NORFOLK, VIRGINIA MEETING OF COUNCIL TUESDAY, AUGUST 26, 2025 Mayor Kenneth Cooper Alexander, called the meeting to order at 4:00 p.m., with the following members present: Mr. Carlos J. Clanton, Mrs. Courtney R. Doyle, Mrs. Mamie B. Johnson, Mr. Jeremy D. McGee, Mr. John E. Paige, Mr. Thomas R. Smigiel Jr., and Vice Mayor Martin A. Thomas Jr. AGENDA City Planning Update Presenter: Mr. Bobby Tajan, Director of City Planning Mr. Tajan reported as follows: City Planning Commission Zoning Text Amendment An amendment to the Zoning Ordinance to allow Recreation Facility, Outdoor use by Conditional Use Permit (CUP) in the I-L (Industrial-Light) zoning district and create additional performance standards. Mr. Tajan stated this request is by a property owner in the light industrial district who wishes to use a small portion of their lot for recreational purposes. The current Zoning Ordinance does not permit outdoor recreation fields. He emphasized that the amendment would strictly limit outdoor recreation to no more than 25% of the lot area and 2,500 square feet and would be limited to two years by Conditional Use Permit (CUP). The proposal, recommended by the Planning Commission on a 7-0 vote, was described as “opening the door just very slightly” to such uses, preserving the future industrial potential of the property. The City Planning Commission, by a vote of 7-0, recommends approval.  Allows for potential additional use on a small portion of a lot through the CUP process  Any CUP would expire after two years to preserve future industrial use of the property  Improvements are limited to ensure the use is temporary City Planning Commission Zoning Text Amendment Mr. Tajan stated a text amendment is proposed for the 21st Street and Colley Avenue Pedestrian Commercial Overlay (PCO) District, allowing restaurants serving alcohol to operate by right if they close by 11 p.m. This request originates from the Ghent Business Association and applies only to a limited area. Mr. Tajan provided a map and context for the district’s boundaries, noting the history of establishing this and he presented a list of certificates issued (2018-2022) and CUPs granted (2022-2025). -1- The City Planning Commission recommended this amendment on a 7-0 vote, aiming to make it easier for restaurants with no entertainment and closing by 11:00 p.m. to open more quickly while still having the proper tools to address locations with issues. The amendment can serve as a test before considering it in other PCO’s or parts of the city. City Attorney, Mr. Bernard Pishko, interjected with a caution: Entities whose Conditional Use Permits (CUPs) were revoked could then return and conduct by right closing by 11:00 p.m. Councilwoman Doyle suggested further historical review, stating, “We probably should look into that and know a little bit more of the history.” Mr. Tajan stated that staff would look at what was noted to ensure the text addresses it. Mr. Pishko stated he would verify whether an amendment to the text will require another Planning Commission vote. Colonna’s Shipyard, Inc., Conditional Rezoning Mr. Tajan presented a conditional rezoning request from Colonna Shipyard, Inc., for property at 344 West Indian River Road and 335 Emmett Place. The proposal is to change the site from its current designation of Planned Development River's Edge (PD-River’s Edge) and Multi-Family Neighborhood Scale (MF-NS) to Industrial Deep Water (I-DW). The site, currently a temporary parking lot, was previously designated for multi-family development but remained in industrial use. Mr. Tajan stated that the development never occurred, and the site has always supported industrial operations. Amending the comprehensive plan to its pre-2016 designation is appropriate. Mayor Alexander inquired whether any buildings or improvements are proposed. Mr. Tajan responded that the applicant had submitted no site plans to show what they are planning on the site. The applicant intends to remove a barge and remediate some environmental impacts from the site. If approved, Mayor Alexander asked what the permitted uses would be. Mr. Tajan stated industrial deep-waterfront activities, including shipbuilding, would be permitted, subject to stormwater and environmental requirements. He added that the applicant did not propose any buildings or use on the site at this time. Mayor Alexander asked if there are any setbacks from residential properties. Mr. Tajan answered yes, and that the most intense buffer we have is required, which is somewhere between 20 and 30 feet, for a landscape buffer from anything that has residential exposure. Councilman Paige stated he heard from Colonna’s that one of the things they want to do with this site is to mitigate sandblasting. He stated he’s been told this could decrease sandblasting by 40-50%. He asked if we can we get more information about this to share with citizens because it is important for this community partnership to work better than it has in the past. Mr. Tajan stated they had asked for that information, but currently Colonna’s has not provided it. Mr. Tajan stated that a temporary permit was required to refresh the gravel on the parking lot, and they had some environmental impact on that. That will be addressed in a plan that they will have to submit within 120 days. -2- Smigiel advocated for infrastructure improvements at Indian River Road and State Street, and road improvements by the apartment complex. He suggested a setback on the apartment building to prevent equipment placement too close to residential areas. Mayor Alexander stated there are at least four residential properties between Indian River Road and South Main Street. Mayor Alexander confirmed the time sensitivity of the matter, noting this is scheduled for a future meeting. He requested additional information for public clarity on decreased sandblasting to 40-50%, a new building, setbacks, screening, etc. Councilman Smigiel added that some of the site is needed for parking and as a lay-down area for ship parts. Hopefully, this will allow structures to be moved away from residential properties. Councilwoman Johnson confirmed that Colonna’s is a River Star business designation, clarifying it as an Elizabeth River Project designation and an environmental partnership with gold standards. Councilman Paige reminded the council to consider impacts on local churches and community organizations, particularly those near West Indian River Road where the shipyard may impact them. The City Planning Commission, by a vote of 6-1, recommends approval.  Zoning is appropriate due to the property’s proximity to the water, similar uses and limited direct exposure.  Proffered conditions correct current on-site erosion sediment control violation and will remove a dilapidated barge from the site.  Speakers in opposition discussed limited public input and current operations impacts on the neighborhood.  Commissioners recommended the applicant meet with others in the community to discuss concerns and potential solutions. Soulfull Vegan Events Conditional Use Permit Flea Market and Banquet Facility Mr. Tajan introduced a Conditional Use Permit request by Soulfull Vegan Events for a flea market and a banquet facility at 1200 East Little Creek Road. The applicant currently operates a retail space and has utilized temporary flea market permits. The proposal includes indoor and outdoor flea market operations from 9 a.m. to 7 p.m. (Monday-Saturday) and 8 a.m. to 7 p.m. (Sunday), with a banquet facility operating from 9 a.m. to 11 p.m. seven days a week. No alcohol or entertainment is offered, and the banquet facility is intended for small events associated with the flea market. Mayor Alexander requested a site map and clarification on adjacent properties. Mr. Tajan stated that behind the establishment is a residential home. Councilman Smigiel provided further details: “To the right is a vacant real estate office; to the left, a beauty salon and -3- office building. Parking is an issue, as permission has not been granted for people to park on adjacent lots, though people are doing it now.” Mayor Alexander asked about the floor plan and seating arrangements. Mr. Tajan described three layout options for vendors and food trucks, noting differences from previous temporary operations where the entire front area was blocked off for their food market. Councilman Smigiel expressed concern over past incidents: “A graduation party got out of control and police were called, and a temporary permit was not given for that event. The South Bayview Civic League hasn’t had the opportunity to really weigh in on the banquet facility, and there are two applications that came through. We’re coordinating a meeting with the owner.” Mayor Alexander clarified, “They have used all their temporary flea market permits. We will consider a permanent flea market and possibly a banquet facility. Let’s prepare to separate these applications.” Mr. Tajan confirmed, “Staff notified them of permit limits, and the South Bayview Civic League called a special meeting scheduled for September 11th to allow the applicant to come and discuss their items, and with staff attendance.” The City Planning Commission, by a vote of 6-1, recommends approval of the Conditional Use permit.  No alcoholic beverages on the premise or live entertainment are proposed as a part of the banquet hall.  The banquet hall and flea market will not operate at the same time.  The CUP for the banquet hall will expire in two years.  South Bayview Civic League provided a letter of opposition with concerns of traffic and noise impacts.  City staff are facilitating an additional meeting between the operator and the community. Conditional Use Permit: Faughnan Hauling Mr. Tajan presented a Conditional Use Permit request by Faughnan Hauling for an automobile storage facility in addition to the proposed by-right contractor’s office at 2770 Saint Julian Avenue. The site, zoned Industrial-General (I-G), and the operator plans on utilizing the property for a by-right contractor's office, a hauling contractor, but also requests a Conditional Use Permit for stored automobiles and recreational vehicles. The site is located at the end of Saint Julian Avenue, adjacent to the city's facility but with no direct access. To the south are railroad tracks and city-acquired properties. The City Planning Commission recommended limiting hours of operation (6 a.m. to 10 p.m.) and restricting commercial vehicle traffic (6 a.m. to 5 p.m.), with a three-year expiration. The recommendation passed on a 5-2 vote, with dissenting commissioners citing concerns that the community did not know of the proposed changes in operation. -4- Conditional Use Permit: Kryptohaus, LLC Short-Term Rental Mr. Tajan described a request by Kryptohaus, LLC, to operate a short-term rental at 1069 Rugby Street, which is an existing single-family home. The applicant installed improvements without permits, including an accessory structure with a kitchen and bathroom. There are very few short-term rentals in this area. He added that until the applicant corrects their violations, they will not be scheduled for a public hearing. The Planning Commission recommended denial (7-0) until violations are corrected, citing neighbors in opposition and ongoing commercial operations on the site, which staff has investigated and provided a violation notice for. Update: Text Amendment Accessory Dwelling Units Conditional Use Permit Mr. Tajan provided an update on the proposed changes. Staff reached out to civic organizations through flyers and letters to civic leaders via Neighborhood Services and received mostly positive feedback or feedback in favor of the changes. The amendment would allow accessory units in all residential districts except in multi-family apartment complex districts, either by right or by Conditional Use Permit. The City Planning Commission, by a vote of 6-0, recommends approval.  Consistent with plaNorfolk2030 and public comments received during three public outreach phases of NFK2050  Provides diversity of housing with minimal impacts to surrounding properties and neighborhood  Updates regulations with best practices  Only permitted by-right in areas where existing single-family residence meets zoning regulations and owner lives on the property Update: NFK2050 Plan Mr. Tajan briefly updated the Council on the NFK2050 Plan, which is proposed to come forward to the City Planning Commission for public hearing and final public comment at the end of September. He reported ongoing positive feedback from both the public and stakeholders, expressing optimism about the plan’s potential to drive city improvements. Appeal: Denial of Certificate of Appropriateness 709 West Princess Anne Road Mr. Tajan presented an appeal for denial of a Certificate of Appropriateness (COA). The applicant had applied for an after-the-fact COA for several items but most notably the replacement of 30 windows at the property. The Architectural Review Board approved most items, but they denied the window replacements (8-1 vote) because they did not match the historical character of the original windows, and, at a minimum, did not have the internal consistency in their design, including whether they could open or not, their having multiple light patterns, or being full panes of glass. -5- Mr. Pishko advised that this is just to give Council information and that the applicant will have an opportunity during the formal session to tell Council why they think their appeal should be granted. CLOSED SESSION Motion for a closed session was approved at 4:35 p.m. for purposes which are set out in Clauses 8 and 29 of subsection (A) of Section 2.2-3711 of the Virginia Freedom of Information Act, as amended: (8) Consultation with legal counsel pertaining to probable litigation that requires the advice of counsel.
