CITY OF NEWPORT, KY SPECIAL MEETING OF THE BOARD OF COMMISSIONERS Thursday, August 31, 2023 MINUTES Call to Order: A special meeting was called to order by Mayor Guidugli Jr. on August 31, 2023, at 7:00 p.m. op and held via video teleconference via the Zoom meeting application with a live stream to the City’s Facebook page for public viewing. In attendance via video teleconference were: y Commissioner Radwanski, Commissioner Smith-Morrow, Commissioner Rechtin, Vice Mayor Fennell, Mayor Guidugli Jr., City Manager Thomas Fromme, City Attorney Dan Braun, Lt. Col. lC Herschel Day, Fire Chief Frank Peluso, Planning and Development Director Brian Steffen, City Clerk Tiffany Myers. City Attorney Dan Braun stated this special meeting is being held in a replacement of the regular meeting originally scheduled for Monday, August 28, 2023, due to a COVID outbreak ca causing various members of the Board of Commissioners being unable to physically attend. As a result of such, in order to comply with the notice of requirements contained within the KY Open Meetings Act, this special meeting is being properly held by means of a video teleconference as indicated on the agenda. O-2023-009 An AN ORDINANCE OF THE BOARD OF COMMISSIONERS OF THE CITY OF NEWPORT, KENTUCKY AMENDING SECTION 93.63 OF THE CODE OF ORDINANCES CONCERNING OUTDOOR DINING AND/OR DRINKING UPON CITY SIDEWALKS AND/OR RIGHTS-OF-WAY AND PROVIDING A PENALTY FOR THE VIOLATION THEREOF. A motion by Commissioner Rechtin, seconded by Commissioner Smith-Morrow, to approve Ordinance O-2023-009 as read. ot Comments: City Manager Thomas Fromme stated that this ordinance has been a two-year process. This N ordinance was revised numerous times, especially during the COVID-19 pandemic. Recently, when talking to residents and owners, they wanted to allow residential bars/restaurants to participate. This Ordinance will be enforced, and it will have strict closing times. Comments: y City Manager Thomas Fromme said Ordinances 10-12 are housekeeping items. Ordinance 10 is changing titles and allowing additional front office staff. Ordinances 11 and 12 split up the Code and Planning & Zoning Departments to be stand-alone departments. O-2023-015 AN ORDINANCE OF THE BOARD OF COMMISSIONERS OF THE CITY OF NEWPORT, KENTUCKY CREATING SECTION 130.26 OF CHAPTER 130: OFFENSES AGAINST PUBLIC PEACE AND Page 4|6 DECENCY OF TITLE XIII, GENERAL OFFENSES, OF THE CODE OF ORDINANCES REGARDING THE REQUIREMENT TO SECURE FIREARMS LEFT UNATTENDED IN ANY VEHICLE AND CREATING A PENALTY FOR VIOLATION THEREOF. A motion by Commissioner Radwanski, seconded by Vice Mayor Fennell, to approve Ordinance O- 2023-015 as read. Comments: Lt. Col. Day stated that in 2022 there were 18 firearms thefts. Out of 18 thefts, 13 vehicles had op firearms in plain sight. This Ordinance will help keep these guns off the streets and out of the wrong hands. So far this year, we have only had 4 firearms stolen from vehicles. O-2023-016 AN ORDINANCE OF THE BOARD OF COMMISSIONERS OF THE CITY OF NEWPORT, KENTUCKY, REPEALING, IN FULL, SECTIONS 32.060 THROUGH 32.080 OF THE CODE OF ORDINANCES AND RE-ENACTING THE SAME SECTIONS 32.060 THROUGH 32.081 ffi THEREOF REGARDING THE HISTORIC PRESERVATION COMMISSION. O A motion by Vice Mayor Fennell, seconded by Commissioner Smith-Morrow, to approve Ordinance O-2023-016 as read. Comments: An Planning and Development Director Brian Steffen said there has been speculation that this ordinance has to do with the Buena Vista Local Historic District, but it does not. This has to do with historical activity within the city. This process started with looking into adopting Buena Vista as a historic district, but some things needed to be corrected after looking into our ordinances and state statutes. Wendy Moeller with Compass Point Planning helped us examine our ordinance to ensure we follow the correct protocols. These changes are reflected in this ot ordinance tonight. One difference is how the city adopts its local historic districts by involving the Planning and Zoning Department.
