CITY OF NEWPORT, KY REGULAR MEETING OF THE BOARD OF COMMISSIONERS Monday, August 19, 2024 MINUTES Call to Order: Mayor Guidugli Jr. called a regular meeting to order on August 19, 2024, at 7:00 p.m. in the op Multipurpose Room of the Newport Municipal Building at 998 Monmouth Street. The meeting was opened with a silent invocation and the Pledge of Allegiance. In attendance were: y Commissioner Radwanski, Commissioner Smith-Morrow, Commissioner Rechtin, Mayor Guidugli Jr., City Attorney Daniel Braun, Police Chief Christopher Fangman, Fire Chief Frank lC Peluso, and City Clerk Tiffany Myers. Absent was Vice Mayor Fennell. PUBLIC FORUM  ca Brant Owens introduced himself as a candidate for Campbell County Soil and Water District Supervisor. APPROVAL OF MINUTES ffi A motion by Commissioner Smith-Morrow, seconded by Commissioner Rechtin, to approve the Regular Meeting minutes from July 22, 2024, and Special Meeting minutes from July 30 and August 5, 2024, as presented. Motion carried- so ordered. NEW BUSINESS O FIRST READING OF COMMISSIONERS ORDINANCE NO. O-2024-17 An AN ORDINANCE OF THE BOARD OF COMMISSIONERS OF THE CITY OF NEWPORT, KENTUCKY, PERMITTING MEDICAL CANNABIS BUSINESS OPERATIONS WITHIN THE JURISDICTIONAL BOUNDARIES OF THE CITY OF NEWPORT, KENTUCKY A motion by Commissioner Radwanski, seconded by Commissioner Smith-Morrow, to approve Ordinance O-2024-17 as read. ot Roll Call: Commissioner Rechtin Commissioner Radwanski No Yes N Mayor Guidugli Commissioner Smith-Morrow Motion 3-1. Motion carried- so ordered. Yes Yes Comments:  City Manager Fromme advised the Board that there were only three options that we, as a city, could choose from: opt-in, vote to put on the November ballot, or opt-out. During the legislative session, the State passed the use of Medical Cannabis; this law will be in effect on January 1, 2025. This law restricts how and where a dispensary could be in a city and how one can apply to Page 1|3 receive medical cannabis. Also, if the city were to pass this, there is no guarantee that a medical cannabis shop would open in the city because it is a lottery. If the Board decides to pass this, the city must update the zoning to reflect the changes.  Charles Williams, a Newport resident, stated he is against this.  Jerry Peluso, Newport resident and business owner, is against this. Comments: lC  Wade Johnston, Executive Manager with Tristate Trials, stated that this order is for the final action plan. Much hard work has gone into this transportation plan. R-2024-57 ffi AN ORDER OF THE BOARD OF COMMISSIONERS OF THE CITY OF NEWPORT, KENTUCKY, AUTHORIZING THE EXECUTION AND DELIVERY OF AN ASSIGNMENT OF LEASE, CONSENT O TO ASSIGNMENT AND ESTOPPEL CERTIFICATE, AN ESTOPPEL CERTIFICATE, AND AMENDED AND RESTATED HOME OFFICE PAYMENT AGREEMENT, AN AMENDED AND RESTATED INTERCREDITOR AGREEMENT AND OTHER COMMERCIALLY REASONABLE INSTRUMENTS AND AMENDMENTS AND RELATED DOCUMENTS IN ACCORDANCE THEREWITH RELATING TO THE $13,500,000 CITY OF NEWPORT, KENTUCKY, TAXABLE An INDUSTRIAL BUILDING REVENUE BONDS, SERIES 2014, (LOT B HOTEL PROJECT) TO FACILITATE THE SALE AND ASSIGNMENT OF THE LOT B HOTEL PROJECT AND TAKING OTHER ACTIONS IN FURTHERANCE THEREOF. A motion by Commissioner Rechtin, seconded by Commissioner Smith-Morrow, to approve Order R-2024-57 as read. ot Comments:  City Manager Fromme advised that we must transfer the IRBS since Aloft has changed ownership. Page 2|3 CITY MANAGER COMMENTS  Thanked the Board for their leadership in the bike plan.  I will write an article for the Voice News about the tax rate. The city will see a decrease of .45 cents. We plan to have the first reading in September before our regular BOC meeting and the second reading at the regular BOC meeting on September 23.  There have been many complaints about the Campbell County PVA evaluations this year. This was Newport’s year for assessments, and the city has nothing to do with this. BOARD OF COMMISSIONERS' COMMENTS Commissioner Radwanski: op y  Reminded everyone about the September Mammoth Music and Arts Festival and the Car Show in October. Mayor Guidugli: lC  Purple People Bridge will hopefully open in a few weeks. However, we do not have a definitive date for its official reopening.  Many cities have been dealing with complaints about the Campbell County PVA ca assessments and the procedures for how these are conducted. This has made it to KLC to review for the legislative session. ADJOURNMENT ffi A motion by Commissioner Radwanski, seconded by Commissioner Smith-Morrow, to adjourn the meeting.
