Village Board of Trustees Meeting

Minutes of the Regular Meeting of the Village of Nyack Board of Trustees held at 7:30 on Thursday, January 27, 2022. Politi Interim Village Administrator Lise J Chanin Village Clerk Treasurer Walter Sevastian Village Attorney Absent: Dr. Don Hammond Mayor *Delayed Pledge of Allegiance Adoption of Minutes –January 13, 2022 A motion was offered by Marie Lorenzini to approve the minutes, seconded by Joseph Rand. The minutes were approved by a vote of 3 Yeas to 0 Nays. Public Comment – Discussion of Action Items Only – 3 Minute Time Limit None Action Items: Resolution No. 2022-05 A resolution of the Nyack Village Board of Trustees to approve the Abstract of Audited Claims as presented by the Village Clerk/ Treasurer. A motion was offered by Marie Lorenzini to approve the Abstract of Audited Claims as presented, seconded by Joseph Rand. The motion was approved by a vote of 3 Ayes to 0 Nays. Resolution No. 2022 -06 A resolution of the Nyack Village Board of Trustees to schedule a Public Hearing to approve the 2022 Community Development Block Grant submittals for February 10, 2022. Jim Polite presented information on Census tract 131.00-4, which is only one that qualifies as eligible for funding through the Community Development Block Grant program. The Village would apply for $300,000.00. A motion to approve was offered by Marie Lorenzini and seconded by Joseph Rand. The motion passed by a vote of 4 Yeas to 0 Nays. Resolution No. 2022 – 07 A resolution of the Nyack Village Board of Trustees to schedule a Workshop on the Leaf Blower Group for February 10, 2022. A motion to schedule the Workshop was offered by Joseph Rand, seconded by Donna Lightfoot Cooper. The motion passed by a vote of 4 Yeas to 0 Nays. Public Comment 1. Andrea DeVitta, 23 Burd St raised several concerns: a. She requested an update on the project on Gedney St. Walter Sevastian advised that the Developers are still involved in litigation. He advised her to check the Rockland County Clerk’s website to view the filings. b. Raised the possibility of allowing boats to tie up and be able to come into downtown Nyack about the dock next to the Claremont and. Marie Lorenzini advised that it belonged to the Claremont. Walter Sevastian pointed out that the dock is part of the Phase I condos which are the low-rise portion of the development. There is an easement in place, but the burden of maintenance is on the Homeowner’s Association, and in any case there is not public mooring space there. He advised that the easement was also available on the Rockland County Clerk’s website. c. Asked about the possibility of using the Marina Lot for overnight parking for residents. Walter Sevastian advised that part of the upper portion of the lot was owned by Lugana. The portion of the lot from the wall east is the Villages. James Politi pointed out that all permit parking had been moved to the upper portion of as a result of parking studies done, and from the wall east was muni-meter parking. 2. A motion to go into an Executive Session to discuss personnel was offered by Louise Parker, seconded by Joseph Rand. The motion was approved by a vote of 4 Yeas to 0 Nays. Department Reports to the Board of Trustees (based on availability) Orangetown Police Department--None Village Attorney--Walter Sevastian presented his report. He advised the Board that at the next meeting he would be discussing legislation to prohibit semi articulated tractor-trailers in the Village of Nyack. Village Administrator--Jim Politi presented his report: The DPW is ready for the upcoming snow storm. The Village is ready to open up the Senior Center should there be any power outages. Update on the TAP project: He has been working with HVEA and McLaren Engineering on solutions to issues that have come up. He showed the Board a rendering of the solution. The potential danger areas at street crossing will be highlighted by colorized concrete while the sidewalk between each crossing will be regular concrete. In addition to highlighting the danger zones at the crossings, should there be a water main break or service repairs to buildings between crossings, concrete repair will be easier to be done. The Board expressed their agreement with the plan he outlined. Mill/Pond Street Update. The repair work is proceeding. The contractor does not begin work until 8:00 am allowing residents, especially the condos, can get out. After work begins at 8:00 am, residents will have to wait, the contractor tries to get them in. The Parking Authority is aware of the temporary street parking during the project and the questions and concerns from residents has fallen off so it appears that the solutions put in place are working. Village Clerk – Treasurer--Lise Chanin presented her report: Continuing to work with the Auditors and Comptroller’s Office on 5/31/2020 year end Working on Bond Funding Has begun the Budget Process Old Business None. New Business The Board congratulated the Mayor on the birth of his first grandchild. Communications Rockland Community Power Annual Performance Review. Peggy Kurtz presented the review to the Board. Phoenix Live Arts Festival Joe Rand advised that he presented to the Business Council. They wanted to do a Theater Program. Most show will be at the Marydell Center and one at the Hopper House and create a walking tour of Nyack. There is a possibility of busing participants.  Marie is concerned about the walking tour creating a liability issue. Walter advised that it would be a permit. They are looking to be able to put up signs. Public Comment None. Comments from the Village Board of Trustees Donna Lightfoot Cooper and Marie Lorenzini had no comments. Joseph Rand updated the Board on the Nyack Feast event to promote local restaurants scheduled for March 1st-10th. The Hudson Market is temporarily closed, while RCC looks for another vendor to run the operation, but the Culinary Institute is still up and running. Louise Parker updated the Board on the Juneteenth Parade there will be no bounce house and they are concentrating on social distance activities and the NAACP Covid test distribution. The motion was approved by a vote of 4 Yeas to 0 Nays.
