Minutes of the regular meeting of the Village of Nyack Board of Trustees held at 7:30pm on Thursday October 10, 2019 at Nyack Village Hall, 9 N. Broadway, Nyack, New York Hon. Motion passed by unanimous vote. Public Comment Action Items Resolution No. 2019 – 73 Resolution of the Nyack Village Board to accept the Audited Voucher Summary #17-2019 Motion by Louise Parker, seconded by Elijah Reichlin-Melnick to accept the motion as presented. Motion passed by unanimous vote. Resolution No. 2019 – 74 Resolution of the Nyack Village Board to authorize Mayor Hammond to sign the Justice Court Assistance Program Grant Application Motion by Louise Parker, seconded by Donna Lightfoot-Cooper to accept the motion as presented. Motion passed by unanimous vote. Resolution No. 2019 – 75 Resolution of the Nyack Village Board approving the ACADA street fair events for 2020 Motion by Louise Parker, seconded by Marie Lorenzini to accept the motion as presented. Motion passed by unanimous vote. Resolution No. 2019 – 76 Resolution of the Nyack Village Board approving the Nyack Chamber of Commerce events for 2020 Motion by Louise Parker, seconded by Marie Lorenzini to accept the motion as presented. Motion passed by unanimous vote. Resolution No. 2019 – 77 Resolution of the Nyack Village Board to award the tree maintenance contact to Wickes Arborists Motion by Elijah Reichlin-Melnick, seconded by Marie Lorenzini to accept the motion as presented. Motion passed by unanimous vote. Resolution No. 2019 – 78 Resolution of the Nyack Village Board to approve the Policy Against Discrimination and Harassment Motion by Donna Lightfoot-Cooper, seconded by Louise Parker to accept the motion as presented. Motion passed by unanimous vote. Public Comment Christopher Taylor – Requested a handicap parking spot in front of his home at 237 High Ave. The neighborhood will be notified of this and a formal resolution will be added to the next board meeting agenda. PUBLIC HEARING Revisions to Section 250-10 of the Parks and Recreation Law to allow for the Village Clerk-Treasurer to issue park usage permits for groups of 10-40 Motion by Marie Lorenzini, seconded by Donna Lightfoot-Cooper to open the public hearing at 8:00pm. Motion passed by unanimous decision. Joe Carlin – Asked how the code would be enforced and who would enforce it. Village Attorney Sevastian responded that it is part of the code and the police would be in charge of enforcing it. The board also stated that there is a park monitor during high usage times that would also assist in enforcing the code. Motion by Louise Parker, seconded by Marie Lorenzini to close the public hearing at 8:03pm. Motion passed by unanimous vote. Motion by Louise Parker, seconded by Elijah Reichlin-Melnick to adopt local law 6-2019 Revisions to Section 250-10 of the Parks and Recreation Law to allow for the Village Clerk-Treasurer to issue park usage permits for groups of 10-40. Motion passed by unanimous decision. Department Reports to the Board of Trustees Orangetown Police Department – None Village Attorney – None Village Administrator – Reviewed the status of the capital projects (see attached report). The footbridge bids are in and are being reviewed. A meeting was had with Senator Carlucci regarding getting additional funding for this project. Reviewed the status of the recreation department (see attached report). Presented the Water Commission report (see attached). Request for executive session regarding CBA discussions. Motion by Marie Lorenzini, seconded by Elijah Reichlin-Melnick to accept the motion as presented. Motion passed by unanimous decision. Reviewed the honor banners with the board and stated that a sample has been received and will be presented at a later meeting for review. Banners would be purchased by veterans’/families and hung throughout the Village from Memorial Day to Labor Day annually. He will be reviewing what the parking revenue has been on Saturdays in the Village parking lots as well as all throughout the Village and will present the information at the next meeting. A request for a speed bump at Depew Ave. and Prospect St. was received and the board instructed Village Administrator Politi to review the prior traffic reports to see if this area has been reviewed in the past. Village Clerk – Treasurer – Presented the general fund financials (see attached report) Commission and Authority Reports to the Board of Trustees Water Commission - None Parks Commission – Jim Willcox stated that the parks commission would like to start exploring wayfinding signage. The parks commission will also be exploring a wash box where boaters would be able to remove invasive species from watercraft and deposit into the wash box. Nyack Parking Authority - None Nyack Housing Authority - None Old Business Communications Request from Paulette Ross for host the 15th Annual ArtWalk on June 19, 2020 through June 21, 2020 Resolution will be added to the next agenda for the ArtWalk dates. Any future request for free parking for this event will be discussed at a later date. New Business Correspondence between the Village of Nyack and Rockland County regarding the Rockland County Acquisition Program Correspondence from Young/Sommer LLC regarding an application of Champlain Hudson Power Express, Inc. for a Certificate of Environmental Compatibility and Public Need Pursuant to Article VII of the PSL for the Construction, Operation and Maintenance of a High Voltage Direct Current Circuit from the Canadian Border to New York City Public Comment Joe Carlin – There is a barrier on Gedney Ave. from Lydecker St. to Main St. and on Main St. from Gedney to the end. He asked if this has been looked at to see if it can be moved to keep the sidewalks functional. Mayor Hammond responded that the building inspector has not yet been able to review this. Comments from the Village Board of Trustees Elijah Reichlin-Melnick – None Marie Lorenzini – There was a food truck event at Nyack High School that also included vendors and games and it was a great day. Louise Parker – None Donald Hammond – There will be a Nyack 2030 Community Leaders Workshop on November 13th, 2019 which will bring different community groups together to talk about how to reduce our carbon footprint and further our sustainability initiative. Donna Lightfoot-Cooper – The Housing Authority project at Depew Manor has been pushed out again to the end of October and is causing major issues to the residents effected including not being able to get access to their belongings. Mayor Hammond instructed Administrator Politi to contact the building department to see if they can help residents get temporary access. Executive Session Motion by Marie Lorenzini, seconded by Louise Parker to move to executive session at 8:07pm. Motion passed by unanimous vote. Motion by Donna Lightfoot-Cooper, seconded by Elijah Reichlin-Melnick to exit executive session at 8:28pm. Motion passed by unanimous vote. Adjournment Motion by Elijah Reichlin-Melnick, seconded by Donna Lightfoot-Cooper to adjourn the Village board meeting at 8:29pm. Motion passed by unanimous vote.
