Minutes of the Regular Meeting of the Village of Nyack Board of Trustees held at 7:30 on Thursday, October 13, 2022 Present Don Hammond Mayor Louise Parker Deputy Mayor Donna Lightfoot-Cooper Trustee Joseph Rand Trustee Also Present Walter Sevastian Village Attorney Andrew Stewart Village Administrator Jennifer Hetling Village Clerk/Treasurer Absent Marie Lorenzini Trustee Meeting called to order at 7:32pm Pledge of Allegiance Adoption of Minutes – September 22, 2022 A motion was offered by Louise Parker to approve the adoption of the minutes of September 22nd, 2022, seconded by Donald Hammond. The motion was approved by vote of 3 yeas, 1 abstain (Trustee Lightfoot-Cooper), 1 absent. Public Hearings Cannabis zoning regulations local law Public Hearing remains open from the September 22, 2022 meeting Motion by Donna Lightfoot-Cooper, seconded by Joseph Rand to close the public hearing at 7:44pm. Motion passed by a vote of 4 yeas and 1 absent. Standard Fee Schedule local law Mayor Hammond explained that this is to take the fees out of all the laws and make one fee schedule so that they can be easier changed. Public Comment – Daniel Jean-Gilles – He stated that the revised cannabis regulations local law includes the DMU-1 but asked why it doesn’t include DMU-2. Attorney Sevastian stated that this was because of the high residential concentration in that area. Resolution No. 2022-149 Resolution of the Nyack Village Board adopting a local law to amend Chapter 360 of the Code of the Village of Nyack, the Village of Nyack Zoning Code, to provide for regulations regarding Cannabis Retailers. Motion by Joseph Rand, seconded by Donna Lightfoot-Cooper to amend the resolution changing the hours of operation on Sunday from 12pm – 10pm. Motion passed by a vote of 3 yeas, 1 nay (Trustee Parker) and 1 absent. Motion by Donna Lightfoot-Cooper, seconded by Joseph Rand to accept the resolution as amended. Motion passed by a vote of 3 yeas, 1 nay (Trustee Parker) and 1 absent. Resolution No. 2022-152 Resolution of the Nyack Village Board approving use of Nyack Senior Center by Pride Center for meetings. Motion by Donald Hammond, seconded by Joseph Rand to accept the resolution as presented. Motion passed by a vote of 4 yeas and 1 absent. Resolution No. 2022-153 Resolution of the Nyack Village Board accepting audited voucher summary. Motion by Louise Parker, seconded by Joseph Rand to accept the resolution as presented. Motion passed by a vote of 4 yeas and 1 absent. Resolution No. 2022-154 Resolution of the Nyack Village Board adopting a local law to add Chapter to the Code of the Village of Nyack, entitled “Standard Schedule of Fees of the Village of Nyack”. Motion by Donald Hammond, seconded by Donna Lightfoot-Cooper to accept the resolution as presented. Motion passed by a vote of 4 yeas and 1 absent. Resolution No. 2022-155 Resolution of the Nyack Village Board adopting the Standard Schedule of Fees of the Village of Nyack. (Skipped due to redundancy) Resolution No. 2022-156 Resolution of the Nyack Village Board approving the submission of a NYS Community Resiliency, Economic Sustainability, and Technology program grant application to pay for a new roof on village hall Motion by Louise Parker, seconded by Donna Lightfoot-Cooper to accept the resolution as presented. Motion passed by a vote of 4 yeas and 1 absent. Resolution No. 2022-157 Resolution of the Nyack Village Board approving and accepting the examination of the Nyack Justice Court Motion by Joseph Rand, seconded by Donna Lightfoot-Cooper to accept the resolution as presented. Motion passed by a vote of 4 yeas and 1 absent. Motion by Donald Hammond, seconded by Donna Lightfoot-Cooper to approve the submission of a JCAP grant request by the Village Justice Court staff. Motion passed by a vote of 4 yeas and 1 absent. Public Comment – Donny Moskovic – Stated that he owns multiple dispensaries in the area and was happy with the board’s decision to allow cannabis sales on Sunday because that’s one of the days with the highest sales. Tom Morrison - The parking lot at the Nyack Library has a sign that says free 15 is allowed but then he received a ticket and was informed that the free 15 does not apply to that lot. Administrator Stewart will work with the parking staff regarding this issue. Department Reports to the Board of Trustees Orangetown Police Department – Tyrone McNeil, the last remaining active member of the disbanded Nyack Police Department is retiring from OPD. Village Attorney – Request for executive session regarding the assistant building inspector terms of employment. Motion by Louise Parker, seconded by Donald Hammond to approve the request. Motion passed by a vote of 4 yeas and 1 absent. Village Administrator – Request for executive session regarding the terms of a lease. Administrator Stewart gave an overview of the current capital projects. The Orangetown Democratic Committee has requested a “Get out the Vote” Rally in Memorial Park on October 22. Motion by Donald Hammond, seconded by Louise Parker to approve the rally. Motion passed by a vote of 4 yeas and 1 absent. There is a request for an exception to the filming policy to film in a residential area on the weekend. Trustee Rand excused himself from the conversation as the location is his residence. The filming would be isolated to his home and property. The board requested that the neighbors all sign off in approval of the exception. Motion by Donald Hammond, seconded by Donna Lightfoot-Cooper to allow the exception based on the neighbors approval. Motion passed by a vote of 3 yeas, 1 abstain (Trustee Rand) and 1 absent. New Business Nyack Center program report – Kim Cross Kim Cross gave a review of the programs that are offered by the Nyack Center. She reviewed the programs that are partially funded by the Village as well as some of their other programs that are run by the center. Communications Proposal for Zumba dance event, Hezekiah Easter Park Gazebo, 10-22-22. – Request was withdrawn prior to meeting. Abigail Stever – Construction staging on Depew Ave. Comments from the Village Board of Trustees Joseph Rand – Stated that AnnMarie Tlsty does a fabulous job on organizing the filming in Nyack. Louise Parker – None Donna Lightfoot-Cooper – The fireman’s parade this past weekend was very nice. Donald Hammond – The chamber may be coming to the board soon to request free holiday parking. Executive Session Motion by Louise Parker, seconded by Donna Lightfoot-Cooper to move to executive session at 9:00pm. Motion passed by a vote of 4 yeas and 1 absent. Adjournment Motion by Joseph Rand, seconded by Louise Parker to adjourn the meeting at 9:17pm in honor of Tyrone McNeil. Motion passed by a vote of 4 yeas and 1 absent.
