Minutes of the regular meeting of the Village of Nyack Board of Trustees held at 8:00pm on Thursday May 13th, 2021 at Nyack Village Hall, 9 N. Broadway, Nyack, New York Hon. Dr. Don Hammond Presiding: PRESENT Dr. Don Hammond Mayor Louise Parker Trustee Donna Lightfoot-Cooper Trustee Joseph Rand Trustee Marie Lorenzini Trustee ALSO PRESENT James Politi Village Administrator Walter Sevastian Village Attorney Jennifer Hetling Village Clerk/Treasurer Meeting called to order at 8:00pm Pledge of Allegiance As we continue to address our respective challenges associated with COVID-19, Village government continues to operate. And as there are matters the Village must continue to address as part of keeping the Village operational, our May 5, 2021 Village Board meeting remains as scheduled and was held remotely. We will be keeping the Agenda (see posting on website) to essential items. On March 7, 2020, in Executive Order No. 202.1, Governor Cuomo suspended certain provisions of the Open Meeting Law to permit a Village Board to meet and take actions authorized by law without permitting in public in-person access and authorizing such meeting to be held remotely by conference call or similar service, provided that the public has the ability to view or listen to such proceeding and that such meetings are recorded and later transcribed. The Village will be activating a remote meeting platform for the May 5th Village Board meeting, which will enable residents to phone in and listen to the meeting in compliance with the Executive Order. In the interests of the public's health and safety, the Village Board strongly encourages residents to utilize this platform. The Village Board appreciates your patience and understanding during this difficult and evolving situation. Please be sure to check in on the Village website for updates which will be posted on an ongoing basis. Adoption of Minutes – April 22, 2021 - Motion by Donna Lightfoot-Cooper, seconded by Marie Lorenzini to accept the motion as presented. Motion passed by a unanimous vote. May 5, 2021 - Motion by Louise Parker, seconded by Marie Lorenzini to accept the motion as presented. Motion passed by a vote of 4-0-1 (Trustee Rand abstained) Public Comment – None Action Items - Resolution No. 2021 – 35 Resolution of the Nyack Village Board to accept the Audited Voucher Summary #8-2021 Motion by Donald Hammond, seconded by Donna Lightfoot-Cooper to accept the motion as presented. Motion passed by a unanimous vote. Resolution No. 2021 – 36 Resolution of the Nyack Village Board to enter into an agreement with Montefiore Nyack Hospital’s employee assistance program for use by village employees and their families Motion by Marie Lorenzini, seconded by Louise Parker to accept the motion as presented. Motion passed by a unanimous vote. Public Comment – None Department Reports to the Board of Trustees Orangetown Police Department – None Village Attorney – Advised the board to start thinking about the marijuana legalization and taxation state legislation. Municipalities have the option to opt out, by local law, of retail sales or on premises consumption. If a municipality opts out then they would not get a share of the sales tax revenue. Village Administrator – The water main project is moving ahead. The Broadway TAP rebuild final documentation went up to the state this week. The bump-out program is expanding. Village Clerk – Treasurer – None Communications Request from Aldona Pilmanis from the Nyack Library to host Preschool Story Time at the gazebo in Memorial Park on July 5, 13 and 20 from 11-11:30 Motion by Donald Hammond, seconded by Donna Lightfoot-Cooper to approve this request. Motion passed by unanimous vote. Request from Roger Harris to hold the Nyack Memorial BBQ at Memorial Park on July 31, 2021 from 7am – 6pm Motion by Louise Parker, seconded by Marie Lorenzini to approve this event. Motion passed by unanimous vote. Request from Rivertown Film Society to use Memorial Park on July 17th with a rain date of July 18th OR July 24th with a rain date of July 25th OR August 14th with a rain date of August 15th from 8pm to 1030pm for a family film screening for approximately 100-150 people. Motion by Joe Rand, seconded by Donna Lightfoot-Cooper to approve this request. Motion passed by unanimous vote. Public Comment – None Comments from the Village Board of Trustees Joseph Rand – The team working on the Spring Fling has been doing great. Louise Parker –. None Donna Lightfoot-Cooper – None Marie Lorenzini – None Donald Hammond – The bathrooms at Memorial Park will be opening up on Saturday. Executive Session – Motion by Louise Parker, seconded by Marie Lorenzini to enter into executive session at 8:43pm. Motion passed by a unanimous vote. Motion by Donna Lightfoot-Cooper, seconded by Louise Parker to adjourn executive session at 9:17pm. Motion passed by a unanimous vote. Adjournment – Motion by Joseph Rand, seconded by Marie Lorenzini to adjourn the meeting at 9:18pm. Motion passed by a unanimous vote.
