CU-2018-0002, TO MITCHELL KIRSNER AND ELITE PAWN SHOP, LLC., FOR THE OPERATION OF A PAWN SHOP ON PROPERTY AT 10117 JEFFERSON AVENUE, ZONED C1 RETAIL COMMERCIAL. BACKGROUND: Elite Pawn Shop is seeking to relocate from 10011 Jefferson Avenue to 10117 Jefferson Avenue and purchase the building. The current location, once vacated, opens the potential for another pawn shop due to the location's grandfathered status. The Police Department objects to the pawn shop citing a detrimental impact upon public safety and quality of life for the neighborhood and residents of the area. The request is not consistent with the Framework for the Future 2030 Comprehensive Plan neighborhood commercial designation and vision for safe neighborhoods. On May 2, 2018, the Planning Commission voted 4:3 to recommend denial. WHEREAS, application number CU-2018-0002 has been made by MITCHELL A. KIRSNER, owner, and ELITE PAWN SHOP, LLC, applicant, for a conditional use permit for the hereinafter described property for the purpose of the operation of a pawn shop in a C1 Retail Commercial District; and WHEREAS, the application has been referred to the Planning Commission of the City of Newport News for recommendation and has been duly advertised as required by law and the said Planning Commission has made its recommendation. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Newport News: (a) That conditional use permit number CU-2018-0002 is hereby granted for the property described in paragraph (b) hereof for the purpose of the operation of a pawn shop in a C1 Retail Commercial District; and (b) That the property, hereinafter referred to as the "Property," to which the conditional use permit applies is particularly described below: Beginning at a point on the westerly side of Jefferson Avenue located 289.44 feet north of the northwesterly intersection of Village Parkway and Jefferson Avenue and from said point of beginning thus established, running thence along the westerly side of Jefferson Avenue N 26°23'00" W 92.43 feet to a point; thence S 63°37'00" W 135.10 feet to a point; thence S 52°57'00" E 55.75 feet to a point; thence S 26°23'00" W 42.57 feet to a point; thence N 63°37'00" 110.17 feet to the point or place of beginning, all as shown and designated as PARCEL “B” on that certain plat entitled “BOUNDARY LINE ADJUSTMENT PLAT OF THE PROPERTY OF JESSIE R. PARKER AND PEGGY S. PARKER”, dated September 11, 2001, made by Davis & Associates, Surveyors and Planners, which said plat was recorded in the Office of the Clerk of the Circuit Court for the City of Newport News, Virginia, on October 26, 2001, as instrument number 9951. The Property has a common street address of 10117 Jefferson Avenue and Real Estate Assessor’s Tax I.D.# 259.00-01-09. (c) That this conditional use permit is granted subject to the following conditions, each of which shall be implemented upon approval of this ordinance: 1. The applicant shall install no more than one freestanding sign on the Property. The sign shall be a monument style not to exceed eight (8) feet in height, including the base, and the sign area limited to fifty (50) square feet. The sign shall be located within the Property. The design of the freestanding sign and any landscaping proposed around it, as well as all building signs, shall be submitted to the Department of Planning and approved by the Director of Planning prior to the issuance of a sign permit. No electronic display, temporary or portable signs shall be permitted on the Property. 2. Signage placed in or on any window of the building shall be limited to no more than 25 percent of each window. 3. All outdoor storage and displays of saleable items shall be prohibited. 4. The applicant shall adhere to all local and state laws pertaining to the regulation of pawn shops. 5. The applicant shall cause a plan (“the Plan”) to be prepared for the installation and operation of digital video equipment (the “Equipment”) with recording devices and capability sufficient to include date and time the recording is made. The Equipment shall provide surveillance coverage encompassing the front, side and rear exteriors of the use permitted by this ordinance. The Plan shall be submitted for review and approval by the Police Department. The Plan shall include an operational period for the Equipment, which shall include all operating hours of the business and one hour or more after the close of business. Once the Plan is approved, the applicant shall install the Equipment in accord with the provisions of the Plan; and operate, record, and maintain the Equipment to provide for the required surveillance coverage. The Equipment and recordings made thereby shall be subject to periodic inspection by the Police Department at reasonable times. Commencement of the use authorized by this conditional use permit shall constitute acceptance of the conditions of this permit, including consent for such inspections. Surveillance tapes or recorded data must be maintained in a condition permitting review of the information recorded or stored therein or thereon for a period of time no less than thirty days. 6. The applicant, as well as successors, assigns and agents, if any, shall comply with all of the conditions stated herein, as well as all codes, ordinances and regulations of federal, state and local governments. 2 7. The applicant, as well as successors, assigns, and agents, if any, shall obtain all necessary licenses, approvals, conditional approvals, and permits prior to commencing any use, which is authorized by this conditional use permit or law. Furthermore, the applicants, as well as successors, assigns, and agents shall maintain all necessary licenses, approvals, conditional approvals, and permits for the entire period of time during which the real property, whether improved or otherwise is put to a use which is authorized by this conditional use permit. 8. A Certificate of Use and Occupancy shall be obtained prior to the occupancy of, or the operation of, any use of the Property. If applicable, the use approved by this conditional use permit shall not begin until a site plan is approved and fully implemented. If applicable, any landscaping component of the site plan shall be maintained in a healthy condition for the duration of the use authorized by this permit. 9. Violation of any of the above conditions or safeguards attached thereto shall be deemed a violation of the Zoning Ordinance, and, in addition, and notwithstanding any other provision of law, shall serve as grounds for revocation of the conditional use permit by City Council. 10. Notwithstanding any other provision of law, this conditional use permit is being approved due, in part, to the mitigating effects of each and every condition attached hereto; therefore, the conditions contained in this conditional use permit are not severable; in the event that any condition contained herein, or part thereof, is found by a court of competent jurisdiction to be invalid, unconstitutional, or otherwise unenforceable, then this conditional use permit shall be void and the use permitted by this conditional use permit shall cease. If this conditional use permit becomes void as a result of a condition or a part thereof, or conditions therein, being ruled invalid, unconstitutional or otherwise unenforceable, the property owner shall be afforded the right to reapply for a conditional use permit. 11. Notwithstanding any other provision of law, this conditional use permit is being approved due, in part, to the mitigating effects of each and every condition contained herein; as such, in the event an amendment to the zoning of the property described in Section (b) hereof is produced by a comprehensive implementation of a new or substantially revised Zoning Ordinance, the conditions imposed by the conditional use permit shall continue in effect. (d) That this conditional use permit shall be deemed to have been abandoned and shall be revoked: ` 3 1. If the construction of the improvements or occupancy authorized by this conditional use permit has not commenced within twenty-four (24) months of May 22, 2018, or, 2. In the event of the continuous nonuse of the property as herein permitted for a period of twelve (12) months. 4 E. Public Hearings 2. CU-2018-0004 TO CHRISTOPHER CROSSING APARTMENTS, LLC, FOR THE INSTALLATION OF AN ELECTRONIC DISPLAY SIGN IN CONJUNCTION WITH MULTIPLE FAMILY FACILITIES ON PROPERTY LOCATED AT 11054 WARWICK BOULEVARD, ZONED C1 RETAIL COMMERCIAL. BACKGROUND: The proposed sign meets all the regulatory requirements cited in the sign ordinance for electronic display signs. It is compatible with surrounding uses and consistent with the Framework for the Future 2030 Comprehensive Plan land use map. Resolution Approving the Consolidated Plan for Housing and Community Development Annual Action Plan for Fiscal Year 2018-2019 ACTION: A REQUEST TO APPROVE A RESOLUTION APPROVING THE CONSOLIDATED PLAN FOR HOUSING AND COMMUNITY DEVELOPMENT ANNUAL ACTION PLAN FOR THE CITY OF NEWPORT NEWS, INCLUDING THE PROPOSED USE OF COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) AND HOME INVESTMENT PARTNERSHIP FUNDS (HOME) FOR FY 2018-2019 AND AUTHORIZING SUBMISSION OF THIS PLAN TO THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT (HUD). ATTACHMENTS: Description CM Memo re FY2018-2019 Annual Action Plan FY2018-2019 Annual Action Plan Documents sdm16215 Approving the Consolidated Annual Action Plan CITY OF NEWPORT NEWS OFFICE OF THE CITY MANAGER May 16, 2018 TO: The Honorable City Council FROM: City Manager SUBJECT: Consolidated Plan for Housing and Community Development - Annual Action Plan FY 2018-2019 The FY 2018-2019 update to the Consolidated Plan for Housing and Community Development has been prepared and is ready for the required approval of City Council. This document will be submitted to the U. S. Department of Housing and Urban Development (HUD) to identify the City’s needs for housing and community development, the resources available to meet the needs and the priorities for directing the resources. HUD's approval of this document enables the City to receive its annual entitlement grants of Community Development Block Grant (CDBG) and the HOME Investment Partnership (HOME). HUD requires that a five-year strategy document be developed and submitted on a regular basis. The latest five-year plan covered fiscal years 2016-2020 and was approved by City Council on April 28, 2015. For each year between the five-year cycles only an update, referred to as the Annual Action Plan (Action Plan) is required to be submitted to HUD. The current Action Plan includes the proposed use of funds for the upcoming FY 2018-2019 for CDBG and HOME. Entitlement grant amounts received last year for the CDBG and HOME programs were used for purposes of preparing the draft Action Plan that is out for public review. The recommendations were derived from the CDBG Application Committee. Eighteen proposals were received this year, totaling over $1.9 million in requests. Of those received, two were not recommended for funding and most of the requests to be funded were at a lower funding level than what was requested. The total projected CDBG budget for FY 2018-2019 is $1,591,136, which includes an entitlement grant amount of The Honorable City Council Page 2 Consolidated Plan for Housing and Community Development - Annual Action Plan FY 2018-2019 May 16, 2018 $1,257,434, $83,702 in prior year’s unbudgeted program income and $250,000 in general program income. The HOME Program description includes an initiative for rehabilitation of lower-income owner-occupied homes, an initiative for acquisition and rehabilitation of rental housing units and an initiative for down payment assistance for first-time homebuyers. Also included is the required set- aside for use by nonprofit affordable housing providers called Community Housing Development Organizations (CHDOs) and administrative funds. Funds designated for CHDOs are normally available to qualifying nonprofit groups on a first-come, first-served basis. The HOME budget is comprised of the entitlement grant amount of $786,711, coupled with estimated program income of $190,000, which gives a total of $976,711 available for recommended activities. The required local match is normally realized through in-kind sources and an annual cash contribution from the City’s budget. The total amount of projected funding formulating the FY 2018-2019 HUD-related Community Development Program budget is $2,567,847 for both programs. To recap, this includes $1,591,136 in CDBG-related funds and $976,711 in HOME-related funds. Public meetings regarding the Action Plan have been held at the Downing Gross Cultural Arts Center. The first meeting was December 5, 2017, and the second was May 3, 2018. The third and final public meeting and opportunity for citizens to be aware of the Action Plan is your May 22, 2018 City Council meeting. The required 30-day public comment period started on April 18, 2018 and will end May 18, 2018. No public comments have been received at this time. Department of Engineering – FY 2018 Bond Authorization, Stormwater Drainage Category: Construction of Lake Maury Spillway Improvements Projects – $3,163,000 ACTION: A REQUEST TO APPROVE A RESOLUTION APPROPRIATING $3,163,000 FROM THE FY 2018 BOND AUTHORIZATION, STORMWATER DRAINAGE CATEGORY FOR THE CONSTRUCTION OF THE LAKE MAURY SPILLWAY IMPROVEMENTS PROJECTS. BACKGROUND: The requested funds will addressed improvements to the dam for Lake Maury, to include the armor of the entire downstream dam embankment, and construction to control the lake level and discharge from the lake. In addition, an offshore stabilization will be executed prior to removal of shoreline vegetation based on the State Department of Conservation and Recreation's (DCR) requirements. The City Manager recommends approval.
