JOURNAL OF THE COUNCIL OF THE CITY OF NORWICH April 15, 2024 The regular meeting of the Council of the City of Norwich was held April 15, 2024 at 7:30 PM in Council Chambers. Present: Mayor Nystrom, President Pro Tem DeLucia, Ald. Gould,Ald. Bettencourt, and Ald. Hayes. Absent were Ald. Singh and Ald. Nash. City Manager John Salomone, Corporation Counsel Michael Driscoll were also in attendance. Mayor Nystrom presided. Please be advised that meetings of the Norwich City Council can be viewed in their entirety on the City of Norwich website “norwichct.org”. Ald. Gould read the opening prayer and Pres. Pro Tem DeLucia led the members in the Pledge of Allegiance. Mayor Nystrom called for citizen comment general. Jan Sawicki, 39 Andrea Ln., spoke with appreciation to the DPW department for a great job with the Spring 2024 Curbside Cleanup. There being no further speakers Mayor Nystrom declared the citizen comment closed. Mayor Nystrom called for the following public hearing on AN ORDINANCE AMENDING SECTION 9- 28 OF THE NORWICH CODE OF ORDINANCES BY AMENDING THE FEE TO BE CHARGED TO COMMERCIAL HAULERS FOR THE DISPOSITION OF SOLID WASTE AND ANY OTHER MATERIALS COLLECTED IN NORWICH AND DISPOSED OF AT FACILITIES OPERATED BY THE SOUTHEASTERN CONNECTICUT REGIONAL RESOURCE RECOVERY AUTHORITY There were no speakers. Hayes on a roll call vote it was unanimously voted to waive the reading of the full text and incorporate into the minutes this ordinance being given its second reading and action. Upon a motion of Ald. Gould seconded by Ald. Hayes on a roll call vote it was unanimously voted to adopt the following ordinance introduced by Mayor Nystrom, Pres. Pro Tem DeLucia and Ald. Gould. 1 JOURNAL OF THE COUNCIL OF THE CITY OF NORWICH April 15, 2024 AN ORDINANCE AMENDING SECTION 9-28 OF THE NORWICH CODE OF ORDINANCES BY AMENDING THE FEE TO BE CHARGED TO COMMERCIAL HAULERS FOR THE DISPOSITION OF SOLID WASTE AND ANY OTHER MATERIALS COLLECTED IN NORWICH AND DISPOSED OF AT FACILITIES OPERATED BY THE SOUTHEASTERN CONNECTICUT REGIONAL RESOURCE RECOVERY AUTHORITY WHEREAS, the City of Norwich is a party to a Municipal Service Agreement with the Southeastern Connecticut Regional Resource Recovery Authority (SCRRRA) whereby SCRRRA bills the city a charge to be referred to as a tip fee for materials generated in Norwich and brought to a SCRRRA facility for disposition; and WHEREAS, the SCRRRA tip fee per ton will increase by $6.56 effective July 1, 2024; and WHEREAS, the City of Norwich currently charges commercial haulers $70.00 for each ton of solid waste collected in Norwich and delivered to a SCRRRA facility. NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORWICH that items c. and d. of Sec. 9-28 of the Norwich Code of Ordinances be and hereby is amended as follows: Sec. 9-28. Permit for collection, transportation or disposition of solid waste and other materials. c. The charge to be imposed on commercial haulers by the city of Norwich for solid waste and other materials collected in Norwich and transported to the Lisbon Incinerator or to any facility operated by the Southeastern Connecticut Regional Resource Recovery Authority shall be $70.00 $77.00 per ton. d. This charge of $70.00 $77.00 per ton shall become effective July 1, 2023 2024. Purpose: To increase the tip fee per ton charged to commercial haulers. Upon a motion of Ald. Gould, seconded by Ald. Hayes on a roll call vote it was unanimously voted to waive the reading of the full text and incorporate into the minutes this ordinance being given its second reading and action. Upon a motion of Pres. Pro Tem DeLucia, seconded by Ald. Bettencourt on a roll call vote it was unanimously voted to postponed until June 17, 2024 the following ordinance introduced by Mayor Nystrom, Pres. Pro Tem DeLucia and Ald. Gould. AN ORDINANCE AMENDING SECTIONS 7-131.3 AND 7-132.4 OF ARTICLE VI OF CHAPTER 7 OF THE CODE OF ORDINANCES TO CORRECT THE LANGUAGE REGARDING PERMITTED USES OF GENERAL FUND UNASSIGNED FUND BALANCE AND TO REDUCE THE VARIANCE ACTUARIALLY DETERMINED CONTRIBUTIONS. WHEREAS, the general fund unassigned fund balance policy was intended to preclude the use of fund balance in place of normal operating revenues; and WHEREAS, the City has taken a number of measures to reduce the volatility of pension and other post-employment benefit contributions, such as reducing the assumed rate of return and utilizing more conservative actuarial assumptions; and 2 JOURNAL OF THE COUNCIL OF THE CITY OF NORWICH April 15, 2024 WHEREAS, it is in the best interest of the City to further reduce volatility by reducing the year-to- year variances in budgeted pension and other post-employment benefit contributions from 15% to 10%. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORWICH, that sections 7-131.3 and 7-132.4 be amended in Article VI of Chapter 7 of the Code of Ordinances: Sec. 7-131.3. Permitted uses of unassigned fund balance. UFB may be used to absorb operating deficits caused by unanticipated, unbudgeted revenue shortfalls or expenditure overages which cannot be mitigated by utilizing the contingency appropriation. UFB may shall not be used in the place of normal operating revenues in the annual budget process. To the extent that UFB exceeds 17 percent of the current fiscal year's budgeted expenditures and operating transfers, the council of the City of Norwich may appropriate, by ordinance, some portion of such excess for one or more of the following purposes: (a) Additional capital improvements beyond those required by Charter Chapter VII, Section 17 which can be demonstrated to reduce the future operating expenses of the city. (b) Make transfers to a bonded projects fund to pay for projects with authorized, but unissued debt. (c) Retire existing debt early. (d) Make employer contributions to the pension or other post-employment benefits trust funds above the amount required by section 7-132.4. (e) Fund projects and other expenditures for which the City of Norwich is authorized to incur indebtedness pursuant to Charter Chapter VIII, Section 1. Sec. 7-132.4. Contributions. (a) Generally. The city shall contribute the actuarially determined contribution ("ADC"), as defined by Government Accounting Standards Board Statements 68 and 75, each fiscal year unless the amount varies by more than 15 10 percent ± from the previous year. This variance shall be calculated by division (e.g., Norwich Public Utilities, Norwich Public Schools, Police, Fire, Volunteer Fire, and all other General City). (b) If the ADC is less than 85 90 percent of the previous year's contribution, the city shall contribute an amount equal to 85 90 percent of the previous year's contribution. (c) If the ADC is greater than 115 110 percent of the previous year's contribution, the city shall contribute an amount equal to 115 110 percent of the previous year's contribution. Purpose: To amend financial policies to correct the language regarding permitted uses of general fund unassigned fund balance and to reduce the variance from 15% to 10% for actuarially determined contributions. To: Mayor Nystrom and members of the City Council From: John Salomone, City Manager Subject: City Manager’s Report Date: April 15, 2024 Meetings attended were Connecticut Conference of Municipalities (CCM) Board of Directors Meeting, Southeastern Council of Governments Executive Committee Meeting (SCCOG) Southeastern Area Transit (SEAT), Connecticut Interlocal Risk Management Agency (CIRMA) Board of Directors 3 JOURNAL OF THE COUNCIL OF THE CITY OF NORWICH April 15, 2024 meeting NPU-City Coordination Meeting, NCDC Board of Directors meeting, and budget hearings. I also attended the swearing in of our two new police officer recruits – Alexis Freel and Dylan Beaudoin. Robert Scalise has been selected as Director of Human Resources to succeed retiring Director Brigid Marks. Rob started with the City on March 25th and has extensive experience in all areas of human resources administration. He formerly served as Director of Human Resources for the City of Meriden. Most recently, Rob served as Assistant Director of Human Resources for the City of Stockton, California and the Human Resources Manager for Labor and Employee Relations for the City of Santa Monica, California. Rob received a Bachelor of Arts from Boston College, a Master of Arts from the University of Chicago and a Juris Doctor from DePaul University College of Law. Public Works submitted a FY25 Congressionally Directed Spending (CDS) request, to Senators Blumenthal and Murphy, for $6.6M, representing 80% of the funds needed for the replacement of the New London Turnpike Bridge over the Yantic River. Last year $800K of CDS funds were awarded to the City for the design of the bridge replacement. The grants require a 20% local match, which will be funded from the Infrastructure Improvement Bond approved by voters in November 2023. The project replacing the floating docks on the Shetucket side of Howard Brown Park was completed this past week. The new docks are now open to the public, and include an 80 foot long ADA compliant ramp down to the docks. A ribbon cutting is scheduled for 9:00 am, on April 24th. The City will continue to pursue funds for the replacement of the smaller floating docks adjacent to the boat launch. Human Services’ Youth, Family, and Rec Division has released their new program book that is loaded with free programs, including free swim lessons this year. Camp registration is also open. Adult & Family Services is partnering again with NPU to co-host an awareness event about Utility Assistance Programs on April 16th at 5pm, right at NPU. Thank you to my assistant Jacquie Barbarossa, and the Mayors Secretary, Bonnie Cuprak, for hosting a tour of City Hall for a group of 17 students from Norwich Adult Education on March 25th. WHEREAS, the property owners listed below want to participate in a cost sharing program with the City of Norwich to construct concrete sidewalks along their property; and WHEREAS, the City of Norwich wants to improve sidewalks throughout the City. Relative to the school construction grant application for the construction of a new elementary school on the grounds of the Uncas Elementary School. WHEREAS, the voters of the City of Norwich approved the $385,000,000 School Construction Program bond ordinance #1820 by referendum on November 8, 2022; and 5 JOURNAL OF THE COUNCIL OF THE CITY OF NORWICH April 15, 2024 WHEREAS, one of the items authorized by ordinance #1820 is the construction of a new elementary school on the grounds of the Uncas Elementary School (“Project”); and WHEREAS, the City intends to apply for a School Construction Grant for the Project; and WHEREAS, the Office of School Construction Grants & Review of the Department of Administrative Services of the State of Connecticut requires that the legislative body of the City take the following actions prior to submitting a School Construction Grant Application for the Project: 1. Authorize its Board of Education to apply to the Commissioner of Administrative Services and to accept or reject a grant for the proposed Project, 2. Establish a building committee for the Project, and 3. Authorize the preparation of schematic drawings and outline specifications for the Project. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORWICH, that the Norwich Board of Education be and hereby is authorized to apply to the Commissioner of Administrative Services and to accept or reject a grant for the Project; BE IT FURTHER RESOLVED BY THE COUNCIL OF THE CITY OF NORWICH, that the School Building Committee established by the Council of the City of Norwich by resolution on January 21, 2020, as updated and amended from time to time, shall serve as the building committee with regard to the Project; and BE IT FURTHER RESOLVED BY THE COUNCIL OF THE CITY OF NORWICH, that the City hereby authorizes the preparation of schematic drawings and outline specifications for the Project. WHEREAS, on October 2, 2023 the Council of the City of Norwich adopted a resolution authorizing and directing City Manager John Salomone to enter into a Purchase and Sales Agreement with Ox Hill Land LLC to purchase property under terms and conditions acceptable to him and the corporation counsel and to provide for a sale to take place on or before December 31, 2023; and WHEREAS, no Purchase and Sales Agreement has been entered into at this time and the council wishes to extend the time to complete any purchase by the city to permit the incoming council to review this. Brown Park from 6:00 P.M. to 8:00 P.M. and the “Rockin the Green,” a Friday night series of acoustic concerts to be held at the Norwichtown Green from 6:00 P.M. to 8:00 P.M.; and WHEREAS, the “Rock the Docks” concert shall be held on the following dates: Wednesday, July 10, 2024 Wednesday, July 17, 2024 Wednesday, July 24, 2024 Wednesday, July 31, 2024 Wednesday, August 7, 2024 Wednesday, August 14, 2024 Wednesday, August 21, 2024 (Rain Dates if needed); and WHEREAS, the “Rockin the Green” acoustic concerts shall be held on the following dates: Friday, July 12, 2024 Friday, July 19, 2024 Friday, July 26, 2024 Friday, August 9, 2024 Friday, August 16, 2024 Friday, August 23, 2024 and Friday, August 30, 2024 (Rain Dates if needed); and WHEREAS, “Rock the Docks” and “Rockin the Green” will allow the entire community to enjoy a variety of music and entertainment at scenic locations; and WHEREAS, the Greater Norwich Area Business and Industry Foundation, Inc., established through the Greater Norwich Area Chamber of Commerce, proposes to make available beer and wine for sale during these concerts to patrons thereof at a location in Howard T. Brown Park and Norwichtown Green, subject to satisfactory proof that the Greater Norwich Area Business and Industry Foundation, Inc. has complied with the applicable regulations of the State Liquor Commission; that identification will be mandatory from each person purchasing an alcoholic beverage; that the sales of beer and wine will be made under a proper liquor license, and that proper insurances will be obtained and maintained by the Greater Norwich Area Business and Industry Foundation, Inc. and any vendor of beer and/or wine for the events. WHEREAS, Damm Creative, LLC has requested permission to hold various events in connection with a Rose Arts Festival to be held at Chelsea Parade on June 29, 2024, the event starting with a Children's Fun Run at 8:00 am and continuing with music and other entertainments through approximately 9:00 pm; and WHEREAS, Damm Creative, LLC proposes to sell and serve beer and wine at Chelsea Parade during the Festival with this service to be provided by a vendor holding an off-premises vendor liquor permit. NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORWICH, that Damm Creative, LLC be and hereby is permitted to use Chelsea Parade to provide the listed and other events to be held in connection with the Festival on June 29, 2024 at Chelsea Parade; and BE IT FURTHER RESOLVED BY THE COUNCIL OF THE CITY OF NORWICH, that, pursuant to section 13.14.2 of the Norwich Code of Ordinances, City Manager John L. Salomone be and hereby is authorized and directed to grant Damm Creative, LLC permission to sell beer and wine 9 JOURNAL OF THE COUNCIL OF THE CITY OF NORWICH April 15, 2024 at the Festival during the events to be held on June 29, 2024 at Chelsea Parade, subject to satisfactory proof that said sales are conducted by a vendor holding an appropriate liquor license and permit for said sales; that such sales be limited to the hours when such sales are permitted pursuant to the Connecticut General Statutes and the applicable regulations of the State Liquor Commission, and be made no later than 8:00 pm on June 29, 2024; that identification will be mandatory for each person purchasing beer and/or wine at the event; and that insurance coverage satisfactory to the city manager has been obtained and maintained by both Damm Creative, LLC and the vendor selling beer and wine pursuance to an appropriate liquor license and permit. WHEREAS, the Women’s City Club of Norwich proposes to install a small plaque at the tip of Monument Point identifying the 1889 water trough located there as having been originally located in Franklin Square before being relocated to its present location; and WHEREAS, the Women’s City Club of Norwich has requested the permission of the Council of the City of Norwich to install a plaque which will be made of cast metal with dimensions of 6”x9” on a 12”x12” stone base and placed adjacent to the water trough and bearing the following inscription: 1889 WATER TROUGH MAINTAINED BY THE WOMAN’S CITY CLUB OF NORWICH ORIGINAL SITE FRANKLIN SQUARE MOVED TO THIS SITE 1907 NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORWICH, that it approves the installation of the plaque as described herein and hereby also expresses its appreciation for the efforts of the Women’s City Club of Norwich in annually beautifying the water trough with flowers and plantings.
