The request is consistent with the Framework for the Future 2030 Comprehensive Plan land use map and compatible to the surrounding uses. Schools and community centers are community facilities located in the P1 Park district. The proposed amendment will allow them to install electronic display signs in a park district with the issuance of a conditional use permit. On February 1, 2017, the City Planning Commission voted unanimously 7:0 to recommend approval of the sign ordinance text amendment. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Newport News, Virginia: That Chapter 33.01, Signs, of the Code of the City of Newport News, Virginia, Article I., General Regulations, Section 33.01-6.1, Electronic display signs, be, and the same hereby is, amended and reordained, as follows: CHAPTER 33.01 SIGNS ARTICLE I. GENERAL REGULATIONS Sec. 33.01-6.1. Electronic display signs. (a) Electronic display signs shall conform to the provisions of this section, to all applicable general regulations as stated in Article I of this section, and to all applicable sign regulations of the district in which the electronic display sign is located; except, that such signs shall not be allowed as building signs, though electronic display marquee signs shall be permitted. (b) Electronic display signs shall be permitted as free standing signs in the following manner: (1) By right in conjunction with commercial and/or industrial uses, except that such non- conforming uses in residential districts may not use electronic signs; (2) By conditional use permit in conjunction with multiple family facilities. (3) By conditional use permit in conjunction with community facilities in a residential or park district. (c) No electronic display sign shall be allowed in conjunction with any use or establishment unless such use or establishment is allowed to have a freestanding sign under applicable district sign regulations, and no such sign shall be allowed in any historic district. In addition, no electronic display sign visible from and within 250 feet of any portion of a single or multiple family dwelling district shall be illuminated between the hours of 10:00 p.m. and 6:00 a.m. (d) Electronic display signs shall conform to the following requirements: (1) No more than one such sign shall be permitted on any developed site; (2) The entire sign structure, including the structure surrounding the sign face, shall not exceed ten (10) feet; (3) The area encompassing an electronic display sign shall not exceed thirty-two (32) square feet per sign face. (4) No such sign shall advertise or direct the attention of the general public to an establishment, business or service that is located on a separate site from the site on which the sign is located; (5) All electronic displays shall remain static for a period of at least five (5) seconds, and automatic change sequences shall be accomplished by means of instantaneous re- pixelization. Flashing, scrolling, blinking or any other type of intermittent illumination of elements of the display shall be prohibited; (6) Audio speakers on, or electronically connected to, such signs shall be prohibited; (7) The illumination of such signs shall be no greater than 10,000 nits or foot candles from sunrise to sunset or 700 nits or foot candles between sunset and sunrise, and shall be equipped with automatic brightness control which will operate at all times the display is lit, and which can further dim the display’s brightness when ambient conditions do not require the maximum allowed brightness. Prior to the issuance of a sign permit, the applicant shall provide written certification from the sign manufacturer that the light intensity has been factory pre-set not to exceed the maximum intensity level and the owner/operator understands and agrees to these restrictions. BACKGROUND: Berkley Preservation, L.P. desires to acquire and renovate two existing apartment complexes consisting of 373-units known as Berkley West and Berkley Village, at 800 and 900 Daphia Circle. In order to assist with the financing of the project, Berkley Preservation, L.P. sought the NNRHA's issuance of Multi- family Housing Revenue Bonds in an amount not to exceed $43 million. The NNRHA approved a resolution at its January 17, 2017 Board meeting for issuance of the bonds and held the required public hearing. Statutory provisions require that the highest elected governmental unit of the locality must approve the issuance of the bonds. WHEREAS, the Newport News Redevelopment and Housing Authority (the “Authority”), was created pursuant to the Virginia Housing Authorities Law (the “Act”), found in Chapter 1, Title 36, Code of Virginia of 1950, as amended (the “Virginia Code”), and is now existing and operating as a public body corporate and politic, and the Act empowers the Authority to issue its notes or bonds in accordance with the provisions of the Act for the purpose of making loans for the prevention and elimination of slum or blighted areas, for assistance in housing construction or rehabilitation by private sponsors and to refund prior obligations issued for any such purposes; and WHEREAS, Berkley Preservation, LP, a Delaware limited partnership (the “Borrower”), has applied to the Authority for the issuance of not to exceed $43,000,000 of the Authority’s Multifamily Housing Revenue Bonds (Berkley Apartments), Series 2017 (the “Bonds”), to provide financing for the acquisition, rehabilitation and equipping of a 373 unit, 31.27 acre affordable multi-family residential rental seniors and disabled housing project comprised of 46 two-story garden apartment buildings and 3 one-story auxiliary buildings, known as Berkley West and Berkley Village Apartments, the funding of debt service and other reserve funds and the payment of issuance and other transaction costs (collectively, the “Project”); and WHEREAS, the Borrower, which will commence the Project promptly following the issuance of the Bonds, has its principal place of business at Fairstead Affordable, 152 W. 57th Street, 36th Floor, New York, New York 10019, in the City of New York, New York; and WHEREAS, Section 147(f) of the Internal Revenue Code of 1986, as amended (the “Code”), requires, among other things, the approval by this Council of the issuance of any new issue of private activity bonds after the Authority has held a public hearing to consider the issuance of such bonds as one of the acts required in order for the interest on such bonds to qualify for exemption from the imposition of federal income tax; and WHEREAS, pursuant to due notice, the Authority has, on January 17, 2017, conducted a public hearing on the application of the Borrower for the issuance of such Bonds in compliance with the requirements of Section 147(f) of the Code, Section 15.2-4906 of the Code of Virginia of 1950, as amended, and Section 2 of Chapter 514 of the Acts of Assembly of 1983, and after such public hearing did adopt a resolution to issue an amount not to exceed $43,000,000 of its tax-exempt bonds, subject to the adoption of this resolution; and  WHEREAS, pursuant to Section 146 of the Code, Title 15.2, Chapter 50 of the Virginia Code and the 2017 Virginia Private Activity Bond Allocation Guidelines, promulgated by the Virginia Department of Housing and Community Development (“DHCD”), an allocation from the “State ceiling” (as defined in Section 146 of the Code) limitation on the volume of private activity notes or bonds which may be issued in the Commonwealth of Virginia in 2017 (“Volume Cap”) must be granted by DHCD, in its capacity as Allocation Administrator, in order for the interest on the Bonds to be exempt from the imposition of federal income tax, for which allocation of Volume Cap an application must be submitted by the Authority to DHCD; and WHEREAS, the Authority has recommended that the Council approve the issuance of the Bonds and support the Authority’s application to DHCD for an allocation to the Bonds of a portion of the State ceiling of Volume Cap; and WHEREAS, a Fiscal Impact Statement complying with the requirements of Section 15.2- 4907 of the Virginia Code and Section 2 of Chapter 514 of the Acts of Assembly of 1983, a record of the public hearing held by the Authority, and a copy of the Authority's resolution approving the issuance of the Bonds, subject to the terms to be agreed upon, have been filed with the Council. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NEWPORT NEWS, VIRGINIA: 1. The Council hereby finds that the recitals in the preambles hereto are found to be true and correct in all respects, and are adopted as findings of this Council as if fully rewritten herein. 2. That the Project proposed to be financed by the issuance of the Bonds is deemed appropriate for such financing, and, accordingly, the Council approves the issuance of the Bonds by the Authority. 3. That the Council supports the Authority’s application to DHCD for one or more allocations for the Bonds totaling $43,000,000 of the State ceiling of Volume Cap. 4. The approval of the issuance of the Bonds, as required by Section 147(f) of the Code and by Virginia Code, does not constitute an endorsement to a prospective purchaser of the Bonds of the creditworthiness of the Project or the Borrower. 5. The Bonds shall provide that neither the City nor the Authority shall be obligated to pay the Bonds or the interest thereon or other costs incident thereto and that neither the faith and credit nor the taxing power of the Commonwealth of Virginia, the City of Newport News, or the Authority is pledged to the payment of the principal of the Bonds or the interest thereon or other costs incident thereto.  6. In adopting this resolution, the City, including its elected representatives, officers, employees and agents, shall not be liable for, and hereby disclaim all liability for, any damages to any person, direct or consequential, resulting from the Authority’s failure to issue the Bonds for any reason. 7. This resolution shall be in effect on and after the date of its adoption, February 28, 2017. H. Accommodations include pedestrian signal indications, pushbuttons, ADA compliant sidewalk ramps, and pedestrian signage and pavement markings. The appropriation request for this program is $373,535. Bright Lights, Safe Nights Street Lighting Program: This program identifies and funds new lighting in areas currently not served by streetlights as well as reviews existing locations for streetlight upgrades to bring the lighting levels up to current City standards. The appropriation request for this program is $140,000. Neighborhood Enhancement Program: This program is intended to fund a wide variety of projects in residential areas identified through citizen and staff collaboration. The neighborhood program provides funds for physical improvements such as traffic calming, sidewalks, roadway reconstruction, playground, trees, handicap accessibility, enhancement of greenways and bikeways. Traffic Signal Upgrade and Installation: The traffic signal upgrade program funds new traffic signals and converts older traffic signals consisting of wooden or old metal poles and span wire.
