Rebecca Bean / Mark Howery Action needed: Motion to adjourn meeting Action Taken: _____________________________________________________________  Animal Welfare Oversight Committee December 10th, 2018 The Norman Animal Welfare Oversight Committee of the City of Norman, Cleveland County, State of Oklahoma, met in the Multi-Purpose room on the 10th day of December, 2018, at 6:00PM. The notice and agenda of the meeting were posted at the Norman Animal Welfare Center on 3428 South Jenkins on the 6th of December, 2018. The meeting was also posted on the City of Norman website at www.normanok.gov. I. Call to Order Chairperson Mark Howery called the meeting to order at approximately 6:04PM. II. City Attorney Major David Teuscher Mark Bechtel, Animal Welfare Manager Trey Amrein, Animal Welfare Supervisor III. Discussion & Approval of the November Minutes A motion to approve the minutes was made by Jennifer Kidney. Sandy Moore- Furneaux seconded. Motion passed. IV. Monthly Statistics Mark Bechtel briefly went over November statistics. He spoke about the length of stay metric dropping, so animals are moving through the shelter faster. The owner surrender wait list was back up to 36 animals needing to be surrendered. The shelter was trying to manage intakes because the number of animals being sent to Spay Way Thanksgiving week would be half the usual number due to the holiday. In a normal week, there are two days of surgeries with about twenty animals each day. Mark says they will have to consider this with the Christmas holiday week as well. Euthanasia is up in the month of November for aggression in dogs; Mark said he doesn’t have a reason for this. V. Review of Comments Received during Nov. 26 Public Meeting and Continued Discussion of Animal Welfare Ordinance Proposals Co-chairperson Mark Howery began by discussing the public meeting that was held to discuss the ordinances on November 26th. He liked the way that the discussion was organized by tiers dependent on the degree of change involved with each ordinance. Section 3-119 Exotic Wildlife and Native Wildlife. There was a discussion about moving the word fox to the wolf, jackal, and hyena section. Section 3-501 Keeping of Animals Other than Dogs and Cats Changes were made for grammatical problems. Section 3-205 Sale and Disposition of Animals There was a discussion about terminology and the processes involved with Returned to Field versus Trap/Neuter/Return. Section 3-407 Sale of Dogs and Cats There was a discussion about the sale of dogs or cats in parking lots and the ordinance language regarding public or private parking lots. Section 3-206 Relinquished Animals There was a discussion about what details were necessary for this ordinance or whether they were more related to Norman Animal Welfare policy rather than an ordinance. Rebecca Bean asked what the legal recourse is if a citizen doesn’t fill out an owner surrender questionnaire. Captain Barbour said that it would be a policy issue, and Mark Bechtel said he didn’t think there was an enforcement component to the questionnaire. Rebecca Bean asked on what days or times the shelter would want to restrict owner surrender intake. Mark Bechtel said that it would depend on labor and staff capabilities. Section 3-223 Altering of Dogs and Cats Co-Chairperson Mark Howery said he agreed with the staff recommendation to discard this ordinance due to public input. Co-Chairperson Rebecca Bean asked that in lieu of this ordinance, we might consider mirroring what the OKC shelter is doing and spaying/neutering an impounded animal before it could be reclaimed. There was a discussion about the cost of impounding an animal; even when an impounded animal is picked up by an owner only hours later, there is still a cost associated with the impoundment. Dr. Amy Tyler said that, for Norman, the number of additional surgeries that would result from mandatory a spay/neuter ordinance for reclaimed animals would be about 400 more surgeries per year. There was a discussion about additional funding for Best Friends of Pets for their low cost spay/neuter program and targeting specific areas in Norman for outreach and education on spaying and neutering. Section 3-301 Cruelty to Animals Co-chairperson Rebecca Bean asked about section I and the selling of dyed animals. There was a discussion about the exact language of item I. Captain Barbour said that it was covered in the first section. 3-305 Reporting Found Animals Co-Chairperson Rebecca Bean asked about reporting to the shelter versus reporting on social media. There was a discussion about the different ways to report found and lost animals. 3-401 Tethering Co-chairperson Mark Howery talked about the intent of the tethering ordinance to address situations where dogs are living their whole lives on a tether. Jennifer Kidney stated she was in favor of a tethering ordinance with exemptions made at the discretion of the Animal Welfare Officers. Dr. David Biles stated that to him, there is no good reason to tether an animal. Kristy Wicker spoke about the public meeting comments and said she didn’t think it would be a bad thing to have an anti-tethering ordinance with exemptions made for certain situations. There was a discussion about how it would be enforced if it became an ordinance. There was a discussion about the language used for collars and harnesses and what was the definition of a short duration in time. There was a consensus that Tethering Option One would be left in the ordinance changes. 3-4032 Confinement of Dogs and Cats Sandy Moore-Furneaux said she preferred option one that would keep cats indoors, as it would be safer for the cats themselves and wildlife. Kristy Wicker said that feral cats do have an impact on wildlife populations, but she thought option one was unenforceable. Kim Fairbanks said she thought option two was best. It was already in the ordinances and had a few revisions to it. Norman Animal Welfare and the Oversight Committee should make make an effort to provide more community education. Norman citizen Nathan Kuhnert spoke about being in favor of the Confinement of Dogs and Cats ordinance. He mentioned that the City of Tulsa also has an ordinance for the confinement of Dogs and Cats. His concern was for protecting local wildlife from outside cat populations. Officer Amrein spoke about how the current ordinance is enforced with respect to nuisance cats. There was a discussion about how all of the new ordinances should have a slow roll out with lots of public education. There was a discussion about the effect option one would have on the shelter statistics regarding the goal of no euthanasia of adoptable animals. 3-502 Use of Animals at Festivals, Carnivals, Parades, and Other Similar Events. This ordinance was to address the animals that are brought into the city for public events. There was a discussion about who would be required to have a permit. Major Teuscher said that Ordinance 3-502, part one, could be covered by a policy change at the parks and recreation department. Co-Chairperson Rebecca Bean spoke about some of the instances she has seen with animals that are brought in for public attractions. There was a discussion about omitting the word parade, so that there isn’t any interference with riders of horses in parades. There was a discussion about having a permit that would not allow exotic animals in parades. 3-505 Numbers of Snakes and Lizards Allowed There was a discussion about adding the word tortoise back into the ordinance. There were some small grammatical changes made to the ordinance. There was a discussion about codifying the TNR program and the difference between the words may and shall. The committee moved forward on voting to recommend several of the ordinances to put before the city council. Kristy Wicker made a motion to vote on recommending Section 3-301 Cruelty to Animals. Sandy Moore-Furneaux seconded. Motion passed. Sandy Moore-Furneaux moved to recommend Section 3-305 Reporting Found Animals to city council. Jennifer Kidney seconded. Motion passed. Rebecca Bean made a motion to forward option 1 of Section 3-401 Tethering as amended to city council. Jennifer Kidney seconded. Motion passed with six in favor, one against. Sandy Moore-Furneaux moved to advance section 3-403 Confinement of Dogs and Cats to city council with option one. Dr. David Biles seconded. Motion did not pass-- three in favor four against. Kristy Wicker made a motion to move forward 3-403 Confinement of Dogs and Cats option 2. Jennifer Kidney seconded.
