DRAFT CITY OF NORWICH ZONING BOARD OF APPEALS SEPTEMBER 13, 2011 Meeting Minutes The regular meeting of the City of Norwich Zoning Board of Appeals was called to order at 7:05 p.m. Roll call was taken and it was determined that a quorum was present. PRESENT: Marc Benjamin, Chairman Joseph Jacaruso, Co-Chairman Paul Kramarewicz Henry Olender ABSENT: Dorothy Travers Raymond Dussault-Alternate ALSO PRESENT: Tianne Phoenix Curtis, Zoning Enforcement Officer Linda Lee Smith, Recording Secretary E. COMMUNICATIONS-NONE F. ACCEPTANCE OF MINUTES On a motion by Paul Kramarewicz/Joseph Jacaruso, it was voted unanimously to APPROVE the minutes of the June 14, 2011 and August 9, 2011 regular meetings. Prior to the opening of the Public Hearings, Chairman Benjamin explained the meeting’s procedure. As there were four members present, the decision of all appeals must receive a unanimous vote in order to pass. Applicants were allowed to option to be heard, or to table their appeal to the next regularly scheduled meeting. G. OLD BUSINESS Ms. Curtis stated for the record that all Old Business items had been tabled from the August meeting as a quorum had not been present; and had been noticed in compliance with C.G.S. 8-7(d). 1. V#11-10 – Request of April Rose for property located at 36 Pearl St. in a Multifamily (MF) zoning district. In accordance with Sec.3.9 Corner visibility, 3’ maximum fence height, request increase to 6’ for the construction of a privacy fence; Sec.5.6 Swimming pools, location within the front yard; Sec.12.1 Northerly front yard 25’ setback, request reduction to 2.5’; Westerly front yard 25’ setback, request reduction to 4’ for the construction of 15’ above ground pool. 1 of 11 Seated were, Marc Benjamin, Joseph Jacaruso, Henry Olender, and Paul Kramarewicz. The applicant stated for the record that they wished to be heard this evening, and understood they must receive a unanimous vote in order to pass. Ms. Curtis entered into the record Exhibits “A” – “H.” Speaking in favor was the property owner April Rose and Pamela Rose, 36 Pearl Street, Apartment 1. Ms. Rose told the Board she purchased the 15’ pool not realizing permits were needed. She was requesting a 6’ fence to prevent rocks from being thrown into the pool as well as to prevent their dogs from jumping up at people that may be walking by. Ms. Rose stated that her property is a corner lot, with a 10’ tree, 4 way stop, and no side or backyard. Ms. Rose stated the stop bar is 7’ from where the actual fence will be. She would be happy with a 5’ fence. Ms. Rose stated that, due to location of the existing parking spaces, handicap ramp, and electrical meter, there is no other place to put the pool. She stated their hardship having no other choice/place on the property to put the pool, and her medical condition in addition to the positive effect the pool creates for her son’s social skills due to his autism. There being no other speakers, the public hearing was closed. 2. V#11-11 – Request of Linda Kane for property located at 118 Rockwell St. in a Residential R-40 zoning district. In accordance with Sec.12.1, 10% maximum lot coverage, request increase to 12%; 50’ front yard setback, request reduction to 1’; 30’ Westerly side yard, request reduction to 14’; 30’ Easterly side yard, request reduction to 13’ for the construction of a 20’10” x 23’ 5” garage and 4’5” x 24’ porch. Seated were, Marc Benjamin, Joseph Jacaruso, Henry Olender, and Paul Kramarewicz. The applicant stated for the record that they wished to be heard this evening, and understood they must receive a unanimous vote in order to pass. Ms. Curtis entered into the record Exhibits “A” – “H.” Speaking in favor was Jim Bernardo, licensed land surveyor, 102A Spithead Road, Waterford, CT. The property is located at 118 Rockwell Street consisting of approximately 0.31 acres with a lot width of 69’. The existing house does not conform to current Zoning requirements with front and side setbacks. Mr. Bernardo stated Ms. Kane is requesting the variance for the construction of a garage and rooftop porch at the front of the property in addition to the existing garage. Mr. Bernardo noted the significant structural issues with the house that had been corrected. The Board stated their concerns of considering a reduction of the front yard setback to only 1’. Mr. Bernardo stated that, while the construction would need the 1’, Ms. Kane’s property line is located approximately 60’ from the actual street line. Mr. Bernardo referred to the property survey, Exhibit “G.” Mr. Bernardo stated the proposed location was the only feasible choice due to the existing ledge and steep slope. Photographs of existing conditions were submitted at this time and were entered in the record as Exhibit “I” by Ms. Curtis. Page 2 of 11 Linda Kane, homeowner, 118 Rockwell Street came forward to speak in favor and was available to answer any questions. Ms. Kane reiterated the above-listed hardships and noted the 60’ swath of City property her drive crosses to the curb cut of the City street. There being no other speakers, the public hearing was closed. 3. V#11-12 – Request of Sergio Casillas for property located at 20 Weber Farm Rd in a Residential R-40 zoning district. In accordance with Sec.12.1 30’ side yard, request reduction to 6’ for the construction of a 12’ x 16’ shed. Seated were, Marc Benjamin, Joseph Jacaruso, Henry Olender, and Paul Kramarewicz. The applicant stated for the record that they wished to be heard this evening, and understood they must receive a unanimous vote in order to pass. Ms. Curtis entered into the record Exhibits “A” – “I.” Speaking in favor was the property owner Sergio Casillas, 20 Weber Farm Road. Mr. Casillas stated he has owned the property for 5 years, and that the home was built on ledge. He stated that he needs a shed for personal storage, and the proposed location within his rear yard is the only level area. Mr. Casillas stated his hardships were the location of the septic and driveway, and noted the Uncas Health Dept. had approved the proposed location (Exhibit “E” as the only potential location. The Board questioned the conditions of the abutting lots. Mr. Casillas stated that one lot was undeveloped, and that both abutting properties are subject to the Residential R-40 lot requirements. There being no other speakers, the public hearing was closed. H. New Business 1. V#11-13 – Request of Kevin Daley for property located at 329 Canterbury Turnpike in a Residential (R-40) zoning district. In accordance with Sec.12.1 R-40 30’ Side yard required, request reduction to 5’ for the construction of a 10’x12’ shed. Seated were, Marc Benjamin, Joseph Jacaruso, Henry Olender, and Paul Kramarewicz. The applicant stated for the record that they wished to be heard this evening, and understood they must receive a unanimous vote in order to pass. Ms. Curtis entered into the record Exhibits “A” – “G.” Speaking in favor was the applicant Kevin Daley, and property owner Susan Daley-Clinton both of 329 Canterbury Turnpike. Mr. Daley stated the shed had already been constructed, as he didn’t realize a permit was needed. Mr. Daley Page 3 of 11 listed his hardship was the location of an engineered septic that had been recently installed and took up the majority of the yard. The Board questioned the impact to the abutting property. Mr. Daley said the nearest house is located 50’ from the shed. Mr. Daley added that the aesthetics of the shed will mirror the existing home and, while the shed hasn’t been anchored or strapped down, this will be completed at the time the building permit would be pulled. There being no other speakers, the public hearing was closed. 2. V#11-14 – Request of Virginia Hale for property located at 8 West Avenue in a Residential R-20 zoning district. In accordance with Sec.12.1 R-20 20% Lot coverage required, request increase to 28%; 30’ Front yard required, request reduction to 4’; 15’ Side yard required, request reduction to 1’ for the construction of a 23’x26’ carport. The applicant stated for the record that they wished to be heard this evening, and understood they must receive a unanimous vote in order to pass. Seated were, Marc Benjamin, Joseph Jacaruso, Henry Olender, and Paul Kramarewicz. Ms. Curtis entered into the record Exhibits “A” – “I.” She handed out copies of Exhibit “I’ photos submitted that evening and were not included in the packets. Speaking in favor was the property owner Virginia Hale, 8 West Avenue and Craig, last name and address unknown. Ms. Hale stated that Norwich Public Utilities is in the process of installing sewer lines on her street, and will need to tear down a large portion of her retaining wall in order to complete the installation. Ms. Hale stated she has no off street parking, and therefore needs the carport. She added that in the winter the cars are buried by snow and very difficult to get out. She listed her hardships as the preexisting location of the swimming pool, the close proximity of the home to the road, and the minimum 6’ apron to park their vehicles and motorcycles for protection. Ms. Hale noted that the proposed carport would not encroach any farther into the front yard setback as the existing house. She stated there is no opposition from her neighbors. There being no other speakers, the public hearing was closed. 3. V#11-15 – Request of Stephen Majeski for property located at 43 Canterbury Turnpike in a Residential R-40 zoning district. In accordance with Sec.3.24.1 to permit the use of a shared driveway for residential use. The applicant stated for the record that they wished to be heard this evening. Marc Benjamin recused himself on this application because of a conflict. This left only three members therefore a decision could not be made this evening. The Public Hearing portion could be conducted and testimony taken, and the decision tabled to the 10/11/2011 regular meeting. Seated were, Acting Chair Joseph Jacaruso, Henry Olender, and Paul Kramarewicz. Ms. Curtis entered into the record Exhibits “A” – “F.” Page 4 of 11 Speaking in favor was the applicant Stephen Majeski 33 Old Mill Road, East Hampton, property owner Richard Vendola, 248 Scotland Road, Norwich and Richard Deschamps of Advanced Surveys, LLC 25 Apple Lane Colchester. Mr. Majeski testified that their original surveyor, who was employed by CLA, had had discussions with City Staff no longer employed and able to verify the modified plan to approve the shared drive for which the variance was being sought. Ms. Curtis stated she was present on-site with then Planner Michael G. Schaeffer and then City Engineer Barry Ellison in response to a major erosion and sediment control issue, but to the best of her knowledge was not aware of any documents granting the construction of a shared drive or discussion thereof. Mr. Majeski stated his hardship that the shared drive has already been constructed to address anticipated sheet flow and runoff issues. Mr. Majeski stated the property to the south and southwest was in favor of the proposed drive as they were of the opinion it would correct the existing water problem. Mr. Majeski and Mr. Vendola stated the property was proposed to tie into City sewer and water, however issues beyond their control did not make this possible. The applicant stated the proposed easement would divide the responsibility of maintenance to the proposed drive 75%-25%. There being no other speakers, the public hearing was closed. Being there were only three members and not a quorum this decision would automatically be TABLED until the October 11, 2011 regularly scheduled meeting. 4. V#11-16 – Request of Randy Robinson for property located at 4 Barbers Road in a Residential R-80 zoning district. In accordance with Sec.12.1 R-80 60’Front yard required, request reduction to 52’; 40’ Side yard required, request reduction to 6’ for the construction of a 14’x15’ seasonal room and 14’x12’ deck. Seated were, Marc Benjamin, Joseph Jacaruso, Henry Olender, and Paul Kramarewicz. Ms. Curtis stated the Public Hearing was not be opened, and that the applicant had requested it be tabled until the 10/11/2011 regular meeting due to faulty abutters’ notices. On motion by Paul Kramarewicz and seconded by Marc Benjamin it was unanimously voted to TABLE the hearing to the October 11, 2011 regular meeting. 5. V#11-17 – Request of David Kendall for property located at 330 Canterbury Turnpike in a Residential R-40 zoning district. In accordance with Sec.12.1 R-40 50’ Front yard required, request reduction to 36’; 50’ Rear yard required, request reduction to 29’; 30’ southerly Side yard setback required, request reduction to 18’ for the construction of an18’x33’ pool and 25’x26’ deck. Seated were, Marc Benjamin, Joseph Jacaruso, Henry Olender, and Paul Page 5 of 11 Kramarewicz. The applicant stated for the record that they wished to be heard this evening, and understood they must receive a unanimous vote in order to pass. Ms. Curtis entered into the record Exhibits “A” – “H.” The Kendalls submitted five letters of support from neighbors. Ms Curtis entered these as Exhibits “I-M” to the record. The Board took a moment to review said exhibits. Speaking in favor were the applicants and property owners David and Amy Kendall of330 Canterbury Turnpike. Mr. Kendall stated they are requesting the variance in order to construct a deck and swimming pool. Mr. Kendall stated the hardships as the location of the recently installed septic system, slope at the rear of the property and preexisting lot size and home location. There being no other speakers, the public hearing was closed. 6. V#11-18 – Request of David Sanchez for property located at 6 Traders Court in a Residential R-20 zoning district. In accordance with Sec.12.1 R-20 30’ Front yard required, request reduction to 20’; 15’ Side yard required, request reduction to 5’ for the construction of a 21’x13’ carport. The applicant stated for the record that they wished to be heard this evening, and understood they must receive a unanimous vote in order to pass. Seated were, Marc Benjamin, Joseph Jacaruso, Henry Olender, and Paul Kramarewicz. Ms. Curtis entered into the record Exhibits “A” – “H.” Speaking in favor were Patrick Reed, 102 Prospect Street, and property owner David Sanchez, 6 Traders Court. Mr. Sanchez stated he has lived in this house for 30 years and is now 73 years old. He would like to add a carport at this time so he wouldn’t need to shovel snow off of his vehicle. Mr. Reed stated the proposed carport would be open on the sides and located on a portion of the existing drive. Mr. Sanchez stated his hardships were the preexisting location of the home and driveway. Ms. Curtis noted for the record that the submitted drawing of the carport appeared to propose 3 bays while in fact it is only 1. There being no other speakers, the public hearing was closed. 7. V#11-19 – Request of Richard Clark for property located at 3 Colony Court in a Residential R-20 zoning district. In accordance with Sec.12.1 R-20 30’ Front yard setback, request reduction to 27’; 15’ Side yard required, request reduction to 4’ for the construction of a 15’x24’ carport. Seated were, Marc Benjamin, Joseph Jacaruso, Henry Olender, and Paul Kramarewicz. The applicant stated for the record that they wished to be heard this evening, and understood they must receive a unanimous vote in order to pass. Ms. Curtis entered into the record Exhibits “A” – “F.” Page 6 of 11 Speaking in favor were property owners Richard and Lonila Clark. The Clarks submitted photos of existing conditions of the property. Ms. Curtis entered these into the record as Exhibit “G”. The Board took a moment to review said exhibits. Mr. Clark stated that they would like to construct the carport, as they currently have no cover for their vehicles. Mr. Clark noted they have been experiencing water issues in the basement as a result of water build up in the driveway, and they feel the carport will provide relief from this problem as well. Mr. Clark stated the proposed carport would be set back farther from the front property line then the existing house. There being no other speakers, the public hearing was closed. Discussion/Decisions on Applications 1. V#11-10 – Request of April Rose for property located at 36 Pearl St. in a Multifamily (MF) zoning district. In accordance with Sec.3.9 Corner visibility, 3’ maximum fence height, request increase to 6’ for the construction of a privacy fence; Sec.5.6 Swimming pools, location within the front yard; Sec.12.1 Northerly front yard 25’ setback, request reduction to 2.5’; Westerly front yard 25’ setback, request reduction to 4’ for the construction of 15’ above ground pool. Seated were, Marc Benjamin, Joseph Jacaruso, Henry Olender, and Paul Kramarewicz. Motion was made and seconded to accept the variance for discussion. Paul Kramarewicz stated the location of the pool was the only logical place and that the request for fence height appeared reasonable given the stated problems in the neighborhood. The Board was open to reducing the requested 6’ fence to 5’ should the variance go forward. Joe Jacaruso noted the property was a corner lot with 2 front yards and was in favor. Marc Benjamin stated he was not in favor as he felt they were asking for too much on too small a lot, there was no clear hardship, and regardless of fence height it would create a safety hazard at a 4-way intersection. Henry Olender stated while he was not in favor of the 6’ fence, the pool would be beneficial and the applicant had stated the pool would be taken down every year for the season. Motion was made by Paul Kramarewicz, seconded by Joseph Jacaruso to approve the application as presented. Marc Benjamin and Henry Olender opposed. FAILED (2-2) 2. V#11-11 – Request of Linda Kane for property located at 118 Rockwell St. in a Residential R-40 zoning district. In accordance with Sec.12.1, 10% maximum lot coverage, request increase to 12%; 50’ front yard setback, request reduction to 1’; 30’ Westerly side yard, request reduction to 14’; 30’ Easterly side yard, request reduction to 13’ for the construction of a 20’10” x 23’ 5” garage and 4’5” x 24’ porch. Seated were, Marc Benjamin, Joseph Jacaruso, Henry Olender, and Paul Page 7 of 11 Kramarewicz. The Board noted the 60’ setback from Rockwell Street is more than the required setback if this were the true property line. The Board was in agreement this qualified as a valid hardship, as well as the unusual topography and ledge. Marc Benjamin acknowledged the construction of a garage is reasonable use of the property, and lot coverage increase from 10-12% is insignificant. On a motion by Paul Kramarewicz, seconded by Marc Benjamin it was unanimously voted to APPROVE the variance. 3. V#11-12 – Request of Sergio Casillas for property located at 20 Weber Farm Rd in a Residential R-40 zoning district. In accordance with Sec.12.1 30’ side yard, request reduction to 6’ for the construction of a 12’ x 16’ shed. Seated were, Marc Benjamin, Joseph Jacaruso, Henry Olender, and Paul Kramarewicz. Marc Benjamin made a motion to approve the variance, given the stated hardships of site conditions, including the location of the septic, and unusual topography. Marc Benjamin noted a shed today for storage is almost a necessity, and the proposed location is the only reasonable site. On a motion by Marc Benjamin, seconded by Paul Kramarewicz it was unanimously voted to APPROVE the variance. 4. V#11-13 – Request of Kevin Daley for property located at 329 Canterbury Turnpike in a Residential (R-40) zoning district. In accordance with Sec.12.1 R-40 30’ Side yard required, request reduction to 5’ for the construction of a 10’x12’ shed. Seated were, Marc Benjamin, Joseph Jacaruso, Henry Olender, and Paul Kramarewicz. Motion was made by Paul Kramarewicz to approve the variance, given the recently installed septic system, and Uncas Health District approval for the proposed location. Marc Benjamin added that, given the size and location of the septic system, pool and fence, it appears any location would require a variance. On a motion by Paul Kramarewicz, seconded by Marc Benjamin it was unanimously voted to APPROVE the variance. 5. V#11-14 – Request of Virginia Hale for property located at 8 West Avenue in a Residential R-20 zoning district. In accordance with Sec.12.1 R-20 20% Lot coverage required, request increase to 28%; 30’ Front yard required, request reduction to 4’; 15’ Side yard required, request Page 8 of 11 reduction to 1’ for the construction of a 23’x26’ carport. Seated were, Marc Benjamin, Joseph Jacaruso, Henry Olender, and Paul Kramarewicz. Motion was made and seconded to grant. The Board discussed at length the proximity of the home to the street and the applicant’s lack of off-street parking as opposed to the surrounding homes. Paul Kramarewicz stated the proposed carport will provide shelter for their personal vehicles and would not be enclosed, and added that although they are requesting the 1’ setback, the home on the property to the south lies a considerable distance from the shared property line and appears to have a wooded buffer. Paul Kramarewicz pointed out there has been no opposition from the neighbors. Henry Olender and Marc Benjamin voiced their concerns relative to the excessive width (26’) of the proposed carport. The Board considered the potential of maximizing the excavation project to provide two bays, however similar proposals were at a smaller scale. The Board considered reducing the width to 16’, as the home had a 1-bay garage. Motion was made by Marc Benjamin, seconded by Joe Jacaruso to amend the motion for the construction of a 15’x23’ carport; all other requests remaining the same. Henry Olender stated he would like to approve a 16’x23’ carport, as the industry standard for a garage door is 8’ wide, allowing 2-bays. Chairman Marc Benjamin made a second amendment to the original motion for the approval of a Southerly Side Yard reduction from 15’ to 11’, Lot Coverage increase to 28% and Front Yard reduction to 4’ for the construction of a 16’x23’ carport. Chairman Marc Benjamin clarified with Ms. Curtis the setback requirement for the proposed retaining wall. Ms. Curtis stated that a freestanding retaining wall would be treated as a fence, requiring a minimum of 6” from the property line. Upon request of the Board, Tianne Phoenix Curtis, ZEO will require an as-built at the completion of construction. Amended motion carried. Variance APPROVED with amendment and condition. 6. V#11-15 – Request of Stephen Majeski for property located at 43 Canterbury Turnpike in a Residential R-40 zoning district. In accordance with Sec.3.24.1 to permit the use of a shared driveway for residential use. Seated were, Acting Chair Joseph Jacaruso, Henry Olender, and Paul Kramarewicz The Board determined the decision must be tabled to the October 11, 2011 regular meeting, as a quorum was not present. Chairman Marc Benjamin restated to the Board that he will continue to recuse himself and while the application will be up for discussion, no further testimony will be taken. Ms. Curtis noted to the Board that the members not present this evening and acting on the decision, must thoroughly review the minutes to prepare for a vote. 7. V#11-16 – Request of Randy Robinson for property located at 4 Barbers Page 9 of 11 Road in a Residential R-80 zoning district. In accordance with Sec.12.1 R-80 60’Front yard required, request reduction to 52’; 40’ Side yard required, request reduction to 6’ for the construction of a 14’x15’ seasonal room and 14’x12’ deck. Seated were, Marc Benjamin Joseph Jacaruso, Henry Olender, and Paul Kramarewicz. The variance was TABLED to the October 11, 2011 regular meeting upon request of the applicant. 8. V#11-17 – Request of David Kendall for property located at 330 Canterbury Turnpike in a Residential R-40 zoning district. In accordance with Sec.12.1 R-40 50’ Front yard required, request reduction to 36’; 50’ Rear yard required, request reduction to 29’; 30’ southerly Side yard setback required, request reduction to 18’ for the construction of an18’x33’ pool and 25’x26’ deck. Seated were, Marc Benjamin Joseph Jacaruso, Henry Olender, and Paul Kramarewicz. Paul Kramarewicz made a motion to accept the variance given; the proposed pool location will not extend into the front yard setback any further than the existing house, location of the newly installed septic system, and the slope at the rear of the property. Henry Olender stated he did have concerns this may be overdevelopment of a small lot, however, should the Board approve the variance, he would like to see a permanent vegetative buffer at the shared property line of 328 & 330 Canterbury Tpke. After a lengthy discussion, the Board determined the dimensions of the proposed pool were not going to able to meet the requested setbacks – the main concern being the numeric request for front yard reduction, as it appeared there was a 7’ discrepancy. Ms. Curtis felt the potential discrepancies in the dimensions were not clear, however clarification could be reached between herself and the Kendalls. Marc Benjamin noted that while they could take no further testimony, they would be able to request clarification from Staff. On a motion by Marc Benjamin and seconded by Paul Kramarewicz, the Board voted unanimously to TABLE the decision to the 10/11/2011 regular meeting pending further clarification of the dimensions. 9. V#11-18 – Request of David Sanchez for property located at 6 Traders Court in a Residential R-20 zoning district. In accordance with Sec.12.1 R-20 30’ Front yard required, request reduction to 20’; 15’ Side yard required, request reduction to 5’ for the construction of a 21’x13’ carport. Seated were, Marc Benjamin Joseph Jacaruso, Henry Olender, and Paul Kramarewicz. Ms. Curtis stated that, in response to the letter of opposition, she had visited the site to measure the approximate width of Mr. Sanchez’s driveway. She did explain to the neighbor that she is not qualified to stake out property lines, and the Page 10 of 11 office’s GIS system is used in lieu of a survey. Ms. Curtis’s site visit was to determine visually if the proposal was feasible. To the best of her knowledge, the proposed placement of the carport will end 5’ from the side property line. Ms. Curtis did note that the proposed carport will not be the full width of the existing driveway, but will end approximately ½ - ¾ ways across pavement. There are no setback requirements for paving of a property. Paul Kramarewicz made a motion to accept the variance given; a 1-bay carport is a reasonable request for use of one’s property, the preexisting location of the driveway and small lot. On a motion by Paul Kramarewicz, seconded by Marc Benjamin it was unanimously voted to APPROVE the variance. 10. V#11-19 – Request of Richard Clark for property located at 3 Colony Court in a Residential R-20 zoning district. In accordance with Sec.12.1 R-20 30’ Front yard setback, request reduction to 27’; 15’ Side yard required, request reduction to 4’ for the construction of a 15’x24’ carport. Seated were, Marc Benjamin Joseph Jacaruso, Henry Olender, and Paul Kramarewicz. Paul Kramarewicz made a motion to accept given; the stated water problem, the pre-existing non-conforming lot size and lack of any vehicle cover. Marc Benjamin noted the earlier comment from Henry Olender that the reduction to 4’ is only at the front corner and, given the angle of the property line, will increase towards the rear of the carport.
