Minutes of the regular meeting of the Village of Nyack Board of Trustees held at 7:30pm on Thursday September 26, 2019 at Nyack Village Hall, 9 N. Broadway, Nyack, New York Hon. Dr. Don Hammond Presiding: PRESENT Dr. Don Hammond Mayor Louise Parker Trustee Marie Lorenzini Trustee Elijah Reichlin-Melnick Trustee ALSO PRESENT James Politi Village Administrator Walter Sevastian Village Attorney Jennifer Hetling Village Clerk/Treasurer ABSENT Donna Lightfoot-Cooper Trustee Meeting called to order at 7:30pm Pledge of Allegiance Nyack Thanks Adoption of Minutes September 12, 2019 Motion by Marie Lorenzini, seconded Louise Parker by to accept the motion as presented. Motion passed by unanimous vote. Public Comment Joe Carlin – Congratulated the board on the new website. Stated that he as in favor of the Nyack Memorial BBQ but asked why this event with such a large attendance would be allowed as opposed to other events with large attendance that have been denied to which the board responded that this is a community event. Action Items Resolution No. 2019 – 70 Resolution of the Nyack Village Board to accept the Audited Voucher Summary #16-2019 Motion by Elijah Reichlin-Melnick, seconded by Louise Parker to accept the motion as presented. Motion passed by unanimous vote. Resolution No. 2019 – 71 Resolution of the Nyack Village Board to approve the use of Memorial Park on July 18, 2020 for the Nyack Memorial BBQ Motion by Elijah Reichlin-Melnick, seconded by Louise Parker to amend the resolution by adding the correct date of July 18, 2020. Motion passed by unanimous vote. Motion by Louise Parker, seconded by Elijah Reichlin-Melnick to accept the motion as presented. Motion passed by unanimous vote. Resolution No. 2019 – 72 Resolution of the Nyack Village Board to approve to request from The Montessori Center of Nyack to close Fifth Ave. from Marion St. to North Broadway from 8:30am to 2:30pm for a school picnic on October 4, 2019 Motion by Marie Lorenzini, seconded by Louise Parker to accept the motion as presented. Motion passed by unanimous vote. Public Comment John Dunnigan – The music at Up Lounge was very excessive last Saturday night. Joe Carlin – Asked what is happening with TZ Vista. The Village Attorney responded that the Village does not have signed copies of the land acquisition contracts yet but there are time limits on the process and construction. He stated that plans are in and are being reviewed. He also asked if the barricades that are blocking the sidewalks on Main St. near the property can be removed to allow access for walking to which the Mayor responded that the Village would look into it. Roger Cohen – Stated that the barriers at Main St and Gedney Ave are creating a safety issue for traffic. Department Reports to the Board of Trustees Orangetown Police Department – None Village Attorney – There was correspondence regarding a modification of the tree ordinance. The ordinance is part of the zoning code so this would have to be sent out to Rockland County Planning and other groups for further comment before adoption. Requested a public hearing on the proposed change to the tree ordinance on December 8th, 2019. Trustee Elijah Reichlin-Melnick requested that the tree committee be able to review the proposal before moving forward. Reminded the Board that there are 3 public hearings upcoming. Requested an executive session regarding litigation. Motion by Louise Parker, seconded by Elijah Reichlin-Melnick to approve this request. Motion passed by unanimous vote. Village Administrator – Presented a summary of the progress of the ongoing capital projects. See attached. The bids for the Memorial Park footbridge will be in tomorrow. Presented a summary of the recreation department update. See attached Request for review of the CBA to be added to the executive session. Village Clerk – Treasurer – Orange and Rockland have a municipal portal listing all street lights in the Village and will be used to report street light outages. Trustee Reichlin-Melnick suggested that a link be added to the website to show residents how to report this to Orange and Rockland or the Village offices. Commission and Authority Reports to the Board of Trustees Water Commission - None Parks Commission - None Nyack Parking Authority Finance Update – Unaudited financial statements for the fiscal year end May 31, 2019 were provided to the board as well as year to date financials statements. Nyack Housing Authority - None Old Business Communications Request from the Nyack Chamber of Commerce for approval of the 2020 event dates and for free holiday parking Marie Lorenzini asked if it would be in the Villages’ interest to allow for free holiday parking throughout the entire Village. Mayor Hammond responded that we should look into what the financial implications would be and then review the request for free holiday parking after that has been completed. A resolution will be added to the next agenda for the Chamber of Commerce and ACADA event dates. Request from the Center for Safety and Change to hold a vigil on October 24, 2019 from 6:30pm to 7:30pm in Veteran’s Park in honor of Domestic Violence Awareness Month Village Attorney stated that there is no resolution or other document that designates Veteran’s Park as an official park. The board approved this request. Request from Abraham Ohayon for a refund of $25 – launched a kayak at the marina but accidently paid the boat launch fee. The board stated that the signage is clear and denied this request. Correspondence from Saffron Trading Company regarding traffic safety concerns at Burd St. and S. Broadway The board responded that the upcoming TAP project should address these issues. New Business Public Comment Comments from the Village Board of Trustees Elijah Reichlin-Melnick – Members of the John Green House Coalition are attempting to give the property an historical designation and asked that the board consider the fees charged by the building department for this process to be less. Marie Lorenzini – None Louise Parker – None Donald Hammond – Penguin Plunge T-Shirts were received by the Board Request from the Housing Authority to run a breakfast club at a cost to the Village of $11,000. He stated that this is not in the current budget but the request will be reviewed when next year’s budget is being compiled. Executive Session Motion by Marie Lorenzini, seconded by Louise Parker to move to executive session at 8:23pm. Motion passed by unanimous vote. Motion by Marie Lorenzini, seconded by Elijah Reichlin-Melnick to exit executive session at 9:07pm. Motion passed by unanimous vote.
