Village Board of Trustees Meeting

Minutes of the Regular Meeting of the Village of Nyack Board of Trustees held at 7:30 on Thursday, March 10, 2022. Present Don Hammond Mayor Louise Parker Deputy Mayor Donna Lightfoot-Cooper Trustee Joseph Rand Trustee Also Present: James C. Politi Interim Village Administrator Walter Sevastian Village Attorney Absent: Marie Lorenzini Trustee Meeting called to order at 7:34pm Pledge of Allegiance Adoption of Minutes –February 24, 2022 A motion was offered by Donald Hammond to approve the minutes, seconded by Louise Parker. The minutes were approved by a vote of 4 Yeas to 0 Nays, and 1 Absence. Public Comment – None Action Items: Resolution No. 2022- 16 A resolution of the Nyack Village Board of Trustees to approve the Abstract of Audited Claims as presented by the Village Clerk/ Treasurer. A motion was offered by Donald Hammond to approve the Abstract of Audited Claims, seconded by Joseph Rand. The motion was approved by a vote of 4 Yeas to 0 Nays, and 1 Absence. Resolution No. 2022-17 A resolution of the Nyack Village Board of Trustees to approve the application for CDBG funding related to sidewalk replacement and roadway repairs on Burd St. from Broadway to Cedar St. A motion was offered by Louise Parker to approve the resolution as presented, seconded by Donna Lightfoot-Cooper. The motion was approved by a vote of 4 Yeas to 0 Nays, and 1 Absence. Public Comment - None Department Reports to the Board of Trustees Village Attorney - He is working on the charter license agreement with the single bidder that responded to the marina RFP. - Short term rental legislation can be prepared if the board would like. - The Village has proposed legislation which opts out of on premise lounges as they pertain to cannabis but will allow dispensaries which would be limited to the CC zoning district. He then explained the provisions of the legislation. The planning board does not agree that it should be kept within the CC zoning district. We are waiting on the county response. Village Administrator - The collective bargaining agreement negotiations are continuing and getting close to being final. - Budget is being worked on for presentation to the board. - The Broadway TAP project is moving forward. A-Tech will be back on site at the end of March or early in April. Old Business Fire Pit Legislation – The Village building inspector will be discussing this issue with the Fire Chiefs and will get back to the Board at a later date. Lori Fellmer stated she feels the Board is trusting the opinion of the fire chiefs. Trustee Rand stated that the Village wants to make sure that the people that protect the residents from fire are on board with the legislation. Restaurant Bump-outs – Joseph Rand stated that the issue was brought up at the business council meeting and although the members are mostly merchants and not restauranteurs, they were for the bump-outs. Mayor Hammond stated that the outdoor seating brings people into the Village which is beneficial to the merchants as well. He also stated that the bump-out in from of the Nyack Burger and Breakfast Club created half of a remaining parking space that he is working with the Parking Authority to correct. Also, there is a grab and go that is creating traffic issues at Main and Broadway. The board all agreed that bump-outs will be allowed for the upcoming season. New Business Senior Center Use Fees – The board will review the prior fees, current costs to run the Center and will determine if the fees should change. Meals on Wheels request for use of the Senior Center – The board will revisit this request once the use fees are determined Nyack Community Garden Request for use of the Senior Center for an orientation meeting – The board approved this request. Communications Request from the Nyack Park Conservancy to hold “Music on the Hudson” events in Memorial Park in July and August Motion by Donald Hammond, seconded by Donna Lightfoot-Cooper to approve this request. -3 yea, 1 absent, 1 abstain Request to use Memorial Park for a Birthday Party for Eleanor Pigby – She will need insurances for park use. Email from Paul Ferguson, 22 E Catherine St, regarding building permit fees This will be referred to the Building Department Montefiore Nyack Hospital Report The report will be available on the Village website Public Comment - None Comments from the Village Board of Trustees Donald Hammond – There will be a rally for equal pay for immigrants and excluded workers on March 17th at 6pm. Thanked James Politi for his service as interim Village Administrator. He stated that he would like the Board to begin discussing returning to in-person meetings. There is a request for an event honoring those we lost due to COVID which will include music and art. The request will be sent to the Board for consideration. Bob Galvin sent a memo to the board regarding hotel tax. This is be up for board discussion soon. Donna Lightfoot-Cooper – None Joseph Rand – Stated that the Board may want to consider talking about short-term rentals in conjunction with the hotel tax discussion. The board should consider a virtual option to meeting once the meetings go back to in person. Louise Parker - None Adjournment 8:40 pm: A motion to adjourn the meeting was offered by Joseph Rand seconded by Louise Parker. The motion was approved by a vote of 4 Yeas to 0 Nays, and 1 Absence.
