Minutes of the Regular Meeting of the Village of Nyack Board of Trustees held at 7:30 on Thursday, September 8, 2022 Present Don Hammond Mayor Louise Parker Deputy Mayor Marie Lorenzini Trustee Donna Lightfoot-Cooper Trustee Joseph Rand Trustee Also Present Walter Sevastian Village Attorney Andrew Stewart Village Administrator Jennifer Hetling Village Clerk/Treasurer Meeting called to order at 7:32pm Pledge of Allegiance Adoption of Minutes – August 25, 2022 A motion was offered by Donald Hammond to approve the adoption of the minutes of August 25, 2022, seconded by Donna Lightfoot-Cooper. The motion was approved by a unanimous vote. Public Comment – None Resolution No. 2022-116 Resolution of the Nyack Village Board to approve electricity supply agreement with Joule Assets A motion was offered by Donald Hammond to untable the resolution as presented, seconded by Donna Lightfoot-Cooper. The motion was approved by a unanimous vote. A motion was offered by Donald Hammond to approve the resolution as presented, seconded by Louise Parker. The motion was approved by a unanimous vote. Resolution No. 2022-133 Resolution of the Nyack Village Board to appoint Mary Adler as a member to the Architectural Review Board A motion was offered by Donald Hammond to untable the resolution as presented, seconded by Marie Lorenzini. The motion was approved by a unanimous vote. A motion was offered by Donna Lightfoot-Cooper to approve the resolution as presented, seconded by Marie Lorenzini. The motion was approved by a unanimous vote. Resolution No. 2022-138 Resolution of the Nyack Village Board approving Supplemental Agreement #2 D034998 to include additional preliminary engineering, construction and construction inspection funds and extend the contract end date from 9/30/2020 to 9/30/2024 A motion was offered by Louise Parker to approve the resolution as presented, seconded by Marie Lorenzini. The motion was approved by a unanimous vote. Resolution No. 2022-139 Resolution of the Nyack Village Board approving use of Hezekiah Easter Square for an outdoor poetry reading September 16 at 3:30-4:30 pm and at 6:30-7:30 pm. A motion was offered by Donna Lightfoot-Cooper to approve the resolution as presented, seconded by Louise Parker. The motion was approved by a unanimous vote. Resolution No. 2022-140 Resolution of the Nyack Village Board approving the street closure for October 14, 2022 for South Broadway Halloween Night Market A motion was offered by Joseph Rand to amend the resolution to approve only the event, seconded by Louise Parker. The motion was approved by a unanimous vote. A motion was offered by Joseph Rand, seconded by Donna Lightfoot-Cooper to allocate $500 of Village funds to cover road closure and security expenses for the event. Motion passed by a vote of 4 yeas and 1 nay (Trustee Parker) Resolution No. 2022-141 Resolution of the Nyack Village Board to schedule a public hearing to amend Chapter 305 of the code of the Village of Nyack to legislate the collection of the hotel tax in the village A motion was offered by Louise Parker to approve the resolution as presented, seconded by Donna Lightfoot-Cooper. The motion was approved by a unanimous vote. Resolution No. 2022-142 Resolution of the Nyack Village Board to schedule a public hearing to amend the code of the Village of Nyack to adopt a uniform fee schedule A motion was offered by Donald Hammond to approve the resolution as presented, seconded by Louise Parker. The motion was approved by a unanimous vote. Resolution No. 2022-143 Resolution of the Nyack Village Board to approve the refund of a portion of a building permit fee A motion was offered by Donald Hammond to amend the resolution to change the refund amount to $526.50, seconded by Donna Lightfoot-Cooper. The motion was approved by a unanimous vote. A motion was offered by Donald Hammond, seconded by Marie Lorenzini to accept the resolution as amended. Motion passed by unanimous vote. Resolution No. 2022-144 Resolution of the Nyack Village Board accepting audited voucher summary A motion was offered by Marie Lorenzini to approve the resolution as presented, seconded by Joseph Rand. The motion was approved by a unanimous vote. Resolution No. 2022-145 Resolution of the Nyack Village Board authorizing the installation of additional EV charging stations and applications for funding from Orange and Rockland and NYS DEC A motion was offered by Donald Hammond to approve the resolution as presented, seconded by Donna Lightfoot-Cooper. The motion was approved by a unanimous vote. Public Comment – None Department Reports to the Board of Trustees Village Attorney – None Village Administrator – Administrator Stewart presented the ARPA memo. Clerk-Treasurer Hetling explained that the ARPA money could be used for lost revenue and showed the board the areas where revenue was lost in fiscal year ended 5/31/21 due to COVID. Administrator Stewart then went over possible uses of the 2022 ARPA allocation. The board agreed to the uses and plans to create resolutions for formalize the future expenditures at the next meeting. Village Clerk Quarterly Financial Report- Clerk-Treasurer Hetling presented the financial report and explained the current budget vs. actuals are currently in line with expectations. Mayor Hammond requested that the board review the financials and contract the Clerk-Treasurer with any questions. He also requested the quarterly financial reports be presented to the board regularly. Old Business Burd St closure plan for 9/25 for Bishop Joseph street sign dedication – The sign is ready and Administrator Stewart will continue to work with Pastor Joseph on the event. Communications Megan Alicia request birthday party in Memorial Park 9-18-22 – The board approved this request. A formal resolution will be added to the next agenda. E Manigo request wedding photo event in Memorial Park 9-17-22 – The board approved this request. My Father’s House liquor license 30 day notice Nyack Community Garden request potluck event at Senior Center 10-27-22 – The board approved this request. Request from the 5th graders of the local elementary schools to hold a field trip in Memorial Park called Hudson River Day on October 12, 2022 – The board denied this request. It is the position of the board to not allow such large numbers of people to hold events in the park. Comments from the Village Board of Trustees Joseph Rand – The 9/11 Memorial Event will be on Sunday at 630pm and it will be a lovely event. Donna Lightfoot-Cooper – None Louise Parker – Thanked everyone who participated in the Back to School Barbeque. It was a good day that was had by all. Marie Lorenzini – None Donald Hammond – The gun buyback event has been cancelled. It will be in Spring Valley this year instead. There was a meeting with the Fire Department and they continue to work through issues they have regarding parking and having clear roads to get through the Village. October 8, 2022 there will be a huge parade in the Village. The democratic committee held an event last night and it was a wonderful event. Adjournment Motion by Joseph Rand, seconded by Donna Lightfoot-Cooper to adjourn the meeting at 9:00pm. The motion was approved by a unanimous vote.

Village of Nyack 9 North Broadway, Nyack, NY 10960 Village Board of Trustees Meeting September 8, 2022 7:30pm Agenda On September 2, 2021 Governor Kathy Hochul signed legislation (S.50001/A.40001) extending virtual access to public meetings under New York State's Open Meetings Law, which allows New Yorkers to virtually participate in local government meetings during the COVID-19 pandemic. The legislation, which was initially implemented by Executive Order during last year's State of Emergency, allows state and local government meetings that are normally held in person to be held remotely instead, as long as the public has the ability to view or listen to the meeting on the remote platform, and the meeting is recorded and later transcribed. This statute will reduce the need for congregation at public meetings while the Delta variant is prevalent, while ensuring public business can continue. The Village will be activating a remote meeting platform for the Thursday, September 8, 2022 Village Board meeting, which will enable residents to watch a livestream of the meeting and comment on the Zoom platform in compliance with the legislation.
