Minutes of the Regular Meeting of the Village of Nyack Board of Trustees held at 7:30 on Thursday, May 12, 2022 Present Don Hammond Mayor Louise Parker Deputy Mayor Joseph Rand Trustee Marie Lorenzini Trustee Also Present Walter Sevastian Village Attorney Andrew Stewart Village Administrator Jennifer Hetling Village Clerk/Treasurer Absent Donna Lightfoot-Cooper Trustee Meeting called to order at 7:31pm Pledge of Allegiance Adoption of Minutes – April 27, 2022 A motion was offered by Donald Hammond to approve the adoption of the minutes of April 27, 2022, seconded by Louise Parker. The motion was approved by a vote of 3 yeas, 0 nays, 1 absent, 1 abstain (Trustee Lorenzini). Public Comment – None Action Items Resolution No. 2022-52 Nyack Village Board approving of the Nyack Village Board to approve the Abstract of Audited Claims as presented by the Village Clerk/Treasurer. A motion was offered by Donald Hammond to approve the resolution as presented, seconded by Louise Parker. The motion was approved by a vote of 4 yeas, 0 nays, 1 absent Resolution No. 2022-53 of the Nyack Village Board approving the street closure for July 17, 2022 for Nyack jazz week (change of date from July 24). A motion was offered by Louise Parker to approve the resolution as presented, seconded by Joseph Rand. The motion was approved by a vote of 4 yeas, 0 nays, 1 absent. Resolution No. 2022-54 Nyack Village Board approving Pamela Bruce use of the Hezekiah Easter Square gazebo for a student piano recital on Sunday, June 26, 2022 from 12:00pm – 3:00pm. A motion was offered by Joseph Rand to approve the resolution as presented, seconded by Marie Lorenzini. The motion was approved by a vote of 4 yeas, 0 nays, 1 absent Resolution No. 2022-55 of the Nyack Village Board to award the Depew sidewalk replacement project to Belleville Landscaping Inc. A motion was offered by Louise Parker to approve the resolution as presented, seconded by Joseph Rand. This project is between Franklin and Broadway on Depew Ave. and mostly on the south side. The motion was approved by a vote of 4 yeas, 0 nays, 1 absent Resolution No. 2022-56 of the Nyack Village Board approving the street closure and Memorial Park event for June 4, 2022 (rain date June 11) for the African American Day Parade. A motion was offered by Louise Parker to approve the resolution as presented, seconded by Marie Lorenzini. Administrator Stewart explained that OCADA requested to add a film to the end of the event and they have spoken to the parade committee who agreed The motion was approved by a vote of 4 yeas, 0 nays, 1 absent Resolution No. 2022-57 of the Nyack Village Board approving Nancy Selover’s use of memorial park upper lawn for a World Labyrinth Day event on May 7, 2022 from 12:00 pm to 3:00 pm. A motion was offered by Joseph Rand to approve the resolution as presented, seconded by Louise Parker. Administrator Stewart explained that the event was rained out and they have requested May 22 instead to which the board agreed. The motion was approved by a vote of 4 yeas, 0 nays, 1 absent Resolution No. 2022-58 of the Nyack Village Board approving the closure of Hart Place for a neighborhood block party on May 7, 2022, until 10 PM. A motion was offered by Donald Hammond to approve the resolution as presented, seconded by Louise Parker. The motion was approved by a vote of 3 yeas, 0 nays, 1 absent, 1 abstain (Trustee Rand) Public Comment – Terence McGlynn – He is requesting permission for a swim across the Hudson River which will start in Nyack and end in Sleepy Hollow. They have done this swim in prior years but it has not been done in the recent past due to the bridge construction. They are expecting about 100 swimmers. People would be bussed to Memorial Park from other parking areas for the event. Mayor Hammond stated that he should contact the Village Clerk regarding the requirements to request a permit for park usage. T Paul Bailey – He is coordinating the construction of the new kayak racks with BOCES. Regular racks require a specific footings and therefore he is speaking with engineers about a different mounting system. Department Reports to the Board of Trustees Village Administrator – Requested that the Village Board pass a resolution authorizing the development of an inter-municipal agreement with the Town of Clarkstown regarding paving. The Village has money set aside to fill a trench caused by water main work being done. The Village will pass this money along to Clarkstown so that they can pave the entire road rather than just the trench. Motion by Marie Lorenzini, seconded by Joseph Rand to approve this request. The motion was approved by a vote of 4 yeas, 0 nays, 1 absent He also gave a review of the capital projects currently in progress. The DPW is actively seeking a laborer. Old Business Re-issue River Club site development RFP with deadline for responses of July 8. The board agreed that it is a good idea to update and re-issue this. Motion by Donald Hammond, seconded by Louise Parker to reissue the RFP with a 60 day window for response. The motion was approved by a vote of 4 yeas, 0 nays, 1 absent NYS Stretch Code – The adoption guide was previously provided. The NY Stretch Code would bring Nyack to the forefront of green energy. There is no cost to the adoption of the code. New Business Discussion of The Lighthouse Swim proposed use of Nyack Marina for event on Saturday, September 10, 2022, starting at 7:00 AM. Terry McGlynn. Communications Law enforcement memorial event, May 22, New City, NY, 11 AM. Nyack Fire Department Parade Committee – Chief’s Inspection Parade, Saturday, October 8, 2022 at 2pm. – This will be added to the next meeting for resolution. Assemblyman Lawler requested permission to use Memorial Park for a Women of Distinction event on June 10th – The board approved this request. Request from Jeffery Friedberg to host a music event for special needs people on June 11 in Memorial Park. Trustee Parker stated that this is the rain date for the African American Day Parade. Administrator Stewart will reach out to him to see if he would change the date. Request for an adult day care park day on June 8th for 8 people – The board approved this request. Public Comment – None Comments from the Village Board of Trustees Donald Hammond – There was a meeting with the Orangetown Police Department regarding the upcoming events. They also spoke about accidents at Burd and Main St. and speeding issues on Piermont between Depew Ave and Burd St. The Village will be sending out letters of thanks to all the people involved in the build of the new kayak rack A pillar of the community was lost last week, Salahudin Rahim. A resolution will be done thanking Mr. Rahim for his service to the community which will be sent to his family. Louise Parker – Thanked Andy and the group for all the help they have given to the African American Day Parade Committee. Joseph Rand – Asked if there is a reason why Memorial Park doesn’t open until 6am. He would suggest changing it to 5am or 5:30am. Mayor Hammond suggested changing it to sunrise instead but to talk to the Parks Commission about this first. Attorney Sevastian stated the code would have to be updated which requires a public hearing. Trustee Rand also listed the following businesses which have opened since the onset of COVID-19.
