Village Board of Trustees Meeting

Minutes of the Regular Meeting of the Village of Nyack Board of Trustees held at 7:30 on Thursday, February 24, 2022. Present Don Hammond Mayor Louise Parker Deputy Mayor Donna Lightfoot-Cooper Trustee Marie Lorenzini Trustee Also Present: James C. Politi Interim Village Administrator Lise J Chanin Village Clerk Treasurer Walter Sevastian Village Attorney Absent: Joseph Rand Trustee Pledge of Allegiance Adoption of Minutes –February 10, 2022 A motion was offered by Don Hammond to approve the minutes, seconded by Louise Parker. The minutes were approved by a vote of 4 Yeas to 0 Nays, and 1 Absence. Public Comment – Discussion of Action Items Only – 3 Minute Time Limit—None. Action Items: Resolution No. 2022- 13 A resolution of the Nyack Village Board of Trustees to approve the Abstract of Audited Claims as presented by the Village Clerk/ Treasurer. A motion was offered by Louise Parker to approve the Abstract of Audited Claims, seconded by Donna Lightfoot Cooper. The motion was approved by a vote of 4 Yeas to 0 Nays, and 1 Absence. Resolution No. 2022-14 A resolution of the Nyack Village Board to authorize the bonding of funds of $700,000.00 to fund emergency repairs to Mill St & DPW garage of damages incurred during Hurricane Ida. A motion was offered by Don Hammond to approve the Bond for emergency repairs to Mill Street & DPW Garage, seconded by Donna Lightfoot Cooper. The motion was approved by a vote of 4 Yeas to 0 Nays, and 1 Absence. Public Comment PUBLIC HEARING 8:00 PM A Local Law to regulate semi attached tractor trailer traffic within the Village of Nyack A motion was offered by Louise Parker to open the public hearing, seconded by Marie Lorenzini. The motion was approved by a vote of 4 Yeas to 0 Nays, and 1 Absence. Walter Sevastian presented the Local Law. NYS Vehicle & Traffic Law allows municipalities to regulate large vehicle traffic within their jurisdiction, as long as does no limit deliveries. The local law provides for the appropriate signs to be posted at all entrances to the Village. There was no public comment. A motion was offered by Don Hammond to close the public hearing, seconded by Louise Parker. The motion was approved by a vote of 4 Yeas to 0 Nays, and 1 Absence. A motion to adopt a Local Law to amend Chapter 330 of the Village Code entitled “Vehicles & Traffic”, Section 330-7 was offered by Don Hammond, seconded by Donna Lightfoot Cooper. The motion was approved by a vote of 4 Yeas to 0 Nays, and 1 Absence. Department Reports to the Board of Trustees (based on availability) Orangetown Police Department Village Attorney: 1. Walter Sevastian requested an Executive Session A motion was offered by Louise Parker go into Executive Session, seconded by Marie Lorenzini. The motion was approved by a vote of 4 Yeas to 0 Nays, and 1 Absence.  2. He reported the Village has received Cannabis comment from the Town of Clarkstown. We are awaiting comment from Rockland County. Mayor Hammond asked the Mr. Sevastian to present a review of the Cannabis legislation at the March 10th meeting. Village Administrator: Jim Politi updated the Board on the following: 1. The Village is working through getting the final plans for the TAP project base bid for submission. 2. Budget Season has begun. Department heads are preparing their submissions. 3. The Village is prepared to deal with the anticipated snow event tomorrow. 4. He continues to work with the new Village Administrator, Andy Stewart. Village Clerk – Treasurer: Lise Chanin updated the Board on the following: 1. The Budget process has begun. Old Business Nyack Marina Boat Charter. Joe Rand was following up on what other marina’s charged. He found that there was not much helpful information. The Mayor added to the Executive Session for the Board to review and revise. Fire Pit Legislation. Joe Rand and some specific recommendations and requested that the Building Inspector review the proposal. Don Hammond requested the Board’s comments. The Board still had some safety concerns and would prefer to wait until Joe Rand was back. Don Hammond also expressed safety concerns in the more densely populated areas of the Village. He was also concerned about equity issues if the Village enacted a law that allowed something in one part of the Village and not in another. Restaurant Bump-outs. Don Hammond asked the Board to review the map and get him their comments. He will be bringing this to the Business Council on Monday, February 28, 2022. New Business Communications. Rockland County Solid Waste Authority is raising the tipping fees in 2024 approximately $30.00. American Forest Grant. Don Hammond provided an outline of the Grant. Marcy Denker has been working with Nice-Pak on a tree grant which will help reduce the Village’s carbon footprint. The Village is recommending the grant go through the Park Conservancy, rather than the Village. It would also allow the Village to do some more Public/Private Partnerships. The Village will continue to develop these partnerships. He has already received a communication from and organization looking to put in additional charging stations around the Village. Public Comment. Andrea De Vitta the signs have been effective. OPD is clearing the lot. Comments from the Village Board of Trustees Donna Lightfoot Cooper attended the Housing Authority Meeting, unfortunately there was no quorum so the meeting could not be held. It was brought to her attention that they are still being charged for taxes. Louise Parker updated the parade route in June would be the same as it has been. Executive Session—to discuss personnel matters. 9:09 pm: A motion to adjourn the Executive Session was offered by Louise Parker, seconded by Marie Lorenzini.
