CITY OF NEWPORT BOARD OF ADJUSTMENTS February 15, 2024 MINUTES A regular meeting of the Newport Board of Adjustments was held on Thursday, February 15, 2024, at 4:30 p.m. at the Newport Municipal Complex, 998 Monmouth Street, Newport, Kentucky. In attendance were: Steve Mathisen, Susan Whitehead, Ed Davis, Stephanie Steffen, Nicki Bishop, Planning and op Development Director Brian Steffen, Assistant City Manager John Hayden, and City Clerk Tiffany Myers. Vote on a Chairperson: y A motion by Ed Davis, seconded by Steve Mathisen, to approve Susan Whitehead as the Chairperson. All parties, including the applicant, City staff, Board Attorney, and those in support and opposition of the applicant, have a right to give testimony and cross-examination. An Public Hearing: BA-24-01 The applicant is requesting a Dimensional Variance for the property located at 1301 Monmouth Street, Newport, KY 41071 ot Requested by: Land Design & Development Inc., Mike Hill N Comments: Planning and Development Director Brian Steffen provided the Board with the city’s findings for requesting a dimensional variance for the property at 1301 Monmouth Street. Attorney Dan Hunt, representing Mike Hill, the developer, provided the Board with a handout of their plans (see attached). Page 2|3 Resident Don Spaulding, 25 15th Street, requested the developer to keep LED lights and the brightness of these lights in mind. This was an issue in that area in the past. Also, he questioned if this variance is the same as the variance for the street. Planning and Development Director Brian Steffen advised that this is a separate issue. A motion by Steve Mathisen, seconded by Ed Davis, to approve the 35ft side yard setback variance (15 ft on both sides) reducing the required 50ft side yard to 15ft for the following reasons: The property owner/applicant cannot acquire additional land to eliminate the need for op the variance. The strict application of the zoning ordinance would probably be the reasonable use of the property due to the 50ft required side yard setback. Utility easements exist on the property that are not a result of the applicant’s actions. The proposed setbacks for the project are in kind with similar buildings in the same. y That granting this variance at this location will be in harmony with the general purpose and intent of the Ordinance as well as the adopted Comprehensive Plan for the City of Newport. It will not lC be injurious to the neighborhood or otherwise detrimental to the public welfare. It will not adversely affect the public health, safety, or welfare. It will not alter the essential character of the general vicinity. It will not cause a hazard or nuisance to the public. It will not allow an unreasonable circumvention of the requirements of the zoning regulations.
