Minutes of the Regular Meeting of the Village of Nyack Board of Trustees held at 7:30 on Thursday, February 10, 2022. Present Don Hammond Mayor Louise Parker Deputy Mayor Donna Lightfoot-Cooper Trustee Joseph Rand Trustee Also Present: James C. Politi Interim Village Administrator Lise J Chanin Village Clerk Treasurer Walter Sevastian Village Attorney Absent: Marie Lorenzini Trustee Pledge of Allegiance Adoption of Minutes –January 27, 2022. A motion to approve the Minutes was offered by Don Hammond, seconded by Louise Parker. The motion was approved by a vote of 4 ayes to 0 nays, and 1 absence Public Comment – Discussion of Action Items Only – 3 Minute Time Limit None. Action Items: Resolution No. 2022-09 A resolution of the Nyack Village Board of Trustees to approve the Abstract of Audited Claims as presented by the Village Clerk/ Treasurer. A motion to approve the Abstract of Audited Claims was offered by Don Hammond, seconded by Joseph Rand. The motion was approved by a vote of 4 ayes to 0 nays, and 1 absence. Resolution No. 2022-10 A resolution of the Nyack Board of Trustees to appoint Andy Stewart as Village Administrator for a term to expire December 31, 2022. A motion to approve the appointment of Andy Stewart as Village Administrator was offered by Don Hammond and seconded by Trustees Parker, Lightfoot Cooper, and Rand. The motion was approved by a vote of 4 ayes, 0 nays and 1 absence. Public Comment Lori Fellmer requested an update from the Board on the Fire Pit Legislation. Don Hammond advised that the feedback from the Fire Inspector and Fire District Commissioners had requirements to implement that the Board thought could be onerous. He was unable to meet with the Fire Commissioners due to the Administrator and would try schedule a meeting with them. The Board decided to place the item on the February 24, 2022, Agenda. PUBLIC HEARING 8:00 PM Community Development Block Grant Submittal for 2022-2023 Year. Village Administrator James Politi presented the proposed grant: There is only 1 Census Tract that is applicable to receive funding through the CDBG. The Village Administrator proposed a grant for $300,000 for sidewalk installation/repair that would complement the Broadway project. There were no comments from the Public. A motion to approve the submission of a $300,000 request as proposed by the Village Administrator was offered by Don Hammond, seconded by Donna Lightfoot Cooper. The motion was approved by a vote of 4 yeas to 0 nays, and 1 absence. Department Reports to the Board of Trustees (based on availability) Orangetown Police Department Village Attorney—Walter Sevastian presented his report. Mr. Sevastian requested a Public Hearing be scheduled for the February 24, 2022, Board Meeting to consider a local law to prohibit Tractor-trailer combinations be prohibited from Village of Nyack streets. A motion was offered by Louise Parker, seconded by Joseph Rand. The motion was approved by a vote of 4 ayes to 0 nays, and 1 absence. He advised the Board that the proposed Cannabis Regulations have been referred out to adjoining municipalities for review and comment. Village Administrator—James Politi presented his report. Budget. He advised the Board that the Budget process has started. Department Heads have received the current budget and will need to provide their requests for the Fiscal Year 2023 by March 1. Bayard Rustin Way Changes. The Dates were changed to Saturday April 30th, rain date May 14th. It would not interfere with any of the Street Fairs. A motion to approve the date change was offered by Joseph Rand, seconded by Louise Parker. The motion was approved by a vote of 4 yeas to 0 nays, and 1 absence. Capital Plan—Roads 2022 Village Clerk – Treasurer Old Business Nyack Marina Boat Charter Village Attorney Walter Sevastian noted several points on the RFP: Timeframe is two years, does the Board wish to continue a two year licensing agreement? The scope of services has changed, is the Board interested in providing additional services There is no schedule of fees outlining the services provided. Does the Board wish to continue the fee of 5% of gross receipts or go to a Flat Fee, which could contain an increase in year two. There have been complaints about a 5% surcharge per charter. There is a prohibition in the agreement about such charges. The Board decided that some additional research needs to be done and they will revisit that at the next meeting. Joseph Rand will research fees charged at other marinas in the area. New Business Communications American Legion Post 310 request to hold a Memorial Day Parade on Monday, May 30, 2022. Louise Parker offered a motion to approve the Memorial Day Parade, seconded by Donna Lightfoot Cooper. The motion was approved by a vote of 4 yeas to 0 nays, and 1 Absence. The Climate Smart Communities Team Request for Workshop on the Climate Action Plan. The Village Clerk-Treasurer was instructed to offer the dates of either February 24, 2022, or March 10, 2022, for the Climate Action Plan. Montefiore/Nyack Parking Lot Monthly Update. Monthly Update Lighthouse Swim. No decision. The Mayor, Village Administrator and Village Clerk Treasurer will discuss. 1619 Project. Carissa Barquin presented the proposal to do a Story Walk to be put up in Memorial Park to allow families to walk along Memorial Park to present a family event on learning about the 1619 Project. An event would take place on March 11, 2022, Village Administrator James Politi will work with the sponsors on the logistics of the event. Public Comment None. Comments from the Village Board of Trustees. Donna Lightfoot Cooper asked for update on: Supermarket—work is proceeding. African American Day Parade/Juneteenth—there appears to have been a miscommunication with Lise. Louise Parker—None. Joseph Rand—None. Don Hammond—updated the Board on the Leaf Blower Group Executive Session—to discuss personnel matters. A motion to move into Executive Session to discuss personnel was offered by Louise Parker, seconded by Joseph Rand, the motion was approved by a vote of 4 yeas, 0 nays, and 1 absence.
