Adoption of Minutes – July 14, 2022
A motion was offered by Donald Hammond to approve the adoption of the minutes of July 14, 2022,
seconded by Joseph Rand. The motion was approved by a vote of 3 yeas, 0 nays, 1 absent (Trustee
Lightfoot-Cooper), 1 abstain (Trustee Lorenzini).
Public Comment –
Jim Willcox – Asked if the marina would be closed for the Nyack Joint Fire District event to which
Mayor Hammond stated that it would not.
Dana Harkrider – Member of the Nyack Pollinator Pathway Group which plants flowers along Main St.
Their goal is to be able to plant more beds.
Resolution No. 2022-115 Resolution of the Nyack Village Board approving the use of Marina parking
lot by Nyack Joint Fire District, October 8, 2022
A motion was offered by Louise Parker to approve the resolution as presented, seconded by Marie
Lorenzini. The motion was approved by a unanimous vote.
Resolution No. 2022-116 Resolution of the Nyack Village Board to approve electricity supply
agreement with Joule Assets
A motion was offered by Donald Hammond to table the resolution as presented, seconded by Marie
Lorenzini. The motion was approved by a unanimous vote.
Resolution No. 2022-117 Resolution of the Nyack Village Board to award the municipal
financial service agreement to Munistat
A motion was offered by Joseph Rand to approve the resolution as presented, seconded by Louise
Parker. The motion was approved by a unanimous vote.
Resolution No. 2022-118 Resolution of the Nyack Village Board approving the street closure for August
27, 2022 for back to school community event
A motion was offered by Louise Parker to approve the resolution as presented, seconded by Donna
Lightfoot-Cooper. The motion was approved by a unanimous vote.
Resolution No. 2022-119 Resolution of the Nyack Village Board approving the removal of sidewalk at
18 Front Street
A motion was offered by Louise Parker to approve the resolution as presented, seconded by Marie
Lorenzini. The motion was approved by a unanimous vote.
Resolution No. 2022-120 Resolution of the Nyack Village Board to approve and ratify a
memorandum of agreement between the Village of Nyack and IBEW Local 363.
A motion was offered by Donald Hammond to approve the resolution as presented, seconded by Marie
Lorenzini. The motion was approved by a unanimous vote.
Resolution No. 2022-121 Resolution of the Nyack Village Board to approve Duncan Solutions
service agreement five year renewal for parking payments management
A motion was offered by Donna Lightfoot-Cooper to approve the resolution as presented, seconded by
Joseph Rand. The motion was approved by a unanimous vote.
Resolution No. 2022-122 Resolution of the Nyack Village Board approving the use of marina boat
launch dock by Lindblad Expeditions October 19, 26 and November 2, 2022
A motion was offered by Marie Lorenzini to approve the resolution as presented, seconded by Louise
Parker. The motion was approved by a unanimous vote.
Resolution No. 2022-123 Resolution of the Nyack Village Board approving changes to parking
regulations.
A motion was offered by Donald Hammond to approve the resolution as presented, seconded by Louise
Parker. The motion was approved by a unanimous vote.
Resolution No. 2022-124 Resolution of the Nyack Village Board to approve the expenditure of
$1,140 to plant pollinator gardens on Main Street.
A motion was offered by Donna Lightfoot-Cooper to approve the resolution as presented, seconded by
Marie Lorenzini. The motion was approved by a unanimous vote.
Resolution No. 2022-125 Resolution of the Nyack Village Board to approve sale of surplus
vehicles and equipment
A motion was offered by Donald Hammond to approve the resolution as presented, seconded by Louise
Parker. The motion was approved by a unanimous vote.
Resolution No. 2022-126 Resolution of the Nyack Village Board to renew an agreement with
Ubicquia for remote streetlight controller connectivity services
A motion was offered by Donna Lightfoot-Cooper to approve the resolution as presented, seconded by
Joseph Rand. The motion was approved by a unanimous vote.
Resolution No. 2022-127 Resolution of the Nyack Village Board to approve Addendum #1 to
HVEA contract for TAP project construction inspection service
A motion was offered by Marie Lorenzini to approve the resolution as presented, seconded by Joseph
Rand. The motion was approved by a unanimous vote.
Resolution No. 2022-128 Resolution of the Nyack Village Board accepting audited voucher summary
A motion was offered by Donald Hammond to approve the resolution as presented, seconded by Louise
Parker. The motion was approved by a unanimous vote.
Resolution No. 2022-129 Resolution of the Nyack Village Board to approve consulting agreement with
Rockland Housing Action Coalition for affordable housing policy update
A motion was offered by Donna Lightfoot-Cooper to approve the resolution as presented, seconded by
Marie Lorenzini. The motion was approved by a unanimous vote.
Resolution No. 2022-130 Resolution of the Nyack Village Board to issue a
negative declaration under SEQRA for PFOS/PFAS treatment at the Nyack Water
plant
A motion was offered by Joseph Rand to approve the resolution as presented, seconded by Donna
Lightfoot-Cooper. The motion was approved by a unanimous vote.
Resolution No. 2022-131 Bond Resolution of the Village of Nyack, New York, adopted
August 25, 2022, authorizing the construction of improvements to the village water system,
stating the estimated maximum cost thereof is $5,000,000, appropriating said amount for
such purpose, and authorizing the issuance of bonds in the principal amount of not to
exceed $5,000,000 to finance said appropriation
A motion was offered by Joseph Rand to approve the resolution as presented, seconded by Louise
Parker. The motion was approved by a unanimous vote.
Resolution No. 2022-132 Resolution of the Nyack Village Board approving the submission of a grant
application for grant funding through the Environmental Facilities Corporation for PFAS/PFOS treatment at
the Nyack Water plant
A motion was offered by Donna Lightfoot-Cooper to approve the resolution as presented, seconded by
Louise Parker. The motion was approved by a unanimous vote.
Resolution No. 2022-133 Resolution of the Nyack Village Board appointing a new member to the
Architectural Review Board.
A motion was offered by Donald Hammond to table the resolution as presented, seconded by Donna
Lightfoot-Cooper. The motion was approved by a unanimous vote.
Resolution No. 2022-134 Resolution of the Nyack Village Board appointing Anngela Vasser-Cooper to
the Nyack Housing Authority Board.
A motion was offered by Louise Parker to approve the resolution as presented, seconded by Marie
Lorenzini. The motion was approved by a unanimous vote.
Resolution No. 2022-135 Resolution of the Nyack Village Board scheduling a Public Hearing for
September 25, 2022, at 8:15pm, regarding the residency requirement for appointment to the Nyack Board of
Water Commissioners.
A motion was offered by Donna Lightfoot-Cooper to approve the resolution as presented, seconded by
Louise Parker. The motion was approved by a unanimous vote.
Resolution No. 2022-136 Resolution of the Nyack Village Board approving the standard work
day and reporting resolution for Acting Village Justice Robert Lewis
A motion was offered by Donald Hammond to approve the resolution as presented, seconded by Donna
Lightfoot-Cooper. The motion was approved by a unanimous vote.
Resolution No. 2022-137 Resolution of the Nyack Village Board to award the contract for the
Main St. Drainage and Paving to Contech
A motion was offered by Louise Parker to approve the resolution as presented, seconded by Marie
Lorenzini. The motion was approved by a unanimous vote.
Public Comment – None
Department Reports to the Board of Trustees
Village Attorney – In the next few months there will be a few local laws with the expansion of the
water commissioner residency requirement, cannabis legislation, hotel tax, and the new fee schedule.
Village Administrator –
The hotel tax passed the state legislature. To implement this the Village needs a local law so a public
hearing needs to be set.
Motion to set a public hearing on September, 22, 2022 at 8:45pm by Donald Hammond, seconded by
Louise Parker. Motion passed by unanimous vote.
There will be a budget review at the next meeting and we will go over the ARPA funding.
The Broadway TAP project is moving along nicely.
Downtown revitalization grant applications are due on September 23rd and we are working on a
proposal.
The marina lighting contract was let and the pre-construction meeting was held.
Communications
Todd D’Andrea re: Marina parking lot nighttime activity
The activity in the parking lot has increased since COVID. The lot closes at midnight and the police
clear the lot but cars still come back. The cars are noisy, race through the Village and makes messes in
the parking lot. The request is to change the time the lot closes from midnight to 10pm.
Pastor Joseph, (Haitian) Church of God, 85 Burd St re: renaming Burd St for late Bishop Kenol
Joseph
Pastor Joseph would like to honor Bishop Kenol Joseph by co-naming Burd St. from Broadway to
Cedar.
The board agreed to the request.
Public Comment
Vishal Greenaway – Asked when the lights will be installed in the Marina to which Mayor Hammond
stated that the project is in the planning phase.
He also asked if the solution to the parking lot noise issue is to call the Orangetown Police Department
to which Mayor Hammond said it was.
Comments from the Village Board of Trustees
Joseph Rand – September 11 at 6:30pm will be the annual Heroes Tribute which will include
remembrances and music.
Donna Lightfoot-Cooper – Stated that the celebration of Salahudin Rahim’s life was a great event. She
also attended the viewing of the documentary “The Virgin Blacktop” which was really wonderful and
touching.
Louise Parker – The historical society in conjunction with the Edward Hopper House will be doing
tours of the Village on Nyack at the end of October and the beginning of November.
Marie Lorenzini – The DPW is doing a great job and she thanked Jonathan Abrams and all the
department personnel.
Donald Hammond – Shoprite is doing their community drive from August 28 to October 1, 2022. The
board members should consider participating.
He encourages the board members to attend the community bbq this weekend.
The attorney general will be doing a gun buy-back program in Nyack this year. Its from 4pm-7pm at the
fire department on Catherine St. on September 15, 2022.
Executive Session
Motion by Donald Hammond, seconded by Louise Parker to enter into executive session for personnel
and contract matters at 9:21pm. Motion passed by unanimous vote.
Motion by Louise Parker, seconded by Donna Lightfoot-Cooper to exit the executive session at 9:25pm.
The motion was approved by a unanimous vote.

On September 2, 2021 Governor Kathy Hochul signed legislation (S.50001/A.40001) extending virtual
access to public meetings under New York State's Open Meetings Law, which allows New Yorkers to
virtually participate in local government meetings during the COVID-19 pandemic. The legislation,
which was initially implemented by Executive Order during last year's State of Emergency, allows state
and local government meetings that are normally held in person to be held remotely instead, as long as
the public has the ability to view or listen to the meeting on the remote platform, and the meeting is
recorded and later transcribed. This statute will reduce the need for congregation at public meetings
while the Delta variant is prevalent, while ensuring public business can continue.
The Village will be activating a remote meeting platform for the Thursday, July 14, 2022 Village Board
meeting, which will enable residents to watch a livestream of the meeting and comment on the Zoom
platform in compliance with the legislation. Remote platform access information may also be found on
the Village of Nyack official website.
