are consistent with and appropriate to our mission. 1.2. This policy sets out guidelines such sponsorship agreements. 1.3. Sponsorships are distinct from donations or gifts for which there is no recognition or compensation and to which this policy does not apply. 1.4. The decision to grant any requested sponsorship is at the City’s discretion and the City is under no obligation to approve any requested sponsorship. Section 2: Purpose 2.1. To outline the guidelines and procedures for entering into sponsorship or naming rights agreements. 2.2. To recognize that sponsorships provide an effective means of generating new revenues and alternative resources to support recreation facilities and programs. 2.3. This policy is not applicable to gifts, grants, or unsolicited donations in which no benefits are granted to the donor and where no business relationship exists. Section 3: Policy and Criteria 3.1. Sponsorship or naming rights agreements must comply with guidelines and procedures set forth in the policy. 3.2. Sponsorships must support the mission and policies of City of New Ulm. 3.3 Sponsorships will not result in any loss of City of New Ulm jurisdiction or authority. 3.4 In general, businesses and organizations are eligible for sponsorships if they meet the following criteria: a) Support the City Park and Recreation Departments mission; b) Relate to the intent/purpose of the facility or park; c) Provide a positive and desirable image to the community; d) Enhance rather than detract from the design standards and visual integrity of the facility or event; and e) Benefits should be commensurate with the value of the sponsorship; Page 11 of 19 3.5 In general, the City shall not approve sponsorships if they relate to, or applications are received from the following: a) Companies whose business is substantially derived from the sale of alcohol, tobacco, cannabis, and other products regulated under Minnesota Statutes, Chapter 342, gambling, firearms or pornography; b) Religious or political organizations; and c) Businesses regarded as “Adult Uses” defined in Chapter 13.3 of the Zoning Ordinance of the City of New Ulm; 3.6 The Park and Recreation Director, Park and Recreation Commission and City Council may also consider the following when evaluating a proposal: a) The timeliness or readiness of the sponsor to enter into a sponsorship agreement; b) The operating and maintenance costs associated with the proposal; and c) The sponsor’s record of responsible environmental stewardship and past involvement in community and City projects. 3.7 The City shall not consider or approve any sponsorship which: (1) creates a conflict of interest with the City; (2) conflicts with or contradicts any policy or ordinance of the City; or (3) adversely affects the City’s reputation. 3.8 The City reserves the right to reject any sponsorship proposal. 3.9 The sponsorship agreement shall require that any approved sponsor must indemnify, hold harmless, and defend the City against claims or damages that may arise out of the approved sponsorship according to the terms set forth in that agreement. Section 4: Sponsorship Categories 4.1. Site-Specific Program Sponsorship: A neighborhood business, local merchant or local branch of a corporation sponsors a time limited event or program at an individual recreation facility. 4.2 City wide Program Sponsorship: A neighborhood business, local merchant or local branch of a corporation sponsors a time limited program that is held at multiple recreation facilities or has a citywide presence. 4.3 Temporary Logo or Recognition Display Sponsorship: A sponsorship agreement that includes a display of recognition on park property for more than several calendar days and less than one year. 4.4 Naming Rights Sponsorship: A sponsorship that includes the naming of a facility or portion of a facility by a neighborhood business, local merchant or local branch of a corporation. In addition to the criteria set forth in this policy, all naming rights sponsorships shall be subject to evaluation by the City and the execution of a naming rights agreement in a form acceptable to the City on a case-by-case basis. Page 12 of 19 4.5 This policy does not apply to advertisement agreements with local user groups and associations within the City-operated facilities. The City of New Ulm Park and Recreation Department reserves the right to enter advertisement agreements with local user groups and associations within City operated facilities. These agreements are separate and no subject to this policy. Section 5: Responsibility 5.1 The City Council is authorized to enter into sponsorship and naming rights agreements and may designate such authority to the City Manager. 5.2 The Park and Recreation Director will seek approval from the Park and Recreation Commission on proposed sponsorship and naming rights agreements. 5.3 The Park and Recreation Director will not seek approval of a sponsorship or naming rights agreement affecting a city facility or special program or event without seeking input from the Park and Recreation Commission. Section 6: Signage and Advertisement 6.1 Advertising: The type, location, size, design, content and duration of any advertising, advertising display or sponsor recognition is subject to approval by the City and therefore will be specified in the relevant agreement and any applicable permit or contract. 6.2 Signage: Allowed signage and recognition display details, including type, location, size, design, content and duration of display, if permitted, will be a component of the sponsorship or naming rights agreement and must comply with all applicable ordinances and sign permitting requirements; additional signage requests shall require approval by the Park and Recreation Director. 6.3 Billboards: Freestanding billboards are not allowed in park facilities. 6.4 Sponsored Materials: All sponsored products, materials and services require the Park and Recreation Director’s approval and must meet the specifications and standards used by City of New Ulm in the purchase of similar materials. 6.5 Employee Participation: No City employee is required to wear clothing with corporate logos or advertising. 6.6 Youth Programs: Businesses and merchants may sponsor youth recreation programs (soccer, t-ball, etc.) and are not subject to this sponsorship policy. 6.7 Any depiction which gives the appearance or impression that a product or business is endorsed or recommended by City or its officers, agents, or employees shall not be permitted. Section 7: Procedures 7.1 All sponsorship proposals must be submitted in writing to the Park and Recreation Director on a form provided by the City. 7.2 The Park and Recreation Commission will provide comments and a recommendation to the Park and Recreation Director on all submitted proposals. Page 13 of 19 7.3 The Park and Recreation Director along with City Manager will take recommendations to City Council for formal approval of the sponsorship agreement. 7.4 The City reserves the right to terminate an existing sponsorship agreement if, in its sole discretion, continuation of the sponsorship is not in the best interests of the City. A new foundation was poured for a shelter at the Dog Park. Pickleball replacement project was completed and courts were open early August. The Tomahawk East playoffs were held at Johnson August 3 and 10. The Brewers finished their regular season games August 19 and are off to the playoffs. Attendance at the wading pools dropped significantly in August; around 372 visited Washington and 233 Lincoln in August. This is approximately 25% of July’s numbers. The wading pools closed for the season on August 18. There were 5 community concerts in German Park. Rec on the Go provided additional opportunities for families to play before the concert! All youth summer programming concluded. Civic Center Summer ice has been busy 5 of 7 days per week for various hockey and figure skating programs. Open Skate and Hockey sessions were offered to the Public. There are currently 13 annual memberships and 171 punch cards active. The New Ulm Area Faith Community and Brown County Fair both had events in the South Arena. Community Center 600 N. German St. There were roughly 3,443 meals prepared at the Community Center in July. Approximately 43 percent of the meals were delivered to neighboring communities. The Park and Recreation Commission is recommending a 3% fee increase for LSS effective January 1, 2025. The Indoor pool was closed for the week of August 26 for deep cleaning, pump replacement, warranty work on the tot slide and repainting areas.
