Minutes of the regular meeting of the Village of Nyack Board of Trustees held at 7:00pm on Thursday April 22, 2021 at Nyack Village Hall, 9 N. Broadway, Nyack, New York Hon. Pledge of Allegiance As we continue to address our respective challenges associated with COVID-19, Village government continues to operate. And as there are matters the Village must continue to address as part of keeping the Village operational, our April 22, 2021 Village Board meeting remains as scheduled and was held remotely. We will be keeping the Agenda (see posting on website) to essential items. On March 7, 2020, in Executive Order No. 202.1, Governor Cuomo suspended certain provisions of the Open Meeting Law to permit a Village Board to meet and take actions authorized by law without permitting in public in-person access and authorizing such meeting to be held remotely by conference call or similar service, provided that the public has the ability to view or listen to such proceeding and that such meetings are recorded and later transcribed. The Village will be activating a remote meeting platform for the April 22nd Village Board meeting, which will enable residents to phone in and listen to the meeting in compliance with the Executive Order. In the interests of the public's health and safety, the Village Board strongly encourages residents to utilize this platform. The Village Board appreciates your patience and understanding during this difficult and evolving situation. Please be sure to check in on the Village website for updates which will be posted on an ongoing basis. Adoption of Minutes – April 22, 2021 - Motion by Donald Hammond, seconded by Joe Rand to accept the motion as presented. Motion passed by a vote of 4-0-1 (Trustee Lorenzini abstained) Public Comment – Action Items - Resolution No. 2021 – 29 Resolution of the Nyack Village Board to accept the Audited Voucher Summary #7-2021 Motion by Donald Hammond, seconded by Marie Lorenzini to accept the motion as presented. Motion passed by a unanimous vote. Resolution No. 2021 – 30 Resolution of the Nyack Village Board establishing the standard work days for specific elected and appointed officials Motion by Donna Lightfoot-Cooper, seconded by Marie Lorenzini to accept the motion as presented. Motion passed by a unanimous vote. Resolution No. 2021 - 31 Resolution of the Nyack Village Board to adopt the 2021-2022 budget Motion by Donna Lightfoot-Cooper, seconded by Louise Parker to accept the motion as presented. Motion passed by a unanimous vote. Public Comment – None Department Reports to the Board of Trustees Orangetown Police Department – None Village Attorney – Stated that the Village will be closing on the street lights on May 7. He drafted legislation on rooftop dining and it reviewed by the planning board at their last meeting. The planning board supported the legislation but they stated that there should be no rooftop dining within 50 feet of a residential area and that the legislation should also include wording that a variance would not be allowed. Because of this restriction there are very few restaurants that would fit therefore he doesn’t think it’s a good idea to move forward. The board agreed that it wouldn’t make sense to move forward. Mayor Hammond suggested that the business council try to think of alternate ideas. There are two sections in the code that deal with prohibition of large trucks in the Village. The code needs to be tweaked a bit and there needs to be better signage in the Village about laws. He will provide a proposed revision at the next meeting. The boat charter policies and insurance levels are adequate so allowing different activities would be a board decision. The board agreed to allow 3 boats to run from the marina and allow off-shore water sports. Motion by Joe Rand, seconded by Donna Lightfoot-Cooper, to authorize an addendum to the Nyack Boat Charter agreement, authorizing 3 boats, off-shore water sports, no water sports from shore. Motion passed by a vote of 4-1-0 (Trustee Parker nay) Village Administrator – The bumpouts are moving along. The water main improvement project is moving along in the Village. The PSAP project is on S Broadway and Depew Ave. where they are working on pedestrian crossings. There will be a small filming next Friday night that should have a minimal effect on parking. Village Clerk – Treasurer – None Communications Request from Jeff Beauchard to have a wedding in Memorial Park on September 19, 2021 for 26 people which would take approximately 1-2 hours. They would like to use the gazebo and pier for the ceremony and pictures. Request denied as weddings historically are not allowed. Request from Elias Price to do an eagle scout project benefiting the John Green Coalition Mr. Price gave a brief overview of the proposed project. Mayor Hammond requested that he contact the Mayor after the meeting to setup a date to speak about the project further and determine a way to accomplish the task safely during the pandemic. Request from the Nyack Library to host a Juneteenth celebration on June 26 at Veterans’ Memorial Park for approximately 100 people. This will be added to the next meeting for discussion. Request from the Rockland Pride Center and the Nyack NAACP to do a crosswalk painting in celebration of both the African American and LGBTQ+ pride. Motion by Donald Hammond, seconded by Marie Lorenzini to allow the crosswalk painting with temporary paint. Motion passed by unanimous vote. Public Comment – None Comments from the Village Board of Trustees Joseph Rand – Thanked everyone for their work and support on the spring fling promenade event this past Sunday. Louise Parker –. Thanked everyone for all their work on the covid vaccine pop-up. Some will be meeting to see if something can be done for Juneteenth that fits within the proper health protocols. Donna Lightfoot-Cooper – Agreed that the spring fling promenade was a great event. Marie Lorenzini – Today was the last day of 2nd covid vaccine shots and it went very well. Recipients were very happy with the Village and the easy process. Donald Hammond – 38% of people in the 10960 zip code have been vaccinated. He and Marie spoke with Senator Reichlin-Melnick regarding the state budget. CHIPs funding went up 28%. AIM funding went up about 2500. There are many grants for water infrastructure included. Motion by Donald Hammond, seconded by Donna Lightfoot-Cooper to hold an executive session for a discussion related to the position of Village Administrator. Motion passed by unanimous vote.
