March 21, 2024
MINUTES
A regular meeting of the Newport Board of Adjustments was held on Thursday, March 21, 2024,
at 4:30 p.m. at the Newport Municipal Complex, 998 Monmouth Street, Newport, Kentucky.
In attendance were:
Steve Mathisen, Susan Whitehead, Nikki Bishop, Ed Davis, Stephanie Steffen, Planning and

The applicant requests a dimensional variance for a fence at 80 Home Street, Newport, KY
41071.

Comments:
Planning and Development Director Brian Steffen presented the City’s findings to the
ot Board.
Tim O’Hara, 80 Home Street, briefly described the fence he is building. He also provided
photos of his property to the board.

Steven Mathisen moved, seconded by Ed Davis, to approve application BA -24-02 for the
dimensional variance for the property at 80 Home Street for a specific 48 inches for the entire
project because this property has unique dimensions. The size of the property and its use as a
pet park justifies this. In addition, it will not obstruct the view when constructing the fence.

Before this case proceeded, Assistant City Manager John Hayden advised the Board that Board
member Nikki Bishop would recuse herself from this case (BA-24-03.) Ms. Bishop was involved
in the original transfer of the property to the Housing Authority. She is doing this out of caution. It

is also noted that Bill Kreutzjans is part of the Planning & Zoning Commission and is involved in
this case. It’s not a conflict for him to come forward to present this case.

The applicant is requesting a side yard setback variance to construct attached single-
family dwellings for the property located at 179 Grandview Drive, Newport, KY 41071

Correction to the address. This is a lot known as Grandview School Block PIDN # 999-999-36-948.00

The Planning and Development Director advised the board of the city’s findings. The
Board received the site plans for the entire project, but tonight, the Board is here only to
approve a side yard setback variance for two units in this proposed development, which

are on the far south end of the property.
Bill Kreutzjans with Ashley Builders presented his case to the Board.
Chris Maloney, 229 Main Street, voiced his concerns about the project and the use of the
alley for parking cars.

A motion by Steve Mathisen, seconded by Stephanie Steffen, to approve case BA-24-03 for two
side yard setback variances on the width of three feet to zero feet for two units on the Grandview

School lot. Given that the current view-shed easement limits placement significantly limited, they
will do their best to orientate these units. In addition, the property itself has had some issues with
the landscape and topography, which the Builder will address. Lastly, the Builder is doing their
due diligence to address limited on-street parking. That granting this variance at this location will
be in harmony with the general purpose and intent of the Ordinance as well as the adopted
Comprehensive Plan for the City of Newport. It will not be injurious to the neighborhood or
ot
otherwise detrimental to the public welfare. It will not adversely affect the public health, safety, or
welfare. It will not alter the essential character of the general vicinity. It will not cause a hazard or
nuisance to the public. It will not allow an unreasonable circumvention of the requirements of the

zoning regulations.
