Minutes of the Regular Meeting of the Village of Nyack Board of Trustees held at 7:30 on Thursday, October 27, 2022 Present Don Hammond Mayor Louise Parker Deputy Mayor Marie Lorenzini Trustee Donna Lightfoot-Cooper Trustee Joseph Rand Trustee Also Present Walter Sevastian Village Attorney Andrew Stewart Village Administrator Jennifer Hetling Village Clerk/Treasurer Meeting called to order at 7:30pm Pledge of Allegiance Adoption of Minutes – October 13, 2022 A motion was offered by Louise Parker to approve the adoption of the minutes of October 13th, 2022, seconded by Joseph Rand. The motion was approved by vote of 4 yeas, 1 abstain (Trustee Lorenzini). Resolution No. 2022-155 Resolution of the Nyack Village Board to adopt the Standard Schedule of Fees of the Village of Nyack. Motion by Donald Hammond, seconded by Donna Lightfoot-Cooper to accept the resolution as presented. Motion passed by a unanimous vote. Resolution No. 2022-158 Resolution of the Nyack Village Board authorizing the Village Administrator to sign a lease agreement with Head Start for use of 85 Depew Ave. Motion by Donna Lightfoot-Cooper, seconded by Joseph Rand to accept the resolution as presented. Motion passed by a unanimous vote. Resolution No. 2022-159 Resolution of the Nyack Village Board to set a public hearing to consider a local law to establish the residency requirements for the appointed offices of village attorney, and deputy and assistant village attorneys, to be designated as a new Article “V,” to be entitled “village attorney, and deputy and assistant village attorneys,” of Chapter 79 (Residency Requirements) of the code of the Village of Nyack. Motion by Marie Lorenzini, seconded by Joseph Rand to accept the resolution as presented. Motion passed by a unanimous vote. Resolution No. 2022-160 Resolution of the Nyack Village Board accepting audited voucher summary. Motion by Donald Hammond, seconded by Louise Parker to accept the resolution as presented. Motion passed by a unanimous vote. Resolution No. 2022-161 Resolution of the Nyack Village Board to approve reappointment of Brooker Engineering as village engineer Motion by Louise Parker, seconded by Marie Lorenzini to accept the resolution as presented. Motion passed by a unanimous vote. Resolution No. 2022-162 Resolution of the Nyack Village Board to set a public hearing to consider amendments to local laws 95 and 330 to enable the Village Board to establish parking fees and fines via the Standard Schedule of Fees of the Village of Nyack. Motion by Donna Lightfoot-Cooper, seconded by Marie Lorenzini to accept the resolution as presented. Motion passed by a unanimous vote. Public Comment – Belkys Perdomo Ortiz – She applied for a roof replacement permit and she feels the cost is too high. Drew Burke – Stated that the sidewalk renovations on Depew Ave. are very noisy and questioned why only one side of the street is being done. Stated that the Village cut the senior funding to the Nyack Housing Authority from $1500 to $750 and he requested it be restored. Stated that some people come to the Nyack Housing Authority meetings and interrupt and they should not be. Department Reports to the Board of Trustees Village Attorney – None Village Administrator – Request for an executive session as it relates to personnel. Motion by Louise Parker, seconded by Donna Lightfoot-Cooper to approve the executive session. Motion passed by unanimous vote. The Depew sidewalk project will include the area at the corner near the real estate office. The Broadway sidewalk project is nearing completion for the year. The drainage problem at First Ave will happen in the spring. Lights have been installed along N. Broadway Halloween Parade preparation have begun. We will be borrowing new style barriers from the County to use for the event rather than using trucks to block roadways. Paving will be begin on some Village roads including High Ave, Prospect St, South Mill St and Hudson Ave. This will happen starting November 14th but is weather permitting. The upper Main St drainage project is complete. The tree committee planted trees on Artopee Way and there will be another planting day this coming Saturday. There will be a rally on Saturday at the Hezekiah Easter Park for Congressman Maloney. New Business Review of Standard Schedule of Fees – Building Dept. Chief Building Inspector Manny Carmona presented the new schedule (included) Motion by Donna Lightfoot-Cooper, seconded by Marie Lorenzini to approve the standard schedule of fees for the building department. Motion passed by a unanimous vote. Review of Standard Schedule of Fees – Parking fees and fines Administrator Stewart explained the proposal which is attached. This will be discussed again during a workshop on November 10th, 2022. Communications Edward Tangredi, Knights of Columbus, creche for Hezekiah Easter Park on Main St, week of Dec. 12 – January 6. Motion by Marie Lorenzini, seconded by Donna Lightfoot-Cooper to approve the request to place a crèche in Hezekiah Easter Park. Motion passed by unanimous vote. Belkys Perdomo re: roof replacement permit fee waiver Public Comment Drew Burke – The traffic on Depew Ave is bad due to construction. John Dunnigan – Asked about approving street fairs for next year to which the board responded that it would be on the agenda for the next meeting. Comments from the Village Board of Trustees Joseph Rand – Hudson Market on Main has reopened. Louise Parker – The African American Day Parade committee is prepping for next year’s parade. Line- up will be in Memorial Park. Tyrone McNeil will serve as one of the grand marshalls. Donna Lightfoot-Cooper – It was a beautiful day for the Brinks Memorial Service. Marie Lorenzini – She hears the Brinks Memorial Service was great and thanked all involved. Donald Hammond – He suggested changing the mayoral term from 2 years to 4 years prior and asked if anyone had any input which there wasn’t any therefore he asked Walter to draft legislation to start the process. He attended the 147th Anniversary of Pilgrim Baptist Church and it was a wonderful event. The Board needs to start thinking about the Tourism Fund which will use some of the revenue from the hotel tax. The Board needs to discuss the street fair fees. A commemorative street sign will be installed on Lydecker St. honoring the Nyack officers involved in the Brinks robbery. Executive Session Motion by Donna Lightfoot-Cooper, seconded by Louise Parker to move to executive session at 8:58pm. Motion passed by a unanimous vote.
