The motion was approved by a vote of 3 yeas, 0 nays and 2 absent Public Comment – Action Items Resolution No. 2022-37 of the Nyack Village Board to award the Upper Depew curb replacement project to Belleville Landscaping Inc. A motion was offered by Joseph Rand to approve the resolution as presented, seconded by Louise Parker. The motion was approved by a vote of 3 yeas, 0 nays and 2 absent Resolution No. 2022-38 of the Nyack Village Board approving the street closure for Thursday, June 9, 2022 for the Bayard Rustin Pride event, including closure of Jackson Ave and use of the Hezekiah Easter Square gazebo, and painting of Main Street crosswalks. A motion was offered by Louise Parker to approve the resolution as presented, seconded by Joseph Rand. The motion was approved by a vote of 3 yeas, 0 nays and 2 absent Motion by Donald Hammond, seconded by Joseph Rand to take the budget public hearing off the table. The motion was approved by a vote of 3 yeas, 0 nays and 2 absent. Motion by Donald Hammond, seconded by Louise Parker to close the public hearing. The motion was approved by a vote of 3 yeas, 0 nays and 2 absent Resolution No. 2022-39 of the Nyack Village Board approving the 2022-2023 general fund budget A motion was offered by Donald Hammond to approve the resolution as presented, seconded by Louise Parker. The motion was approved by a vote of 3 yeas, 0 nays and 2 absent Resolution No. 2022-40 of the Nyack Village Board to award the Camp Nyack contract A motion was offered by Louise Parker to approve the resolution as presented, seconded by Joseph Rand. The motion was approved by a vote of 3 yeas, 0 nays and 2 absent Resolution No. 2022-41 of the Nyack Village Board approving the street closure for Thursday July 21, 2022 for Classic Car Night. A motion was offered by Donald Hammond to approve the resolution as presented, seconded by Louise Parker. The motion was approved by a vote of 3 yeas, 0 nays and 2 absent Resolution No. 2022-42 of the Nyack Village Board approving a contract for Employee Assistance Program services with Montefiore Nyack Hospital. The motion was approved by a vote of 3 yeas, 0 nays and 2 absent Resolution No. 2022-43 of the Nyack Village Board approving an agreement with Henningson, Durham and Richardson architecture an engineering, p.c. for review of cell antenna applications and related tasks A motion was offered by Louise Parker to approve the resolution as presented, seconded by Joseph Rand. The motion was approved by a vote of 3 yeas, 0 nays and 2 absent Resolution No. 2022-44 Nyack Village Board approving the Nyack Art Collective’s use of the Hezekiah Easter Square gazebo for an art exhibit on May 28, 2022 from 1:00pm – 5:00pm. A motion was offered by Louise Parker to approve the resolution as presented, seconded by Joseph Rand. The motion was approved by a vote of 3 yeas, 0 nays and 2 absent Resolution No. 2022-45 Nyack Village Board approving of the Nyack Village Board to approve the Abstract of Audited Claims as presented by the Village Clerk/Treasurer. A motion was offered by Louise Parker to approve the resolution as presented, seconded by Joseph Rand. The motion was approved by a vote of 3 yeas, 0 nays and 2 absent Resolution No. 2022-46 of the Nyack Village Board to respond (consent) to the Town of Orangetown town Board being designated as lead agency for its zoning update project for the hamlet of South Nyack A motion was offered by Donald Hammond to approve the resolution as presented, seconded by Joseph Rand. The motion was approved by a vote of 3 yeas, 0 nays and 2 absent Resolution No. 2022-47 of the Nyack Village Board approving the street closure for June 12, 2022 for the Pride Promenade A motion was offered by Joseph Rand to approve the resolution as presented, seconded by Louise Parker. The motion was approved by a vote of 3 yeas, 0 nays and 2 absent Resolution No. 2022-48 of the Nyack Village Board to approve the tax rate and base proportions for fiscal year 2022-2023 A motion was offered by Louise Parker to approve the resolution as presented, seconded by Joseph Rand. The motion was approved by a vote of 3 yeas, 0 nays and 2 absent Resolution No. 2022-49 of the Nyack Village Board approving the appointment of David Smith as Nyack fire inspector subject to compliance with NYS civil service law regulations A motion was offered by Donald Hammond to approve the resolution as presented, seconded by Joseph Rand. The motion was approved by a vote of 3 yeas, 0 nays and 2 absent Resolution No. 2022-50 of the Nyack Village Board approving the street closure for July 24, 2022 for Nyack jazz week. A motion was offered by Louise Parker to approve the resolution as presented, seconded by Joseph Rand. The motion was approved by a vote of 3 yeas, 0 nays and 2 absent Resolution No. 2022-51 of the Nyack Village Board approving Riverkeeper’s use of memorial park for a river sweep cleanup event on May 7, 2022 from 9:00am – 12:00pm. A motion was offered by Louise Parker to approve the resolution as presented, seconded by Joseph Rand. The motion was approved by a vote of 3 yeas, 0 nays and 2 absent Public Comment - None Department Reports to the Board of Trustees Village Attorney – The remote meeting platform for board meetings allowed currently are only in effect until June 8. The State is allowing for some members to appear remotely but only under certain circumstances. If the Board is interested in allowing this a local law would have to be passed. The Village is working on a master fee schedule to be included in the code rather than having fees scattered throughout the code. The cannabis legislation was referred out to local municipalities and the planning board and the comments are back for Village Board review. A workshop will be set to discuss the details. Village Administrator – The sidewalk work on South Broadway has started. There is also work starting on one of the vaults in that area. The bumpout by the Art Café and church has been taken out of the construction plan due to drainage issues. The Orangetown board has approved the curb improvements on Cedar Hill Ave. The senior center hosted a meeting on the Safe Routes to School project this week. The project is still in the planning stages. We will be going to bid on the lighting project in the marina parking lot and walkway area. There is a grant opportunity from the County and the plan is to request funding for a walkway from the parking area in Memorial Park to the playground, bathroom and splashpad. The other idea is to request funding for ADA swings and a new playground surface area. The kayak racks have been moved in the marina and the new rack is being built. Old Business Discussion of adding parking meters to Upper Main St, S. Franklin St and around the hospital. Andy Stewart stated that the proposal of metering on upper Main St would be a bit less than originally proposed in the memo due to fire truck activity and a new housing development proposal. The proposal on the other locations remains the same. Mayor Hammond stated that this business should be done during a Nyack Parking Authority board meeting. New Business Discussion of NYS Stretch Code (Energy efficiency building code) Building Inspector Manny Carmona briefly explained the NYS Stretch Code. Mayor Hammond asked Manny Carmona to put together a summary and then the Board would set a workshop to discuss and to get public comment. Communications Nancy Selover request for May7 event at Memorial Park to create a temporary, free labyrinth in celebration of World Labyrinth Day. The Mayor requested that the Village obtain a certificate of insurance from organizer. The board approved this request. Request for a neighborhood block party on Hart Place on May 7th from noon until midnight. Trustee Rand requested to recuse himself from this vote due to a conflict of interest. Attorney Sevastian informed the board that due to the “rule of necessity” since the there is only 3 board members present, Trustee Rand must vote to keep government business moving forward. The board stated that the event should end at 10pm. Motion by Donald Hammond, seconded by Louise Parker to approve this request. Motion passed by a vote of 3 yays, 0 nays and 2 absent. Request for piano recital on June 26th at the gazebo on Main St. in the early afternoon. This will go onto the next meeting for resolution. Public Comment – Alain’s Bistro – They are opening a new restaurant on Main St. He stated that many of the local bars have very loud music and it’s not fair for the patrons of other businesses to have to hear it. They also generate a lot of garbage that sits outside for multiple days. Mayor Hammond stated that those rules are difficult to enforce but he would look into it. He will also bring those concerns to the Chamber of Commerce members at an upcoming meeting. Comments from the Village Board of Trustees Donald Hammond – He and Andy Stewart met with Orangetown Police Department about the issues at Head Start and the need for additional coverage during the morning and afternoon pickup times. They requested a crossing guard at that location as well. The paving of Route 59 from Route 303 to Route 9W is starting and should be completed in the next few weeks. Central Nyack Civic Organization requested to meet on May 19th regarding the water project. Louise Parker – Budget time is very intense and she thanked everyone that worked on it. There was a meeting of the African American Day Parade committee, and they requested to have free parking in the marina parking lot for the vendors. Joseph Rand – Thanked the budget team on all their hardwork.
